The ordinance creating the storm water utility provides for the creation of a storm water utility commission. The Mayor and Council created the Storm Water Utility Commission (SWUC) and appointed its first members in October 2001. The duty of the commission is to advise the Mayor and Council on matters related to the storm water utility. Specifically, the commission is to make recommendations regarding the level of service to be provided by the utility, prioritization of storm water management projects and the methods for financing the services and projects provided by the utility. Since their appointment in October, SWUC members have been meeting monthly. They have considered the requirements of the federal National Pollutant Discharge Elimination System (NPDES) Phase II program and crafted the various plans making up the attached storm water program. The SWUC members are currently engaged in the necessary preparations required for meeting the application deadline for coverage under the NPDES Phase II Municipal General Permit. This includes preparing a strategy and schedule of Best Management Practices (BMP's) they will recommend the Town implement to meet the six Minimum Control Measures required by the NPDES program. Simultaneously, the SWUC members are determining the BMP implementation cost and exploring funding mechanisms. Additionally, the SWUC members are beginning to explore the type and extent of drainage and flood control problems in the Town identified in the Town Wide Drainage Study. The SWUC has prepared an aggressive schedule to have a Storm Water Utility Fee ordinance to the Town Council for consideration by the end of TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 2 of 2 this year. They will also have a Storm Water Ordinance ready for your consideration by spring 2003. Additionally, the Notice of Intent for coverage under the NPDES Phase II Municipal Permit and the necessary program documents will be ready for submittal to the EPA or ADEQ (as applicable)by March 10, 2003. - --- Town Engine At". Town Manager TO: HONORABLE MAYOR & COUNCIL FROM: Commissioners Storm Water Utility Commission SUBJECT:ECT: Pro ram prepared by the Storm Water Utility Commission DATE: July 8, 2002 The Environmental Protection Agency (EPA) mandates that cities and towns comply with the Clean Water Act to further protect the nation's waters from polluted stormwater run-off. As a result of this mandate the Town of Oro Valley must meet requirements of the National Pollution Discharge Elimination System (NPDES) Phase II Rule. This Rule defines six minimum control measures that must be implemented to the "maximum extentp ossible". The Town must then develop best management practices (BMPs) to facilitate implementation of each of the minimum control measures. To meet requirements of the NPDES Phase II Rule the Mayor and Council established the Storm Water Utility and appointed five Oro Valley residents who function as the Storm Water Utility Commission (SWUC). The SWUC has been meeting regularly on a monthly basis since October 2001, and hasreP ared the following plans, which constitute the Storm Water Program, for the P Mayor and Council's review and approval: • Storm Water Management Plan establishes the organizational structure of the Commission. It defines membership, terms of officers, meeting dates and times, and other relevant information necessary for the commission to function. • Storm Water Quality Plan states objectives of the Phase II Rule and specifies federal requirements for storm water management under the Rule. The Plan adopts the BMPs for the six minimum control measures and names the Town of Oro Valley as the entity responsible for complying with the federal or state NPDES permit. • Storm Water Quality Funding Plan provides funding guidelines and proposes funding sources for start-up and on-going projects. • Flood Water Operations Plan recognizes floodwaters, in addition to storm water, as ap otential pollutant to the nation's waters. This Plan states the objectives of the SWUC as they relate to floodwaters. It names the Town of Oro Valley as the responsible entity for management of design and construction of flood hazard and drainage nuisances identified by the Storm Water Utility Commission, and identifies the Pima County Flood Control District (PCFCD) as a funding source for floodwater management. .._ . ...._.. . TOWN OF ORO VALLEY STORM WATER UTILITY COMMISSION STORM WATER MANAGEMENT PLAN 1. ORIENTATION; AUTHORITY 1.1 The Oro Valley Storm Water Utility is an enterprise of the Town which may issue bonds and prescribe service charges so that this utility undertaking for which bonds were issued may remain self-supporting with revenue. The Storm Water Utility Commission (SWUC) also provides a forum to hear and recommend issues surrounding bonds, expenses, and service fees charged to assure planning, design, construction, operation, and