If any person with a disability needs any type of accommodation, please notify Kathryn Cuvelier, Town Clerk, at 297-2591. t )17 TOWN OF ORO VALLEY COUNCIL COMMUNICATION MEETING DATE: September 11, 1998 TO: HONORABLE MAYOR& COUNCIL FROM: Chuck Sweet, Town Manager SUBJECT: Annexation—Map #2 "Shannon/Limewood"—Ordinance No. (0)98-4° Extending and Increasing the Town limits of the Town of Oro Valley, pursuant to the provisions of Title 9, Chapter 4,Article 7, Arizona Revised Statutes, and amendments thereto SUMMARY: This annexation was initiated at the request of property owners located within the proposed annexation area. In addition, a resolution supporting this annexation has been received by Amphitheater Public School District. The area contains 857 acres and is located generally west of La Cholla Road, East of Shannon Road, South of Limewood Road, and northern portion of Section 9, north and south of Naranja Road. The proposed annexation meets the requirements set out in the Town's Policy for the annexation of unincorporated land adopted by Resolution (R)95-22 on May 17, 1995. This request also conforms to the boundaries of the Town's General Plan. The blank petition, map and legal description was filed with the Pima County Recorder on August 22, 1997. Signatures representing 53% of the property owners and 64% of the assessed valuation of the area has been received. FISCAL IMPACT: There have been two separate fiscal impact studies prepared for this annexation. The first analysis was prepared in September of 1997, and extends over a ten-year period, from FY 1997/98 through 2006/07. Over this ten- year period, and assuming the Town follows the densities recommended in the General Plan. Revenues $415,093 Expenses $454,320 Net fiscal impact-recurring $(39,227) Recurring expenses are assumed to be for legal, police, court, streets & roads maintenance, and administration. The second fiscal impact statement prepared July 15, 1998 reflects actual current zoning under Pima County, and the statement anticipates no change in the zoning over a ten-year period from FY 1998/99 through 2007/08. (0)98-40 AN ORDINANCE RELATING TO ANNEXATION; EXTENDING AND INCREASING THE TOWN LIMITS OF THE TOWN OF ORO VALLEY, PIMA COUNTY, STATE OF ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, ARTICLE 7,ARIZONA REVISED STATUTES,AND AMENDMENTS THERETO,BY ANNEXING THERETO CERTAIN TERRITORY CONTIGUOUS TO THE EXISTING TOWN LIMITS OF THE TOWN OF ORO VALLEY, MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY. WHEREAS, a petition in writing, accompanied by a map of said real property, having been filed and presented to the Town Council of the Town of Oro Valley, Arizona, signed by the owners of more than one-half in value of the real and personal property and more than one-half of the persons owning real and personal property as would be subject to taxation by the Town of Oro Valley in the event of annexation within the territory and land hereinafter described as shown by the last assessment of such property, which territory is contiguous to the Town of Oro Valley and is not now embraced within its limits, asking that the property, more particularly hereinafter described, be annexed to the Town of Oro Valley and to extend and increase the corporate limits of the Town of Oro Valley so as to embrace the same; and WHEREAS, the Mayor and Council of the Town of Oro Valley, Arizona, are desirous of complying with said petition and extending and increasing the corporate limits of the Town of Oro Valley to include said territory; and WHEREAS, the said petition sets forth a true and correct description of all the exterior boundaries of the entire area proposed to be annexed to the Town of Oro Valley, Arizona and had attached thereto at all times an accurate map of the territory desired to be annexed; and WHEREAS, no alterations increasing or reducing the territory sought to be annexed have been made after the said petition had been signed by any owner of real and personal property in such territory, and WHEREAS, the provisions of A.R.S. § 9-471 et seq., and amendments thereto, have been fully observed; and, WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on file in the office of the Oro Valley Town Clerk of the Town of Oro Valley, Arizona, together with a true and correct copy of the original petition referred to herein, which is on file in the office of the Pima County Recorder. