In 2002, the Parks and Recreation Advisory Board (PRAB) agreed to begin work on a Master Plan Update. The two primary reasons to pursue an update were (1) the completion of the Naranja Town Site Master Plan and (2)requests from neighbors after Phase I construction was completed at West Lambert Lane Park. The Naranja Town Site Master Plan reflected a number of amenities which were also planned for West Lambert Lane Park—such as the in-line skating facility—and it seemed practical to recommend removal of those facilities from the West Lambert Lane Park plan. Secondly,when Phase I was completed at West Lambert Lane Park—consisting primarily of natural trails and parking—the neighbors requested that the plans for the east side of the Park be readdressed to consider a possible decrease or elimination of active recreation amenities shown in the existing Master Plan. As described in the attached documents, PRAB held two Community Forums, gathered surveys, and held a site tour in preparation of this recommendation. The attached recommendation is submitted by PRAB for Town Council consideration. Attachments: 1) West Lambert Lane Park: Master Plan Update Recommendation Parks &Recreation Administrator Com unity Deve �pment Director '•141 r Town Manager West Lambert Lane Park: Master Plan Update Recommendation By the Oro Valley Parks and Recreation Advisory Board November 8, 2004 On September 9, 2002, the Parks and Recreation Advisory Board (PRAB) received a memo from Parks and Recreation Administrator Ainsley Reeder urging PRAB to update the proposed layout of the West Lambert Lane Park. In response to this memo,PRAB put this item on our September 25, 2002 agenda. At that meeting,PRAB agreed to revisit the existing plan and serve as Executive Committee for the update process (Attachment #1). At the following meeting, on October 23, 2002,PRAB reviewed a time line for community forums and planning sessions proposed by Ms. Reeder. At the November 21, 2002 meeting, PRAB officially voted to accept the process and timeline for revisiting the plan (Attachment#2). Subsequently, two community forums were held. Both forums were advertised widely through postcards and notices in the NW Explorer(Attachment #3). Before the first community forum, PRAB took a Site Tour of the West Lambert Lane Park on January 27, 2004. Topography and distance to houses in the Canada Hills subdivision were noted (Minutes Attachment#4). The first forum was held on January 30, 2003. This community meeting was for informational purposes only(Attachment#5). Feedback was accepted in written form only. Surveys were handed out and those present were told of PRAB's schedule of upcoming meetings. At the second community forum on March 27, 2003, speakers from the audience were given time to discuss their ideas for the park(Attachment#6). Surveys were also collected at this time (Attachment#7). With information from public input and the surveys received, PRAB suggested changes to the Master Plan at their May 15, 2003 meeting. The suggestions not only accommodated local residents, but considered the interests of the Town of Oro Valley as a whole. The suggested changes include: • Move active recreation currently positioned on the north east side of the Park to the south, away from existing homes to the north. • Remove the lit parking lot on the north side, off of Canada Hills Drive. Provide pedestrian access only from the north. • Move the lighted tennis and basketball courts from the north east side of the park to the central east side of the park. • Addg rass from the north east side to the central east side of the park, near the active recreation areas. • Remove the skating facilities, as these facilities were provided for in the Naranja Town Site Master Plan accepted by Town Council in 2003. • Add a hard surface trail around the entire eastern side of the park, encompassing the active recreation development proposed for that area. • Add trail connections from the existing trail system to the proposed hard surface trail. • Add a second Tot Lot to the south • Place restrooms in the center of the active recreation area on the east side of the park. • Move thero osed south east entrance into the park into a more western position, p p aligning in with the existing neighborhood street to the south. This may remedy some of the visibility constraints associated with that area. • Add interpretive signage throughout the park. • Add water fountains throughout the park. • Leave the south western plan for the park in place, expanding the existing development as shown in the original plan. Attachedy ou will find the revised West Lambert Lane Park Master Plan as recommended #9). byPRAB (Attachment#8), as well as the original 1997 Master Plan(Attachment Upon review, we believe you will find a Park that appeals to Town residents of all ages and will be a wonderful addition to the Town. PRAB recommends that implementation of the Park be given priority. REVIEW OF PREVIOUS TOWN COUNCIL MINUTES No discussion 3. OPEN MEETING LAWS - REVIEW Chair Doug White explained Arizona's Open Meeting Law requires that meetings be conducted openly and that an agenda be provided for meetings. He also explained that when Parks & Recreation Advisory Board Members gather for Town events they are not to discuss Board business. 