Although the school district is not subject to municipal zoning ordinances, the development plan has been submitted to the Town for a courtesy review. The size of the property is about 13 acres, including a park site on the north side that is to be dedicated by town to the school district. SUMMARY: The architecture can be described as Spanish Colonial, consistent with architecture found throughout Rancho Vistoso. Architectural elements include clay barrel, pitched tile roofs, stucco pillars and walls, and wainscot. Different roof heights and lines add variety to the large scale buildings. Vertical and horizontal elements help break up the building mass. The only visible windows are at the main entry to the school, which is well defined. Windows look onto the interior courtyard, which is not apparent in the elevations. Although there are some wall areas that appear bare, landscaping will screen much of the view in front of the multi-purpose room and on the south elevation. The DRB may wish to request additional elements on these walls. An ornamental iron fence is shown along much of the north elevation. This fence, along with gates decorated with geckos,is used in part around the outdoor eating area. The tallest building is the multipurpose room at 32 feet, which will also be used as a gymnasium. The remaining buildings do not exceed 24 feet in height. The colors are as follows: tuscany blend tile; sandpiper base wall color; wild cranberry eave trim; tulip hill (mauve) for doors and frames, and acapulco(copper patina)for decorative metal. Cella Barr Associates is requesting a grading waiver for construction of a single-family residence for lot 34 in the Wild Ridge Estates. The existing topography on the lot makes construction difficult without a waiver. The existing topography on the lot makes construction difficult without a waiver. In order to place a monolithic slab, the applicant will utilize terracing to increase the fill from 6 feet to 8 feet as per the grading ordinance. A 50 linear feet area of this terracing will exceed the 8 feet total height allowed by the code, this excess height will be 11 feet max on the left side of the driveway. This portion of the terracing is not in conformance with the grading ordinance, hence the applicant is requesting the waiver. The 4 feet area between the retaining walls will be landscaped. Public Works department staff has reviewed the grading waiver request for the proposed single family residence, and recommends continuance because the applicant submitted the physical addresses of the properties instead of property mailing addresses. Hence this cannot be considered as a proper public noticing. MOTION: Moved, seconded (Underwood/Mager) to continue this item to the August 10tn, 1999 DRB Meeting. Chair Lewis moved items 7, 8, and 9 the Woodbume Avenue Rancho Vistoso Elementary School up on the agenda as the applicant had a prior meeting. OV12-99-2 WOODBURNE AVENUE ELEMEMTARY SCHOOL DEVELOPMENT PLAN Valerie Feuer introduced the staff report into the record. The Amphi Public School District is planning to build a new elementary school in Rancho Vistoso, on Woodbume Avenue between Moore Road and Arrowsmith Drive. Although the school district is not subject to municipal zoning ordinances, the development plan has been submitted to the Town for a courtesy review. The school planned to serve 800 students from kindergarten to fifth grade. Is situated entirely on the school site property, with staff parking, buss drop-off and play fields located on the park site. The north parking lot includes 107 spaces and the south lot has 53 spaces. Parking lot islands shown differ from those required by OVZCR. Staff recognizes the need to maximize the number of parking spaces and has accepted the design. Planning Staff finds the Woodburne Avenue Elementary School Development Plan to be in substantial conformance with OVZCR. We recommend approval, subject to the suggested conditions set forth in Exhibit "A". . This project will be accessed from Woodburne Avenue, which is a four-lane street. Four access points are proposed off Woodbume Avenue. The site drains from west to east. Since this project is commercial, 5-year threshold retention is required. No drainage report has been submitted. Ron Essley, Architect, representing the Amphi School District, provided a site plan for the Board, and made himself available for questions. Member Glueck questioned the driveway circulation 07-13-99 Development Review Board Minutes Page 3 plan. Mr. Essley commented that he traffic will be a community and school district concern and there are still things to be worked out to make it work the most effective way. There is some study and