Councilmember Greene was excused from the meeting at 5:42.   CALL TO AUDIENCE There were no speaker requests at this time.   COUNCIL LIAISON COMMENTS (INFORMATIONAL ONLY) Councilmember Greene commented that the Council has engineers looking into the settlement of soil in the housing areas considered for development around Moore Loop. Chair Crocker asked for clarification of what Moore Loop is. Stormwater Division Manager John Spiker commented that it is Moore Rd east of Rancho Vistoso Blvd, in the Valley Vista and Alterra subdivisions.   DIRECTORS REPORT (INFORMATIONAL ONLY) Stormwater Division Manager John Spiker commented on the following: There is a storm front moving into the Tucson Region through the weekend. Be aware of flooded low water crossings. A late season fire in the northwest portion of the Santa Catalina Mountains which burned 300 acres before it was extinguished with no property damage or loss of life. We will monitor for flooding post-fact. Pima County Flood Control District (PCFCD) was awarded a 2.3 million dollar hazard mitigation grant by the Federal Emergency Management Agency (FEMA). Construction is to begin next calendar year to raise the bank elevation along the Canada del Oro (CDO) Wash. From Oracle Road to La Canada is to be enhanced. The PCFCD grant application was in the cycle ahead of the Towns' three applications. 11/16/23 Minutes, Stormwater Utility Regular Session Meeting 1 enhanced. There will be a Stormwater Utility Commission (SWUC) Commissioner shirt order next year.   REGULAR SESSION AGENDA   1.PRESENTATION AND DISCUSSION REGARDING THE COMMUNITY'S NEXT 10-YEAR ACTION PLAN, KNOWN AS OV'S PATH FORWARD       Principal Planner Milini Simms and Senior Planner Rene Olvera presented the Community's new 10-year action plan, known as OV's Path Forward. Discussion ensued amongst the Commissioners and staff regarding the new 10-year action plan, known as OV's Path Forward. You need to Register to add comments.   2.REVIEW AND APPROVAL OF THE AUGUST 17 AND SEPTEMBER 21, 2023 MEETING MINUTES       Motion by Chair Richard Crocker, seconded by Commissioner Gary Mattson to approve the August 17, 2023 meeting minutes with the following change: Commissioner Hawkinson provided comments toward the MS4 Annual Report.  Vote: 4 - 0 Carried    Motion by Commissioner Richard Hawkinson, seconded by Vice Chair William Thomas to approve the September 21, 2023 meeting minutes.  Vote: 4 - 0 Carried   3.RECOGNITION OF OUTGOING STORMWATER UTILITY COMMISSIONER WILLIAM "ED" THOMAS       The Stormwater Commission and Staff made farewells to Commissioner Thomas and wished him well. Mr. Spiker thanked Commissioner Thomas for always giving back to his community.   4.DISCUSSION OF MEETINGS AND EVENTS       Mr. Spiker discussed recent meeting and events.   5.REVIEW AND DISCUSSION OF THE OCTOBER 16, 2023 STORMWATER UTILITY COMMISSION FIELD TRIP TO KINO ENVIRONMENTAL RESTORATION PROJECT (KERP)       Mr. Spiker recapped the Stormwater Utility Commissions field trip to the Kino Environmental Restoration Project (KERP) where former Director of Pima County Flood Control District Suzanne Shields gave a presentation and tour of the facility. Mr. Spiker gave an overview of the field trip which focused on the multi-use aspects of the KERP. The uses being flood-control, stormwater harvesting, vegetation restoration, and recreation.   6.DISCUSSION AND PRESENTATION OF THE CANYON DEL ORO BIBLE CHURCH PRIVATE DRAINAGE IMPROVEMENTS    11/16/23 Minutes, Stormwater Utility Regular Session Meeting 2    Mr. Spiker made a presentation on the Canyon Del Oro Bible Church private drainage improvements. One main purpose was to show that the town isn't the only one doing stormwater and flood control improvements. Mr. Spiker noted that Mr. Lowell Jensen, who spearheaded most of the Canyon Del Oro Bible Church drainage improvements, was in attendance in the audience. Mr. Spiker commented that a couple years back, Mr. Jensen had contacted the Stormwater Utility asking for guidance and additional help with the sediment and erosion issues. The damage was mostly caused by sediment transport. Mr. Spiker continued the presentation by showing a series of photos documenting the timeline of