MOTION: Moved/Seconded (Briggs/McCook) and carried by a 5-0 vote to approve the March 2, 1999 Planning and Zoning Commission Meeting minutes, with the following correction: Excused was Commissioner Moody and Present was Commissioner McCook. 1. PUBLIC HEARING: OV9-98-17, WONG PROPERTY REZONING FROM R1-144 TO R1-36 AND R1-20, LOCATED SOUTH OF NARANJA DRIVE AND APPROXIMATELY 1 %2 MILES EAST OF LA CANADA DRIVE APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 2 Mr. Nodine, AICP stated that the applicant has requested to postpone this item until the May 6th, 1999 Planning and Zoning Commission meeting. 2. PUBLIC HEARING: OV8-99-03, CHURCH OF THE APOSTLES PAROCHIAL SCHOOL REQUEST FOR CONDITIONAL USE PERMIT (CUP) Mr. Nodine, AICP explained that The Church of the Apostles is requesting a conditional use permit to establish a parochial school, located in the recently annexed area known as La Cholla/Tangerine, which is currently undeveloped. The parochial school segment will be located on the eastern side and the church and related offices will be located on the western side of the property. He added that the proposed parochial school will serve students from pre-school through 8th grade with approximately 220 students and 15 faculty and staff. The development will comply with all requirements of the County and State Health Department. Mr. Nodine, AICP reported that the subject property is bounded on the west, south, and east by Oro Valley R1-144 zoning, and to the north by Pima County SR. The site is located on the northwest corner of La Cholla Boulevard and Tangerine Road, and is 35.8 acres. Mr. Nodine, AICP expressed to the Commissioners that there are determining factors to be considered before granting the conditional use permits. In terms of the first factor, nuisance arising from noise will be mitigated by designing the church and school in the center of the parcel, leaving the periphery in its natural desert state. This natural desert vegetation at the edges will screen this development from the street and adjacent properties. Illumination will be mitigated by implementing conditions 3 and 4 in Exhibit "A". The second factor is not relevant to this application. Regarding the third factor, as noted above, traffic volume and character will change as a result from the proposed uses. However, a traffic analysis will be done for the development plan phase of this project which will address potential traffic problems commonly associated with churches and schools. All required parking will be located within the property boundaries. The proposed school is a day school with students being dropped off and picked up in the early part of the morning and afternoon. Similar to the peak use of the church on Sundays, the school will have two peaks of automobile traffic impact to the surrounding area. There is an adjacent parcel to the north, but the house is more than 600 feet away from the proposed parochial school. Due to the possibility for major traffic impacts in this area because of the school, staff will require a preliminary traffic study to be done that addresses impacts to the surrounding area. Mr. Nodine, AICP summarized that there are requirements in Chapter 9, Conditions for Specific Uses and Pima County Zoning Code CUP regulations which apply to the proposed parochial school. Per Section 9- 1147G.7 of the Oro Valley Zoning Code Revised, all recreational facilities and related apparatus shall be a minimum of 100 feet from all property lines. Per Section 9-114H.2 of the OVZCR, guest parking, mechanical structures and appurtenances, storage and refuse areas shall be screened according to the requirements of Section 14-206 as approved by the Development Review Board. Pima County Zoning Code requirements include compliance with Section 18.09.020A, all outdoor lighting used in conjunction with the school use shall be located and directed to eliminate light trespass on adjacent streets and residential properties. All outdoor lighting for outdoor recreational areas shall cease no later than 10:00 p.m. The proposed parochial school will comply with all provisions of the Tangerine Raod Corridor Overlay District. A viewshed analysis of vistas across the site, including any view corridors to the mountains, shall be prepared. Other Tangerine Road Corridor Overlay District provisions that this project must address relate to vegetation and landscape standards, architecture, and setbacks. APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 3 Mr. Nodine, AICP stated that regarding General Plan compliance, Oro Valley has designated this area as acceptable for rural low-density residential uses (R-LDR). The Plan denotes "areas of large lot single family development ...desirable in a rural environment". This is the lowest intensity land use designation category in the General Plan, with density from 0-0.3 dwelling units per acre, and is identified as an "area where there is a desire to retain a rural lifestyle or where protection of the natural environment is necessary". Mr. Nodine, AICP explained that the General Plan also established an Urban Growth Boundary (UGB) along the northern edge of the planning area. The site lies immediately north of the UGB, as shown on the attached map. The General Plan states that: "...any land north of the [urban growth] line should not receive any increase in density or land use intensity over what currently exists...the purpose...was to ensure rural character preservation of the land within the area...it is strongly recommended that the Town Council and other jurisdictions consider and honor the existing resident's wishes to maintain the rural character of the area. Additionally, increasing the intensity of development of this area over the next twenty years will continue the trend toward urban sprawl that the Focus 2020: Oro Valley General Plan is attempting to limit." The Town Council approved the translational zoning for this property with the condition that no more than 30% of the 36-acre site may be developed, which meets the intent of the UGB. Mr. Nodine, AICP reported that staff has reviewed the request for conditional use permit for compliance with Article 3-2, Use Permits, Section 9-114, Churches, and the Pima County Zoning Code. Staff finds this request in compliance with the above-mentioned provisions, the General Plan, and recommends approval with those conditions stated in Exhibit"A". EXHIBIT "A", OV8-99-3, CONDITIONS FOR CONDITIONAL USE PERMIT APPROVAL, CHURCH OF THE APOSTLES, PAROCHIAL SCHOOL 1. Per Section 9-114G.7 of the Oro Valley Zoning Code Revised (OVZCR), all recreational facilities and related apparatus shall be a minimum of 100 feet from all property lines. 2. Per Section 9-114H.2 of the OVZCR, guest parking, mechanical structures and appurtenances, storage and refuse areas shall be screened according to the requirements of Section 14-206 as approved by the Development Review Board (DRB). 