4. WEST LAMBERT LANE MASTER PLAN UPDATE — DISCUSSION AND POSSIBLE RECOMMENDATION Ms. Ainsley Reeder, Parks & Recreation Administrator, requested that the Parks & Recreation Advisory Board (PRAB) consider updating the West Lambert Lane Park Master Plan. Ms. Reeder explained that some of the facilities at West Lambert Lane might be a better fit at the Naranja Town Site. In response to a question by Board Member Laura Clark, Ms. Reeder explained McGann and Associates developed the West Lambert Lane Master Plan. Any costs would be for revisions only. It was the consensus of PRAB that a Master Plan's update should be done. The Parks & Recreation Advisory Board would like to serve as the Executive Committee of the West Lambert Lane Master Plan Update. Mr. Richard Tracy thanked PRAB and offered his assistance in the West Lambert Lane Master Plan Update. Ms. Reeder thanked Mr. Tracy for his assistance, which has been greatly appreciated. 5. FISCAL YEAR 2003 — 2004 CAPITAL IMPROVEMENT PLAN — DISCUSSION AND RECOMMENDATION Chair Doug White explained the Capital Improvement Plan (CIP) process. Following discussion the Parks & Recreation Advisory Board recommended the following capital projects. ► Interpretative Signage at West Lambert Lane ► Space heaters at Oro Valley Municipal Swimming Pool ► Diaper Changing Stations 2 Attachment 11/21/02 Minutes, Parks & Recreation Advisory Board 2. REVIEW OF PREVIOUS TOWN COUNCIL MINUTES No discussion 3. INTRODUCTION TO UPCOMING ZONING CODE REVISIONS FOR PRIVATE SUBDIVISION RECREATION AREA STANDARDS Planning & Zoning Senior Planner Bayer Vella made a brief presentation of current zoning code in and issues in relation with Parks & Recreation to the Parks & Recreation Advisory Board. Mr. Vella requested the Parks & Recreation Advisory Board provide input on these zoning codes and issues. Following discussion, the Parks & Recreation Advisory Board (PRAB) came to the conclusion they needed additional information. PRAB requires a clear understanding of the current codes, issues and PRAB's role in order to respond wisely. Chair Doug White asked Mr. Vella how does PRAB work to assist and benefit you. In response to the question, Mr. Vella commented the PRAB needs to identify issues then a survey would be conducted by the Town to identity need/issues from the community, draft reports would be prepared, hold study sessions and present updated report to Council for approval. PRAB scheduled on Wednesday, December 18, 2002 Study Session meeting with Mr. Vella to review and make recommendations about the zoning codes and issues. Mr. Bayer Vella remarked he appreciated the Parks & Recreation Advisory Board input and enthusiasm. 4. WEST LAMBERT LANE MASTER PLAN UPDATE — DISCUSSION AND POSSIBLE RECOMMENDATION In response to the above concern by Mr. Tracy, Parks & Recreation Administrator Ainsley Reeder explained that the PRAB requested this item be placed on the agenda to set dates for the West Lambert Lane Master Plan Update process/timeline. In response to a question by Chair Doug White, Ms. Reeder agreed that the West Lambert Lane Master Plan Update meetings could be publicized in Homeowners Association newsletters and on the Town's website. MOTION: Board Member Joel Brault made a MOTION to accept the proposed West Lambert Lane Master Plan Update proposed process and timeline. Board Member John Russell SECONDED the motion. PARKS & RECREATION ADVISORY BOARD DEVELOPMENT REVIEW SUBCOMMITTEE / ROTATION OF BOARD MEMBERS - DISCUSSION AND RECOMMENDATION Chair Doug White referenced the discussion at the PRAB October 23, 2002, Regular Session Meeting regarding the rotation of PRAB members to participate in the PRAB Development Review Subcommittee (DRS). It was recommended by Board Member Thomas Honebrink to have continuity by adding one board member while one board member drops out each month. He had explained it might slow the process if the Parks & Recreation Administrator Ainsley Reeder had to update all the new members each month. The Chair had suggested on the third Thursday a PRAB member would leave and another would begin so that two members would be familiar with the projects. Attachment 7 Town of Oro Valley Parks and Recreation Advisory Board Results: West Lambert Lane Park Master Plan Update Questionnaire — 4/24/03 Total number of responses collected to date: 112 Total number of calls for requesting questionnaire: 15 NOTE: This document has been provided as summary of the feedback from the questionnaires and e-mails. This document does not repeat every comment made in the responses. Similar comments have been collapsed and tabulated for general presentation. To insure a complete review of each comment by the Parks and Recreation Advisory Board, each Board member has been given copies of each response so that the exact recommendations from each citizen can be read in its entirety. 