Memorandum of Understanding
Between
The City of Tucson,Pima County,City of South Tucson,Town of Sahuarita,Town of Marana,and
Town of Oro Valley
For the
Recovery Act: Edward Byrne Memorial Justice Assistance Grant(JAG)Formula Program:Local
Solicitation
This Agreement is made and entered into this 1st day of July,2009,by and between the City of Tucson,
Hereinafter known as the City,Pinta County,hereinafter known as the County,City of South Tucson,
Town of Sahuarita,Town of Marana,and the Town of Oro Valley acting by and through its governing
body,witnesseth:
WHEREAS,the City and County,City of South Tucson,Town of Sahuarita,Town of Marana and Town
of Oro Valley,disparate jurisdictions,wish to submit a joint application for JAG Recovery Act funds to
the U.S.Department of Justice;and
WHEREAS,the Department of Justice requires disparate jurisdictions to enter into an MOU indicating
which jurisdiction will serve as the applicant/fiscal for the joint JAG fun;and
WHEREAS, the City agrees to act as the applicant/fiscal agent and will withhold $294,161 for
administrative costs as permitted by the JAG application. In addition,the City will use$1,323,724.50 and
provide the County with$1,323,724.50,City of South Tucson with$92,388,Town of Sahuarita with
$13,701,Town of Marana with$38,696 and Town of Oro Valley with$14,256 front the JAG award for
use in eligible programs;and
WHEREAS,it is in the City's,County's,City of South Tucson's,Town of Sahauarita's,Town of
Marana's and Town of Oro Valley's best interests to reallocate the JAG funds.
NOW THEREFORE,the jurisdictions and City agree as follows:
Section I.
The above recitals are incorporated herein as if set out verbatim.
Section 2.
The parties shall cooperate in the submission of an application for JAG funds. City shall act as the
applicant/fiscal agent for the grant on behalf of all parties and shall pay the participating jurisdictions their
agreed upon allocations after such funds are received by the City,based on each jurisdiction's accounting
of expenditures,to be used by the jurisdictions for programs eligible for the use of JAG funds pursuant to
applicable U.S. Department of Justice rules and regulations. The parties will complete an
Intergovernmental Agreement detailing financial reporting requirements prior to using JAG funds.
Section 3.
By entering into this MOU,the parties do not intend to create any obligations express or implied other
than those set out to herein.This MOU shall not create any rights in any party not a signatory hereto.

This MOU is subject to cancellation for conflict of interest as provided in A.R.S.ss38-511

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
ORO VALLEY, ARIZONA, AUTHORIZING AND APPROVING A
MEMORANDUM OF UNDERSTANDING BETWEEN THE TOWN OF
ORO VALLEY,CITY OF TUCSON,PIMA COUNTY,CITY OF SOUTH
TUCSON,TOWN OF SAHUARITA AND TOWN OF MARANA FOR THE
RECOVERY ACT: EDWARD BYRNE MEMORIAL JUSTICE
ASSISTANCE GRANT TO FUND THE PROXIMITY READER SECURITY
SYSTEM FOR THE ORO VALLEY MARKETPLACE SUBSTATION
WHEREAS,The Town of Oro Valley is a municipal corporation within the State of Arizona
and is vested with all the rights,privileges and benefits and entitled to the immunities and
exemptions granted to municipalities and political subdivisions under the Laws of the State of
Arizona;and
WHEREAS,the Department of Justice requires participating local jurisdictions to enter into a
Memorandum of Understanding(MOU)to submit a joint application for Justice Assistance
Grant(JAG)Recovery Act funds;and
WHEREAS,the Town of Oro Valley's allocation under the grant is$14,256,which will be used
to fund the proximity reader security system for the Oro Valley Marketplace substation;and
WHEREAS,it is in the best interest of the Town of Oro Valley to enter into the Memorandum
of Understanding(attached hereto as Exhibit"A")in support of the application for JAG funds
for the proximity reader security system for the Oro Valley Marketplace substation.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF
THE TOWN OF ORO VALLEY,ARIZONA,that:
1. The Memorandum of Understanding between the Town of Oro Valley,City of Tucson,
Pima County,City of South Tucson,Town of Sahuarita and the Town of Marana is
hereby approved.
2. That the Mayor and any other administrative officials of the Town of Oro Valley are
hereby authorized to take such steps as are necessary to execute and implement the terms
of the Memorandum of Understanding attached hereto as Exhibit"A".
PASSED AND ADOPTED by the Mayor and Town Council of the Town of Oro Valley,
Arizona this 19th day of Aug.,2009.
