If any person with a disability needs any type of accommodation, please notify the Town Clerk's Office at 229-4700. s TOWN OF ORO VALLEY COUNCIL COMMUNICATION MEETING DATE: September 20, 2004 TO: HONORABLE MAYOR& COUNCIL FROM: Bryant Nodine, AICP, Planning and Zoning Administrator SUBJECT: GENERAL PLAN UPDATE: CITIZEN COMMITTEE BACKGROUND On August 18, the Council considered the General Plan and directed staff to assemble names for a citizen committee per the following motion: Mayor Loomis DIRECTED staff to contact the Planning and Zoning Commission, Development Review Board, Water Utility Commission, Parks and Recreation Advisory Board, Budget and Bond Board and Public Art Review Committee and ask them to appoint a representative; to place in the newspaper an ad seeking volunteers to work on a General Plan Update Citizen Committee; and to plan on a Study Session on September 20th to further plan and establish direction for this committee. Council Member Culver SECONDED the motion. MOTION carried, 6-1. CITIZEN COMMITTEE The following bodies have submitted recommendations for a representative to the committee: Planning and Zoning Commission Don Cox Development Review Board Al Kunisch Water Utility Commission to be provided at the meeting Parks and Recreation Advisory Board Bob Evans Budget and Bond Board Lyra Done Public Art Review Committee David Grigsby In addition an ad was run in the Explorer and 11 persons submitted applications. Those applications are attached. DIRECTION FOR THE COMMITTEE Update Process The following steps are the minimum to meet State requirements: • Complete the revisions • Planning and Zoning Commission and Town Council review of the draft Plan • 60-day review period • Two Commission public hearings in separate locations • Council Hearing • Council adopts Plan and declares election • Election (Based on the experience of the two other communities where the General Plan was not ratified, the election should not be coincident with a Town Council election or with any locally referred items.) TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 2 Suggested Committee Process After an orientation on the adopted Plan, the process 40 to date, and State requirements, the Committee would start addressing the identified issues within the Plan (per the section below). They should: • host and actively participate in any public workshops; • be involved throughout the 60-day Review Period; • modify the plan based on review comments; • remain involved during the public hearing process to address issues referred to them and to make recommendations to the hearing bodies; and, • as a separate volunteer group, support the plan through the election. AREAS TO CONSIDER FOR CHANGES As presented in the April 26 report to Council, the following areas within the Plan should be considered to address the primary concerns expressed in the post-election surveys. They are presented in the order of presentation in the Plan and not by importance. General Policy Changes The 1996 General Plan included 132 policies of which 10%were stated as "shall" statements. Early in the process of revising the 1996 Plan, the policy statements were all redrafted to begin with: "The Town shall..." Later, the Council directed staff to review all of the policies to start the sentences with an active verb so that the policies, though still very directive, only use the verbiage "the Town shall" where the policies are: • mandated by the Town Code or State or Federal law; • partially implemented by Code; • already being accomplished even though not required by law; and/or, • are strongly supported by the community As a result 12% of the 220 policies in the proposed plan are stated as "shalls" and the remaining policies are clearly directive. However, the perception in the community is that the policy content of the plan was weakened from the 1996 plan. Accordingly, the Council may wish to reconsider and apply "shalls" to a greater number of the policies. Amending the Plan (p. 10) The Town has provided a definition of Major Amendment that makes the proposed plan one of the most difficult to amend of any of the general or comprehensive plans that the staff has reviewed in the State. The requirement for a super-majority vote of the Council to approve a Major Amendment means that the ability to amend the plan became more difficult (as compared to the 1996 Plan) in 90% of our plan area the only exception being the "Growth Areas." Regardless, there was significant concern in the community that amending the proposed plan would be easier than amending the 1996 Plan. This concern could be addressed by considering changes to the following two items. Definition of Minor Amendment (p. 11) There was some concern related to criterion #2, which allows increases in intensity within growth areas to be classified as "minor amendments". TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 3 Adoption of Amendment ("Findings", p. 13) In the 1996 Plan, there were four findings required in order to amend the Plan. In the proposed plan, one finding was removed and the remaining findings were reworded. The perception in the election was that this was one of the changes that weakened the Plan. Definition of Policy (p. 16 and p. 86) There are two (not identical, but similar) definitions of policy in the Plan. The definition on page 16 is the definition approved by the Steering Committee. Policy 1.5.3 (p. 21) This policy is in place as a method of achieving better air quality. It