the work that needed to be done. Discussion ensued where it was questioned if HOA's would be able to obtain advice or assistance from the Town regarding drainage issues. Mr. Spiker commented that since the issue is regarding an HOA, it is private property and is not eligible for Town funding, but that the Town and the Stormwater Utlity are here to offer our experiences and guidance to HOA's and commercial properties. We can come out to do assessments, to evaluate scopes of work you might receive from contractors or consultants, and to help you understand the regulations you will need to meet. We certainly are here to help.   7.DISCUSSION AND POSSIBLE ACTION REGARDING THE ANNUAL STORMWATER UTILITY RATE ANALYSIS RECOMMENDATION TO MAYOR AND COUNCIL FOR FY 2024/25       Mr. Spiker gave an overview of the Stormwater Utility projected revenues and expenses, its fee structure and the Environmental Protection Agency (EPA) and Arizona Department of Environmental Quality (ADEQ) regulations the Town is mandated to meet. Discussion among the Commission and staff affirmed the need and the ability of the Stormwater Utility fee first and foremost to meet the required mandated regulations. Discussion ensued regarding the concern that in the future the Towns Next 10-Year Action Plan does not provide the Town with additional developable space and its related sales/construction tax revenue and that there is concern that the Town will face a funding shortfall due to the lack of revenue. At this time, our funds are going to existing maintenance and not future projects. We have been deferring capital investments, and we will have to deal with aging infrastructure. What will the council's direction be with this 10-Year Plan. We will need to find more money. With inflationary pressures, next year we will need to revisit the $4.50 fee and start a detailed discussion on a change to the fee structure, the rate change, and the measurement value. Keeping in mind the objective of maintaining the quality of life in Oro Valley. It was agreed to save discussion on the budget for another time and to make a motion concerning the base rate for the upcoming fiscal year 2024-2025, which will be July 1, 2024 - June 30, 2025. Mr. Spiker commented that starting next year at Stormwater Utility Commission meetings different scenarios will be presented, while taking into consideration what will be the idea from the council about where revenue streams will be generated from.    Motion by Chair Richard Crocker, seconded by Vice Chair William Thomas to approve a recommendation to Mayor and Council to support a status quo base rate for the Stormwater Utility for the upcoming fiscal year 2024-2025.  Vote: 4 - 0 Carried   8.DISCUSSION AND POSSIBLE ACTION REGARDING THE CANCELATION OF THE DECEMBER 21, 2023 SWUC REGULAR SESSION MEETING       Motion by Chair Richard Crocker, seconded by Commissioner Richard Hawkinson to cancel the December 21, 2023 SWUC Regular Session Meeting. EXECUTIVE SUMMARY: The Town of Oro Valley Stormwater Utility Commission holds their Regular Session Meetings on the 3rd Thursday of the month at 4:00 p.m. The attached document lists the anticipated meeting dates for regular meetings of the Stormwater Utility Commission for 2024. BACKGROUND OR DETAILED INFORMATION: Town Code Section 15-24-6 establishes a Town of Oro Valley Stormwater Utility Commission comprised of five (5) Oro Valley residents, and the Mayor and Council shall appoint the members. Commissioners serve two-year terms, with possible reappointment for a second term.   Regular Session Meetings are scheduled on the 3rd Thursday of the month at 4:00 p.m.   Topics discussed during Regular Session Meetings are mostly informational related to ongoing SW projects and administrative reports.  One exception to this is the requirement in Town Code 15-24-13 Section H that the Stormwater Utility Commission (SWUC) annually review the Stormwater Utility revenue requirements and recommend to the Town Council rate adjustments as necessary.  