3. Per Section 18.09.020A, of the Pima County Zoning Code, all outdoor lighting used in conjunction with the school use shall be located and directed to eliminate light trespass on adjacent streets and residential properties. 4. All outdoor lighting for outdoor recreational areas shall cease no later than 10:00 p.m. 5. The proposed parochial school shall comply with all provisions of the Tangerine Corridor Overlay District. 6. A preliminary traffic impact analysis shall be done prior to Town Council approval of the CUP. APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 4 Vice Chair Wiant expressed that he does not agree with the access from Tangerine Road. He suggested that for the sake of public safety, the access should be limited to La Cholla. Tangerine Road does not have acceleration and deceleration lanes. Mr. Nodine, AICP stated that traffic studies will be conducted and these issues will be addressed when the development plan stage. Bob Vint with Bob Vint and Associates Architects, 312 East Sixth Street, Tucson, 85705, explained that in terms of site speculation the entrance would eventually include another access, Limewood to La Cholla. He stated that the Fire Department encouraged having two access points to help ease the flow of traffic from Tangerine. Mr. Vint stated that, as recommended by staff, a traffic engineering report will be conducted and they may very well recommend pull-out lanes on Tangerine. Mr. Vint stated that as part of the project, they will be paving Limewood and Como up to the point where the entrance road begins. He added that the school will be a real asset and service to the community. Mr. Vint requested that "Parochial School" be changed to "Parochial/Private/Charter School" instead of using "Parochial School" as a general term. Mr. Vint stated that in any case, the church and the school would be very closely associated. He pointed out that the church may arrange with an educational institution to come in and operate the school in terms of operation and faculty. PUBLIC HEARING OPENED Barbara Smith, 13600 N. Como Drive, Oro Valley is concerned that the court will not rule in favor of the Town of Oro Valley and that the church will have be in serious trouble where building is concerned. Her second concern is that the proposed school is going to be in the flight path of La Cholla Airpark. PUBLIC HEARING CLOSED In answer to Chair Douglas' question, Mr. Nodine, AICP stated that the issue of the La Cholla Airpark flight path was not addressed. Mr. Nodine, AICP added that it is in the flight path but out the airport safety zone. Mr. Moody asked how far from the end of the runway the property is located. Mr. Nodine, AICP stated that the location is approximately a mile and a half away from the end of the runway. Chair Douglas asked Barbara Smith to please use the microphone, so that what she said would go on record. Barbara Smith 13600 N. Como Drive, Oro Valley stated that she had flown the flight patterns last weekend and they were east of La Cholla. But if someone did a turn out and headed west there is the possibility that they would fly right over the school. Chair Douglas stated that this is obviously a concern and asked Mr. Nodine, AICP about this issue. APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 5 Mr. Nodine, AICP stated that at this time, he does not have the data to address this issue. Mr. Moody stated that the government should have established guidelines for this air park Chair Douglas suggested that he would like to see this item continued on the basis of the safety zone and flight patterns for the La Cholla AirPark. MOTION: Moved/Seconded (Moody/Wiant) and carried by a vote of 6-0 to continue OV8-99-03, Church of the Apostles Request for a Conditional Use Permit (CUP) to the May 4, 1999 meeting, to allow staff the opportunity to research the safety zone and flight patterns of the La Cholla Airpark and the effects this may or may not have on the proposed school. 3. PUBLIC HEARING: OV9-99-50, TRANSLATIONAL ZONING FOR THE STEWART TITLE & TRUST PROPERTY (AKA CHAPARRAL HEIGHTS), LOCATED AT THE SOUTHWEST CORNER OF LAMBERT LANE AND LA CHOLLA BOULEVARD (CONTINUED FROM MARCH 2, 1999 COMMISSION MEETING) Mr. Nodine, AICP reported that on August 5, 1998, pursuant to Section 9-471B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council annexed the area known as Map 4. The Town is required to change, or "translate", the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town must translate the County zoning by May of 1999. This item was continued from the March 2nd Commission hearing for a meeting to be held between the property owners and the neighbors. This meeting was held on the evening of March 24th, 1999. Mr. Nodine, AICP stated that the property is located on the southwest corner of Lambert Lane and La Cholla Boulevard, and extends approximately%2 mile to the west and to the south. Mr. Nodine, AICP explained that there was a pre-annexation agreement negotiated between the property owner and the Town, which is attached to this report. Per the terms of this Annexation Development Agreement, the property will be limited to a maximum 150 lots when subdivided, and the applicant will be required to submit a Native Plant Preservation and Salvage Plan in order to preserve the significant stands of Ironwood and Saguaro onsite. The annexation agreement also permits grading at Pima County standards, and the right to construct erosion control improvements to previously approved plans by the County. All other aspects of development and use for the property will be subject to Oro Valley development standards. Mr. Nodine, AICP summarized that this property is not in conformance with the Town's General Plan land use map. The proposed translated zoning of R1-20 will not be in conformance with the General Plan land use designations for the property, which are Low Density Residential (0.6 — 1.2 DUA), Rural Low Density Residential (0.0 — 0.3 DUA), and Parks and Open Space. However, the proposed translated zoning of R1-20 is consistent with the current CR-1 zoning designation under Pima County. Mr. Nodine, AICP added that staff recommends approval of the translation of zoning on the Stewart Title and Trust property, from Pima County CR-i to Oro Valley R 1-20 and all applicable R APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 6 development standards of the R1-20 zoning district shall apply thereto, with those conditions listed in the Annexation Development Agreement and Exhibit A, attached herewith. Exhibit "A", Planning &Zoning Commission Conditions for Approval, OV9-99-50 Stewart Title Trust Property(aka Chaparral Heights) Translational Zoning from County CR-1 to R1-20. 