1. What changes would you like to see on the West Lambert Lane Park Master Plan? Allow pedestrian access only from Canada Hills Drive. (4) Delete all pedestrian access from Canada Hills Drive. (3) Delete parking option from Canada Hills Drive. (6) Move proposed Canada Hills Drive pedestrian access east, away from existing homes. Delete all lights. (6) Delete all planned development from the east side of the park. (4) Delete the tennis court. (5) Delete skate facility. (4) Delete any picnic areas or benches in sight of houses. Delete ramadas. (2) Delete environmental education center unless coordinated with other agencies. Add patios, using concrete pavers. Park should stay exactly as it is. Provide signage that prohibits equestrians in the park. Add signage for dog owners to clean up after their pets. (2) Limit all structures to 12' in height. Create groves of trees on elevated areas off of trails for picnics/gathering areas complete with site furniture. Improve steps on hills. One centralized restroom. In place of skate facility, and add basketball, artificial turf, playground equipment,picnic areas, or restroom facilities. Leave as a natural park. (5) Add more picnic tables, garbage cans, and benches. Add more trails. 2. What amenities would you like to add to the existing West Lambert Lane Park Master Plan? More walking paths. (6) None. (3) Complete path to Canada Hills Drive. (2) Ramadas along the walkway. (2) Interpretive signage along the walkways. Water stations along the walkways. (4) Do not add any water. Parking facilities off of Lambert Lane only. More benches. Add restrooms. Keep it simple. Restrooms near parking off of Lambert Lane only. Picnic areas off of Lambert Lane only. Big trees. Substitute badminton for tennis. Develop the park as a nature preserve. (2) Move the path at the Canada Hills Drive end of the park so that it is not near yards. No additional garbage cans or benches Substitute a multi-use space surrounded by a running/bike track for the existing skate facility in plan. A recreational pond. 3. What amenities would you like to remove from the existing West Lambert Lane Park Master Plan? Remove all lights. (7) Remove any access from Canada Hills Drive (private road). (4) Remove all planned facilities from northeast side of park. (3) Remove all wide area lighting along or visible from the eastern boundary of the park. (2) Remove tennis court. (4) Remove existing steps from trails. Remove any paved or concrete trails. Remove any tall structures. Remove any proposed water service to the property. Remove basketball court. Remove playground. (2) Remove restroom. Remove everything except walking paths. Remove any parking along Canada Hills. Additional Comments: Leave the park as is. Purchased home in 1996 without notice that a park was planned behind the house. Want a daytime park only. Public restrooms spell trouble. Add restrooms. Canada Hills would be penalized greatly with the installation of lights and ball courts. Parks is a neighborhood facility; not be for regional or community wide appeal. Sweet,Town Manager L MOTORIZED SCOOTERS ORDINANCE STUDY This document is submitted for review as a draft Article to Chapter 11 Traffic to the Town of Oro Valley Code which will provide legal guidance for Motorized Scooters, Skateboards and other Motorized play vehicles. This document has only been submitted to the following Town authorities for review before goingto the town council study session. Three(3) copies were provided to the TOV Police Department Command Staff and two (2)copies to the TOV Attorney's office. All documents in this document have been marked with DRAFT COPY and are not to be used for publication. Additional copies of the document can be obtained through the Police Department. The electronic portion of this document has not been provided to anyone for quality control purposes. It will be provided at the request of the Chief of Police after the Police Department and the Town Attorney have reviewed the document and changes implemented into the document for clarification for the town council study session. There are two (2) courses of action to be considered for this Article. One is regulatory procedure allowing use of these types of vehicles on TOY streets, and the other is non-regulatory procedure banning this type of vehicle. The first course of action discussed is the regulatory procedure. In Tab 1 you will review a draft copy not for publication of the regulatory article/procedure. This procedure was put together using other municipalities' ordinances that were published to regulate these types of vehicles and includes additional recommendations. The other agencies looked at were: Tempe, Gilbert, Phoenix and Mesa. In Tab 2y ou will review the draft copy not for publication of the same article/procedure in TAB 1. In this document the following must be clarified: ► After reviewing the regulatory ordinances for the four agencies listed, it was apparent that several of them used the same verbiage or similar verbiage throughout their regulation. The Tempe Ordinance was selected as a base document to compare the other ordinances