AUTHORIZE THE TOWN OF ORO VALLEY TO EXPEND AN AMOUNT
NOT TO EXCEED $1,500,000.00 TO PURCHASE UP TO 200 ACRES
OF LAND (INCLUDING A POSSIBLE SITE LOCATED AT THE
SOUTHEAST CORNER OF FIRST AVENUE AND TANGERINE ROAD-
APPROXIMATELY 150 ACRES) WITHIN THE CORPORATE LIMITS OF
ORO VALLEY JOINTLY WITH OR IN CONJUNCTION WITH
AMPHITHEATER UNIFIED SCHOOL DISTRICT NO. 10 FOR PUBLIC
USE.

SUBJ: Possible Joint Acquisition of Land with Amphitheater School District for
new High School Site
SUMMARY:
The Board of Directors for the h Amphitheater School p coo District st ict have been attempting to
select a site for a new high school to relieve the continued growth that the School
District is experiencing at CDO High Schools
The site identified at Shannon and Naranja has been tied up in Federal District Court for
the past several months due to the Endangered Species Act. Recently, the
Amphitheater School Board narrowed their site selection as an alternative site for the
new high school to six sites, of which three are located in the town limits of Oro Valley.
For many months there has been an expression of the desires of Oro Valley citizens
that the new high school for the Amphitheater School District be located in the town
limits of Oro Valley, where the existing student population exists today and where
growth will appear in the future.
Also at the recent meeting of the Amphitheater School Board, Council Member Fran
LaSala presented an official position of the Town regarding the need to locate the new

high school within the town limits of Oro Valley for a variety of reasons ranging from the
School Resource Officer Program to the ability to develop joint use facilities of regional
athletic, cultural and recreational character.
One of the most viable sites within Oro Valley that is under consideration by the
Amphitheater School District is the southeast corner of Tangerine and N. 1st Avenue.
Because of this site's topography, it apparently will be necessary for the School District
to purchase 150 acres in order to locate a new high school and its amenities on 80
acres of the 150.
Tonight's special meeting has been called by Mayor Loomis in order to provide the
opportunity for the Town Council to discuss possible action relating to the Town's
financial participation in conjunction with Amphitheater School District for the purchase
of the site at Tangerine and N. 1st Ave.
Attached to this Council Communication is a memorandum from David Andrews, the
Town's Finance Director, which analyzes the ability of the Town of Oro Valley to
participate financially in the acquisition of land with the Amphitheater School District up
to $1.5 million.

If the Council is in agreement with the financial participation with Amphitheater School
District, the immediate benefit would be the location of the new high school within the
town limits of Oro Valley with the long term benefit of community facilities and
recreational amenities for the years's use in to come.

FISCAL IMPACT:
Up to $1.5 million.
SUGGESTED MOTION:
I make a motion to authorize up to $1.5 million for land acquisition at the southeast
corner of Tangerine and N. 1st Avenue in conjunction with the Amphitheater School
Districts efforts to locate the new high school in Oro Valley.

MEMORANDUM

SUBJ: Town Acquisition of Land in Conjunction with the Amphitheater School
District
I have reviewed the Town's finances with respect to the possible land acquisition in
conjunction with the Amphitheater Unified School District. it is my understanding that
the estimated cost to the Town of Oro Valley would be approximately $1.5M.
Should the Town desire to purchase the property for cash, the funding source would be
the General Fund's contingency reserves. For FY 1999-2000, the General Fund
contingency is budgeted at an amount of$5,831,686. After a review of preliminary
figures, lam comfortable in predicting that cash reserves will be approximately
$400,000 better than what was expected.
The Town's budgetary policy requires a minimum 25% contingency reserves. Based on
the FY 1999-2000 budget, the minimum reserve must be approximately $3.2M. The
land could be purchased by the Town for$1.5M leaving a contingency reserve of$4.7M
($5.8M + $.4M - $1.5M). The remainder would still be well in excess of the $3.2M
minimum requirement figure.
In assessing the risk with regard to a $1.5M drawdown on the General Fund cash
reserves, the most serious concern I have about future Town finances is the uncertainty
of the economic impact surrounding the Cactus Ferruginous Pygmy m Owl issue. For FY
1999-2000, the Town budget includes approximately $2.1M in construction sales tax
and another $1 M in building permit fees. The survey protocol requirements may slow
down construction either soon or at some point within the next fewY ears.
However and on the upside, a Year 2000 Census count of 28,190 in population will

generate additional General Fund revenues of approximately $1.8M starting in FY
2001/02.

SUBJECT: Possible Joint Acquisition Of Real Property (Not Exceeding $1.5 Million Or 200
Acres Within The Town Of Oro Valley) With Amphitheater Unified School
District No. 10
Pursuant to A.R.S. § 9-241, the Town may "purchase, receive, hold, lease and convey property,
real and personal, necessary or proper to carry out the purposes of the corporation, within or
without its limits." Once purchased, pursuant to A.R.S. § 9-402(A), the Town may sell or
convey that real estate. However, pursuant to A.R.S. § 9-407(B), the Town could sell the parcel
of real property to any political subdivision. The $100,000 limitation on the sale to a private
individual would not be applicable to a transaction to another political subdivision, including a
school district.
However, any subsequent sale of any residual land or land not otherwise utilized by the Town to
any private individual would be subject to special election pursuant to A.R.S. § 9-403 if the
value of the real property exceeded $100,000.
I found no other limitations or prohibitions upon the Town from entering into the purchase
and/or resale of that land to a school district or the joint purchase of the land by the school
district and the Town.

MEMORANDUM
TO: MAYOR AND COUNCIL MEMBERS

SUBJ: VICE MAYOR JOHNSON SUPPORT
In an effort to keep the entire Town Council informed on town matters, contact
was made with Vice Mayor Johnson today concerning the subject matter of this
evening's meeting.
Following discussion with Mayor Loomis and myself about the events, which
have occurred during the past week, Vice Mayor Johnson indicated his support
of moving forward with the proposal on tonight's agenda. Mr. Johnson is deeply
committed to the new high school being built in Oro Valley and is supportive of
the town jointly purchasing the Tangerine and N. 1st Ave site with Amphi School
District in an amount up to $1.5M in an effort to support that decision.