1. Grading shall be restricted to 50% of the area of the individual lots, to a maximum of 20,000 square feet, excluding driveways. Robert Stubbs, represents the applicant, stated that there has been a sewer improvement district in this area and the property owner has spent over$300,000 for improvements on this property. Mr. Stubbs referenced the pre-annexation agreement that the Town Council had already approved. He requested that this agreement be included in the minutes. He summarized that he felt that this area is the ideal location for this project. He sincerely requests that the Commission consider approving the R 1-20 zoning request for the 150 units. PUBLIC HEARING OPENED Barbara Smith, 13600 N. Como Drive, stated that she objects to The Town of Oro Valley annexing this property into Oro Valley and would like to go on record as stating that this is going to cause future problems for the Town of Oro Valley and when the court case is finally decided and they don't rule in Oro Valley's favor there will be serious repercussions and she wanted to make sure that the Town of Oro Valley understands that. She wanted to make sure that the Town of Oro Valley understands that. She summarized that Oro Valley is annexing land that does not belong to Oro Valley and by giving permits to people and businesses and allowing changes the Town of Oro Valley is inviting disaster. Linda Snodgrass, 11311 N. Vista Del Sol, resident for 21 years, and does not wish to be annexed into the Town of Oro Valley. She stated that she does not want high density housing approved in this area. PUBLIC HEARING CLOSED Mr. Nodine, AICP stated that the main issue is that the grading maximum set at 20,000 square feet. He added that the applicant has requested and staff does support that the grading could be increased to 60%,with the Planning and Zoning Administrator's approval. In answer to Chair Douglas'question,Mr. Nodine,AICP explained that through the Pre- Annexation Development Agreement, Oro Valley Zoning has already taken care of the height limitations and the recreational area and took care of the concern with the additional runoff inline drainage issues. He added, in regard to the vegetation issue, that would be a condition that could be added, it is not a part of the code. It is a policy in the Platting stage but staff felt that it was appropriate to add it in at this time. MOTION: Moved/Seconded (Wiant/Moody) and carried by a 6-0 vote to approve OV9-99-50, translating zoning of the Stewart Title and Trust property, from Pima County CR-1 to Oro Valley R1- 20 and all applicable development standards of the R1-20 zoning district, with those conditions listed in the Pre-Annexation Development Agreement and Exhibit "A", . APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 7 1. Grading shall be restricted to 50% of the area of the individual lots,to a maximum of 20,000 square feet, excluding driveways. With the additional allowance that additional grading could be increased to 60% with the approval of the Planning and Zoning Administrator. AMENDED MOTION: Amended as approved by those making and seconding the motion and carried by a 6-0 vote to also add the condition that the lot size be limited to 24,000 square feet. 4. PUBLIC HEARING: OV9-99-51, TRANSLATIONAL ZONING FOR THE HALLAQ PROPERTY, LOCATED AT THE NORTHEAST CORNER OF LAMBERT LANE AND LA CHOLLA BOULEVARD Mr. Nodine, AICP stated that in accordance with State Statutes, the Town should translate Pima County's zoning designations for the Hallaq properties, to Oro Valley's closest equivalent designations. The translational designations are: CB-1 (Commercial) to C-1 (Commercial): 10 acres TR(Multi-family residential/offices) to R-6 (Multi-family residential/offices): 20 acres CR-2 (Single-family residential) to R1-10 (Single-family residential): 50 acres Mr. Nodine, AICP added that this item was noticed as a public hearing, noticing the change from CB-1 to C-1. Since then staff has looked into case law and the precedence that was set in the annexation rezoning, and due to the additional information that was received and the problem with the noticing staff is recommending a continuance for this item. PUBLIC HEARING OPENED Bill Adler 10720 N. Eagle Eye, Oro Valley stated that he would like to complain that if not a legal error, then the Town has made a procedural error in knowingly entering into an agreement which violates the General Plan, without going through an amendment process to the General Plan. He added that he cannot conceive why under some conditions, staff is insist upon going through the amendment process and other conditions are not. He suggested that if an annexation agreement will violate the General Plan, then an amendment procedure should be required. Mr. Adler also suggested that he would translate this to RS, which would take into consideration of the people who live in the area. Chair Douglas thanked Mr. Adler and stated that, as always, his comments are insightful. Richard Tracy, 10674 N. Sand Canyon Place, Oro Valley, President of the La Privada Homeowner's Association. Mr. Tracy is representing the homeowners this evening and is relaying their concerns regarding the zoning. One of the main issues of concern is the diminishing property values, the water supply-there is a water pressure issue now, the increase of vehicular and pedestrian traffic from these apartments, and of course the negative impact on the views. There are homeowners that were told that these views would not be obstructed and that is why they purchased their lots. Another concern is for the wildlife that traverses through the wash areas that are in close proximity to the La Privada subdivision. . APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 8 Mr. Tracy stated that he would like to see every house in a certain subdivision should be "noticed", not just the one's that are within 300 or 600 feet of proposed changes. Mr. Tracy added that considering the closest apartments are located over a mile away in any direction the proposed location would not be the best place in Oro Valley to plant an apartment complex. Barbara Smith, 13600 N. Como Drive, expressed her to objection of the annexation. Glen Smith, 10361 N. Sand Canyon Place, stated that he is a resident of the La Privada subdivision and his property does border the property in question. He explained that he does not agree with the proposed zoning translation of the Hallaq property. PUBLIC HEARING CLOSED Mr. Nodine, AICP stated that it is the request of the applicant to continue this item to another meeting. MOTION: Moved/Seconded (Moody/Wiant) and carried by a 6-0 to continue OV9-99-51, Translational Zoning for the Hallaq Property, located at the northeast corner of Lambert Lane and La Cholla Boulevard. Discussion: Mr. McCook stated that he would like to see the square footage requirement a little closer to the Pima County designation. 5. PUBLIC HEARING: OV9-99-52, TRANSLATIONAL ZONING FOR THE FUTURE ARIZONA INC. PROPERTY, LOCATED AT THE SOUTHEAST CORNER OF LAMBERT LANE AND LA CHOLLA BOULEVARD,WITH CONDITIONS The Town is required to change, or "translate", the zoning on the annexed property from the SR Pima County zoning designations to the closest comparable Oro Valley zoning designation, R1-144. Chair Douglas stated that Item 5 will be included and considered with Item 9, translational zoning. 