Dear Paul:
We are writing this letter as a formal request for an extension of the above referenced
Phase III Development Plan for Steam Pump Village. This plan was approved by Town
Council on May 21, 2008. Due to unforeseen circumstances in the economy, financing
for tenants and a difficult market for new construction, the planned tenants have been
delayed and we kindly request the Town and Town Council permit a 2 year extension of
the existing approved Development Plan.
Thank you in advance for your consideration and we look forward to working together to
help make Steam Pump Village a success.

rCOUNCIL COMMUNICATION MEETING DATE: February 17, 2010
TO: HONORABLE MAYOR ANDTOWN COUNCILOF RO VALLEY O rApp d —
FROM: Paul R. Popelka, RLA/AICP, Acting Planning and Zoning Director
SUBJECT: OV12-03-16E, Evergreen Steam Pump LLC, representing the landowner, requests approval
of a two year development plan extension for Phase 3 of the Steam Pump Village
Development, located in proximity to the northwest corner of Oracle Road and Hanley
Boulevard.
SUMMARY:
The applicant requests a two year extension of the development plan for this project to May 21, 2012. This
development plan was approved by Town Council on May 21, 2008 with future development phases. Phase 3
will consist of nine commercial buildings with retail, restaurant and office uses on 16 acres.
DISCUSSION:
Time limits for development plans are a common element in zoning codes. Their purpose is primarily to bring
closure to the review process in a timely fashion, reconsider a project if there are changes to site or market
conditions, and ensure compliance with pertinent updates to zoning standards.
The applicant seeks relief from Sec. 22.9.F.8.b of the Oro Valley Zoning Code Revised (OVZCR) process
requirement, which states, "If improvements have not been started within 2 years of the date of approval of the
development plan, the plan shall be deemed to have been abandoned. A request to extend the time beyond
the 2 years must be submitted in writing to the Town Council within 2 years of the date of approval." The
development plan expires on May 21, 2010, and the request for this time extension was received on January
15, 2010.
The Phase 3 property is zoned Steam Pump Village Planned Area Development (commercial district) and is
currently vacant and undeveloped.
Proposed improvements include:
• Total building area 147,597 square feet
• Total of 7 lots with 9 buildings
• Parking and vehicular circulation
• Courtyard area and pedestrian connections
Phase 3 Approvals
• May 21, 2008, Town Council approved development plan/preliminary plat for Phase 3
• April 15, 2009, Town Council approved final plat for Phase 3
• April 8, 2008, DRB approved landscape plan and architectural elevations (day care building and bank
building)
• Improvement plans for paving, grading, and other infrastructure improvements approved by Public
Works in November 2008

FISCAL IMPACT:
None
CONCLUSION/RECOMMENDATION:
The development plan meets General Plan policies and OVZCR requirements. With the exception of the
landscape code, there have been no recent code updates that would require changes on the development
plan. Improvement plans have been approved by Public Works.
Staff recommends approval of a two year development plan extension.
SUGGESTED MOTION:
The Town Council may wish to consider one of the following suggested motions:
I move to [approve, approve with conditions, OR deny] OV12-03-16E, Evergreen Steam Pump LLC,
representing the landowner, requests approval of a two year development plan extension to May 21, 2012
for Phase 3 of the Steam Pump Village Development.
