POSTED: 4/8/99 4:30 p.m. Ih TOWN OF ORO VALLEY COUNCIL COMMUNICATION MEETING DATE: April 12th, 1999 TO: HONORABLE MAYOR& COUNCIL FROM: David Marsh, Planner I SUBJECT: PUBLIC HEARING, ORDINANCE NO.(0)99-2 4 ,OV9-99-50 STEWART TITLE AND TRUST PROPERTY (AKA CHAPARRAL HEIGHTS), TRANSLATIONAL ZONING FROM PIMA COUNTY CR-1 TO ORO VALLEY R1-20, WITH CONDITIONS, LOCATED AT THE SOUTHWEST CORNER OF LAMBERT LANE AND LA CHOLLA BOULEVARD BACKGROUND: On August 5, 1998, pursuant to Section 9-471B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council annexed the area known as Map 4. The Town is required to change, or "translate", the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law,the Town must translate the County zoning by April of 1999. The attached map identifies the location of the parcel of land owned by Stewart Title and Trust. The property is located on the southwest corner of Lambert Lane and La Cholla Boulevard, and extends approximately 1/2 mile to the west and to the south. SUMMARY: In accordance with State Statutes, the Town should translate Pima County's CR-1 zoning, which allows single family residential (2.1 — 5.0 Dwelling Units per Acre), to Oro Valley's closest equivalent designation, R1-20, Single Family Residential (2.1 DUA). There was a pre-annexation agreement negotiated between the property owner and the Town, which is attached to this report. Per the terms of this Annexation Development Agreement, the property will be limited to a maximum 150 lots when subdivided, and the applicant will be required to submit a Native Plant Preservation and Salvage Plan in order to preserve the significant stands of Ironwood and Saguaro onsite. The annexation agreement also permits grading at Pima County standards, and the right to construct erosion control improvements to previously approved plans by the County. All other aspects of development and use for the property will be subject to Oro Valley development standards. A neighborhood meeting was held on the evening of March 24th, with the property owner, the neighbors, and Staff in attendance. The neighbors expressed concerns over lot size along the western and southern borders of the property, height limitations, drainage issues, and grading limits for individual lots. The majority of these issues are bound by the pre-annexation agreement or are dealt with by the OVZCR. Staff has placed a condition within the attached ordinance which sets a maximum grading limit of 50% of the area of the individual lots, to a maximum of 20,000 square feet, excluding driveways. This condition is comparable to grading restrictions placed on other developments of this density. PLANNING & ZONING COMMISSION ACTION: On April 6th, 1999, the Planning & Zoning Commission voted 6-0 to recommend approval of this item, with the condition that there be a minimum lot size of 24,000 square feet per lot. This condition has been incorporated into the attached ordinance. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 2 of 2 GENERAL PLAN CONFORMANCE: The current County zoning of this property is not in conformance with the Town's General Plan land use map. The proposed translated zoning of R1-20 will not be in conformance with the General Plan land use designations for the property, which are Low Density Residential (0.6 — 1.2 DUA), Rural Low Density Residential (0.0 — 0.3 DUA), and Parks and Open Space. However,the proposed translated zoning of R1-20 is consistent with the current CR-1 zoning designation under Pima County. RECOMMENDATION: Staff recommends approval of the translation of zoning on the Stewart Title and Trust property, from Pima County CR-1 to Oro Valley R1-20 and all applicable development standards of the R1-20 zoning district shall apply thereto, with those conditions listed in the Ordinance and the Annexation Development Agreement, attached herewith. (0)9924 AN ORDINANCE TRANSLATING THE ZONING FROM PIMA COUNTY CR-1 TO ORO VALLEY R1-20, WITH CONDITIONS, ON THE PROPERTY KNOWN AS THE STEWART TITLE & TRUST PROPERTY (AKA CHAPARRAL HEIGHTS), LOCATED WITHIN MAP 4; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. WHEREAS, the owners of certain real property known as the Stewart Title & Trust Property (aka Chaparral Heights), located within Map 4, has requested that the provisions of the previously approved Annexation Development Agreement for said property be preserved; and WHEREAS, the Planning and Zoning Commission, has considered said translational zoning with added conditions