SUBJECT: Resolution No. (R)00-29 — Canvass of the Votes — Declaring and adopting the results of the
Primary Election held on March 14, 2000
SUMMARY:
The attached resolution declares and adopts the results of the primary election held on March 14, 2000.
The official canvass prepared by Pima County Elections dated 3/16/00 shows the following results:
Werner Wolff 1878 (46.68%)
Hector Conde 1640 (40.77%)
Wayne Bryant 1628 (40.47%)
Bart Rochman 1562 (38.83%)
Richard Johnson 1374 (34.15%)
Paul Parisi 1040 (25.85%)
Michael Kerrigan 926 (23.02%)
Matthew Moutafis 613 (15.24%)
Emily Smith Sleigh 587 (14.59%)
Since none of the candidates received a majority vote, the following 6 candidates will run in the May 16, 2000
General Election:
Wayne Bryant
Hector Conde
Richard Johnson
Paul Parisi
Bart Rochman
Werner Wolff

RESOLUTION NO. (R)00-29
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO
VALLEY, ARIZONA, DECLARING AND ADOPTING THE RESULTS OF
THE PRIMARY ELECTION HELD ON MARCH 14, 2000.
WHEREAS, the Town of Oro Valley, Pima County, Arizona did hold a primary election
on the 14th day of March 2000, for the nomination of three council members, and
WHEREAS, the election returns have been presented to and have been canvassed by the
Town Council,
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Oro Valley, Pima County, Arizona, as follows:
SECTION 1. That the total number of ballots cast at said primary election, as shown by
the poll lists, was 4023.
SECTION 2. That the number of ballots to be verified was 44, and that voters found to
be ineligible were 17.
SECTION 3. That the votes cast for the candidates for council member were as follows:
Werner Wolff 1878 (46.68%) Paul Parisi 1040 (25.85%)
Hector Conde 1640 (40.77%) Michael Kerrigan 926 (23.02%)
Wayne Bryant 1628 (40.47%) Matthew Moutafis 613 (15.24%)
Bart Rochman 1562 (38.83%) Emily Smith Sleigh 587 (14.59%)
Richard Johnson 1374 (34.15%)
SECTION 4. That it is hereby found, determined and declared of record, that no
candidates received more than one-half of the total number of ballots cast and therefore,
the following candidates will run for the three seats open in the May 16, 2000 General
Election:
Wayne Bryant Paul Parisi
Hector Conde Bart Rochman
Richard Johnson Werner Wolff
SECTION 5. This resolution shall be in full force and effect immediately upon its
adoption.
PASSED AND ADOPTED by the Mayor and Council of the Town of Oro Valley,
Arizona this 20th day of March, 2000.

SUBJECT: Barreras Slope Improvement: Northwest Corner of First Ave. and Lambert Lane.
SUMMARY
This project was presented to DRB at its Jan 11, 2000 meeting. The DRB requested more landscaping at the
toe of the slope and the top of the slope. The Project was also presented to the Town Council regular
meeting on February 2, 2000. The Mayor requested the DPW staff go back and look at different alternatives
to correct the erosion situation and bring the project back to the Council at a later date. The Oro Valley
Public Works Department is currently working on a slope stabilization project located along the north side of
Lambert Lane, approximately 500 feet west of North First Avenue.
The slope in question is the result of the realignment of Lambert Lane, a roadway project completed by
Pima County in the late 1980's, prior to annexation into Oro Valley. This slope is approximately 400' to
450' in length and approximately 20' to 40' in height. Pima County attempted to stabilize the resulting road
cut left by that project with hydro-seeding. However, lack of irrigation and further lack of maintenance to
the slope, have resulted in the heavily eroded condition that is present today.
Proposed Treatment:
The Oro Valley Public Works Department responded to complaints by area residents concerned with the
stability of this slope, as well as the slope's unsightly appearance. McGann & Associates was retained to
prepare plans to address these issues. In addition, AGRA Earth and Environmental, Inc. was retained to
study the slope stability.
Three options were evaluated for treating the lower (steepest) portions of the slope. Each of the three options
included a treatment that laid the upper slopes back to an angle that would support hydro seeding and
landscape plantings to stabilize the upper areas of the slope.
The Five Options Identified were:
Option One:
This option utilized a series of tiered retaining walls that provided good stability to the lower portions of the
slope. However, at over $200,000.00, it proved to be cost prohibitive.
Option Two:
This option included the use of rock ri.-ra. alon: the lower •ortions of the slope. It •rovided the least