6. PUBLIC HEARING: OV9-99-110, TRANSLATIONAL ZONING FOR THE WHEELER PROPERTY, LOCATED AT THE NORTHEAST CORNER OF SHANNON ROAD AND NARANJA DRIVE Mr.Nodine,AICP stated that in September, 1998,pursuant to Section 9-471B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council annexed the area known as Map 2. The Town is required to change, or "translate" the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town has adopted an ordinance which requires the translation of County zoning to occur by April of 1999. Mr. Nodine, AICP reported that in accordance with State Statutes, the Town should translate Pima County's CR-1 zoning, which allows single family residential (1.2 DUA), to Oro Valley's closest equivalent designation. The translational zoning which was noticed was from County CR-1 to Oro Valley R1-20, Single Family Residential (2.1 DUA). Upon further review, Staff has determined that the nearest Oro Valley equivalent to CR-1 is R1-36, which both require a minimum 36,000 square . • APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 9 foot lot per residence. Moreover, the permitted density under a R1-36 zone(1.2 DUA) is closer to the CR-1 density than the R1-20 advertised in the notice. Mr. Nodine, AICP added that a subdivision plat has been approved by the County for this property. The plat contains eight lots with a minimum lot size of 40,000 square feet, and a condition restricts grading on the individual lots to the building pads and driveways. Mr. Nodine, AICP explained that this property is not in conformance with the Town's General Plan land use map. The land use category for this area is Rural Low Density Residential (0 to 0.3 DU/acre) which does not comply with the proposed translated zoning of R1-20; however, the current Pima County CR-1 zoning designation existed prior to the property being annexed into the Town. Mr. Nodine, AICP conveyed that staff recommends approval of the translation of zoning on Parcel #224-11-0480, the Wheeler property, from Pima County CR-1 to Oro Valley R1-36, and all applicable development standards of the R1-36 zoning district shall apply thereto, with the condition listed in Exhibit"A". EXHIBIT "A", PLANNING& ZONING COMMISSION, CONDITIONS FOR APPROVAL, OV9-99-110 THE WHEELER PROPERTY, PARCEL#224-11-0480 1. This property shall be subject to the conditions of the recently approved plat. In answer to Commissioner Briggs' question, Mr. Nodine, AICP explained that the recorded plat restricts the grading to the building pads and the driveway and with an approved plat there will not be another opportunity to review until the building permits start coming through. Jackie Wheeler, 11220 N. Shannon, applicant stated that the zoning has been in effect since before the annexation process. Ms. Wheeler stated that her goal is to keep the grading to a minimum. PUBLIC HEARING OPENED Barbara Smith, 13600 N. Como Drive, stated that her objection is not of the development itself, but to the Town of Oro Valley and Pima County allowing these changes. PUBLIC HEARING CLOSED MOTION: Moved/Seconded (WiantlBriggs) and carried by a 6-0 vote to approve OV9-99-110, Translational Zoning for the Wheeler Property, located at the northeast corner of Shannon Road and Naranja Drive. 7. PUBLIC HEARING: OV-9-99-106, TRANSLATIONAL ZONING FOR THE SMITH PROPERTY, LOCATED EAST OF SHANNON ROAD AND NORTH NARANJA DRIVE Mr. Nodine, AICP reported that in September, 1998, pursuant to Section 9-471 B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council annexed the area known as Map 2. The Town is required to change, or "translate" the zoning on the annexed properties from Pima County APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 10 zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town has adopted an ordinance which requires the translation of County zoning to occur by April of 1999. Mr. Nodine, AICP added that in accordance with State Statutes, the Town should translate Pima County's SR zoning, which allows single family residential (0 - 0.3 DUA), to Oro Valley's closest equivalent designation,R1-144, Single Family Residential(also permits 0-0.3 DUA). Mr. Nodine, AICP explained that there was not a pre-annexation agreement negotiated between the property owner and the Town; however, the property owner requested, during the annexation process that their existing horse rights under Pima County standards be preserved. Staff has met with the applicant on this issue, and agree with the applicant's request to preserve their existing horse rights, with the conditions listed in Exhibit "A". Since Staff's initial meeting with the property owner, a letter has been submitted which requests that the permitted and conditional uses of the County SR zoning be retained. Mr.Nodine,AICP expressed to the Commission that this property is in conformance with the Town's General Plan land use map. The land use category for this area is Rural Low Density Residential (0 to 0.3 DU/acre)which complies with the proposed translated zoning of R1-144. Mr. Nodine, AICP stated that staff recommends approval of the translation of zoning on Parcel#224- 11-046E, the Smith property, from Pima County SR to Oro Valley R1-144 and all applicable development standards of the R1-144 zoning district shall apply thereto, with the conditions listed in Exhibit"A". These conditions are similar to those placed on the Miller property, located immediately to the north. He added that staff has reviewed the applicant's request for retention of the permitted and conditional uses of the County SR zoning in terms of conformance with the OVZCR and the General Plan, and cannot support the request. The permitted and conditional uses of the County SR zoning include those which are not permitted under R1-144, such as libraries, veterinary hospitals, and substance abuse treatment facilities. These uses would not be compatible with the rural residential character of the area, and would not be in conformance with the General Plan's Rural Low Density(0—0.3 RAC)designation. EXHIBIT "A", PLANNING & ZONING COMMISSION, CONDITIONS FOR APPROVAL, OV9-99-106 THE SMITH PROPERTY, PARCEL#224-11-046E 1. Pima County Standards shall apply to all livestock and horse facilities and activities. 