work yet to be done. Member Glueck expressed she would like to be a part of that traffic study. Wayne Wiant, 76 W. Canyon Road, commented that he lived just south of the property and the school has been moved away from the neighborhood approximately 80 feet. It is his understanding that the parking lots will be depressed below the street level and therefore we probably will not have to look out at the parking lots,he felt that would be a big improvement. Member Underwood commented he felt they had done a good job with what they have to work with. He would like to see this move forward. Dr. Esposito, commented the school district is trying to work with the parents and the community to get the school to be a"walk to" elementary. If the kids live within a half-mile of the school they will have to walk. Except the kindergarten kids. This would help us to reduce the traffic. MOTION: Moved, seconded (Underwood/Glueck) and carried by a 7-0 vote to recommend approval of OV12-99-2 Woodburne Avenue Elementary School Development Plan subject to staff conditions. PLANNING STAFFCONDITIONS: 1. A drainage report shall be submitted for review by the Town Engineers office. The report shall include an encroachment analysis for any encroachment into the wash East of this project. 2. A traffic report shall be submitted for review by the Town's Engineer office. The report shall include the effect of this project to the existing roadway system, striping on Woodburne Ave. and traffic circulation and conflicts. 3. Lot boundary calculations are required. 4. Development plan showing existing/proposed spot elevations shall be submitted for review and approval. 5. Provide a typical parking space cross-section for review and approval. 6. Delineate sight visibility triangles on the development plan. 7. Clearly label and dimension all points of access. 8. Call out dumpster location on the development plan. 9. Amphitheater Public Schools should work with the neighborhood and Oro Valley on both on and off site traffic management. OV12-99-2 WOODBURNE AVENUE ELEMENTARY SCHOOL LANDSCAPE PLAN Valerie Feuer introduced the staff report into the record. A 25 to 40 foot wide bufferyard D is shown on the south side of the school property, including one tree preserved in place and numerous salvaged trees, as well as shrubs, cacti, accents and groundcover. The existing property wall for the residences will be the only wall associated with the southern bufferyard. A 50 foot wide minimum 07-13-99 Development Review Board Minutes Page 4 undisturbed natural desert bufferyard D is provided east of the school, adjacent to the wash. A 6 foot ornamental iron fence separates the schoolyard from the natural desert area. Vegetation on the site prior to development included a large number of prickly pear, barrell and cholla cacti, mesquite and palo verde, most of which will be salvaged and reused on site. Many of the cacti have already been salvaged for re-use by a neighborhood association through the Town's Save A Plant Program. Planning Staff finds the Woodburne Avenue Elementary School Landscape Plan to be in substantial conformance with OVZCR and recommend approval. Member Underwood commented this was a good plan and complimented them on salvaging so much. MOTION: Moved, seconded (Mager/Bell) and carried by a 7-0 vote to recommend approval of OV12-99-2 Woodburne Avenue Elementary School Landscape Plan. OV13-99-35 WOODBURNE AVENUE ELEMENTARY SCHOOL ARCHITECTURE Valerie Feuer introduced the staff report into the record. The architecture can be described as Spanish Colonial, consistent with architecture found throughout Ranch Vistoso. Architectural elements include clay barrel, pitch roof, stucco pillars and walls, and wainscot. Different roof heights and lines add variety to the large scale buildings. The tallest building is the multipurpose room at 32 feet, which will also be used as a gymnasium. The remaining buildings do not exceed 24 feet in height. Planning Staff recommends approval as submitted. Ron Essley, Architect, representing Amphi School District, was available for questions. Mr. Essley also provided visuals for the DRB members. Member Glueck asked about the windows in the classrooms. Mr. Essley replied they are big and they are in all classrooms. Chair Lewis asked if there was a color chart available. Mr. Essley provided a color chart for the DRB Members. Mr. Essley welcomed suggestions from the Board regarding the colors of the building and roof. Member Glueck asked if the auditorium had a stage and Mr. Essley replied there was a platform. MOTION: Moved, seconded (Underwood/Vogelsberg) and carried by a 7-0 vote to recommend approval of OV13-99-35 Rancho Vistoso Elementary School