expensive alternative. However, AGRA's evaluation of this treatment indicated that the slope would not
support the rip-rap treatment.
Option Three:
This option includes the use of rock filled gabion baskets along the lower portions of the slope. The
"gabion" treatment was determined to provide both slope stability and at a reasonable cost. Although not
inexpensive, the cost for the gabion treatment proved to be approximately one - half the cost of the retaining
wall treatment. Cost for this option was $100,000.00
Gabion Slope Treatment:
Gabions consist of woven-wire baskets filled with 4" to 6" diameter rocks. The gabion baskets measure 1.5
feet high x 3.0 feet deep x various lengths. These baskets are stacked one upon the other and stepped back
at a 11/2: 1 slope to form a "stepped" retaining wall along the base of the slope. Each step being 11/2' in
height. The height of the gabion treatment ranges from approximately 8' to 16'.
Aesthetic Considerations:
In an effort to minimize the visual impact of the gabion treatment along the base of the slope, a rock stain
treatment will be utilized that oxidizes the surface of the rock to a natural "desert varnish" color. The color
of the rock filled gabions will blend with the color of the surrounding desert.
Landscaping:
The remainder of the slope above the gabions will be hydro-seeded and planted with trees. A drip irrigation
system will provide water for the trees and a temporary spray irrigation system will be included to establish
the hydro-seeded portion of the landscaping. DRB request for landscape at the toe of the slope and at the top
will be provided. "The Save a Plant Group " have expressed interest in providing more landscaping. DPW
is also working with Parks and Recreation for a potential Bike Oasis at the toe of the slope.
Option Four:
This option was similar to option three, except a 4' tall x 450 L.F retaining wall installed at the bottom of
the slope was considered. Cost for this option was $ 150,000.00.
Option Five:
Larson Treatment:
This treatment includes placement of 6" shotcrete shell with a 12" x 12" mat of #3 rebars and a 2" hand-
carved rock texture. The cost for this will be $ 225,000.00, plus $50,000 for grading, mobilization and
traffic control.
RECOMMENDATIONS
Staff recommends option three for Barreras slope improvement because this option is more cost
effective, aesthetically pleasing, provides good slope stability and is within our budget.

SUBJECT: PUBLIC HEARING — PROPOSED AMENDMENTS TO THE ORO VALLEY ZONING
CODE REVISED, CHAPTER 4, AMENDING SECTION 4-504 F. PUBLIC ART
PROVISIONS
BACKGROUND:
On September 3, 1997, the Mayor and Council adopted Ordinance No. (0) 97-27, amending the Oro Valley Zoning
Code Revised, Chapter 4, adding a new Section 4-504 F., Public Art Provisions. This section has since been
amended twice; adding the Public Art Review Committee (PARC) and amending submittal requirements. Robert
Weede, President of GOVAC, has been at the forefront of this newest proposal. A copy of his letter and formal
request is attached to this report.
The main objective of the current proposal is to create a funding mechanism for public art projects that the whole
town can enjoy while leaving the bulk of the existing on-site requirements intact. Under the current zoning code,
all commercial developers are required to construct and display public art in proximity to their proposed building
which is equal to 1% of the total building construction cost. This proposed amendment would allow commercial
projects valued at or below $500,000, the option to build the 1%($5000) public art on-site or contribute the 1% to
the newly created Public Art Fund. Likewise, commercial projects valued at or above $10,000,000 would have the
option to use all 1% for on-site public art or contribute that portion of the 1% over $100,000 to the Public Art
Fund.
As with any public funding program, there are always issues to resolve. Here are the main ones:
1. Is the contribution to the Public Art Fund voluntary or mandatory?
This involves both a legal and a philosophical analysis. Little case law exists on public art programs while
there is significant case law on exactions from developers in general. Requiring an exaction from one
development and using it for something other than that development may create problems if not done in a
voluntary fashion. In Tempe, cash equivalent donations can be made to their Municipal Art Fund at the sole
discretion of the developer in lieu of constructing any on-site public art. In such a case the developer can
actually earmark the contribution for a specific art project.
2. Who will administer/manage the Public Art Fund?
An art fund can be established as a separate fund account through the Town of Oro Valley or it could be
administered by a private non-profit 501(c)(3) organization (i.e., Greater Oro Valley Arts Council, Arizona
Community Foundation). Outside administration would require administrative fees of 1-2% per year. Another
option would be to establish the fund through the Town of Oro Valley and have an outside administrator for
project management.
3. Who will make the decisions of how and when funds will be expended?
A review committee would need to be established to review and prioritize projects. Project recommendations
would be forwarded to Town Council for approval. The legal establishment of such a fund and the rules