2. Any expansion of the existing livestock and horse facilities shall be in conformance with the requirements of the Oro Valley Zoning Code Revised. Specifically, any additional clearing or grading (including the expansion of livestock areas) of more than 1000 square feet shall require a Type I grading permit. Claud Smith, 11598 N. Shannon Road, applicant, stated that he would like to retain livestock privileges for his property. PUBLIC HEARING OPENED APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 11 Barbara Smith, 13600 N. Como Drive, stated that she is opposed to the Town of Oro Valley's translational zoning of this property because of the pending litigation over the annexation of this land into Oro Valley. PUBLIC HEARING: OV9-99-05 AND OV9-99-06,TRANSLATIONAL ZONING FOR THE TLC PROPERTIES (CONTINUED) Mr. Nodine, AICP stated that on August 5, 1998,pursuant to Section 9-471B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council increased its area by annexing 300 acres, known as La Cholla/Tangerine. The Town is required to change, or "translate", the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law,the Town has adopted an ordinance which requires the translation of County zoning to occur by April of 1999. He added that the property is located north of Tangerine Road, east of the other TLC Investment Group property (# 219-46-0170), and west of the Neville property (# 219-46-0230). Mr. Charles Townsdin is the property owner of these two parcels. Mr. Nodine, AICP explained that this item was continued from the February 2, 1999 Planning and Zoning Commission meeting because of the possible changes to the General Plan as a result of the Mr. Townsdin's development standards request. The following TLC properties are to be translated: 1. OV9-99-5 Parcel#219-46-0200 2. OV9-99-6 Parcel#219-46-0170 Mr. Nodine, AICP stated that in the minutes of the February 2, 1999 Planning and Zoning Commission meeting, Mr. Townsdin, stated that he is opposed to Oro Valley development standards. However, as illustrated in the attached analysis, there aren't many differences between Pima County SR and Oro Valley R1-144. Staff has not met with Mr. Townsdin prior to the report deadline, so there is not an update stated in this report regarding his development standards request. Staff will be • APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 12 meeting with him prior to the Planning and Zoning Commission meeting and will have an update for review. Chair Douglas stated that this would be acceptable with the Commission. Mr. Nodine, AICP explained that on September 11, 1998, pursuant to Section 9-471B of the Arizona Revised Statutes, the Town of Oro Valley Mayor and Council increased its area by annexing 857 acres, known as Map 2. The Town is required to change, or "translate", the zoning on the annexed properties from Pima County zoning designations to the closest comparable Oro Valley zoning designation. In accordance with State law, the Town must translate the County zoning by April of 1999. Mr. Nodine, AICP stated that the boundaries for Map 2 are: bounded on the west by Shannon Road, extending south approximately 1/4 mile south of Naranja Drive, extending north approximately 1/4 mile north of Tangerine Road, and extending east to La Cholla Boulevard, not including the area known as La Cholla/Tangerine. Mr.Nodine,AICP referenced Item 5: In accordance with State Statutes, the Town should translate Pima County's SR zoning, which allows single family residential (0 — 0.3 DUA), to Oro Valley's closest equivalent designation, R1-144, Single Family Residential(also permits 0—0.3 DUA). APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 14 Mr. Nodine, AICP explained that a pre-annexation agreement for this property was approved by Town Council on April 1st, 1998,which recognized that a future change in zoning may be appropriate at a later date. It is important to note that this condition in the pre-annexation agreement does not require the Town to approve a rezoning to a higher density at a later date. Mr. Nodine, AICP reported that this property is in conformance with the Town's General Plan land use map. The translational zoning of R1-144 is in conformance with the land use categories for this property, which are Low Density Residential (0.6 - 1.2 DUA) and Low Density Residential (1.2 —2 DUA). Mr. Nodine,AICP added that staff recommends approval of the translation of zoning on Parcel#224- 39-0020, the Future Arizona Inc. property, from Pima County SR to Oro Valley R1-144 and all applicable development standards of the R1-144 zoning district shall apply thereto, with the condition listed in attached pre-annexation agreement. PUBLIC HEARING OPENED Mark Dickerson, 9960 La Cholla, expressed his concerns for building height, livestock entitlements, and the water pressure coming up the hill. Gary Devlin, 5221 Camino Escuela, stated that he came to listen this evening. He expressed to the Commission that approving the livestock entitlements is acceptable to him. However, he does not want his neighbor to be allowed height changes. Eric Gormally, 11600 N. Vista Del Sol, stated that he is opposed to Oro Valley making any decisions based on the pending litigation regarding the annexation of certain property in unincorporated Pima County. Linda Goodwillie, 11600 Vista Del Sol, stated that she is opposed of the translational zoning until the final decision is given by the courts. Christine, (name undetectable on tape), 11765 N. Vista Del Sol is opposed to the annexation until the courts decide whether or not Oro Valley can legally annex this property. PUBLIC HEARING CLOSED MOTION: Moved/Seconded (Wiant/McCook) and carried by a 6-0 vote to approve OV9-99-52, Future Arizona Inc, property, Translational Zoning from Pima County SR to Oro Valley R1-144, with Conditions, Located at the Southeast Corner of Lambert Lane and La Cholla Boulevard, and all applicable conditions in the pre-annexation agreement approved by Oro Valley Town Council April 1, 1998, and OV9-9953 through OV9-99-109 with the exception of 0, P, 00,YY, and ZZ. MOTION: Moved/Seconded (Wiant/McCook) and carried by a 6-0 vote to approve OV9-99-74, OV9-99-75 and OV9-99-103, Translational Zoning, Map 2, from Pima County SR to Oro Valley R1-144,with Public School Entitlements. . APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 15 PUBLIC HEARING—OV9-99-67 & 68, MAP 2 TRANSLATION OF ZONING FROM PIMA COUNTY SR TO ORO VALLEY R1-144 WITH CHURCH ENTITLEMENTS,ADDENDUM REPORT. These two parcels are part of the Map 2 translational zoning and this report addresses additional Pima County entitlements that the property owners requested. The following properties within Map 2 are requesting Pima County entitlements: 54)OV9-99-67 Parcel#224-11-023C Braun,H. Property 55)OV9-99-68 Parcel#224-11-0240 Braun, O.R. Property Parcel # 224-11-023 C is located on the southeast corner of Tangerine Road and Shannon Road and Parcel#224-11-0240 is located south and adjacent to the first parcel. In accordance with State Statutes, the Town should translate Pima County's SR zoning, which allows single family residential (.3 DU/acre), to Oro Valley's closest equivalent designation, R1-144, Single Family Residential (also permits .3 DU/acre). There was no pre-annexation agreement negotiated between the above-referenced property owners and the Town. A portion of the parcel was purchased by the Catholic Diocese. The property owners request church