Architecture subject to staff conditions and stipulating the colors presented for tile are true and continue to keep working with staff for compatible colors. Mr. Essley addressed the DRB regarding the roof for Woodburne Avenue Elementary, due to finances if the bid is over the estimated amount and to enable to have this school built now. We have been going through some major value engineering study on this building which means looking at all the materials, all of the systems, all of the equipment in the building and trying to determine if there are other systems to serve the function at a lesser cost. We have come up with a substitute that we would like the Board and Staff to consider. Mr. Essley provided colored computer 07-13-99 Development Review Board Minutes Page 5 printouts of the school with a corrugated metal roof. It is a galvanized roof with a pre-finish that never has to be refinished or maintained. We are proposing to paint the roof any color that keeps harmony with the community. It a thought an idea that seems a bit drastic, but he asked the Board to consider it. Member Underwood commented he has looked at metal roofs but asked if it was a standing seam as there are a lot of colors. Mr. Essley replied in a standing seam there are a lot of colors but not in the in the galvanized metal they are pre-finished and the colors are limited. He further explained we couldn't get the color we want but would be willing to paint it. Member Underwood asked what guarantees would we have that it would be maintained. Mr. Essley replied that we might be forced to go with the standing seam pre-finish because of the maintenance of the galvanized metal. Member Glueck expressed her concern over the standing seam, she felt it would not be a wise choice, as we would be hearing from the community. Member Underwood suggested roof samples and colors be presented before any decisions are made. Mr. Essley replied that was a good idea and would be willing to do so. Valerie Feuer commented the architecture has been approved with tile. This would have to come back to DRB for an alternate roof. She explained the next DRB meeting will be August 10th and could the School District bring samples of the metal and color. PREVIEW: RANCHO VISTOSO NEIGHBORHOOD 10 PROPOSED SUBDIVISIONS Valerie Feuer introduced the staff report into the record. A new developer is planning to build a number of subdivisions in Rancho Vistoso Neighborhood 10, generally south of the Golf Club at Vistoso. The purpose of the preview is to review as a whole the proposed subdivisions in Neighborhood 10. Charlie Hulsey, WLB, briefly reviewed the plan for Neighborhood 10; he also provided a colored board. He pointed out where the trails and recreation areas and how they tied into other trails among the different subdivisions. PREVIEW: PUSCH RIDGE CHRISTIAN CHURCH The architect for Pusch Ridge Christian Church has requested a preview of the proposed architecture for expansion of the church, located on Calle Concordia near Canyon del Oro High School. Sergio Martinez, representing Pusch Ridge Christian Church. He explained the church has experienced growth and are looking for ways to expand until a new auditorium can be built. Currently there is one building and parking lot. He has been asked to look at some alternatives of architecture structures that are being used in California. He provided colored boards for the DRB to look at. He explained that the structure that is being presented is semi-permanent and it would be used for gymnasium, fellowship hall. It is a dome type structure, the entrance is more conventional in construction, and it is basically a dome structure that will allow for multi use. We are here to see 07-13-99 Development Review Board Minutes Page 6 if the DRB would consider this type of structure in the Town. Chair Lewis asked at what location would this be placed. Mr. Martinez pointed out on the visual provided the approximate location it would set. Member Underwood suggested a site tour to see what location it would be placed. Member Underwood asked what size is this building. Mr. Martinez replied 9 feet x 105 feet and approximately 25 feet height. Member Mager asked how long it is proposed to be up. Mr. Martinez replied about 10 years until a permanent building could be built. It was the consensus among the DRB members to go out to the site before any decisions are made. OV13-99-43 PULTE ARCHITECTURE, RANCHO VISTOSO, NEIGHBORHOOD 5, PARCEL C,VISTOSO HEIGHTS Valerie Feuer introduced the staff report into the record. Pulte Home Corporation requests DRB approval for seven models for the Vistoso Heights subdivision. The models are 1844, 2137, 2372, 2559, 2720, 3210 and 2842. The