FISCAL IMPACT: N/A SUGGESTED MOTION: This report is informational only. EXECUTIVE SUMMARY: The Town of Oro Valley's (Town) Stormwater Management Program and Annual Report to ADEQ identify Minimum Control Measures (MCM’s) used to manage and control quality of stormwater runoff from the MS4. Each MCM has been given specific implementation dates and frequencies, measurable goals, and responsible departments. This memorandum is a report on the Town’s Stormwater Management Program for the second quarter of the Annual Reporting Period for 2023-2024 (July 1st through June 30th). It has been prepared to keep stakeholders informed of the status of project implementation in terms of completed tasks that are either (A) ongoing or continuous, or (B) to be done a minimum of once each year. Accompanying this Memorandum is a summary Table listing each of the six (6) required MCM’s along with their specific subset of Best Management Practices (BMP’s). This summary Table shows that the Stormwater Utility is up to date, and has met this quarter’s goals for implementing BMP’s that are ongoing and continuous.   BACKGROUND OR DETAILED INFORMATION: The Town manages stormwater quality in accordance with the Arizona Pollutant Discharge Elimination System (AZPDES) Permit AZG2021-002 that authorizes the discharge of stormwater from the municipal separate storm sewer system (MS4) to receiving waters, including Waters of the United States (WOTUS). The MS4 generally consists of roads, storm drains, and infrastructure carrying runoff into drainage ways or ephemeral stream channels. The Town has a Stormwater Management Program (SWMP) that describes the control measures it uses to manage the quality of discharges from the MS4. These Best Management Practices (BMPs) are: MCM-1. Public Education and Outreach MCM-2. Public Participation and Involvement MCM-3. Illicit Discharge Detection and Elimination MCM-4. Construction Site Runoff Control MCM-5. Post-Construction Runoff Control MCM-6. Pollution Prevention/Good Housekeeping for Municipal Operations The Town’s Stormwater Management Program describes specific practices it uses to achieve compliance with Part 6.4 of the AZPDES Permit related to Minimum Control Measures, including specific implementation dates and frequencies, measurable goals, and responsible departments. Our staff keeps track of these thirty-three (33) targeted responsibilities, and has prepared the attached summary table showing project implementation in terms of completed tasks that are either (A) ongoing or continuous, or (B) to be done a minimum of once each year. Meeting Date:01/18/2024   Submitted By:John Spiker, Public Works SUBJECT: PRESENTATION AND DISCUSSION OF THE ORO VALLEY STORMWATER UTILITY FEE STRUCTURE REVIEW RECOMMENDATION: For informational purposes only. EXECUTIVE SUMMARY: As part of our ongoing Stormwater Utility rate review discussion, we are presenting the current stormwater utility fee structure.  In accordance with Town Code Chapter 15-24-13, management of the stormwater system to protect the public health, safety, and welfare as well as meet the federal and state stormwater requirements requires adequate revenues. It is in the interest of the public to finance stormwater management with a fee system that is reasonable and equitable. Single-family residences will be charged a flat rate for one (1) Equivalent Residential Unit (ERU). Commercial property owners will be charged a multiple rate equal to the amount of impervious area on their property divided by the amount of one (1) ERU (four thousand (4,000) square feet). This formula will charge property owners on the basis of their properties’ impact to the stormwater system. The costs of improving, maintaining, repairing, operating, and monitoring the stormwater system shall be allocated, to the extent practicable, to all property owners based on the impact of runoff from the impervious areas of their property on the stormwater control and conveyance system. BACKGROUND OR DETAILED INFORMATION: N/A FISCAL IMPACT: N/A SUGGESTED MOTION: N/A Attachments SWU Fee Structure  Town of Oro Valley Stormwater Fee Structure January 18, 2024 Background The Town initially became covered by the National Pollutant Discharge Elimination System General Permit For Discharges From Small Municipal Separate Storm Sewer Systems (MS4) in 2003. In Arizona, this program is called Arizona Pollutant Discharge Elimination