On behalf of the applicant, Bootz and Duke Sign Company has presented a proposal to install an internally illuminated cabinet-type sign over the teller machine, approximately 5 square feet in size. This sign is to include the logos, in multi-colors, of the banking cards which will be accepted at this machine. The colors, as depicted on a colored sketch of the sign which will be displayed at the meeting, include red, gold, and blue, etc. on a white background. The applicant maintains that, in addition to displaying information as to the cards honored at this machine, the internally illuminated sign is also required for security purposes. This sign will require the DRB's approval of two modifications: 1. While internal illumination is permitted under the Rooney Ranch PAD sign guidelines, such illumination is restricted to only "individual can letters with translucent sides or faces". The use of internally illuminated cabinet type signs, such as the one proposed, is expressly prohibited. 2. The PAD document permits any color specified in the Oro Valley Sign Code (beige, brown, sand and rust) plus black and white. The proposed sign includes non- conforming colors, such as red, blue, gold, etc. This item has been scheduled for public hearing this evening. f:\data\wp\ovcases\13-93-28\banksign.rpt Recommendation: Staff recognizes the need for lighting at this location as it is vital to provide safety and security to the patrons of the ATM. However,we feel this can be provided for adequately through some other means. With regard to the proposed colors of the sign, it should be noted that a consistent sign theme is required throughout any commercial project (Sec. 12-406). The approval of the patina copper, halo-illuminated Fry's signs some time ago"locked in"the theme for this entire commercial complex. The proposed sign over the teller machine is clearly inconsistent with that theme. ITEM NO. 2 Request for Approval of Two Permanent Wall Signs The business identification signs proposed by Great American for the east and north facades of the Fry's building conform to the Oro Valley Sign Code and to the Oracle Road Center PAD sign guidelines. The signs, like the Fry's signs to appear on the same walls, will be of patina copper finish with halo illumination. Each sign is approximately 25.5 square feet in size, well within the size limitations prescribed by the Oro Valley Sign Code. The sign package for the Fry's wall signs, which was originally denied by the DRB, was approved by the Council upon appeal of the DRB decision on March 17, 1993. The sign package presented on that date included a depiction of a "bank" sign, and the entire package was conceptually approved at that time. The sign package presented this evening by the user, Great American Bank, conforms to the concept plan approved in March and serves to formalize that signage for the specific user. Recommendation: Since the two proposed bank signs conform to the Oro Valley Sign Code, the Oracle Road Center PAD and meet the standard for consistency of design throughout the complex, Staff would support approval of Item No. 2, Great American's request for approval of two permanent wall signs to be erected on the Fry's store walls, as submitted. That submittal showed the location of the Great American Bank sign for the 1st Avenue side of the building being placed directly below the Fry's sign. At that September 14th meeting, Mr Bill Gibson of Bootz and Duke Sign Company requested that this 1st Avenue sign be relocated "in-line" with the Fry's Sign on that wall due to technical mounting problems with locating it below the Fry's sign. The DRB was reluctant to approve this relocation without first having staff review the original Council minutes from the meeting that the Fry's Signs were approved to verify if this relocation would be in harmony with that approval. Staff has since researched this issue (see attached Council Minutes from 3/17/93) and find that the only issues that the Council focused on at that meeting were sign material (copper letters), sign color (all sign to be patina copper finish), lighting (all sings to use "halo" backlit illumination) and letter size (Fry's sign limited to 4" tall letters on Oracle Road facing wall and 3' tall letters on the N. 1st Avenue facing wall, all secondary signage limited to 2' tall letters). This proposed Great American bank signage meets all of these criteria. It is staffs opinion that the location of the bank sign on the N. 1st Avenue facing wall was not material to the original Council approval provided all of the other conditions of their approval are met. Staff recommends approval of the relocation of the Great American Bank sign to an "in-line" configuration with the Fry's sign on the N. 1st Avenue facing wall. ATM Sign The DRB denied a request for modification to the Oro Valley Sign Code with respect to a sign which was proposed for placement over the ATM machine on the east facade of Fry's. The requests to modify the colors and the type of illumination proposed for the box-type sign were denied. The Bootz and Duke Sign Company has now resubmitted a plan for this sign. Mr. Gibson proposes that it be approximately 5 square feet in size and, while the sign is still a "box", it will be non-illuminated. As to the colors proposed, the background of the sign will match the stucco color of the building and the credit card logos will be in black and white only (the Oro Valley Center PAD permits black and white). It should be noted that security lighting will still be required at the ATM location, but saic mina will have no connection w____ _le sig was originally proposed. The revised plan for the ATM sign conforms with the Oro Valley Center PAD, however it is still in conflict with Section 12-406 E of the Oro Valley Sign Code which requires that all signs within a complex be the same color. As such, staff recommends denial. Attachments: 1. Revised drawing of Great American wall sign 2. Revised drawing of ATM sign 3. Mr. Rielly stated he feels it is more appropriate to buy alcohol from a supermarket such as Fry's than from a Circle K. Mayor Elliott closed the public hearing. A MOTION was made by Councilmember Hoyt and SECONDED by Councilmember Karol to APPROVE the request for a Series 09 liquor license at the Fry's Food Store to be located at the southwest corner of North First Avenue and Oracle Road. MOTION UNANIMOUSLY carried 5 - 0. OV13-93-2 - APPEAL OF DEVELOPMENT REVIEW BOARD DECISION ON FRY'S FOOD STORES' REQUEST FOR APPROVAL OF PERMANENT WALL SIGNS Steve Hagedorn, Planning & Zoning Director stated on March 10, 1993 Councilmember Karol, Mayor Elliott, Town Manager, Town Attorney and Planning & Zoning Director met with representatives from the Fry's Food Stores to discuss proposed signage for the store. As a result of that meeting, Fry's Food Stores is willing to include the following type of signage on their wall at their shopping center: 1. Sign letter height would not exceed 3 ' in height on the store wall that faces North First Avenue; 4 ' on the wall that faces Oracle Road; all secondary signage would have a letter height not to exceed 2 ' . 