COUNCIL COMMUNICATION MEETING DATE: September 1, 1999
TO: HONORABLE MAYOR& COUNCIL
FROM: Dennis Silva, Jr., Planner I
SUBJECT: PUBLIC HEARING: ORDINANCE (0)99-5° , OV9-99-113 REQUEST TO AMEND THE
RANCHO VISTOSO PAD, TO ADD THE DATE PALM TO THE APPROVED PLANT
MATERIALS LIST
BACKGROUND:
The current Rancho Vistoso Planned Area Development was adopted by the Mayor and Council in 1987. The
PAD encompasses 7,626 acres and is bounded on the south by Tangerine Road, on the east by Oracle Road, and on
the north by the Tortolita Mountains. When fully developed, the PAD will have a variety of residential types,
commercial,technical, and public areas.
NATURE OF REQUEST:
The WLB Group, representing the developer, Vistoso Partners, LLC request to amend the Rancho Vistoso PAD to
add the Phoenix dactyl ifera— Date Palm to the Approved Plant Materials List. The Date Palm is already used in
the El Conquistador Resort, thus, the applicant believes this request is reasonable. If approved, the applicant plans
use the Date Palm for the resort sites in the Rancho Vistoso PAD.
GENERAL PLAN COMPLIANCE:
Staff has evaluated the request for the amendment to the Rancho Vistoso PAD against the General Plan Policies.
Natural Resource Conservation: Policy 8.1 G of the General Plan states that Indigenous (native desert) vegetation
should be maintained and enhanced where possible. The Date Palm is not indigenous to the Sonoran desert
environment. Policy 8.10 encourages restricting the use of non-native plant materials in new developments. The
applicant plans to use the Date Palm for new resort developments in Rancho Vistoso. Policy 8.1U encourages the
use of low water, native plants in golf courses, resorts, developments, parks, etc. The applicant's request is in non-
compliance with the above-referenced General Plan policies.
PLANNING CONSIDERATIONS:
Staff has reviewed the proposed PAD Amendment, and the planning considerations are as follows:
Addendum C, to the Oro Valley Prohibited Plant List in Article 14-2 of the OVZCR, states that any species of tree
or shrub whose mature height may be expected to exceed 25 feet, with the exception of those indigenous plants,
listed in Addendum A, Oro Valley Approved Plant List, is prohibited. While the Date Palm is listed in the Arizona
Department of Water Resources' low-water-use plant list, it meets the Town's criteria for a prohibited plant it is
expected to exceed 25 feet and it is not listed in the Oro Valley Approved Plant List.
though the El Conquistador Resort permits the use of Date Palms, it was approved prior to the passage of the Oro
Valley Prohibited Plant List.

PLANNING AND ZONING COMMISSION ACTION:
The Planning and Zoning Commission recommended approval of the request by a 4 — 0 vote on August 3, 1999

more than two times their height at maturity from a building; (2) at maturity, the trees shall be no taller than the
height of the adjacent buildings; and(3)they shall not be used for perimeter landscaping.
RECOMMENDATION:
Staff recommends denial of the Rancho Vistoso PAD amendment to add the Phoenix dactylifera—Date Palm to the
Approved Plant Materials List. This request does not comply with the General Plan and the OVZCR.