against to see what was different between them. 1 After the comparison,the Tempe base document was then used to add other p portions from the other agencies ordinances that would create the current draft copy of the TOV Article. While reviewing this document you see in Blue the names of the four agencies that were considered listed after each regulatory response. This is to inform you that this response was listed in that agency's ordinance using the same verbiage or similar verbiage. If the agency is not listed then it did not cover or use that regulatory response in its ordinance. i The responses in red were to indicate those items used from the current TOV code p and to identify recommendations that should be considered in the regulatory article. (These were added to the draft article in Tab 1) The red recommendations were placed after the Blue agency names to show you the verbiage used by those agencies and that the recommendation would improve the regulatory response for the TOV community. The second course of action discussed is the Non-regulatory procedure. In Tab 3 you will review a draft copy not for publication of the regulatory Ordinance/procedure currently used by the City of Tucson. This Ordinance banned the use of these types of vehicles in the City of Tucson. The point of contact at the City of Tucson Attorney's office is Laura Brynwood or Allen Marritt Phone# 791-5492 ext 1510. She was the lead attorney on this project. She provided several items and gave permission to use it as needed to inform the town council. She is available to answer questions as needed. In Tab 4 you will see a comparison chart of other agencies' regulatory ordinances used by the City of Tucson when putting together their regulatory action(copy not included). The Non- regulatory action was added after review of manufacture warnings and information to allow their council to have an option to consider. In Tab5 the Power point slides were used to highlight the facts about these types or vehicles to the council and the public that attended the meeting. The City council was interested in several items found on the slide presentation. The top three designers of these types of vehicles had warnings in their user manuals(copies available for review)that these vehicles did not meet Federal Motor Vehicle Safety standards and should not be used on the roadway or street. (tabbed) The use of this vehicle by a child under the age of 16 is not recommended. If used, it needed to be monitored by a responsible adult. Alleys and alleyways are not in any way to be considered thoroughfares. (2) Chief of Police means the Chief of Police of the Town of Oro Valley. (3) Commercial vehicle means every vehicle designed, maintained or used primarily for transportation of property. (4) Curb loading zone means a space adjacent to a curb reserved for the exclusive use vehicles during the loading or unloading passengers or materials. (5) Motorized play vehicle means a coaster, scooter, any other alternatively fueled device or other motorized vehicle that is self-propelled by a motor or engine and which is not otherwise defined in Arizona Revised Statutes, Title 28, as a "motor vehicle," "motor-driven cycle" or "motorized wheelchair." (6) Motorized skateboard means a self-propelled device which has a motor or engine, a deck on which a person may ride and at least two (2) wheels in contact with the ground and which is not otherwise defined in Arizona Revised Statutes, Title 28, as amended, as a "motor vehicle," "motor-driven DRAFT COPY. (7) Operator means a person who operates or is in actual physical control of a motorized play vehicle or a motorized skateboard upon a public roadway, sidewalk, right-of-way, park, bicycle path or any other public property used for the operation of motor vehicles. This includes streets in sub-divisions that are private or gated used by motor vehicles. (8) Owner means a person who holds the legal title to a motorized play vehicle or motorized skateboard, or any person who is a lessee, conditional vendee or mortgagor of a motorized play vehicle or motorized skateboard with a right to immediate possession. (9) Parade means any march, demonstration, procession or motorcade consisting of persons, animals, or vehicles or a combination thereof upon the streets, parks or other public grounds within the Town with an intent to attract public attention that interferes with the normal flow or regulation of traffic upon the streets, parks or other public grounds. (10) Parkway means that portion of a street between the curb lines of a roadway and the adjacent property lines. (11) Rights-of-way means all the property used as a public thoroughfare and lying between the exterior boundary lines of any area granted to or received by the city by grant, gift, easement, deed, dedications or operations of law for street, alley, walk or utility purposes. (12) Sidewalk is any area or way set aside or open to the general public for purposes of pedestrian traffic, whether or not it is paved. (13) Skateboard is defined as a platform mounted on wheels which are propelled