on these properties at a duly noticed Public Hearing, in accordance with State Statue, and having made its recommendations to the Town Council; and WHEREAS, the Oro Valley Town Council has duly considered the translational zoning with added conditions at a Public Hearing and finds that it is consistent with the Town's General Plan, and other Town ordinances, NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ORO VALLEY: SECTION 1. That the Stewart Title & Trust Property contained within Map 4 be translationally zoned from Pima County CR-1 to Oro Valley R1-20, and that all applicable development standards of the R1-20 zoning district shall apply thereto to said property. SECTION 2. That said property shall be subject to the previously approved Annexation Development Agreement, attached herewith. SECTION 3. That a minimum lot size of 24,000 square feet per lot apply to said property. SECTION 4. That grading shall be restricted to 50% of the area of the individual lots, to a maximum of 20,000 square feet, excluding driveways. This limit may be increased to 60% with the approval of the Planning & Zoning Administrator, but shall not exceed 20,000 square feet. SECTION 5. That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict; SECTION 6. That this ordinance and the various parts thereof are hereby declared to be severable. If any section, sub-section, sentence, clause, word or phrase of this ordinance is, for any reason, held to be unconstitutional, such holdings shall not affect the validity of the remaining portion of this ordinance. Any person found guilty of violating any provision of this code shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not to exceed one thousand dollars or by imprisonment. Dudley, Town Attorney F:\ov\ov9\1999\9-99-50\ORDINANCE.doc ANNEXATION DEVELOPMENT AGREEMENT This AlNNEXATION DEVELOPMENT AGREEMENT (the "Agreement"), dated this 16th day of APRIL , 1998, by and between the TOWN OF ORO VALLEY, Arizona, an Arizona municipal corporation (the "Town") and S'1.EWART TITLE AND TRUST ("Stewart Title") as Trustee under Trust No. 2002, the owner of Chaparral Heights Lots 1 through 73 a Subdivision plus the roads and easement abandoned by Pima County within said Subdivision. Said Subdivision includes the northeast I/4 of Section 16, T.-12S., R.-13E., G. & S. R. B. & M., Pima County, Arizona. Said Subdivision is recorded in Maps and Plats Bock 27 Page 20 in the Pima County Recorder's Office (the "Property"). RECITALS WHEREAS, this Agreement shall be adopted by the passage of a resolution at a public meeting of the Mayor and Town Council of the Town of Oro Valley, Arizona, authorizing its designated signatory below to enter into such agreement on behalf of the Town, consistent wit.: the mutual promises, covenants and acknowledgments agreed to by the Mayor and Town Counci: WHEREAS, Stewart Title and the Town desire that the Subject Property be annexed into the corporate limits of the Town and be developed as an integral part of the Town; WHEREAS, the covenants and acknowledgments contained herein have been made i. consideration of annexation into the Town of Oro Valley of the Subject Property and other ter:ns and conditions set forth in this Ageement; WHEREAS, the Town and Stewart Title are entering into this Agreement pursuant to provisions of A.R.S. §9-500.05. NOW THEREFORE, in consideration of the promises, mutual covenants and agreements as set forth herein, the parties agree as follows: A. The appropriate translation for the zoning in Oro Valley when this property annexed shall be R1-20 limited to 150 dwelling units; and B. This translation zoning does not create density and uses which are greater t~ r those permitted by the County immediately before annexation. The Property shall only be subject to the following conditions for development: 1. Adherence to the preliminary development plan (Exhibit A) approved at the public hearin before the Board of Supervisors or such alternative plan as may be approved by the Town. Development shall be done in accordance with Pima County grading ordinances in effect at t time this agreement is signed by both parties. 