Taken together, the Growing Smarter legislation provides comprehensive land use planning and zoning reforms, including the acquisition of open space, and gives residents of Arizona cities and towns a number of tools to shape growth in their own communities, such as the right to vote on general plans and restrictions on how general and comprehensive plans can be amended. In 2002, the Growing Smarter legislation was amended to require the governing body of each city and town with a population of more than two thousand five hundred and less than seventy-five thousand persons, and whose existing general plan was adopted on or after January 1, 1989, to amend its plan to include all the elements required by the new legislation on or before December 31, 2003. Accordingly, Oro Valley's existing General Plan adopted in 1996 was amended as required by the Growing Smarter legislation resulting in the proposed new Oro Valley General Plan Update 2020. The Town's new General Plan Update 2020 was submitted to the voters for ratification on November 4, 2003, in compliance with the December 31, 2003 deadline. However, a majority of the qualified electors voting on the proposed new General Plan Update 2020 failed to approve the new Plan. Pursuant to the provisions of the Growing Smarter legislation (ARS § 9-461.06[L]), the existing 1996 Plan remains in effect and the Town Council is required to either resubmit the proposed new plan, or revise the new plan for subsequent submission to the voters at the next regularly scheduled municipal election or at a special election scheduled at least one hundred twenty days after the Town Council readopts the new or revised new plan. The Town has the following five (5) options concerning the content of the Oro Valley General Plan Update 2020: 1. Make no changes to the Plan; 2. Make minor revisions to the Plan; 3. Make major revisions to the Plan; 4. Retain the 1996 Plan with the inclusion of only those elements mandated under the Growing Smarter legislation; or 5. Totally rewrite the 2003 Plan. F:\Forms\Council Communication(Reg) 110501.doc • TOWN OF ORO VALLEY Page 2 of 3 COUNCIL COMMUNICATION MEETING DATE: 11/17/03 Any revision to the Plan will require compliance with the procedural requirements of ARS § 9-461.06 including notice to all applicable governmental officials and agencies and the holding of public hearings by both the Planning and Zoning Commission and the Town Council. Prior to submission of the Plan, with or without revisions, to the voters for ratification,the Town Council must readopt the Plan by resolution. The existing Plan or revised Plan must be submitted to the voters for ratification at either: a. The next regularly scheduled municipal election after the Town Council readopts the existing or revised Plan; or b. A special election scheduled at least 120 days after the Town Council readopts the existing or revised Plan. The next regularly scheduled municipal elections are the March primaries and May general elections in 2004 and 2006. Pursuant to State statute, municipal special elections may be held in the months of March, May, September or November. A Joint Study Session has not been held between the Town Council and PRAB in quite awhile. A copy of the Oro Valley Town Code, Article 3-6, Advisory Boards, Sections 3-6-1 through 3-6-7 are attached for your review. The Town Attorney will be present at the Joint Study Session to answer questions and discuss details of the Arizona Open Meeting Law and Call to the Audience. The board shall submit recommendations for the council's information and possible action. Section 3-6-2 Term of Office and Membership Such boards shall be created for terms not exceeding two years which terms may be shortened, ended, or extended by action of the council. Members of the board shall serve at the pleasure of the council for a term not exceeding two years. Any vacancy shall be filled by the council for an unexpired term. Members shall serve without compensation and shall be residents of the town and not members of any other town body. Section 3-6-3 Extension of Term of Advisory Board In the event the board sends a letter of intent of desire to continue to the town council three months prior to its expiration date, the council shall consider an extension of the term. In the event of extension of a board's time, the council shall advertise for other board members to volunteer for positions on the board and additionally consider existing board members should they send to the council letters of intent as to their desire to remain on the board. Section 3-6-4 Officers Designated, Meetings, and Rules of Procedure The board shall elect its own officers annually and may conduct its meetings in accordance with Roberts Rules of Order as may be amended by the council for the use of all commissions and boards and shall adhere to all open meetings laws of the State of Arizona. Board meetings shall be regularly scheduled, legally noticed, and held once a month. Special meetings may be called by the chair with at least 24 hours notice or by any three board members with at least 48 hours notice under the same conditions as set forth for the mayor and council under Section 2-4-2 of the Oro Valley Town Code. Agendas shall be posted and meeting minutes taken and both shall be filed with the town clerk. Section 3-6-5 Limitation of Authority Advisory boards shall not have authority to commit the Town of Oro Valley to any agreements with public or private organizations or discuss financial arrangements. Section 3-6-6 Liaison The town manager or his designee from the town staff shall serve as an ex-officio non- voting member of the board to facilitate reports to the council and shall attend such meeting as he/she deems necessary or as a function of the board's agenda Section 3-6-7 Powers and Duties of the Parks and Recreation Advisory Board 1. To act in an advisory capacity to the Town Council in matters pertaining to parks and recreation, parks design, open space and trail use (prior to the review comments being submitted to other Boards, Commissions or the Council). The Board's powers shall be limited to an advisory role with the Parks and Recreation Director and/or the Town Council and shall not provide directions to Town Employees regarding the activities of staff, parks operations or recreation programs. 2. As with any Board, Commission or Committee, all requests for use of any Town Staff time and resources must be approved by the Town Manager or his designee. 3. Give advice to the Town Council and Parks and Recreation Director for general priorities at budget time for those items (other than administrative functions as determined by the Town Manager and the Department Head) relating to park development and recreation programs. This involves a yearly review and update of the five.year plan for park land acquisition and capital improvements as prepared by the Parks and Recreation Director. 4. Give due attention and study to the recreation, open space, trails and park services as they affect the residents of Oro Valley. 5. Make policy recommendations, keeping in mind that the final adoption of the policy is the prerogative of the Council. 6. Make initial contact for soliciting funds after being so directed and approved to do so by the Town Council; again keeping in mind that the Council makes the final determination for any acceptance or rejection in these areas. 7. Interact with the Town of Oro Valley Arts Advisory Board on all matters relating to parks and recreation matters in regards to areas of mutual concern.