encourages "mixed use development with amenities such as day care facilities, bicycle and pedestrian access, employment and housing". After the deletion of the Mixed-use Neighborhood (MUN) designation, this was left in the proposed Plan to refer to the variety of uses allowed under the Master Planned Community (MPC) designation, and what is already allowed in the zoning districts or PADs. It may helpful to change the term "mixed use development"to "development with a variety of uses," or some similar term, thus avoiding any confusion. Land Use Standards (p. 22) The 1996 Plan and the proposed plan both provide ranges of densities for each land use designation. Both plans treat these ranges as the overall densities of parcels and allow densities to vary within the parcel as long as they do not vary from the description in the land use designation (e.g. "single-family, detached"). The proposed Plan provides additional restrictions on this variation in density. Though the proposed Plan is more restrictive than the 1996 Plan, this became an issue in the election. The community preference appears to be that the density ranges establish the upper limit of density allowed in any portion of a parcel. Significant Resource Area (p. 25) Those areas designated as Open Space on the map are only those areas where open space has currently been preserved through the development process. If any other areas are designated as open space, per State Law, they must have a one-unit-per-acre, "back-up" designation. Areas that the Town wants to see as open space in the future (25% of the planning area) are now designated as Significant Resource Area (SRA) with underlying land use designations that are typically less than one unit per acre. The SRA designation includes riparian areas, ironwood areas, archeological sites and other environmentally sensitive lands. The concern in the community is that there could be even a little development in these areas or that a land owner may get "credit" for transferring densities out of these areas. Policy 3.1.7 (p. 38) This policy states "[c]onsider alternative revenue sources, such as a property tax and..." to ensure the Town's economic stability. The inclusion of the term "property tax" became one of the primary issues used to defeat the plan. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 4 Policy 7.2.3 (p. 58) This policy was created to meet the goal of providing a range of housing opportunities by encouraging"the mixing of various residential densities and the integration of commercial uses through high-quality neighborhoods and master planned communities." Though this policy refers to the Land Use Map, which does not include MUN, and it specifically mentions MPCs, the community concern was that this encouraged MUNs. Strategic Implementation Plan Item LU.8 (p. 3 of the SIP) Item LU.8 in the Strategic Implementation Plan (SIP) directs staff to develop a MUN zoning district with regulations and standards for that type of development. While the inclusion of this does not automatically create a MUN use in the Town (zoning code standards must be created, then a General Plan amendment, and finally a rezoning), it did create concern in the community that the Town would, in the future, encourage mixed-use developments. CONCLUSION Staff seeks direction from the Council regarding the composition of the committee and their charge. Attachments: 1. I have owned another piece of Arizona property for thirty five years. I believe that the General Plan for the City of Oro Valley was developed by a hard working group of people. The session was designed to address key issues facing the town, provide an opportunity for the Council and department leaders to work together and build stronger professional relationships, and lay the groundwork for major objectives to be accomplished over the next two years. PART I: THE ASSETS & STRENGTHS OF ORO VALLEY During group introductions, participants were asked to identify what they believed to be the greatest asset/ strength of the Town of Oro Valley. A summary of their responses is listed below: -The spirit of our residents -Involvement of the Community -We embrace the Arts -Optimism of Town Staff -People ( town governance is not a -Strong Citizen Participation spectator sport) -Available knowledge/ expertise -Town staff working together -Town has very high standards -Positive Contributions of many -Diversity of the Town -Emphasis on children's facilities/activities -A willingness to work hard -Commitment of our Volunteers -An upbeat, positive attitude -Variety of available talent PART II: LEAVING A LEGACY Retreat participants were also asked to project out two years and "picture"what the Town of Oro Valley would look like. What would be happening? What would they be seeing? What would people being saying about living there and the governance of the town? The comments below reflect the compelling future the council and staff see for Oro Valley and reflect "beginning with the end in mind" to guide decision-making over the coming two years. The comments are grouped under one of three headings: Quality of Life, Community Successes, &Positive Governmental Actions. Quality of Life: -Industries are located here creating jobs. -We will have Great Parks! -Oro Valley is growing as an arts / cultural center. -Annual "music festivals" are being held in the town. -An abundance of activities for children are sponsored & available. Page 2 -Construction has begun at Naranja Park. -Continued development