STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD MEETING DATE: September 13, 2005
TO: DEVELOPMENT REVIEW BOARD
FROM: Robert Conant, Senior Planner
SUBJECT: OV12-05-21, WLB GROUP INC., REPRESENTING BP ORACLE CROSSINGS
DEVELOPMENT LLC, REQUESTS AN AMENDMENT TO THE DEVELOPMENT
PLAN FOR THE ORACLE CROSSINGS PROJECT LOCATED IN PROXIMITY TO
THE SOUTHWEST CORNER OF ORACLE AND MAGEE ROADS, PARCEL 225-51-
3860 1
BACKGROUND: ry4
Town Council approved the Development Plan for Oracle Crossings on June 23, 2004. The project site has
been graded and several buildings are under construction. At annexation of the project, it was agreed that the
development standards would be those of Pima County as of October 2002.
Pre -Annexation Development Agreement:
The 29.59 acres site is the subject of a Pre -Annexation Development Agreement (PADA) adopted by the Town
Council on March 31, 2003. The PADA also includes the 10.5 acre existing Entrada De Oro shopping center
immediately to the north. The PADA sets development standards for the project which are described later in this
report.
SUMMARY:
The request is to amend the Development Plan to allow the construction of a Kohl's Department Store on the
northern end of the property. The amendment proposes the reduction in square feet of Majors 15 and 16 and the
elimination of Pad 19 and 1. The Kohl's building (Major 17) is proposed to be 88,400 square feet. Majors 15
and 16 are currently proposed at 15, 000 and 19,700 square feet respectfully. The parking for the site has been
adjusted accordingly and is in compliance with the parking code for Pima County.
PADA Development Standards:
The following standards were adopted as part of the Development Agreement:
• The development shall meet applicable development standards of the Pima County Zoning Code (as of
October 2002).
• Where the County Code (PCZC) is silent, the standards of the Town of Oro Valley Zoning Code
(OVZCR) maybe applied to the project, consistent with the Concept Plan attached to the PADA.
• The project may conform to the OVZCR standards with regard to convenience uses on the property.
The PADA further describes the following:
• The general location and configuration of building pad areas and parking areas.
• The location of ingress and egress points for the entire 40 property.
TOWN OF ORO VALLEY
DEVELOPMENT REVIEW BOARD STAFF REPORT Paue 2
• The general vehicular circulation system for the entire 40 acre development.
• A 60 foot western property line building setback from Northern Avenue right-of-way line and landscape
treatment of this property line edge.
• The locations of five development areas (the 5a' being the existing Entrada De Oro shopping center).
PADA Compliance:
The approved Development Plan and this amendment are in substantial compliance with the terms and
conditions of the PADA. The exception is access to the Entrada De Oro shopping center to the north. A cross
access point has been provided just east of the existing southern row of shops in Entrada De Oro. There was
planned a cross access ramp on the west side of the southern shops building. That access point has not been
provided.
Original Development Plan Compliance:
The original Development Plan approval shows the screen wall along Northern Avenue continuing in a straight
line behind what is now to be the Kohl's building; with the addition of Kohl's, staff recommends extending the
screen north of the detention basin and wrapping it to the east in a manner to entirely screen the proposed
loading docks from Northern Avenue as specified in Exhibit A. There will be a break in the wall between Major
16 and Kohl's for pedestrian and bike access from Northern Avenue. The break will be screened by landscaping
which will give the Police Department some surveillance capability into the site.
Pima County Standards:
This project is subject to the Pima County Zoning Code (PCZC) development standards for the CB-1
commercial district. Section 18.43.020 details the "performance standards" for uses within the district. The
proposed Development Plan closely meets the PCZC definition of a "Regional Shopping Center". The
requirements for the use are described below.
1. Circulation: Access shall be provided onto a roadway with not less than four lanes.
The original Development Plan showed five access drives from Oracle Road, a six lane major arterial/highway.
The amendment to the Development Plan does not change any of the access drives from Oracle Road. An
internal intersection for circulation purposes will be changed per this amendment.
2. Setbacks: For any building without an exposed loading area and for trash collection or compaction
activities, a 100 foot setback from the closest residential property line shall be provided.
With the fulfillment of the screening requirements in Exhibit A, the Development Plan does not have an
exposed loading area; that is loading zones viewed directly from the street or other properties. The western edge
of the site abuts Northern Avenue and on the west side of Northern Avenue are single-family detached homes
and the Casas Linda apartments. The back of building activities are located greater than 100 feet from the
residential property lines. The amendment to the Development Plan does not change this condition.
TOWN OF ORO VALLEY
DEVELOPMENT REVIEW BOARD STAFF REPORT Pau 3
3. Light: A light trespass plan must be prepared and implemented in conformance with the Pima County
outdoor lighting code and shall avoid lighting encroachment onto adjacent residential properties.
The Development Plan contains General Note 35, which provides that the lighting plan must meet the standards
of the Town's Chapter 27, Section 27.5 of the OVZCR. The amendment to the Development Plan does not
change this condition.
