07/16/99 Minutes, Special Session 3
In response to a question from Council Member LaSala, Town Manger Chuck Sweet
reported that the agreement between Amphitheater School District and the Town (for the
school site at Rancho Vistoso) was completed in approximately 6— 8 weeks.
Council Member LaSala stated that it makes sense to locate the high school in Oro Valley
because of the demographics and growth of the Town. He stated that he understands the
financial aspects but he felt that the Town should move forward on the issue because "it
fits."
Council Member Bryant stated that this is a rare opportunity for government entities to
work together for the children. He stated that Cathy Esposito from Amphi School
District worked with the neighbors and the Town on the school site at Rancho Vistoso
and he felt comfortable that the same would happen with the new site. He also stated that
if the school was not located on the site, alternatives could be apartments and more
commercial businesses. He said that open spaces and archaeological sites could be
utilized by the children. He also explained that the integrity of the riverbed would be
maintained.
Council Member Parisi stated that co-operation between government entities benefits
everyone and this would be a way for the Town and the School District to jointly develop
property for the benefit of all.
Mayor Loomis thanked Town staff for their work on putting together materials for the
proposal. He said that this would be a great opportunity for the Town and School District
to work together and everyone would gain from the joint effort. Mayor Loomis
explained that Tangerine Road is already scheduled for improvements and those
improvements will be completed by the time the school would open. He also explained
that safety improvements are already being funded for First Avenue so traffic concerns
can be addressed. Mayor Loomis also stated that he has talked with Vice Mayor Johnson
and he has echoed his support for the location of the high school in Oro Valley.
Council Member LaSala recognized Girl Scout Troop 682 who were present in the
audience. He explained that they were working on their Citizen Involvement Badges.
MOTION: Council Member LaSala MOVED to authorize up to $1.5 million for land
acquisition at the southeast corner of Tangerine and North First Avenue in conjunction
with the Amphitheater School District's effort to locate the new high school in Oro
Valley. Council Member Bryant SECONDED the motion.
DISCUSSION: Council Member Bryant stated that he made a statement at the
Amphitheater School Board meeting that too much politics is being played. He stated
that this is an example of putting politics aside and doing what is the best for the children.
Motion carried, 4—0.

There are several in-mot-tut ints that I would like read into the record at the
forthoomix c joint meeting of the Town Council and the Amphi School Board_
I The school site should be in the town limits of Oro Valley where the students
are located. The rationale for this has been detailed previously.
2 The propery north of the Cal-Mat site represents the best site location for the
academic and administrative facilities with development of the athletic and
verforming arts facilities within the Cal-Mat site as part of a joint townf
school district development makes sense, There is adequate space north of the
Cal-Mat land for the academic and administrative facilities with easy access
off of Tangerine Road_ Locating the football field,ball fields_,tennis courts,
swimming pool. n asium.and indoor/outdoor pertbrming arts facilities
within the excavated area of Cal-Mat is logical and saves the taxpayers
money. Why duplicate athletic and recreation facilities so close to each other
as would be the case if the school develops the North First Avenue and
Tangerine Road location and the Town of Om Valley develops the Cal-Mat
site. Putting together a regional education, culture and recreation area at the
Cal-Mat site and the property north is visionary, logical and cost saving in the
long run. Why won't it work?
3. From both the Town's and school districts perspective,the corner of North
First and Tangerine is better developed as commercial,property as will be the
case of the other three corners. This intersection will be a major traffic hub in
the future as both roads are widened and improved. The loss of tax revenue
for both the school district and town will be significant if this corner is not
developed to its potential. The Town of Oro Valley has limited high traffic
volume intersections and to use on of them for a nonntevenue producing use is
not fiduciary sound thinking.
I urge both the Amphi School Board and Town Council to do what's right for our
students as wen as our taxpayers. They deserve your best long range decisions and not
what maybe expedient in the short run. A"pride of authorship"mentality has no place in
this process.

1. Has there been an economic impact study? (Demenution in value to existing
homes in the area)
2. Has an archaeology survey been done?
3. Has a pygmy owl or habitat survey been done?
4. Have any surveys or biological studies for any other T & E(threatened and
endangered) species been done?
5 What is the current zoning for the area and does this support the proposed use?
6 Have any water impact studies been done? Is there enough water to support
the proposed use?
7 Has there been a traffic flow thru analysis/impact study by a traffic engineer?
8 Have air impact studies been done concerning potential airbourne particulates
during and after construction?
9 What is the Oro Valley tax increase to pay for the $ 1.5 million we would put
towards this project?
Palisades South, Palisades Point and Catalina Shadows area homeowners are
forming a research group to determine whether to seek legal counsel with
regards to protecting our environment.

Pursuant to your memo of July 21, 1999 I have attached a response to the majority of
the questions posed in your correspondence. Hopefully the answers to your questions
in advance of the upcoming joint meeting will be helpful to all concerned.
I appreciate Amphitheater School District scheduling the joint meeting at Cross Middle
School which should make it convenient for Town Council Members, School Board
Members and the public to attend this very important meeting.
If you have any questions regarding any of the responses contained in the attachment, I
would appreciate it if you would contact Mr. Dan Dudley, Town Attorney for Oro Valley