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, AS FOLLOWS: SECTION 1. That the following described territory be, and the same hereby is, annexed to the Town of Oro Valley, and that the present corporate limits be, and the same hereby are, extended and increased to include the following described territory contiguous to the present Town limits to-wit as fully described in the Attached Exhibit "A" including county/state lands. That a copy of this ordinance, together with an accurate map of the territory hereby annexed to the Town of Oro Valley, Arizona certified by the Mayor of said Town, be forthwith filed and recorded in the Office of the County Recorder of Pima County, Arizona. SECTION 3. That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict; SECTION 4. That this ordinance and the various parts thereof are hereby declared to be severable. If any section, sub-section, sentence, clause, word or phrase of this ordinance is, for any reason, held to be unconstitutional, such holdings shall not affect the validity of the remaining portion of this ordinance. (R) 95-22 A RESOLUTION OF THE TOWN OF ORO VALLEY, ARIZONA, AMENDING THAT DOCUMENT KNOWN AS THE "TOWN OF ORO VALLEY POLICY FOR THE ANNEXATION OF UNINCORPORATED LAND" AND MAKING SUCH DOCUMENT A PUBLIC RECORD; AND RESCINDING RESOLUTION NO. (R)93- 18 WHEREAS, the Town of Oro Valley has, in the past, annexed unincorporated areas into the town limits, and WHEREAS, the Mayor and Council desire to update and revise the policy of established guidelines for future annexations to ensure that any such annexations will be logical, practical, financially feasible and in the best interest of the town's present and future residents. Strive toward a configuration for the 1) Pursue the filling out and squaring • eliminates countyislands and peninsulas and yields an identifiable, manageable town limits which boundary for the town. 2) Areas to be considered shall be prioritized as to quantifiable benefit to the Town. 3) Require the submittal of a fiscal impact analysis for both undeveloped (rural) and developed properties, the level of detail and contents of which may vary with the intensity or complexity of the proposed or existing use of the land. Such analysis is required, regardless of who initiates the annexation process. the Town shall be generally consistent with the policies and the planning 4) Future annexations of area of Town's adopted General Plan. 5) Consider a proactive stance on annexations initiated in areas deemed most beneficial to the Town as indicated town-prepared by studies and/or professional regional studies. 6) Lands annexed by the Town shall have existing, ordinanced zoning translated to Oro Valley districts in conformance with state law and to densities and uses no greater than those permitted by the zoning ordinance of the governing jurisdiction immediately before annexation. in and ZoningCommission shall review any proposed annexation for 7) The Oro Valley Planning conformity to the adopted General Plan. RESOLUTION A RESOLUTION OF THE AMPHITHEATER PUBLIC SCHOOL DISTRICT ADOPTING AND STATING ITS SUPPORT OF AN ANNEXATION PROPOSED BY THE TOWN OF ORO VALLEY, ARIZONA WHEREAS, for the past several years there has been a positive working relationship between the Amphitheater Public School District Board of Directors and the Town Council of Oro Valley, Arizona; and WHEREAS, the Town of Oro Valley, Arizona is in the process of annexing land to the Town which includes the new high school site and the Wilson K-8 School site owned by the Amphitheater Public School District; and WHEREAS, the Board of Amphitheater Public School District desires to be in the Town of Oro Valley, finding Oro Valley to be strongly supportive of education, NOW, THEREFORE, the Board of the Amphitheater Public School District hereby lends its support to the Town of Oro Valley proceeding with the annexation process of the land as fully set out in the attached legal descriptions and maps. I would caution however as we take in more land I will be asking for additional officers in next year's regular budget. With a proposed high school in the area there would be a need for a School Resource Officer and in order to keep our current 2.19 officers per thousand it would be necessary to hire an additional 3 officers. A conservative figure for the number of officers needed in the area at build out would be a total of four (4). The salary per officer is approximately $30,000 plus benefits ($9,000). You would also need to include all costs for the officer's equipment ($2,000 per officer). For the civil attorne .osition this will not re•uire an increase in staffing positions. On the criminal side for annexations, I tie personnel requests via a ratio of staffing to commissioned police officers. Currently the police department has 50 commissioned officers and is requesting an additional three officers. If the budget is approved, there will still be only one prosecutor and one full—time staff member and one part-time clerk. I believe that for these annexations another attorney position will not be necessary. Our property was designed around our horses and the sport of rodeo. We have Two different sized,lighted roping arenas,a nine stall barn and outside stalls,and four horse pastures. We also have a steer pasture,and calf pasture,as well as holding pins. Our well and water system is designed around all of our animals,as well as dust control for each of the arenas. As you can see we have invested a great deal of time and money, in our home and property. We would like to think that being annex into the town of Oro Valley would only enhance the value of our property,and not destroy its integrity. While the Mayor and council are considering annexing our property into the Town of Oro Valley, we would also like to establish a zoning that is equivalent to our current useage,as well as all other properties of large acreage.