maintenance of storm water facilities that safely drain and control the quantity and quality of storm run-off. 1.2 The SWUC shall have no authority relative to interpretation of the ordinances adopted by the Town nor shall the SWUC be empowered to waive requirements of the Oro Valley Town Code. 1.3 The SWUC may suggest to the Council, by ordinance, any recommendations for amendments to the Oro Valley Town Code or any other ordinance adopted by the Town. 2. ORGANIZATION 2.1 MEMBERSHIP; TERM OF OFFICE The SWUC shall be composed of a total of five (5) members who shall be residents of the Town, but not employees of the Town. The members shall be appointed by the Council and hold office at its pleasure. A member shall be qualified by experience and training to pass upon matters pertaining to needs and requirements of storm water facilities construction. The term of office shall be for a period of two (2) years each ending on October 31. New appointments and re-appointments will be made every year. Vacancies for any reason shall be filled by appointment by the Council for the remainder of the unexpired term. The term of all members shall extend until their successors are appointed. If a member misses three (3) consecutive regular, or five (5) meetings within one (1)year, the SWUC may request that the Council appoint a new person to complete the term. Commission members unable to attend the meetings should contact the secretary. 1 22 OFFICERS The SWUC shall elect a Chairperson and Vice-Chairperson from among its members who shall serve for one year. The Chair shall preside at all meetings and exercise all the usual rights, duties,s, and prerogatives of the g head of any organization.anization. The Vice-Chair shall perform the duties of the Chair in the absence or disability of the Chair. If both Chair and Vice-Chair are absent from a meeting, the member having the most time (seniority) with the SWUC shall preside. Vacancies of the Chair or Vice- Chair created by any cause shall be filled for the unexpired term by a new election. 2.3 SECRETARY The Storm Water Utility Administrative Director shall act as Secretary to the SWUC, shall be an ex officio member, and shall have no vote upon any matter before the SWUC. It shall be the duty of the Secretary, or the Secretary'sdesignee,desi nee, to conduct all official correspondence of the SWUC, send out all notices required by law, to perform all the customary duties of the office; to be the custodian of the records of the SWUC; to supervise the clerical work and technical preparations necessary to the disposition of business before the SWUC; and to perform all other duties required by law, ordinance, or these rules of procedure. 3. MEETINGS 3.1 REGULAR MEETINGS Regular meetings of the SWUC shall be held, at the Oro Valley Town Hall 9 g on the third (3rd) Tuesday of the month and shall be duly noticed, in accordance with State law, as to the exact date and time. If it is necessary to change the meeting, a notice of such change shall be posted at the official Town posting areas. 3.2 SPECIAL MEETINGS Special meetings for good cause may be held by the SWUC on the call of P g its Chairperson or of a quorum of members, which call shall be filed with the Secretary. 3.3 PUBLIC MEETINGS 2 All meetings and hearings of the SWUC, except Executive Sessions, shall be open to the public. Any action calling for a formal vote shall take place only at a public meeting. 3.4 QUORUM AND VOTING Three members shall constitute a quorum. The affirmative vote of a majorityof the members voting shall be required for passage of any matter before the SWUC. The minutes of the meetings shall reflect the "ayes" and "nays" cast on a particular measure and shall reflect the vote of each . member present or if absent, or if failing to vote, shall indicate that fact. if a member declares a conflict of interest relative to a particular issue, the member will abstain both from voting and from the deliberations of the matter in question. This shall be done in accordance with Resolution Number (0) 01 — 80, Town of Oro Valley, Arizona Town Council Parliamentary Rules & Procedures and Code of Conduct, Section 12. If a quorum is not present at a regular or special meeting, such meeting will be continued to a specific time. If hearings are pending, the continuance will be limited to one week or to the earliest date that a quorum can be obtained. 4. OFFICIAL RECORDS 4.1 DEFINITIONS The official records shall include the SWUC Management Program, minutes of the SWUC, together with all findings, decisions, and other official actions and records. 4.1.1 The SWUC Management Program consists of: (1) Storm Water Management Plan, (2) Storm Water Quality Plan, (3) Storm Water Quality Funding Plan, (4) Flood Water Operations Plan, and any other plans that may be proposed and approved. 