2. All sign letters and symbols shall be metal finish and backlit with halo illumination. 3. The sign and logo for the Great American Bank shall be of the same metal finish as the other wall mounted signs. Mr. Michael Franks, Douglas Seaver & Associates, representing Canyon Del Oro Partners. Mr. Franks stated they submitted their sign package to the DRB, no decision regarding the signage could be reached, that is why they are before the Council this evening to appeal. They feel they have a compromise solution that is consistent with the "new" direction for signage in Oro Valley. He presented a sample of a reverse pan metal letter. The intent would be to have this letter illuminated from behind which would take on a halo effect when lit in the evening. The finish of the letter is a concept of what they envision for Phase I of Fry's. He stated it will be consistent with the overall package they are proposing for the center. 03/17/93 Minutes, Council Regular Session 5 In response to a question by Vice-Mayor Skalsky, Mr. Franks stated the concept is to develop a comprehensive package for the 40 acre site with approximately 350, 000 sq. ft. of building when this is built out. He stated they are looking at a reverse pan letter than would be consistent with major anchor tenants on this site, including Fry's. That same type of letter that is backlit, reverse pan, would be consistent with the overall effect on this building. The main letters for the 2 monument signs that will be before the DRB on April 13th, will also be reverse pan letters, rear lit. That sign will read "Rooney Ranch Center" and will have a metal finish similar to the finish proposed for Fry's. The logo's will be cut out and backlit. Mr. Franks stated approval tonight is for Phase I - 60,000 sq. ft. Councilmember Karol MOVED to overrule the DRB decision and approve OV13-93-02 Fry's Wall sign package with the following conditions: The four foot tall Fry's Food & Drug Store sign located on the northwest wall be reduced from 4 foot tall letters to 3 foot tall letters, thereby bringing the signage into compliance with the maximum square footage stated in the Code. Only natural metal letters and symbols be used such brass, bronze, copper, steel or brushed aluminum. These metal letters may be green or blue patina finish. Only non-colored halo illumination type lighting produced by recessing the light source inside a hollow letter with an open back or within the surface the letters are attached may be permitted. The light source shall not be visible from the front or sides. The logo and the bank sign will be the same metal and finish as all the other signs that we are talking about now. Mr. Franks clarified that the Oracle Road sign is four feet and the First Avenue sign is three feet. Mr. Karol replied that is correct. MOTION SECONDED by Councilmember Hoyt. Discussion. In response to a question by Vice-Mayor Skalsky, Steve Hagedorn stated there was a split decision by the DRB on both votes. Neither of the motions made by the DRB were approved. Vice-Mayor Skalsky asked Mr. Hagedorn if the DRB will be comfortable with this proposal? Mr. Hagedorn stated he is confident this proposal would get a majority vote from the DRB in favor, there are aspects of this proposal that 1 or 2 members may not have agreed with. However, it is a very difficult question to answer because of the 03/17/93 Minutes, Council Regular Session 6 circumstances. Vice-Mayor Skalsky suggested that if this happens again, the DRB should be encouraged to come to a decision so the Council can vote on a specific piece. Councilmember Karol stated he would like to add to his motion that since the petitioner has agreed to use patina copper, that is what will be used on the Fry's Stores. He also pointed out that when the DRB examined this under the old Zoning Code because this request was grandfathered. In the meeting that we had with Fry's, they were willing to give up their grandfathering and were willing to recognize the direction in which the Town was proceeding, and therefore they offered to do this on the basis of the green patina copper. He doesn't see any problem with what we are doing here. Mayor Elliott asked Mr. Franks to go back to the DRB with a presentation to inform them of where the direction of the town so that all the Boards are looking at the same thing and understanding the direction in which the Town has gone as a point of information, if nothing else. MOTION UNANIMOUSLY carried 5 - S. Terry Marshall, General Manager, Fry's Food Stores stated they are happy to be in Oro Valley and he hopes we will be as happy with them as they are with the Town. He stated the Town should be proud of its staff and Council because rather than coming in on an adversarial situation, we worked it out in a meeting and he feels they have accomplished with the Town wants, and what staff and Council wants and he feels they will be in compliance with the DRB as well. OV12-92-10 PRELIMINARY PLAT AND LANDSCAPE PLAN - CANADA HILLS, VILLAGE 14, LOTS 1-64, CONSIDERATION AND/OR POSSIBLE ACTION (CONTINUED FROM 3/4/92) Steve Hagedorn stated this came before the Council on March 3, 1993 and there was a question concerning additional access into this project. The Project Engineer has taken a look at that and he is proposed an option for the Council to look at this evening. Warren Thompson, Cella Barr & Associates, representing Canada Hills Development Co. Mr. Thompson stated they have been able to establish a paved 12 ' emergency ingress/egress located between Lots 6 and 7. The paving will consist of decomposed granite.