entitlements and the ability to apply for a conditional use permit for a minor resort and a school. These Pima County entitlements are outlined in Exhibit"A". Most of the area in Map 2 is designated Rural Low Density Residential (RLDR) on the Land Use Map. Other land use designations in this map include Parks/Open Space, Schools, and Low Density Residential. Oro Valley R1-144 is the same or lower intensity than these designations. A church is a higher intensity use, but it is appropriate in a residential neighborhood. A minor resort and a school are also a higher intensity use and these impacts will be addressed in the CUP process. Planning Staff recommends approval of the translation of zoning for parcels 224-11-023C and 224- 11-0240 from Pima County SR to Oro Valley R1-144 and all applicable development standards of the R1-144 zoning district shall apply thereto in addition to the Pima County entitlements outlined in Exhibit"A": ENTITLEMENTS AND CONDITIONAL USES, PARCELS 224-11-023C and 224-11-0240 CATHOLIC DIOCESE,MAP 2 1. The permitted use of a Church in the Pima County SR zoning district will be maintained for this property. 2. A private or parochial school use as permitted in the Pima County SR zoning district with a Conditional Use Permit (CUP), may be permitted on this site. The applicant must apply for the CUP under a separate process from a Development Plan. 3. A minor resort use with a Conditional Use Permit (CUP), may be permitted on this site. The applicant must apply for the CUP under a separate process from a Development Plan. APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 16 4. No building shall exceed 25 feet in height. Steeples, spires, towers, and architectural elements may be permitted up to 34 feet in height. Religious symbols placed atop such structures are not included in the calculation of building height, but are limited to a maximum height of 5 feet. Chair Douglas stated that Braun, Coffinger, and Stenstrom Properties are advertised as a public hearing. PUBLIC HEARING OPENED Herbert Braun, applicant, 11900 N. Shannon, stated that the northern part of the lot sold in July and did not close until November. PUBLIC HEARING OPENED No speakers. PUBLIC HEARING CLOSED MOTION: Moved/Seconded (Moody/Wiant) and carried by a 6-0 vote to approve translational zoning from Pima County SR to Oro Valley R1-144 and Exhibit "A" and the additional condition is that access be limited as a temporary access and it may be closed as the Tangerine Corridor is developed. Specifically, any additional clearing or grading (including the expansion of livestock areas) of more than 1000 square feet shall require a Type I grading permit. 10. PUBLIC HEARING: REQUEST TO AMEND THE TOWN OF ORO VALLEY GENERAL PLAN FOR THAT AREA KNOWN AS THE ALBEE PROPERTY Mr. Nodine, AICP summarized that the Planning and Zoning Commission initiated an amendment to the General Plan on March 2, at the request of the property owner, Maralyn Albee. Requests for General Plan amendments may be submitted twice a year: in February through March, and August through September. Mr. Nodine, AICP explained that the subject parcel is 4.009 acres in size, and is located in the new annexation area, west of La Cholla Boulevard and south of Tangerine Road. . The pending translational zoning for this and the surrounding properties is from SR to R1-144. Access is via an unpaved road at the western end of Glover Road. It is surrounded on the north and east sides by school district property (the Wilson School), on the south side by an unpaved road and vacant property, and on the west by largely vacant property and one home (see the attached location map). The property is in close proximity to a major wash, and has relatively minor topography. Currently on the site are three structures used as residences, and the unpaved road. School playing fields border the north and east sides Mr. Nodine, AICP stated that the request from the property owner is to change the General Plan land use designation from Parks/Open Space, with a backup designation of LDR 1.2, to "a medium density land use category". The medium density land use designation permits 2.1 to 5.0 du/ac. Mr. Nodine, AICP explained to the Commission that the Town of Oro Valley has designated this area as acceptable for park/open space, with a backup designation of low-density residential uses 1.2 (0.6 to 1.2 dwelling units per acre). Park/open space denotes areas that are "to be precluded form development except for public recreational facilities or nature preserves. Open space should be left in a natural state for scenic purposes due to topographic or drainage constraints or the need to provide buffers between potentially incompatible land uses". Mr. Nodine, AICP reported that the General plan backup designations are recommended "in the event that the use shown cannot be realized due to lack of funding or other factors." The low density backup designation denotes areas " where single family residential development is desirable, but only if it is at a density that will permit retention of a rural, open character...clustering and building envelopes would be encouraged within this classification to ensure maximum protection of the Sonoran Desert and allocation of open space". The requested medium density residential designation permits 2.1 to 5.0 dwelling units per acres, and is "where typical single-family detached, townhouse, or patio home development is suitable...these areas should be located with proximity to schools, shopping and employment". Mr. Nodine, AICP stated that several General Plan policies are applicable in consideration of this request for an amendment. Based on the proximity of the site to the Wilson School, policies that promote locating residential development to school sites support the request for an amendment, as it is desirable to site schools with residential use. Additionally, the fact that the site is not in a totally natural state, due to site disturbance and residences, and has infrastructure in place (water and sewer are on site) lessens its value as natural open space and supports higher density development. Conversely, the proximity of the site to a significant wash APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 18 and potential wildlife habitat area supports the need for a low density buffer between the school and sensitive land. Information on vegetation and wildlife habitat has not been made available, however, a site visit showed little disturbance on parcels around the site. Findings of Fact: As stated in"Focus 2020", the granting of a general plan amendment will be based on the following findings of fact: 1. That the amendment constitutes an overall improvement to the general plan and is not solely for the benefit of a particular landowner or owners at a particular point in time. Based on potential impacts to the open space and riparian area, a change to medium density residential will not