2. Concurrent with tentative plat or development plan submittal, a plan: preservation/mitigation study and plan shall be prepared by an independent horticulturist or other qualified professional and submitted to the Town for review and approval. The developer shall preserve in place, relocate or mitigate sig-niflcant on-site cacti and trees, including ironwood trees. as recommended by the preservation plan as approved by the Town. 3. Stewart Title or its successors in interest shall have the right to construct erosion control improvements on the property and fill the property adjacent thereto as shown on the plans as prepared by Pima County's La Cholla Erosion Control Improvement District Engineer's plans nor the Improvement District, provided that, if the construction is not for the entire improvements as •LAw• 1uV1tLlLYciUp111C,111 set forth in the plans, then modifications shall be made where necessary to prevent any adverse impact on properties upstream or downstream from the improvements. The filling and the grading of the property to construct said erosion control improvements shall be subject to the grading ordinances of Pima County in effect at the time this agreement is signed by both parties. Stewart Title or its successors in interest shall be responsible for the construction and maintenance of the erosion control improvements. 4. The property will be subject to those rules, regulations, and official policies which would govern the development of the property that are existing and in force in the Town at the time the property is developed except as modified by the above three conditions of development. INTERPRETATION OF 'PERMS This Agreement shall be construed in all instances when possible to do so in such a fashion as will allow the parties to comply with ail applicable state and federal laws and regulations i✓1 accomplishing the purposes of this Agreement. The Town is required to change, or "translate" the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town has adopted an ordinance which requires the translation of County zoning to occur by April of 1999. The attached map identifies the location of this parcel of land owned by Future Arizona Inc. The property is located at the southeast corner of Lambert Lane and La Cholla Boulevard. SUMMARY: In accordance with State Statutes,the Town should translate Pima County's SR zoning,which allows single family residential (0 —0.3 DUA), to Oro Valley's closest equivalent designation, R1-144, Single Family Residential (also permits 0—0.3 DUA). A pre-annexation agreement for this property was approved by Town Council on April 1st, 1998, which recognized that a future change in zoning may be appropriate at a later date. It is important to note that this condition in the pre-annexation agreement does not require the Town to approve a rezoning to a higher density at a later date. PLANNING & ZONING COMMISSION ACTION: On April 6th, 1999,the Planning&Zoning Commission voted 6-0 to recommend approval of this item. GENERAL PLAN CONFORMANCE: This property is in conformance with the Town's General Plan land use map. The translational zoning of R1-144 is in conformance with the land use categories for this property, which are Low Density Residential (0.6 - 1.2 DUA)and Low Density Residential(1.2—2 DUA). RECOMMENDATION: Staff recommends approval of the translation of zoning on Parcel #224-39-0020, the Future Arizona Inc. property, from Pima County SR to Oro Valley R1-144 and all applicable development standards of the R1-144 zoning district shall apply thereto, with the condition listed in attached pre-annexation agreement. Moreover, the permitted density under a R1-36 zone (1.2 DUA) is closer to the CR-1 density than the R1-20 advertised in the notice. A subdivision plat has been approved by the County for this property. The plat contains eight lots with a minimum lot size of 40,000 square feet, and a condition restricts grading on the individual lots to the building pads and driveways. PLANNING & ZONING COMMISSION ACTION: On April 6th, 1999,the Planning&Zoning Commission voted 6-0 to recommend approval of this item. (0)99- 27 ,OV9-99-106 PARCEL #224-11-046E SMITH PROPERTY, TRANSLATIONAL ZONING FROM PIMA COUNTY SR TO ORO VALLEY R1-144,WITH ADDITIONAL HORSE ENTITLEMENTS, LOCATED EAST OF SHANNON ROAD,AND NORTH OF NARANJA DRIVE BACKGROUND: In September 1998, pursuant to Section 9-471B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council annexed the area known as Map 2. The Town is required to change, or "translate" the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town has adopted an ordinance which requires the translation of County zoning to occur by April of 1999. The attached map identifies the location of this parcel of land owned by the Smith family. The property is located east of Shannon