System (AZPDES). An AZPDES permit is required for any point source discharge of pollutants to a water of the United States. This permit, often simply called a “Stormwater Permit,” is overseen by the Arizona Department of Environmental Quality (ADEQ). Neither the US EPA nor the State of Arizona provides any funding to Oro Valley for operating the Stormwater Program. Background Most cities, towns and counties with a population greater than 10,000 and a population density greater than 1,000 people per square mile as defined by the US Census must follow this permit, which regulates discharges of stormwater runoff to waters of the state. The permit provides requirements in each of the following six Minimum Control Measures which are defined in the Stormwater Management Plan: Public Education and Outreach Public Involvement/Participation Illicit Discharge Detection and Elimination Construction Site Stormwater Runoff Control Post -Construction Stormwater Management of Development Pollution Prevention/Good Housekeeping for Municipal Operations Background 1.All costs of implementation and administration of the Stormwater Management Plan, including the establishment of reasonable operating and capital reserves to meet unanticipated or emergency stormwater management requirements. There shall be a reserve fund of fifteen percent (15%) of the collected annual stormwater fees as specified under Section 15-24-10 of this code. 2.Inspection and enforcement activities. 3.Billing and administrative costs. 4.Other activities that are reasonably required to accomplish the mission of the Stormwater Management Plan. 15-24-13-E Purpose of the Fund Background 15-24-13-F Stormwater Utility Fee A monthly service charge is imposed upon all real property in the Town, as of the first day of each month, beginning January 1, 2008, to fund the Stormwater Management Plan and stormwater system with invoicing as defined in subsection J of this section. This service charge shall be known as the Stormwater Utility fee (“fee”). As any real property is developed or developed real property is annexed into the Town it will be subject to the fee. The fee is based on the cost of implementing a stormwater management program. Fee History A Stormwater Utility Fee of $2.90 per month for each Equivalent Residential Unit (ERU) per parcel was approved in 2007 The Stormwater Fee was increased in 2016 to $4.50 per month for developed residential properties. Commercial properties are billed $4.50 per month for each Equivalent Residential Unit (ERU) of 4,000 sqft of impervious surface. This increase was meant to address additional staff needs to meet inspection, tracking, reporting, and maintenance requirements. Fee Calculation Example Vistoso Village SubdivisionCommunity Recreation Facility GIS analysis calculates 25,979 square feet of impervious surface 25,979/4,000 = 6.49 (round down to 6 ERU) 6ERU * $4.50 = $27.00 per month billed to the HOA Fee Calculation Example The Overlook at Pusch View RidgeApartment Complex GIS analysis calculates 482,421 square feet of impervious surface 482,421/4,000 = 120.61 (round up to 121 ERU) 121ERU * $4.50 = $544.50 per month billed to the apartment complex Stormwater Active Accounts 19,348 Residential Accounts Commercial Accounts 325 representing 8,818 ERUs Stormwater Fee Reduction 15-24-13-G-3&4 Non-Single Family Residential Properties that incorporate first flush capabilities or other approved stormwater pollution prevention devices are eligible for a twenty-five percent (25%) reduction in the fee, providing they apply to and are approved by the Stormwater Utility Commission and meet the annual inspection and maintenance requirements. Educational Facilities, Religious Institutions and Nonprofits Monthly Fee.A developed religious institution, school or other nonprofit property shall be eligible for a twenty-five percent (25%) fee reduction provided they apply to and are approved by the Stormwater Utility Commission. In order to qualify for the fee reduction, the educational facility, religious institution or nonprofit organization must conduct educational programs or other tasks on the topic of stormwater management as approved by the Stormwater Utility Commission.