constitute an overall improvement to the general plan. 2. That the amendment is consistent with the vision, goals, and policies of the general plan. The following goals and policies are relevant to this request. Policies 1.2A and 1.3I support the amendment, while the remainder do not. Policy 1.2A: "Encourage the location of residential neighborhoods close to activity centers to minimize travel times." The proximity of the site to the Wilson School supports a higher density land use classification. Policy 1.2D: "Institute complementary zoning near open space, parks, washes, trails, trailheads, schools, and recreation areas to provide adequate buffer." The underlying land use category LDR 0.6 to 1.2 provides adequate and sufficient buffer between the adjacent school site and wash area. A more intense category will generate additional traffic and may not provide adequate buffer to the wash. Policy 1.3I: "Ensure safe bike/pedestrian access to school sites from open space, parks and neighborhoods." The proximity of this site to the school ensures easy, safe pedestrian access. Policy 6.2B: "Open space preservation shall be used as a criterion in deciding the approval or denial of land use rezoning proposals." For value as preserved open space, given that the site is already partially disturbed, the primary benefit is that it will provide a buffer between the school and potential park/open space site and additional low density residential. 3. That the general plan land use map does not provide appropriate optional sites for the use proposed in the amendment. The land use map does provide other sites appropriate for medium density residential land uses. 4. That the amendment will not adversely impact the community as a whole, or a portion of the community without an acceptable means of mitigating these impacts through the subsequent zoning and development process. The requested medium-density residential designation may adversely impact the open space and riparian area to the west, due to the potential density of up to 20 homes on the site. Mitigation such as clustering would not provide sufficient protection of the wash and open space at this density. Mr. Nodine, AICP stated that the Planning staff recommended that the Planning and Zoning Commission forward the proposed General Plan amendment to the Town Council with a recommendation to retain the current land use designation of park/open space and the backup designation LDR 0.5-1.2. An alternative to the medium density request would be to change the designation to LDR, 1.2 - 2.0 dwelling units per acre. This designation would be a logical transition between the school and the LDR 0.5 - 1.2 designated property APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 19 immediately to the south. However, because of the presence of the wash to the west and uncertainty of the impact of higher density development on the wash, staff cannot support a recommendation to change the General Plan land use designation. Mrs. Albee presented a letter to Chair Douglas, stating that she would like to amend her previous request and change the designation of the Albee property. Mr. Nodine, AICP stated that in light of the amended request and the fact that there is a wash located on the property in question, staff could no longer recommend that this request to amend the General Plan be forwarded to the Town Council. Chair Douglas asked Mrs. Albee if she would like to speak, Mrs. Albee declined. PUBLIC HEARING OPENED Bill Adler, 10720 N. Eagle Eye, stated that the burden should be placed upon the applicant to prove that the findings allow for General Plan amendments. Clearly, even though the applicant has requested to change the density, number three on the requirements will never be met. He stated that the staff report does not state why number three has been met. Barbara Smith, 13600 N. Como Drive, expressed her concern that Oro Valley is approving all these changes while there is still a court case pending. Linda Goodwillie, opposed to the proposed change in the General Plan. PUBLIC HEARING CLOSED MOTION: Moved/Seconded (Moody/Partridge) and carried by a 5-0 vote to deny a request to amend the Town of Oro Valley General Plan for that area known as the Albee property, located in the new annexation area, west of La Cholla Boulevard and south of Tangerine Road. 11. PUBLIC HEARING: REQUEST TO AMEND THE TOWN OF ORO VALLEY GENERAL PLAN FOR THAT AREA KNOWN AS THE WINCHESTER PROPERTY Mr. Nodine, AICP reported that the Planning and Zoning Commission initiated an amendment to the General Plan on March 2, 1999 at the request of the property owners, Ken and Iva Winchester. Requests for General Plan amendments may be submitted twice a year, in February through March and August through September. Mr. Nodine, AICP explained that the subject parcel is 3.909 acres in size, located near the intersection of First Avenue and Palisades Road, approximately 250 feet east of First Avenue. The current zoning is R1- 144. It is part of the 1995 annexation area known as the "Palisades Parcel Splits". Palisades Road borders the north property side, a Rural Metro Fire station and R1-144 zoned vacant property the west, and the east and south sides are bounded by developed and vacant residential property zoned R1-36. It is important to note that although the zoning is R1-36 for 10 of the 12 parcels in the annexation area, restrictions do not allow parcels less than 1.01 acres in size. • APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 20 Mr. Nodine, AICP stated that the site is vacant and undisturbed with the exception of an unpaved 2-track road, and it contains substantial slopes (hillside development zone standards may apply). There are no identified protected riparian areas on the site however, the topography indicates minor drainages may be present. Mr. Nodine, AICP summarized that the landowners are requesting a General Plan amendment to change the land use designation from Rural Low Density Residential (0-0.3 DU/Acre)to Low Density residential (LDR 0.6-1.2 Du/ac). Mr. Nodine, AICP stated that in regards to the General Plan, Oro Valley has designated this area as acceptable for rural low-density residential uses (R-LDR). The Plan denotes "areas of large lot single family development ...desirable in a rural environment". This is the lowest intensity land use designation category in the General Plan, with density from 0-0.3 dwelling units per acre, and is identified as an"area where there is a desire to retain a rural lifestyle or where protection of the natural environment is necessary". The Rural Low-Density Residential designation allows for"clustering of residential densities in order to preserve open space and protect the Sonoran Desert environment. Low density residential, (0.3 —2.0 du/ac) "denotes areas where single family residential development is desirable, but only if it is at a density that will permit retention of a rural, open