4.2 FILES; RETENTION All matters before the SWUC shall be filed in the Public Works Department Storm Water Utility Division in accordance with the Public Works Department's general filing system. The Storm Water Utility Division shall keep all official records as provided by the State's Water Utility Records Retention Schedule. The Secretary shall keep a permanent file of all documents filed with, or issued by, the SWUC. 3 Access to those records by the general public shall be in accordance to the Town's policy on public access to records. 5. RULES AND AMENDMENTS 5.1 AMENDMENT PROCEDURE Amendments to the SWUC Management Plan may be proposed by the SWUC and approved by Town Council. Any such amendment shall be proposed ata preceding meeting, or submitted in writing at a prior meeting of the SWUC, and recorded in the minutes of such meeting or meetings. Amendments adopted as above shall become effective at the next regular meeting of the SWUC following approval by the Town Council. 4 STORM WATER QUALITY PLAN 1. Background 1.1 The federal government has finalized regulations for storm water management in smaller communities. These regulations are known as the National Pollutant Discharge Elimination Systems (NPDES) Phase II Rule. The NPDES program was established as the fundamental regulatory mechanism of the Clean Water Act (CWA). The rule is designed to further protect our nation's streams, rivers, and beaches from polluted storm water runoff. The Phase II rule addresses storm water discharges from the small community(population less than 100,000) municipal separate storm sewer systems (MS4s). 1.2 The Town of Oro Valley is a MS4s Phase II community. 2. Objectives of the Phase II Rule 2.1 Provide a comprehensive storm water program that designates and controls additional sources of storm water discharges to protect water quality. 2.2 Address discharges of storm water activities not addressed by Phase I, including: 2.2.1. Construction activities disturbing less than five acres; 2.2.2. "Light" industrial activities not exposed to storm water; 2.2.3. MS4s located in urbanized areas not covered under Phase I; and 2.2.4. Municipally owned industrial facilities that were addressed under Phase but granted an extension under ISTEA (Intermodal Surface Transportation Efficiency Act). 2.3 Facilitate and promote watershed planning as a framework for implementing water quality programs wherever possible. 3. Federal Government Requirements for Storm Water Management under Phase II 3.1 Specify best management practices (BMPs) for six (6) minimum control measures and implement them to the "maximum extent possible". 3.2 Identify measurable goals for control measures. 3.3 Show an implementation plan of activities or frequency of activities. 3.4 Define the entity responsible for implementation. 3.5 Regulate construction activities that disturb one to five acres. 4. Responsible Entity 4.1 The Town of Oro Valley (TOV) will be in compliance with the applicable Federal or State NPDES permit. 4.2 The TOV will be the entity responsible for implementation of the applicable municipal NPDES permit. 5 5. The Quality Plan stipulates that SWUC will adopt BMPs for Six Minimum Control Measures. SWUC may adopt additional BMPs as needed. 5.1 Public Education and Outreach on Storm Water Impacts; 5.2 Public Involvement/Participation; 5.3 Illicit Discharge Detection and Elimination; 5.4 Construction Site Storm Water Runoff Control; 5.5 Post--construction Storm Water Management in New Development and Redevelopment; and 5.6 Pollution Prevention/Good Housekeeping for Municipal Operations. 6. The Storm Water UtilityCommission may prepare ordinances as a means for the to implement and enforce their permit conditions. The ordinance(s)will permitee p provide a compliance mechanism that assists in the attainment of measurable goals. 6 STORM WATER QUALITY FUNDING PLAN 1. Background 1.1.The Town of Oro Valley (TOV) is part of a large watershed that drains into and through the many washes that make up the topography of the area. Interspersed between the washes are residential housing, resorts with golf courses, shopping centers, offices, light industry, and a large amount of undeveloped land. Storm water drainage is primarily unconfined, coursing through washes and roadways. Some of the washes have been modified to protect adjacent property from bank erosion and flooding. Generally, storm water, if collected, is channeled into underground ducts and discharged into a nearby wash. By and large, this system has worked acceptably in the desert environment, except during heavy storms when traffic has been impacted and property affected by heavy runoff. There has been little known history of illicit dumping or pollution. Mainly, storms carry down vegetation and other debris that occasionally acts as a dam, which causes the storm water, and debris to overflow the banks of the washes. Thus far, there has been no evidence of this runoff affecting the quality of water used by the Town of Oro Valley. 