first six models are currently being built at Rancho Vistoso Neighborhood 5 Parcel T. The square footage of living space corresponds with the model number for each plan. The house and trim colors will match the color palette of the existing homes in this subdivision. The roof tiles will also remain the same colors and style that is currently offered. The architectural styles are also consistent with the previously approved models for this subdivision. Staff finds the models to be compatible and consistent with models being in the immediate area. As such, Staff recommends approval of the seven Pulte models, subject to the conditions attached in Exhibit "A". Andy Pederson, representing Pulte Home Corporation was available for questions. He commented there was a meeting with the residents of Vistoso Heights and it was a very positive meeting. He provided copies of Pulte's agreements reached at the meeting. He further explained that Pulte was limiting 10 of the 24 lots to single level homes. We are also dropping two of the two story models to be built and those models are 2372 and 3210. The only two-story that will be offered is the 2720 model. Pulte will also match the current colors within the neighborhood. We are currently offering a choice of two colors and would like to add a third color choice. Mr. Pederson provided a color sample of the tile. Member Glueck expressed her concern about rows of two story homes, is there any way to limit the number in a row. Mr. Pederson commented the following lots are restricted to single family homes 1, 3, 5, 6, 10, 11, 15, 62, 66 and 94. This should help break up the two-story homes. Member Glueck felt item 1 of the staff condition should be eliminated as the model offered has enough detail on it. She also recommended adding Pulte's agreement letter to staff conditions. MOTION: Moved, seconded (Underwood/Glueck) and carried by a 7-0 vote to recommend approval of OV13-99-43 Pulte Architecture, Rancho Vistoso, Neighborhood 5 Parcel C, Vistoso Heights. Subject to Staff conditions and stipulating models 2372 and 3210 are eliminated, item one of Staff conditions is eliminated and color sample be provided to staff for 07-13-99 Development Review Board Minutes Page 7 approval of additional paint and roof tile. PLANNING STAFF CONDITIONS 2. Ground mounted mechanical equipment shall be enclosed by a wall to provide visual screening and noise mitigation, and shall respect all setbacks. Pulte agreements reached at the meeting; 1. Lots 1,3,5,6,10,11,15,62,66 and 94 will be limited to single story homes. 2. Pulte will offer only one two-story home in its floorplan mix in Neighborhood 5, Parcel C, from its current mix of three two-story homes in parcel T. 3. The roof tiles to be offered are the same as currently being offered I Parcel C and the paint colors were matched to current colors. These packages were acceptable to those homeowners who attended the meeting. 4. Tile and Paint Packages. Monier Tile 16530 (Tan w/gray) - Body: Spanish Sand & Trim: Graystone. Monier Tile 16333 (Green)-Body: Pueblo Clay& Trim: Malibu Beige. 5. One additional paint and roof tile color was presented and was acceptable to those neighbors in attendance. This additional color selection is presented , DRB-meeting. To staff for approval. 6. The front yard landscape package will be comparable to the existing landscape packages offered by A.F. Sterling. OV13-98-59 APPROVAL OF RICHMOND AMERICAN HOMES MODELS 352R, 335R, 355R, 364R,AND 379R,RANCHO VISTOSO NEIGHBORHOOD 7, PARCEL F Valerie Feuer introduced the staff report into the record. The applicant, Richmond American Homes, has presented five models for use in this new subdivision. All five models feature single story residences, with square footages ranging from 1318 SF to 1873 SF in size. The models may be described as having a Santa Barbara Mission architectural style, and feature two elevations. This application for DRB approval complies with section 4.9.3 of the Focus 2020 Town of Oro Valley General Plan. Staff finds that these models are compatible with other homes under construction in Rancho Vistoso, and recommend approval of these models for use in Rancho Vistoso, Neighborhood 7,Parcel F, as part of the conditions attached. Martha Kuenhold, Richmond American, was available for questions. Ms. Kuenhold had no objections to the conditions except item one, she requested that item one is changed to read windows must be recessed or popout. She also provided a color board for the DRB to examine. 