includes preservation of desert/ open space. -Oro Valley no longer has a reputation as "traffic citation city". -Oro Valley library is on the cover of"Library World"journal. -Lots of family-related activities, supported by the community. -Transportation system that is safe, reduces traffic jams, & is linked to all forms of movement (auto, walking, biking, etc.). Community Successes: -Oro Valley is financially stable and has a property tax. -Citizen service expectations are being met, within budget. -There is growth in the resort/tourist final destination economic activity. -Several more bio-tech firms are or have located here. -You can "feel" a sense of community in Oro Valley. -The town is more socially diverse and respects/welcomes all people. Positive Governmental Actions: -Oro Valley has a clear vision, agreed on and developed by many of its citizens and the Town Council & Staff. -There is a "voter approved" general plan in place. -Interactions among the town staff, town council, and citizens is positive, open and ethical. -A new Public Works facility is under construction. -Town council meetings never last longer than two hours. -There is a proactive approach to resolving community problems and the Town Council / staff are seen as working well together for the best interests of the community. PART III: DISCUSSION SUMMARY OF "KEY ISSUES" The following pages summarize the discussions and commitments made by retreat participants on key issues facing the town in the coming year(s). While the initial retreat agenda listed 10 issues, the importance, complexity, and depth to which each issue was discussed resulted in just four of the issues being covered. Each issue is summarized using the following format: -Comments made in response to one or more specific questions raised. -Summary of Actions/Commitments to be undertaken Page 3 Issue#1: The General Plan Question #1: What would the charge/objectives be of the"general plan" committee? -Address the main issues (contentious) that cased the general plan to fail -Look at issues identified in the survey -Look at issues identified by"OV 2004 &Beyond" -Make recommendations to remove, alter, or resolve issues identified -Simplify the language of the plan -Identify new issues to be addressed re the general plan -Educate the community about the plan (why a plan is necessary,how/what the plan would impact, clarity of changes made to the plan and why) Question#2: What should be the composition of/qualifications for committee membership? -Have attended the CPI class -Have knowledge/experience with at least one area of the general plan -Be appointed by Council members (one per Council person) -Be selected by Town Council from a pool of recruited volunteers -Committee should represent all aspects of Oro Valley -Committee chaired by either Brent or Barry -Committee should have between 9-16 members(include two town staff and represent- atives from existing boards & commissions -Ad for volunteers (if used) should ask what they feel they can contribute to the commit- tee Question #3: What is the pathway for the collection / dissemination of information? -Instructions to the committee -Recommendations to the staff -Review by Planning & Zoning department/commission -Public hearings & comments -Report to Town Council for discussion & action Summary of Actions/ Commitments: -Determine exact size the committee will be -Appointment of knowledgeable representatives by council plus two staff persons -Address key issues that caused the failure of the General Plan in the last election -Forward recommendations to Planning &Zoning Staff -Have a variety of public processes to present/discuss plan information Page 4 -Recommendations to Council -Multiple efforts at public education of the plan's contents, benefits, etc. -Prepare for November 2005 ballot Issue #2: Economic Development Question #1: What is the charge / objective of the Economic Development Committee? -Explore & update future economic development strategies -Identify alternative sources of potential income (beyond retail sales tax): Recurring, Non-recurring, Property Tax -Seek to diversify economic base -Make recommendations to Town Council re economic growth directions / strategies -Develop policies for Recruitment/Retention of business & industry -Incentives should be tied to performance -Make recommendations re land to be used for economic development -Review current economic development policies (based on CED's from 1997) -Review Buxton report -Identify cross-over points (when is it profitable?) Population size to sales tax revenue Industry to spending in the community -Promote workforce development (bring PCC &business together) -Coordinate efforts with regional economic development plans and programs -Think creatively about future revenue base (Service/suppliers, biomedical,branch of Pima Community College, music/cultural attractions, auto type dealership: see, drive, order) -How will success be measured and over what time period? -What will the community look like given different development strategies? -What is likely revenue stream from different development strategies? -Is the community vision suburban or urban? -What is the role of town government in economic development (what value is added or competitive edge gained)? -Actively market the Quality of Life that Oro Valley has to offer Question #2: What is the composition of— qualifications for Economic Development Committee Membership? -Have representation from key stakeholders: Chamber