Question 1:
What is the specific nature of the offer?
Oro Valley's offer is to jointly purchase the 150-acre site at the
southeast corner of N. 1st Avenue and Tangerine Road with the
District.
What are the specific terms of the offer?
The specific terms of the offer are the Town would participate jointly
in negotiations and/or condemnation action to acquire approximately
one-half of the 150 acre site with the upper dollar limit for that
purchase not to exceed $1.5 million.
What consideration, if any, does Oro Valley expect for its investment?
Oro Valley expects from it's investment the right to preserve and
develop the Town owned acreage as it deems appropriate.
Also, would it apply to any high school site within Oro Valley?
The Oro Valley proposal currently being offered is specific to the
southeast corner of Tangerine and N. 1st Avenue and does not apply
to any other high school site within Oro Valley.
Question 2:
Will Oro Valley deed land or exchange land that it purchases to the District if the District
needs additional acreage? School districts may not put any improvements on land they
do not own.
Oro Valley would consider the deeding of land or exchange of land in
the future should the district need additional acreage for expansion
of high school amenities. The deeding of additional land would be at
an appraised market value price and the Town would entertain giving
the District a first right of refusal on Town owned acreage.
Question 3:
Oro Valley indicates it will buy 70 acres of land at the site, but the appraisal range
suggests that it may only be able to buy 50 to 60 acres if the limit is $1.5 million. Will
Oro Valley buy 70 acres if called for?
The action approved by the Oro Valley Town Council authorizes the
purchase of an undetermined acreage amount that would not exceed
the $1.5 million upper limit.
Question 4:
Will the offer be conveyed in writing, setting forth all applicable terms and conditions?
It is Oro Valley's proposal that an IGA that details the proposal in
writing would be entered into by the Town and the District. If
additional terms and conditions were necessary outside our current
authority, the Town Council would need to reconvene to take action
on same.
Question 5:
Would Oro Valley be willing to enter into joint condemnation proceedings with the
District seeking 80 acres and the Town seeking the balance, each to pay
whatever the Court determined?
If it is determined the best course of action to pursue is
condemnation proceedings by separate Town Council action, the
Town could file individually or jointly such action as permitted by law
up to the allowed $1.5M.
Question 6:
What is the Town's plan for the land it buys?
At the present time, the Town's plan for the land is to hold it as an
investment in open space until such time that the Town, in
conjunction with the District, would be able to develop a Master Plan
for the useable town-owned acreage.
Question 7:
Is the Town legally able to commit funds without restriction?
Yes.
Question 8:
Does Oro Valley receive state-shared revenue on our property?
No. The Town only receives state-shared revenue based upon a
certified census of population within the town limits of Oro Valley.
Question 9:
What are the possibilities of ingress and egress from First Avenue, and what would the
extra cost for the same be?
The exact location of an ingress and egress from N. 1st Avenue to the
high school site would best be addressed with a Traffic Study and
coordination with the Oro Valley Town Engineer.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
TORTOLITA,PIMA COUNTY,ARIZONA RELATING TO AMPHITHEATER SCHOOL
DISTRICT SITE SELECTION FOR A NEW HIGH SCHOOL.
WHEREAS,there is a significant shortage of classrooms and teachers to serve the educational
needs of high school students in the northern Amphitheater School District;and
WHEREAS,there is an immediate need for relief of those overcrowded conditions; and
WHEREAS,the Amphitheater Governing Board is consideringthepurchase of aparcel of
land
for the purpose of constructing a new High School at the southeast corner of TangerineAve;and 1'�Ave,and
WHEREAS, the Tangerine and 1" site is centrally located in thepopulationgrowth
center of
the Amphitheater School District; and

congestion on Palisades Road, trespassing into common areas, and designing
property that may not be homeowner friendly. He stated that some of the
positives would be in not bussing children, a sense of pride in the community,
and access to facilities. He stated that he is undecided about the school site but
would like to do the right thing for the community.
In response to a question from Council Member LaSala, Town Manger Chuck
Sweet reported that the agreement between Amphitheater School District and
the Town (for the school site at Rancho Vistoso) was completed in approximately
6 — 8 weeks.
Council Member LaSala stated that it makes sense to locate the high school in
Oro Valley because of the demographics and growth of the Town. He stated that
he understands the financial aspects but he felt that the Town should move
forward on the issue because "it fits."
Council Member Bryant stated that this is a rare opportunity for government
entities to work together for the children. He stated that Cathy Esposito from
Amphi School District worked with the neighbors and the Town on the school site
at Rancho Vistoso and he felt comfortable that the same would happen with the
new site. He also stated that if the school was not located on the site,
alternatives could be apartments and more commercial businesses. He said that
open spaces and archaeological sites could be utilized by the children. He also
explained that the integrity of the riverbed would be maintained.
Council Member Parisi stated that co-operation between government entities
benefits everyone and this would be a way for the Town and the School District
to jointly develop property for the benefit of all.
Mayor Loomis thanked Town staff for their work on putting together materials for
the proposal. He said that this would be a great opportunity for the Town and
School District to work together and everyone would gain from the joint effort.
Mayor Loomis explained that Tangerine Road is already scheduled for
improvements and those improvements will be completed by the time the school
would open. He also explained that safety improvements are already being
funded for First Avenue so traffic concerns can be addressed. Mayor Loomis
also stated that he has talked with Vice Mayor Johnson and he has echoed his
support for the location of the high school in Oro Valley.
Council Member LaSala recognized Girl Scout Troop 682 who were present in
the audience. He explained that they were working on their Citizen Involvement
Badges.
MOTION: Council Member LaSala MOVED to authorize up to $1.5 million for
land acquisition at the southeast corner of Tangerine and North First Avenue in

conjunction with the Amphitheater School District's effort to locate the new high
school in Oro Valley. Council Member Bryant SECONDED the motion.
DISCUSSION: Council Member Bryant stated that he made a statement at the
Amphitheater School Board meeting that too much politics is being played. He
stated that this is an example of putting politics aside and doing what is the best
for the children.
Motion carried, 4 — 0.
ADJOURNMENT
MOTION: Council Member Bryant MOVED to adjourn at 7:12 p.m. Council
Member LaSala SECONDED the motion. Motion carried, 4 — 0.
