ANN RODRIGUEZ, RECORDER'., p Recorded By: LW(e-recording),' OyPLLEV AgiZO 1 3 a s S��UNDED,9,ae Town of Oro Valley Public Works Department RIGHT-OF-ENTRY AGREEMENT La Cholla 311 Property LLC,as to Parcel 224-20-001C,224-20-001D and 224-23-001A,("Grantor") does hereby convey to the Town of Oro Valley("Grantee"),a municipal corporation of the State of Arizona,multiple Right-of-Entry Easements(collectively"Right of Entry").This Right-of-Entry shall be on, over and across real property legally situated in the Town of Oro Valley,Arizona,more particularly described in the attached Exhibits"Al,A2,A3,A4,A5,A6,A7,A8,A9 and A10"("Property"). The purpose of this Right of Entry is for the construction of the La Cholla Boulevard:Overton Road to Tangerine Road improvement project("Project")and related utility construction.The Right of Entry is to allow Town staff,its agents,contractors,public utilities and assigns,to use the Property,as described herein,for construction of the Project and appurtenances. The term of this Right of Entry shall commence on the date signed by Grantor and each Right-of-Entry shall be perpetual,and applicable to each parcel,but each Right-of-Entry shall,as the case may be, terminate upon permanent transfer or dedication to Grantee as a permanent Right-of-Way and/or slope easement and/or drainage easement required by Grantee. Further this Agreement is subject to the following conditions: • The Property is subject to changes per the Project approved plans and amendments. • At the request of the Grantor,Grantee shall provide construction plans/reports in electronic format. • Grantee to require a Right-of-Way permit for use of the Property by its agents,contractors, public utilities and assigns. • All waste and debris resulting from the Project shall be removed,and trenches/holes backfilled by the Grantee or those permitted by the Grantee to use the Property. • Grantee to provide erosion control/bank stabilization/landscaping for disturbed areas.