governing it's use, needs to be adopted by ordinance in the Town Code rather than the Zoning Code Revised.
4. What can these funds be expended for?
The GOVAC proposal uses the language "Visual and Performing Arts", suggesting a broader and more
flexible use of public art funds. Using the terminology "Visual Arts", wouldp rovide for a more limited and
defined parameter. Including performing arts is a good idea, but it is a significant deviation from the
original intent of this ordinance.
SUMMARY:
Staff agrees the proposal in general will help create a greater public art program. However, a suggestive,
voluntary approach is recommended for contributions to the art fund. Realizing there were differences of
opinion expressed when this ordinance was initiated, staff is forwarding a proposal that leaves the bulk of the
existing program intact. This proposal also views the art fund as a vehicle to manage funds contributed by
developers not as a true endowment. The actual establishment and maintenance of the art fund or an endowment
extends beyond the scope of Planning and Zoning. There may need to be future discussions and meetings to
successfully determine how best to accomplish this.
In addition, staff proposes to delete Section 4-504 (3) (C). This would allow approval of the public art to occur
during the construction of a project rather than requiring it up front when the scope of costs of the project are in
flux.
GENERAL PLAN CONFORMANCE:
Staff has evaluated the ordinance language against the General Plan Cultural and Historic goals and policies and
finds the following.
Cultural and Historic Resources Element
The Public Arts Projects ordinance does conform to:
1. The policy direction described in the cultural and historic resources element of the General Plan, which
stipulates that "the goals articulated by the Arts Advisory Board shall form the basic guideposts and shall
define the direction of all arts activities, as the Town of Oro Valley recognizes the vital role they play in a
Community of Excellence!" and
2. Table 4.10.5-1, Cultural and Historic Resource Element Strategic Implementation for providing a percent for
art ordinance.

STAFF RECOMMENDATION:
Staff recommends approval of the amended text for Chapter 4 Section 4-504 (F) Public Art Provisions and a new
section of the OV Town Code as set forth in the attached draft, with any additions, corrections or revisions deemed
appropriate.
The Planning and Zoning Commission held a public hearing at their March 7, 2000 Commission meeting, and
made the following recommendation:
MOTION: Commissioner Briggs MOVED to forward this item to Town Council recommending
approval,with the amended text for Chapter 4 Section4-504(F) Public Art Provisions and the
establishment of a Public Art Fund, specifically changing item number 3 of the Establishment of a Public
Art Fund to make that a total of five members of the Public Art Fund Review Committee, so that will be
two members of GOVAC, two members of Town of Oro Valley staff, and one citizen.
Chair Douglas suggested a friendly amendment to the motion:
That the Commission would embrace the verbiage from the letter submitted by Mr. Weede, representing
the Greater Oro Valley Arts Council, and that those items be brought forward to Mayor and Council to
stimulate further discussion for the administration of the Establishment of a Public Art Fund.
MOTION carried by a 5-1 (Commissioner Ruble abstained).