Road, and approximately '/2 mile north of Naranj a Drive. SUMMARY: In accordance with State Statutes, the Town should translate Pima County's SR zoning, which allows single family residential (0 - 0.3 DUA), to Oro Valley's closest equivalent designation, R1-144, Single Family Residential (also permits 0 - 0.3 DUA). There was no pre-annexation agreement negotiated between the property owner and the Town; however, the property owner requested during the annexation process that their existing horse rights under Pima County standards be preserved. Staff has met with the applicant on this issue, and agrees with the applicant's request to preserve their existing horse rights, with the conditions listed in the attached Ordinance. Since Staff's initial meeting with the property owner, a letter has been submitted which requests that the permitted and conditional uses of the County SR zoning be retained; however, at the Commission meeting the applicant stated that he is only interested in the livestock entitlements. PLANNING & ZONING COMMISSION ACTION: On April 6th, 1999,the Planning & Zoning Commission voted 6-0 to approve this item. GENERAL PLAN CONFORMANCE: This property is in conformance with the Town's General Plan land use map. The land use category for this area is Rural Low Density Residential (0 to 0.3 DU/acre)which complies with the proposed translated zoning of R1-144. RECOMMENDATION: Staff recommends approval of the translation of zoning on Parcel #224-11-046E, the Smith property, from Pima County SR to Oro Valley R1-144 and all applicable development standards of the R1-144 zoning district shall apply thereto, with the conditions listed in the Ordinance. These conditions are similar to those placed on the Miller property, located immediately to the north, and the Stenstrom properties, located to the south. The Town is required to change, or "translate" the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town has adopted an ordinance which requires the translation of County zoning to occur by April of 1999. The attached maps identify the location of the parcels of land owned by the Stenstrom and Coffmger families. The properties are located east of Shannon Road, and approximately V2 mile north of Naranj a Drive. SUMMARY: In accordance with State Statutes, the Town should translate Pima County's SR zoning,which allows single family residential (0 - 0.3 DUA), to Oro Valley's closest equivalent designation, R1-144, Single Family Residential (also permits 0 - 0.3 DUA). There were no pre-annexation agreements negotiated between the property owners and the Town; however, the property owners have requested during the annexation process that their existing horse rights under Pima County standards be preserved. Staff agrees with the applicant's request to preserve their existing horse rights, with the conditions listed in the Ordinance. PLANNING & ZONING COMMISSION ACTION: On April 6th, 1999,the Planning&Zoning Commission voted 6-0 to recommend approval of these items. GENERAL PLAN CONFORMANCE: The properties are in conformance with the Town's General Plan land use map. The land use category for this area is Rural Low Density Residential (0 to 0.3 DU/acre) which complies with the proposed translated zoning of R1- 144. TOWN OF ORO VALLEY 9 COUNCIL COMMUNICATION MEETING DATE: April 12, 1999 TO: HONORABLE MAYOR& COUNCIL FROM: Dennis Silva, Jr., Planner I SUBJECT: PUBLIC HEARING — ORDINANCE (0)99-3 2 ,OV9-99-67 & OV9-99-68, MAP 2 TRANSLATION OF ZONING FROM PIMA COUNTY SR TO ORO VALLEY R1-144 WITH CHURCH AND CONDITIONAL USE PERMIT ENTITLEMENTS, ADDENDUM REPORT. BACKGROUND: These two parcels are part of the Map 2 translational zoning and this report addresses additional Pima County entitlements that the property owners requested. The following properties within Map 2 are requesting Pima County entitlements: 1. OV9-99-67 Parcel#224-11-023C Braun, H. Property 2. OV9-99-68 Parcel#224-11-0240 Braun, O.R. Property Parcel # 224-11-023C is located on the southeast corner of Tangerine Road and Shannon Road and Parcel # 224- 11-0240 is located south and adjacent to the first parcel. SUMMARY: In accordance with State Statutes,the Town should translate Pima County's SR zoning, which allows single family residential (.3 DU/acre), to Oro Valley's closest equivalent designation, R1-144, Single Family Residential (also permits .3 DU/acre). There was no pre-annexation agreement negotiated between the above-referenced property owners and the Town. A