07-13-99 Development Review Board Minutes Page 8 MOTION: Moved, seconded (Glueck/Vogelsberg) and carried by a 7-0 vote to recommend approval of Richmond American Homes Models 352R,335R, 355R, 364R, and 379R, Rancho Vistoso Neighborhood 7, Parcel F, subject to Staff conditions and stipulating item one and popout. PLANNING STAFF CONDITIONS: 1. Windows on all four sides of the structure must be recessed or popout except under covered porches. 2. Spark arrestors shall be camouflaged with a cap. 3. All applicable setbacks must be met. 4. Ground mounted mechanical equipment shall be enclosed by a wall to provide visual screening and noise mitigation, as required by OVZCR Sec. 13-106G 5. The color palette for these models shall be compatible with that approved for the DR Horton Homes models. 6. A color palette will be submitted by the applicant for the permanent record. OV13-98-33 ORO VALLEY RETAIL CENTER SIGN PACKAGE AMENDMENT Dennis Silva introduced the staff report into the record. David K. Jones, represent the applicant, PaylessShoeSource, request DRB approval of an amended sign package to permit the display of sign colors as shown in the federal trademark registration. PaylessShoeSource requests the display of sign colors as shown in the federal trademark registration. PaylessShoeSource requests to display reverse pan channel halo-illuminated individual letters, with the faces in the lettering style and the yellow and orange colors displayed in the federal trademark No. 1,731,803 issued on November 10, 1992. The returns and retainers will be copper patina. The United States Court of Appeals, Ninth Circuit held that a zoning ordinance may not require a change in registered trademark. The current sign package for the Oro Valley Retail Center does not require a change in a registered trademark. The Town allows the logo, but restricts the size of the logo, which is a 10 square foot maximum. Staff recommends denial of the proposed sign package amendment for the Oro Valley Retail Center, finding that it does not meet the intent of the approved sign package. David Jones, representing the applicant, PaylessShoeSource, commented that he is before the Board to address the issue of a tenant that comes to a shopping center with a federally registered trademark. The issue is important, there is a federal law protecting registered trademarks. If a trademark holder deviates from the trademark they risk losing protection of that trademark worldwide. We are in agreement with the staff report except for two items, one is the analysis and the other is the recommendation. The facts that are brought before you are the same facts that were brought before the 9th Circuit case on Video Update. The 9th Circuit court of appeals told the City of Tempe regardless of the approved sign code; you cannot require them to alter their color to conform to the City of Tempe sign package. The federal law takes presidents over local law to protect the registered trademark. 07-13-99 Development Review Board Minutes Page 9 Member Glueck wanted to clarify what the issue was. Valerie state the issue here is the color of the letters on the store, not the size, the lighting, or location. She also commented that the Town Attorney has not has a chance to research the issue. Mr. Jones commented that the issue is not whether or not this is interpreted to be a logo. The letters are a part of their registered trademark and are a part of that display every time you see it. If we are going to interpret the letters to be a part of the logo then that has to be applied across the board of all users within the shopping center. MOTION: Moved, seconded (Glueck/Bell) and carried by a 7-0 vote to deny OV13-98-33 Oro Valley Retail Center Sign Package Amendment. Discussion: Member Glueck said she did not feel comfortable making a legal decision and felt led to go with staffs decision. Member Underwood commented he felt it did not meet the intent of the approved sign package. STAFF REPORT Valerie informed the Board of some staff changes; Paul Nzomo will no longer be coming to the meetings. The new engineer, Craig Civalier will be replacing Paul. Every year the Town sends staff to the Arizona Planning Association Conference. This year it will be held August 4th through the 6th in Flagstaff. Valerie asked who from the DRB would like to attend, it was decided Nancy Mager would attend this year. The advanced planning team is requesting someone from DRB who is interested the ESLO PAC which will hold monthly meetings. Nancy Mages volunteered. Valerie also commented that the Agenda Committee is looking for new volunteers. These meetings follow the DRB meeting and usually last 15 to 20 minutes. Barbara Bell and Bruce Enger will be the new Agenda Committee Members. MOTION: Moved, seconded (Vogelsberg/Mager) and carried by a 7-0 vote to adjourn the July 13th, 1999 Development Review Board Meeting at 9 P.M.