2. Funds shall only be used to fund visual public art projects approved by the Town
Council located within Town limits.
3. A Public Art Fund Review Committee (PAFRC) shall be established by the Town
Council and shall be comprised of two members of GOVAC, two members of Town
of Oro Valley staff, and two citizens at large, and .
4. Project proposals shall be submitted to the Public Art Fund Review Committee
(PAFRC) for review and recommendation.
5. The PAFRC shall forward all recommended projects to the Town Council for final
approval. Approved projects will be prioritized and compiled into a list of projects
approved for funding.
6. Contracts with artists will not be entered into unless and until 100% of the money
necessary to complete the term of the contract is in the Art Fund.
DEVELOPMENT PLAN Sec. 4-504
F. Public Art Provisions
1. All new commercial employment related projects, as well as all existing developments that propose
25% or more expansion and/or change in use shall contribute 1% of the building construction cost
towards public arts projects.
2. A note shall be included on the development plan that states that the applicant shall be
responsible for allocating 1% of the cost of all private projects to provide funding for public
art.
3. Public Art Review Committee
a. The Public Art Review Committee shall be composed of 3 to 5 members, appointed
by the Planning and Zoning Administrator. Members shall include at least one
artist, one architect, and one private citizen.
b. A color rendering or model shall be reviewed by PARC, and a recommendation for
the design and location shall be sent to the Town Council for their approval.
c. The public art must be approved by the Town Council prior to issuance of building
permit.
4. All financial arrangements are negotiated between the developer and the artist(s) and
should be verified in a written agreement. Copies of the signed contracts between the
developer and the artist(s) shall be submitted to the Town of Oro Valley Planning and
Zoning Administrator for certification as complying with the dollar amount prior to issuance
of the Certificate of Occupancy. Completion of the artwork is required before a Certificate
of Occupancy may be issued.
5. The installation of the artwork will be done in a manner that will protect the artwork and the
public. Continued maintenance of the artwork shall be the responsibility of the owner.
6. Individual owners within a commercial center may contribute to a major piece of art.
7. Public artwork:
a. shall be defined as art accessible to public viewing at least forty (40) hours each
workweek.
b. Shall be on-site and preferably on the exterior of the building. Art my be located
within the building in a retail or hotel project, but not in an office project.
c. Shall be permanently affixed.
d. Examples of the kinds of art projects to be considered as public artwork include, but
are not limited to: sculpture—freestanding, wall-supported or suspended; murals or
paintings; earthworks, fiberworks, mosaics; and building features and fixtures, like

bike racks, benches, fountains or shade screens, which are unique and/or

Having just had the opportunity to review this document, we offer the following
comments.
Section 4 - 504
(F)(3)(C)- deletion is appropriate
(F) 8 - Qualifying contribution to"any specifically art project in the Fund" is a
viable and useful option
OV Town Code on Public Art Fund, 6 areas addressed:
1.) Oro Valley Finance Dept. certainly could Administer and Maintain the fund. However,
experience dictates that the fund should be an endowment type vehicle with strict
guidelines as to limited withdrawal of principal to insure a perpetual source of earnings.
The cost& resource utilization of the Town Administration and Maintenance should be
compared to that of an organization such as the Community Foundations for"Investment
Management". Rather than 1-2% mentioned, their clients' costs appear to be .75% to 1%.
2.)Limiting the use of the fund to Visual Art has the effect of
A. No money would be available to go toward a dual use project or facility where
Visual Art & Performance co-exist.
B. Funds which could relieve the Town of providing G&A support to GOVAC
would be unavailable. That support assures a broad range of programs in the Arts
which include; the presentation of children's art programs at Festivals and in
schools, the education of the adult population in the appreciation of art which
develops an appreciation for the Public Art Program and the community that
creates it, the Summer Youth Art Project, etc.