4. Outdoor storage, trash collection and loading areas. These elements shall be screened, recessed or enclosed
to mitigate against impacts to the neighbors.
Per the amended Development Plan, these elements are screened.
5. Central features and public spaces. Each retail establishment shall provide public amenities.
The amended Development Plan is in compliance with the original Development Plan the required public
amenities
PCZC Parking and Loading Requirements:
The amended Development Plan provides the required parking per the Pima County Zoning Code including
loading areas.
Traffic and Circulation:
The proposed addition of Kohl's near the northwest section of the development is accompanied by the
elimination of several retail pads and the reconfiguration of several others. In addition, there is a redistribution
of parking in this area and Parking Area Access Lanes (PAALs) have been reconfigured.
There is an increase of 16,780 square feet in proposed building area within this revision. This increase is
considered insignificant and any traffic impacts that result from the additional building area will be offset by
previously proposed traffic impact mitigation measures.
q, 4 CJJ
Drainage:
The primary change in draina resu g from the current revisions involves realigning the northernmost
proposed channel which cone --- of off -site runoff and replacing it with an underground conveyance con -
arch culvert. An additional detention basin is proposed at the north end of the development which drains into
the con -arch culvert. All other drainage features and design remain as previously approved.
Grading:
The proposed change in building locations and the reconfiguration of building layouts necessitates some minor
adjustments in the grading plan in order to maintain the finished floor elevations that were previously approved.
The proposed finished floor elevation for building 16 is unacceptable. This elevation has been raised 1.79 feet.
Building height is a primary concern when the Town Council approved the project.
TOWN OF ORO VALLEY
DEVELOPMENT REVIEW BOARD STAFF REPORT Paae 4
GENERAL PLAN CONFORMANCE:
The project site is designated by the General Plan as "Neighborhood Commercial" land use which would permit
uses that tend to serve the surrounding neighborhoods. With the addition of Kohl's, the proposal is oriented
toward a regional center rather then neighborhood. The following General Plan policies are applicable to this
project:
Policy 1.IE: View protection shall be an essential aspect of Oro Valleys community design review.
Through the adopted Development Plan a height limit was set to protect the views toward the Catalina's of the
adjacent neighborhood. This amended Development Plan respects this agreement by maintaining the Kohl's at
22 feet.
The signage on the Kohl's building shall not be visible from Northern Avenue.
Policy 9.1D: All development proposals should attempt to arrange buildings, massing of buildings, and/or
arrangements of lots to preserve views from adjacent properties and streets while providing privacy for
residents.
The arrangement of buildings in the original Development Plan and this amendment attempts by building
spacing and height to preserve most of the mountain views for the adjacent neighborhood. An opening has been
created between the Kohl's building and the buildings to the south of it which will provided enhanced views of
the mountains which otherwise would have been blocked by building.
Policy R I G: In order to maximize integration of the built environment with the natural environment and
minimize distractions of the built environment, all new development proposals should incorporate means of
reducing the apparent size and bulk of buildings.
The amended Development Plan reduces the size and bulk of two major tenants and eliminates two pads that
would have been developed. The size and bulk of the Kohl's is off -set by color and the breaking up of long
walls. Also, because it is detached from the center, the overall size of the center would appear to be reduced.
PUBLIC PRESENTATION:
Pursuant to Resolution (R) 98-31, "all presentations before Boards, Commissions and Council or rezonings,
subdivision plats, development plans and planned area developments must be formatted to be shown on the
Town's projection system or overhead system. The Planning and Zoning Administrator; however, may exempt
certain projects.
The Applicant is responsible for all aspects of the presentation. If an applicant does not conform to the
aforementioned resolution, the item may be continued due to non-compliance.
The following is offered as guidance for applicant presentation:
• A presentation must be designed to ensure that the audience, staff and voting body can view the
graphics.
TOWN OF ORO VALLEY
DEVELOPMENT REVIEW BOARD STAFF REPORT Paze 5
Presentations should include a location map, project history, site layout and a depiction of all pertinent
design elements. If color chips or sample of materials are needed, 12 sets of samples must be provided.
Examples of acceptable formats are PowerPoint, a videotape presentation, presentation boards and/or
items suitable for overhead projection.
The Applicant is welcome to schedule an appointment to ensure the presentation materials display as intended
on the Town's equipment.
RECOMMENDATION:
It is recommended that the DRB recommend that Town Council approve the amended Development Plan for
Oracle Crossings subject to the conditions listed in Exhibit A.

1. A ten foot high sound wall was required along much of the length of Northern Avenue to
mitigate issues raised by adjacent residential property owners. The sound wall should be
extended along the back and full length of the proposed Kohl's to include the loading areas. In
order to fully shield the view of the loading dock, it is recommended that the screen wall wrap up
around the outer edge (east side) of the detention area and the outer edge of the parking spaces
abutting the detention structure.
These measures will minimize impacts on one residence, 3 pods of apartments, and motorists
passing by on Northern Avenue.
2. Signage is not a part of this approval. All signs will be approved under a separate application.
` 3. All signage shall not be visible from Northern Avenue.