Hospital Education (secondary) Resorts Page 5 Retail Business Industry (Ventana) Financial Services Town Council Citizens at Large -Should the committee be a Task Force vs Standing Committee vs an Annual Activity -Make broad recommendations vs Reviewing EDA's Summary of Actions / Commitments: -By November 2004, select 7-10 people to form a technical assistance task force -Review existing economic development policies/documents -Brainstorm diversification of possible revenue sources -What's thep otential (ideal) mix of retail, industry, residential, service, and cultural? -What will / should Oro Valley look like as the result of pursuing various economic development strategies or alternatives? -Determine if the task force should become a standing committee following completion of their initial charge Issue #3: Annexation Question #1: What should the map ultimately look like? -Go down La Cholla to Ina Road • -Smaller is better -The work of the committee (reducing size of the town)was good -There are opportunities to the north, depending on what happens (state park?) -Going west/ south of Ina Road requires assessing the character of the existing neigh- borhoods -Anyp roposed annexation map should stay in-sink with the General Plan -Should the town be "squared off'? Question p#2: Re existingannexation policies—What needs to be added, deleted or changed? -Anticipate what would be needed to meet new service levels -What is cost if the annexation fails? -During pre-annexation, develop a list of can do's & can't do's -What is the cost of gearing up for annexing? Where is the balance between potential revenues and higher initial cost? Service costs may run at a deficit in the short-term Short-term drain vs long-term gain -Areas available for potential annexation should be PRIORITIZED -Proactive approach vs pre-emptive stance -What economic model is appropriate? How do you quantify the "character of neigh- borhoods being considered for annexation? Page 6 -Pre-annexation agreements MUST be approved by the Town Council -Pertinent information should be gathered prior to map being filed can be done about property owners waiting until the "11th hour"to -What should/ p p Y get concessions? -Concessions should be scrutinized closely(by whom?) -Annexation is a labor intensive process and there is no staff dedicated solely to this function -Pre-existing agreements and proposed annexations should be voted on together -How can the town counteract the ability of some areas to negotiate concessions more effectively? -ONLY the Town Council can approve agreements that violate or are outside the existing annexation guidelines -"Safety" related issues may take precedence when considering the feasibility of annexing any given area Summary of Actions/ Commitments: -Identify priority areas for potential annexation -Determine how to look at, analyze and project costs of annexing -Annexation map should be in line with the General Plan -Develop /review guidelines for individual annexations -The Town Council should vote on ALL pre-annexation agreements Issue #4: Town Council Processes Question#1: How is the newly modified applicant process working? -Changes to applicant process seem to be working and require the applicant to take more responsibility -Is thep rimary issue usually land use when it comes to this process?-Staff will focus more on pros/cons instead of making specific recommendations. But the Town Council should /will take final responsibility for a decision -Council is free to request a more specific recommendation or guidance from staff -Three basic ways to present decision: "I move to approve" "I move to approve with conditions" "I move to deny" Page 7 Question #2: How is the Agenda-setting Process Working and are there other Changes that should be Considered? -Adhere to the policy of agenda items being added if two council persons support the item -Might try going to two-week lead time on council packet preparation. This would: Give the council more time to review and questions during council meetings might be reduced -If change lead time, will have to modify the review process and ascertain the impact on citizens /customers -Shoot for January, 2005 implementation date -Council should be made aware as to which topics are time-sensitive OR going to re- quire extensive discussion time -Maybe a ten-day vs two week lead time on council packets would be more appropriate -Why do Town Council meetings last so long anyway? Oro Valley has a state-wide rep- utation for very long meetings -Target times on agenda were tried in the past. They did not work. Time to try again? -Consider changing the order of items on the agenda -What do other communities do to shorten their council meetings? • Summary of Actions/ Commitments: -Staff will no longer make recommendations on council agenda items being discussed but will offer pros & cons (unless asked for more guidance) -Town Council will adhere to the guideline of adding items to the meeting agenda when two members support the addition -Lead time on delivery of council packets will change on 1-1-05. The time may be two weeks or it may be ten days (impact of this change on citizens and customers of the town will have to be evaluated) -Staff will begin notifying the Town Council when agenda items are going to be time- sensitive (either needing a definite decision or going to require lengthy discussion) -Both the Town Council and staff will search for methods to at least try in an effort to shorten Council meetings.