portion of the northern parcel was recently purchased by the Catholic Diocese. The Braun's and the Diocese request church entitlements and the ability to apply for a conditional use permit for a minor resort and a school. These existing Pima County entitlements are outlined in Exhibit"A". GENERAL PLAN COMPLIANCE: Most of the area in Map 2 is designated Rural Low Density Residential (RLDR) on the Land Use Map. Other land use designations in this map include Parks/Open Space, Schools, and Low Density Residential. Oro Valley R1-144 is the same or lower intensity than these designations. A church is a higher intensity use, but it is appropriate in a residential neighborhood. A minor resort and a school are also a higher intensity use and these impacts will be addressed in the CUP process. PLANNING & ZONING COMMISSION ACTION: This translational zoning was recommended for approval by the Planning and Zoning Commission on April 6, 1999,by a 6—0 vote. (0)99- 32 AN ORDINANCE TRANSLATING THE ZONING FROM PIMA COUNTY SR TO ORO VALLEY R1-144, WITH CONDITIONS, ON THE PROPERTIES KNOWN AS THE CATHOLIC DIOCESE AND BRAUN, LOCATED WITHIN MAP 2 AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. WHEREAS,the owners of certain real property known as the Diocese of Arizona Property, located within Map 2, has requested that their existing development entitlements under Pima County Development Standards be preserved; and WHEREAS, the Planning and Zoning Commission, has considered said translational zoning with added conditions on these properties at a duly noticed Public Hearing, in accordance with State Statue, and having made its recommendations to the Town Council; and WHEREAS, the Oro Valley Town Council has duly considered the translational zoning with added conditions at a Public Hearing and finds that it is consistent with the Town's General Plan, Tangerine Corridor Overlay District, and other Town ordinances, NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ORO VALLEY: SECTION 1. That the Catholic Diocese and Braun properties contained within Map 2 be translationally zoned from Pima County SR to Oro Valley R1-144, and that all applicable development standards of the R1-144 zoning district and entitlement conditions shall apply thereto to said properties. The conditions in Exhibit"A"shall also apply to this property. SECTION 2. That a private or parochial school as permitted in the Pima County SR zoning district with a Conditional Use Permit (CUP), may be permitted on this site. The applicant shall apply for the CUP under a separate process from a Development Plan. SECTION 3. That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict; SECTION 4. That this ordinance and the various parts thereof are hereby declared to be severable. If any section, sub-section, sentence, clause, word or phrase of this ordinance is, for any reason, held to be unconstitutional, such holdings shall not affect the validity of the remaining portion of this ordinance. SECTION 5. Any person found guilty of violating any provision of this code shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not to exceed one thousand dollars or by imprisonment. Each day that a violation continues shall be a separate offense punishable as hereinabove described. The permitted use of a Church in the Pima County SR zoning district will be maintained for this property. 2. A private or parochial school use as permitted in the Pima County SR zoning district with a Conditional Use Permit (CUP), may be permitted on this site. The applicant must apply for the CUP under a separate process from a Development Plan. 3. A minor resort use with a Conditional Use Permit (CUP), may be permitted on this site. The applicant must apply for the CUP under a separate process from a Development Plan. 4. No building shall exceed 25 feet in height. Steeples, spires, towers, and architectural elements may be permitted up to 34 feet in height. Religious symbols placed atop such structures are not included in the calculation of building height, but are limited to a maximum height of 5 feet. 5. This property shall comply with the setback requirements for Oro Valley R1-144 zoning district. The setbacks are as follows: Front— 50', Side — 20', and Rear— 50'. A one hundred fifty-foot half right-of-way will be dedicated on Tangerine Road. 6. Access to Tangerine Road shall be considered temporary and may be closed when, and if, Tangerine Road is developed as a limited-access roadway. ORDINANCE NO.