character". He added that the General Plan land use designation of rural low density residential for the Palisades Parcel Splits area is not an accurate density for the existing residential uses. The requested low density residential designation is an accurate description of the exiting land use, and is appropriate given the topography, which may limit any higher densities, and the absence of riparian habitats. Mr. Nodine, AICP explained that as stated in "Focus 2020", the granting of a general plan amendment will be based on the following findings of fact: 1. That the amendment constitutes an overall improvement to the general plan and is not solely for the benefit of a particular landowner or owners at a particular point in time. The current land use designation does not accurately reflect existing and future land uses in the area immediately surrounding the property (primarily Palisades Parcel Splits), in that approximately one half of the lots are developed at a density of at minimum one unit per 1.01 acres, and the remainder permit development at a density compatible with the requested land use designation. 2. That the amendment is consistent with the vision, goals, and policies of the general plan. The amendment is consistent with the following goals and policies: Land Use Policies: Policy 1.1K: "Consider development impacts on natural rolling terrain and emphasize low-density development in these areas". The requested low density residential is consistent with this policy. Policy 1.1D: "The Hillside Development Overlay Zone (HDZ) and development standards shall be considered at the time of rezoning and shall supersede when a conflict exists between the land use map and the HDZ standards". The average cross slope on this parcel indicates that the requested density for the amendment should allow compliance with the HDZ standards. Natural Resource Conservation Policies: The low density request supports both policies listed below because it permits the designation of maximum grading limits and building envelopes, techniques which support these policies. APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 21 Policy 8.1G: "Indigenous vegetation and riparian habitats should be maintained and enhanced where possible". Policy 8.1N: "Mass grading is prohibited for all residential developments 2 RAC and under and strongly discouraged throughout the community". 3. That the general plan land use map does not provide appropriate optional sites for the use proposed in the amendment. The majority of the land use map does provide for appropriate optional sites for the proposed residential use and density. 4. That the amendment will not adversely impact the community as a whole, or a portion of the community without an acceptable means of mitigating these impacts through the subsequent zoning and development process. The amendment will not adversely affect the community because the change is compatible with surrounding developed properties and with the General Plan designation of Master Planned Community to the north and south of the site, where the overall residential density is limited to 2 du/ac. Mr. Nodine, AICP stated that Planning staff recommends that the Planning and Zoning Commission forward the proposed General Plan amendment to the Town Council with a recommendation to change the General Plan Land Use designation on the Winchester property from Rural Low Density Residential (0-0.3 DU/Acre) to Low Density residential (LDR 0.6-1.2 Du/ac). Mr. Winchester, 199 E. Fort Lowell, applicant has requested to amend the Town of Oro Valley General Plan for his property. PUBLIC HEARING OPENED Bill Adler, 10720 N. Eagle Eye, Oro Valley, stated that in talking with Melissa Shaw, the planner who wrote the report acknowledge that finding number three fails because it does not meet the existing conditions. Richard Bauer, 826 E. Palisades, stated that he would like to endorse everything that Mr. Adler has said. He also stated that the ratio is one house per three acres. He explained that there is a lot of wildlife that roams around the area. He added that the property under consideration does have a wash and really wondered if a house could actually be built there, considering that this area is pretty hilly. Mr. Bauer summarized that as a property owner he would really like to see more wide open space than housing. Duane Delarco, 11484 N. 1st Avenue, and 11414 N. 1st Avenue, Oro Valley, stated the report that was written grossly mischaracterized the current use of the affected properties. He added that one of the 1- acre parcels is a house by itself. He stated that in effect one house per two acres is the current use. He explained that when their property was annexed into Oro Valley they were promised that they would continue to have the suburban ranch zoning. He feels that this would totally change the integrity of the property. APRIL 6, 1999 MINUTES,P&Z COMMISSION MEETING 22 Wendy King, 820 E. Palisades, have been there since 1984 and they have 3.7 acres of land. She added that they are horse people and when they were annexed, they were promised that the integrity of the land would stay suburban ranch. Ms. King stated that she wants to be able to keep their current horse lifestyle and is really against this General Plan amendment. Fred King, 820 E. Palisades, grading and paving contractor, stated that there are less than four acre there will not be anything left of the land after its been graded for home construction. He added that the houses that are out there now sit on larger than 1-acre lots. Sam Sapalla, his wife Robin interpreted for him, 11404 N. 1st Avenue, Oro Valley, stated that they are the newest residents in the neighborhood that the reason why they were here was to support the neighbors. Mr. Sapalla signed that there is a special enclave of homes and both he and his wife feel that it is important to keep this area the way that it is. PUBLIC HEARING CLOSED MOTION: Moved/Seconded (Wiant/Moody) and carried by a 5-0 vote to deny Request to Amend the Town of Oro Valley General Plan for that area known as the Winchester property, located near the intersection of First Avenue and Palisades Road. 12. PUBLIC HEARING: AMENDMENT TO THE ORO VALLEY ZONING CODE REVISED, CHAPTER 4, SECTION 4-504 F. PUBLIC ART PROVISIONS, TO CHANGE SUBMITTAL AND OTHER REQUIREMENTS Staff is recommending that this item be continued to the May 6, 1999 Planning and Zoning Commission meeting. MOTION: Moved/Seconded (Wiant/McCook) and carried by a 5-0 vote to continue the Amendment to the Oro Valley Zoning Code Revised, Chapter 4, Section 4-5-4F. Public Art Provisions, to change submittal and other requirements. 13. INITIATE COMPREHENSIVE CODE AMENDMENTS A project to revise the zoning code (OVZCR) for consistency and clarity, while making minimal changes in meaning. Mr. Nodine, AICP stated that staff is recommending that this item be continued to the May 6, 1999 Commission meeting.