byhumanpower, and skateboarding is defined as the use of a p skateboard. (14) Stand or standing means the halting of a vehicle, whether occupied or not, otherwise than for the purpose of and while actually engaged in receiving or discharging passengers. (I 5) Street is any place or way set aside or open to the general public for purposes of vehicular traffic, including any berm or shoulder parkway, right-of-way, or median trip thereof. (16) Stop, when required, means complete cessation from movement. (17) Stop or stopping, when prohibited, means any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal. (19) Traffic division means the traffic division of the police department of this city, or in the event a traffic division is not established, then such term, whenever used herein, shall be deemed to refer to the police department of this city. Section 11-7-2 Civil sanctions Any person violating any of the provisions of this chapter shall be liable for the imposition of a civil sanction not to exceed two hundred fifty dollars ($250), unless another penalty is specified. Section 11-7-3 Use of coasters, roller skates, skateboards and similar devices restricted (a) No person upon roller skates or riding in or by means of any coaster, skateboard, toy vehicle, go-carts under five (5) horsepower or similar device shall go upon any roadway except while crossing a street in a crosswalk or implied crosswalk, and when so crossing, such a person shall be granted all of the rights and shall be subject to all the duties applicable to pedestrians. This subsection shall not apply upon any street while set aside as a play street or during a special event authorized by permit. (b) No person shall operate a skateboard: (1) On any public property where such activity is specifically prohibited by appropriate posting, except as may be authorized above; or (2) In an unsafe manner so as to infringe upon the safety of themselves or the safety of other persons or property. Section 11-7-4 Application of traffic laws (a) All traffic laws shall apply to persons riding motorized play vehicles and motorized skateboards. Every person operating a motorized play vehicle or motorized skateboard upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this state declaring rules of the road applicable to vehicles, or by the traffic regulations of this city applicable to the driver of a vehicle, except as to special regulations in this chapter and except as to those provisions which by their nature can have no application. (b) This section shall not be construed to require the licensing or registration of motorized play vehicles or motorized skateboards, or the carrying of insurance covering accidents involving motorized play vehicles or motorized skateboards. (c) It is unlawful for any person operating a motorized play vehicle or motorized skateboard not to obey the instructions of official traffic-control signals, signs and other traffic direction devices applicable to vehicles, unless otherwise directed by a police officer. (b)No minor shall operate a motorized skateboard on any Town right-of-way, including streets, roadways, and alley ways, unless the minor possesses at all times while operating the motorized skateboard a written consent of the minor's parent or legal guardian. The written consent shall be signed by the parent or legal guardian,whose signature shall be notarized, and shall contain the following: (a) The name and date of birth of the minor. (b) The residence address of the minor and parent/guardian. (c) The residence and work telephone number of the parent/guardian. Section 11-7-6 Prohibited operation No person shall operate a motorized play vehicle or motorized skateboard: (1) On any sidewalk in the town, except for use in crossing such sidewalk by the most direct route to gain access to any public or private road or driveway; (2) In any town parking structure or town park, except for use on public roadways within such park; (3) On any public property that has been posted or designed by the owner of such property as an area prohibiting "skateboards"; (4) On any public roadway consisting of a total of four (4) or more marked traffic lanes, or having an established speed limit of greater than twenty-five (25) miles per hour; or (5) On any private property of another, or any public property which is not held open DRAFT COPY. (6) No person shall operate a skateboard on a Town right-of-way, including streets, roadways, and alley ways, except during daylight and in no event with in the town before seven(7:00) A.M. or after eight(8:00) P.M. Section 11-7-7 General operating restrictions (a) Na child under the age of sixteen (16) shall operate a motorized play vehicle or motorized skateboard. (b) No person shall operate a motorized play vehicle or motorized skateboard in excess of the posted speed limit or at a speed greater than is reasonable and prudent under the circumstances then existing. (c) The operator of a motorized play vehicle or motorized skateboard, approaching a sidewalk, bicycle path, bicycle lane or multi-use path in order to cross