This is the first project to come under the regulation of the Town's recently adopted telecommunication amendments. The location of the collocation will be on the existing U.S. West monopole tower. The monopole is located on a portion of the Kai/Capri Property, east of and adjacent to North First Avenue, south of Tangerine road. The project includes a new equipment building in addition to the antennae. SUMMARY: Under the new amendments, a major communication facility (those over 20 feet in height) requires a conditional use permit, unless the facility is collocated with an existing provider, in which case the CUP requirement is waived. Collocation is the preferred standard, and as an incentive, a less restrictive review process was developed. Thus, collocated facilities, as with a minor communication facility, require only DRB approval for a Communication Facilities Plan (CFP). The individual elements required for a CFP are discussed below. (See Attachment 3 for excerpts from the OVZCR related to the amendments.) Site Plan showing location and dimensions of all antenna, towers, equipment structures and parking. There are presently two sets of antennae on the 150' monopole, one at the top of the structure, and one at the 104' mark, belonging to Airtouch (formerly part of U.S. West, who still owns the monopole). The 12 new antennae will be located at the 130' mark. As depicted on the site plan attached, the "array" consists of three arms, each with four, 52" long, six inch wide, antennae. A ten foot high equipment building, measuring 230 SF, will also be constructed. On the site at present is the U.S. West shelter, and a chain link fence. The plan provides two paved parking spaces, and extension of the fence around the new shelter. Two parking spaces are required for communication facilities. There is no limit to the number of antenna permitted on a facility use for collocation. Native Plant Salvage and La ape Plans are also required when th s ground disturbance. In this • • case, the site has been previously disturbed. The landscape arcmlect has surveyed the site and determined there is no protected vegetation for salvage. All graded areas will be hydroseeded. These notes are shown on the plan. Photo simulation of the project showing the proposed addition. These photos have been submitted and will be shown during the meeting, as the reproducing quality was poor. Documentation that the NIER emissions are within the limits set by the FCC. This documentation has also been submitted and is attached. The project is within the FCC limits. The project must demonstrate it will have minimal visual impact. As seen in the photo simulations, visual impact by the addition of the facility will be minimal. The Department of Public Works has reviewed the grading concept, and recommended including Condition 1 with Exhibit A. Staff would like to clarify for the DRB the requirement of STEALTH camouflaging of antennae. In the requirements for a CFP, details of the STEALTH camouflaging is required. However, unless a monopole is constructed with STEALTH, it was not intended to require a facility collocating on an uncamouflaged monopole to be camouflaged, just compatible with the existing antennae. RECOMMENDATION: Staff recommends approval of the AT&T Wireless Communication Facility Plan, finding that it meets the requirements for collocation of major communication facility. SUGGESTED MOTION: I move to approve OV13-97-2, the AT&T Communication Facilities Plan, with the conditions in Exhibit A. OR I move to approve OV13-97-2, the AT&T Communication Facilities Plan, and the following added conditions: OR I move to deny OV13-97-2, the AT&T Communication Facilities Plan, finding that: Attachments: 1. La Canada Dr. Oro Valley, AZ 85737 February 28, 1997 Re: Proposed AT&T Wireless Services Antenna Facility # TU-33,Oro Valley,AZ.(Airtouch Co-location) Thank you for giving me an opportunity to respond to your questions about the safety of the AT&T Wireless Services personal wireless service antenna facility in the NE 1/4, NW 1/4, Sec. 6 T125, R14E, G&SRB&M, at the existing Airtouch antenna facility. This antenna facility is an integral part of the wireless infrastructure that provides mobile communication services to individuals, businesses, and safety agencies throughout our community and the nation. People rely on wireless phones for personal safety and security. At the same time, many public service agencies depend on wireless technology to provide disaster relief and emergency services. AT&T Wireless Services is committed to providing safe and efficient wireless communication services to everyone who depends on wireless phones and messaging devices for personal safety, convenience and emergency communications. I'd like to assure you that personal wireless services are not new, untested technologies. Cellular systems use low power radio signals that operate in the same frequency band as UHF television and PCS frequencies have been used by utilities and public safety agencies throughout our communities for years. Personal wireless service antenna facilities transmit low power radio signals to carry telephone conversations. These personal wireless base station antennas typically operate at one hundred watts or less per channel and are placed in inaccessible locations on towers and roof tops. The power density decreases rapidly as you move away from the antenna, creating very low level signals at ground level and points of public access. In addition, when new antenna sites are added in a system, the operating power of both the antenna facilities and the phones decreases as the distance between the antenna sites and the phones is reduced. Personal wireless antenna facilities comply with FCC rules governing the safety of radio emissions. Under the Telecommunications Act of 1996, the FCC has exclusive jurisdiction over the safety of RF emissions from personal wireless antenna facilities. ?O' Recycled Paper AT&T AT&T Wireless Services 2398 E.Camelback Rd. Phoenix,AZ 85016 Public Law 104-104, Section 704(a)(7)(B)(iv). In August, the FCC updated its rules for evaluating the environmental effects of radio frequency (RF) emissions. The new FCC rules constitute a national RF exposure standard that reflects the consensus agreement of the federal agencies charged with protecting public health, including the FDA, EPA, NIOSH, and OSHA. AT&T Wireless Service antenna sites comply with all FCC rules regulating RF emissions and safety. The Telecommunications Act of 1996 recognizes the importance of ensuring the integrity of wireless communication networks that provide nationwide communication services. Nevertheless, we understand people's concerns about health and safety and we recognize our responsibility to address those concerns. Consequently, I have prepared the attached power density report to demonstrate that the above-referenced site complies with FCC regulations governing the safety of the TU-33 antenna facility. The report indicates that under maximum operating conditions, the highest power density in a publicly accessible area (4 ft. from base of tower outside the fenced area)is 8.0678 microwatts per square centimeter, which meets the 1 % of FCC permissible limit allowed for the public at a multiple user transmit facility. Personal wireless services make people and communities safer by providing mobile communications support for law enforcement, disaster relief, and personal emergencies. Personal wireless antenna facilities like this site carry the calls that support the needs of our customers and communities. I hope that the enclosed report answers your questions regarding the safety of this site. If you have any additional questions about this site, I may be reached at (602) 224-2881. In that letter, and in previous discussions with Staff, you were informed that in order to "collocate" antennae or satellite dishes with an existing telecommunications tower, a conditional use permit was not required, and that a courtesy review by staff would be the extent of the permit requirements. That information was incorrect. Under the current zoning code, a conditional use permit is required to "erect, possess or maintain any utility poles or wires...". Utility poles and wires are defined as "poles, towers, structures, wire, cable...and related equipment...used in or as a part of the transportation ...of...cellular telephone...communication" (see Oro Valley Zoning Code Revised, Article 13-7). The Town Council adopted amendments to the zoning code related to communication facilities, which will take effect on March 5, 1997. Under the new amendments, collocation of communication facilities will not require a conditional use permit. What will be required is review and approval by the Town's Development Review Board of a "communication facility plan" (CFP). The new amendments and CFP requirements are attached. We regret any inconvenience caused by the previous interpretation of the zoning code requirements. Your permit request may be processed under the new amendments, and we hope that you will find them to facilitate collocation of communication sites in a streamlined process.