1.2.The TOV is required to implement six Best Management Practices (BIM's) established by the National Pollutant Discharge Elimination Plan (NPDES) Phase II Rule. 1.3. Initial funding will be needed for infrastructure and projects to support the BMP's Six Minimum Control Measures as noted in the Storm Water Quality Plan, Section 4.4. Ongoing revenues will be needed to restore, maintain, and improve existing facilities and to ensure the BMP's continue to be properly applied. 2. Funding Guidelines 2.1.Revenues must be reasonable and equitable. 2.2.The methodology for calculating revenues must be clearly defined and understood by the community. 2.3.Setting the rates and collection of revenues must not impose a complicated or costly burden on the TOV. 2.4.The SWUC will support the Town Council in initiating and providing dialog with the community to gain support for the funding. 3. Funding Sources 3.1.Start-up Funding (One or more funding methods may be used.) 3.1.1. One time charge to all residences and businesses based on an average impervious area of a residential dwelling. 3.1.2. Issue bonds. 3.1.3. Obtain funds from the TOV general reserves or other TOV sources. 3.1.4. Levy assessments on developers and shopping centers. 3.2.On-going Funding (One funding method will be selected.) 3.2.1. Set a simple monthly utility fee based on the average impervious area of a dwelling that will be applied to all residences and businesses. 3.2.2. Set a monthly utility fee based on the individual impervious area of a dwelling that will be applied to all residences and businesses. 3.3.Other Potential Funding Sources 3.3.1. Fees for reviewing the grading plan for NPDES compliance and for review and approval of Storm Water Pollution Prevention Plan. 3.3.2. Secure grant money. 3.3.3. Obtain funds from the Pima County Flood Control District (PCFCD). 3.3.4. Obtain low interest loans. 3.3.5. Use bonds for area and project specific assessment. 3.3.6. Impose clean-up fees for illicit dumping. 8 • FLOOD WATER OPERATIONS PLAN 1. Background 1.1 The citizens of the Town of Oro Valley are occasionally impacted by flood and nuisance drainage flows. These flood waters and nuisance drainage flows occasionally pose a hazard to human life as well as to public and private property. 1.2 The Town of Oro Valley has completed a Town Wide Drainage Study that identified several flood and drainage problem areas. These problem areas were identified using citizen input, citizen complaint files and Town staff. The Town Wide Drainage Study also provides a brief description of possible solutions to identified problem areas and the cost of said solutions. 2. Objectives of the SWUC 2.1 Create criteria by which flood hazard and drainage nuisance problems will be prioritized. 2.2 Prioritize known flood hazard and drainage nuisance problem areas identified in the Town Wide Drainage Study for design and construction of solutions. 2.3 Gather information on other flood hazard and drainage nuisance problems throughout the Town and prioritize the same for design and construction of solutions. 2.4 Prepare a biannual work plan for the Storm Water Utility to execute the design and construction of prioritized projects. 2.5 Annually, or less often as needed, request Town Council approval of the SWUC's prioritized projects. When approved, these projects will be incorporated into the Storm Water Utility biannual work plan. 2.6 As needed, prepare and recommend to the Town Council adjustments to the long term financing plan(s) for the design, construction and maintenance of flood hazard and drainage nuisance projects. 2.7 Recommend to the Town Council, funding and budget requirements and sources for individual projects on an as needed basis. 2.8 Report to the Town Council from time-to-time as needed on flood hazard and drainage nuisance problems in the community. 3. Responsible Entity 3.1 The Town of Oro Valley staff will manage the design and construction of flood hazard and drainage nuisance projects identified in the Storm Water Utility biannual work plan. 3.2 The appropriate Town of Oro Valley staff will report to the SWUC on the progress of design and construction of projects. 4. Funding Sources 9 r 4.1. Property owners in the Town of Oro Valley currently pay an annual assessment to the Pima County Flood Control District (PCFCD). To ensure these funds are spent in Oro Valley, the SWUC, with Storm Water Utility staff, will submit prioritized projects to the PCFCD and request funding to design and construct the projects_ From time-to-time Pima County will hold bond elections for flood control projects. The SWIJC will submit certain prioritized projects to the County to include in the bond election. Additional funding the SWUC will explore includes grants, area and project specific assessments, low interest loans and utility fees.