such, shall yield the right-of-way to all other users. (d) Motorized play vehicles and motorized skateboards may be operated on a path or lane that is designated as a bicycle path or lane by state or local authorities. However, motorized play vehicles and motorized skateboard operators on said bicycle path or lane shall yield at all times to other users. (e) No operator shall allow passengers when the motorized play vehicle or motorized skateboard is in operation or motion. (f) No person operating or riding upon a motorized play vehicle or motorized skateboard shall attach themselves in any manner to any other vehicle. (g) No person shall operate a motorized play vehicle or motorized skateboard while carrying any package, bundle or article which prevents the operator from keeping both hands upon the steering mechanism at all times. (h) No person, other than the owner, shall operate a motorized play vehicle or motorized skateboard without the written permission of the owner. (i) No person shall operate a motorized play vehicle or motorized skateboard that has been structurally altered from the original manufacturer's design. (j) No person shall operate a motorized play vehicle or motorized skateboard in a crosswalk. (k) No person shall operate a motorized skateboard in a manner causing excessive, unnecessary, or offensive noise which disturbs the peace and quiet of any neighborhood or which causes discomfort or annoyance to a reasonable person of normal sensitivity. NOT FOR PUBLICATION Oro Valley Town Code DRAFT COPY.NOT FOR PUBLICATION Section 11-7-8 Operating restrictions on roadway (a) A person operating a motorized play vehicle or motorized skateboard on a roadway at less than the normal speed of traffic, at the time and place and under the then existing conditions, shall ride as close as practicable to the right-hand curb or edge of the roadway, except under the following conditions and when the movement can be made safely: (1) If overtaking and passing a bicycle or vehicle proceeding in the same direction; (2) In preparing for a left turn at an intersection or into a private roadway or driveway; (3) If reasonably necessary to avoid hazardous conditions ahead in the roadway; or (4) If the lane in which the person is operating the motorized play vehicle or motorized skateboard is too narrow for a motorized play vehicle or motorized skateboard and a bicycle or another vehicle to travel safely side by side within the lane. b) No operator of a motorized play vehicle or motorized skateboard shall transport extra fuel in a separate container or alter the fuel reservoir from the original manufacturer's design. This includes the prohibition of physically attaching fuel packs or containers to the operator's person. (c) Persons operating motorized play vehicles or motorized skateboards on the roadway shall not ride more than two (2) abreast. Section 11-7-9 Required safety equipment (a) No person shall operate a motorized play vehicle or motorized skateboard without a head lamp emitting a beam and a red rear reflector anytime from sunset to sunrise, or any other time when there is not sufficient light to render clearly discernible, persons or vehicles on the roadway. (1) A head lamp shall emit a white light and be visible from the front at a distance no less than five hundred (500) feet; (2) A rear red reflector shall be visible when illuminated by a vehicle head lamp from a distance of not less than three hundred (300) feet; and (3) A rear red lamp visible from a distance of five hundred (500) feet to the rear may be used in addition to the rear red reflector. NOT FOR PUBLICATION (b) No person shall operate a motorized play vehicle or motorized skateboard unless it is equipped with a brake which enables the operator to make a braked wheel(s) skid on pavement. (c) Any operator of a motorized play vehicle or motorized skateboard under the age of eighteen (18) years being operated on a roadway shall at all times wear a protective helmet on his or her head in an appropriate and safely secured manner. The helmet shall meet minimum standards of testing and safety inspected by the bicycle industry. (d) No person shall operate a motorized skateboard without wearing footwear. The footwear must have a sole and completely cover the feet and toes. (e) A person operating a motorized skateboard shall wear, at all times, protective glasses or goggles or a transparent face shield of a type approved for motor-drive cycle use. Section 11-7-10 Violations (a) Violations of any of the sections of this article concerning motorized play vehicles and motorized skateboards are designated as civil traffic violations and shall be prosecuted in the same manner as provided by law for other civil traffic violations. (b) If a fine is imposed upon a minor who is found to be in violation of this article, involving motorized skate boards, the parents or legal guardian having custody or control of the minor shall be jointly and severally liable with the minor for payment of the fine whether or not the parents or guardian knew of, or anticipated, a violation of this article.