TOWN OF ORO VALLEY
STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD MEETING DATE: September 13, 2005
TO: DEVELOPMENT REVIEW BOARD
FROM: Robert Conant, Senior Planner
SUBJECT: OV12-05-21, WLB GROUP INC., REPRESENTING BP ORACLE CROSSINGS
DEVELOPMENT LLC, REQUESTS AN AMENDMENT TO THE LANDSCAPE PLAN
FOR THE PROJECT LOCATED IN PROXIMITY TO THE SOUTHWEST CORNER
OF ORACLE AND MAGEE ROADS, PARCEL 225-51-3860
pc,.SS-t, 7-0
BACKGROUND:
The Development Review Board approved the Landscape Plan for Oracle Crossings on May 11, 2004 (see
attached). The project site has been graded and several buildings are under construction. At annexation of the
parcel it was agreed that the development standards would be those of Pima County as of October 2002. For a
more extensive background description, please see the Development Plan report (OV12-05-21)
SUMMARY:
The project amendment meets the requirements of the Development Agreement and the Pima County Zoning
Code (PCZC)
The Landscape Plan meets the requirements of the PCZC as follows:
Section 18.39.040.0 Landscaping and screening. (a) A minimum 60 foot landscape buffer yard, with a minimum
of 15 canopy trees per 100 linear feet shall be required next to residential uses. A 6 foot decorative masonry
wall, which may be placed at the property line, is required unless height and location are otherwise agreed
upon by a signed agreement with the contiguous property owners; (b) Landscaping within the parking lot shall
conform to the requirements of Section 18.75.040.B.3; (c) The landscaping plan shall include water harvesting
features for water to be used in the development; (d) Permanent outdoor sales displays, trash collection
containers and trash compaction shall be screened from adjacent residential view with opaque materials; (e)
The internal walkway from the public sidewalk to the principal customer entrance shall be parallel to a 6 foot
minimum total width landscaped area using the landscaping standards of the parking lot — see Commercial
Design Manual; and (fi Outdoor storage shall be screened from view with opaque materials and be adjacent to
the building.
Upon the recommendation of the acoustical engineer the screen wall along Northern Avenue will be 10 feet in
height. This was approved with original Landscape Plan and this amendment continues the same height wall.
The Northern Avenue screen will wrap at the end of the detention basin to the east in order to screen the loading
docks for the Kohl's building a condition has been added to the Landscape Plan to that affect.
The amended Landscape Plan also continues the 60 foot wide building setback from the Northern Avenue right -
of —way. Included within the 60 feet is a 20 foot native plant vegetative buffer yard which is bordered by the 10
foot tall decorative masonry wall on the eastern edge. The parking lot provides water harvesting.
The Landscape Plan meets the requirements of the subsection stated above.
TOWN OF ORO VALLEY
DEVELOPMENT REVIEW BOARD STAFF REPORT PaEe 2
Parking and Loading Requirements PCZC:
The parking provided by the amended Development Plan meets the requirements of the PCZC. The landscaped
islands proposed in the parking areas are in compliance with Oro Valley Zoning Code per an agreement with the
applicant. The planting palette within the parking area for this amendment is the same as approved by the
original landscape plan.
PCZC Landscaping, Buffering and Screening Requirements:
The project and amendment meets the provisions of the PCZC by providing the following elements:
• A 20 foot wide landscape buffer yard along the western boundary of the project site.
• Staff recommends a 10 foot colored, CMU unit sound wall along the western boundary along the entire
Northern Avenue frontage. The wall entirely models the one previously approved.
• Loading zones feature landscaping around the 6 foot tall screen wall as required.
• A pedestrian access point from Northern Avenue is provided as the only penetration of the sound wall.
This pedestrian access will screened with landscaping in order to give the Police Department some
surveillance into the site.
GENERAL PLAN CONFORMANCE:
The Landscape Plan amendment is in conformance with the General Plan policies as follows:
Policy 9.1H: Landscape improvements are to:
• preserve, restore and enhance the ecological and scenic qualities of the natural landscape;
• mitigate negative visual impacts of buildings and parking lots;
• add aesthetic charm, interest and character; and
• improve the functional use of a site.
The original Landscape Plans, approved provided, substantial landscaping within the parking field and around
the buildings. This amendment continues the same landscape palette and intensity throughout.
Policy 8.1I: Require the use of drought -tolerant vegetation and water-ejfcient irrigation systems where
landscaping and revegetation are implemented.
The Landscape Plan uses desert vegetation and drought -tolerant plantings.
PUBLIC PRESENTATION:
Pursuant to Resolution (R) 98-31, "all presentations before Boards, Commissions and Council of rezonings
subdivision plats, development plans and planned area developments must be formatted to be shown on the
TOWN OF ORO VALLEY
DEVELOPMENT REVIEW BOARD STAFF REPORT Pate 3
Town's projection system or overhead system. The Planning and Zoning Administrator; however, may exempt
certain projects."
The Applicant is responsible for all aspects of the presentation. If an applicant does not conform to the
aforementioned resolution, the item may be continued due to non-compliance.
The following is offered as guidance for applicant presentations:

LANDSCAPE PLAN
