ORO VALLEY PLANNING & ZONING DEPARTMENT DEVELOPMENT REVIEW BOARD MEETING DATE: September 6, 1994 TO: Development Review Board FROM: Don Chatfield, Planning and Zoning Director SUBJECT: OV 12-94-21, Honey Bee Recreation Area Recreation Plan, Neighborhood 13, Rancho Vistoso BACKGROUND: On August 17, 1994, the Town Council approved the final plat for Rancho Vistoso, Neighborhood 13, Parcel B, Honey Bee Estates. Honey Bee Estates is located on the north side of Rancho Vistoso Boulevard, adjacent to the bridge over Honey Bee Canyon. The subject property has a gross acreage of 96.46 acres and is proposed to have 44 lots for a gross density of.45 units per acre. As one of the preliminary plat conditions, the Development Review Board and the Town Council required that improvements to the Honey Bee Recreation Area must be completed prior to the construction of 40% of the lots in Honey Bee Estates. Subsequent action required the developer to construct only Phase I of the Recreation Area by the time that 40% of Honey Bee Estates is completed. Phase I of the Honey Bee Recreation Area is before you for approval. Improvements in Phase I include a 29-space parking lot, an interpretive overlook, restrooms, a drinking fountoun, two ramadas and picnic tables, interpretive plaques, and a loop trail. The improvements will be funded by the Rancho Vistoso Master Association. Operation and maintenance of this private recreation area will be the responsibility of the Master Association. Development of later phases of the Honey Bee Recreation Area will be tied to the development of other parcels in the area. The Parks and Recreation Advisory Board has reviewed this recreation plan and recommends that the item be continued until the completion of the Honey Bee Canyon Management Plan. The Management Plan will consider vegetation, wildlife, and recreation needs in the area and is slated for completion in December of this year (subject to Council approval of funding). Recommendation Staff concurs with the recommendation of the Parks and Recreation Advisory Board and recommends the continuance of this item until the regular DRB meeting of January 1995. If the development in Honey Bee Estates reaches the 39% level prior to January, the developer can insure continued development by posting an assurance with the Town in an amount sufficient to construct the amenities proposed on this plan. Suggested Motion The DRB may wish to consider one of the following motions: i I move to continue OV 12-94-21, the recreation area plan for Honey Bee Recreation Area,Neighborhood 6 until the DRB meeting of January 1995. If the developer wishes to construct more than 39% of the dwelling units in Honey Bee Estates, this will be permissible by posting an assurance with the Town in an amount sufficient to construct the amenities proposed on this plan. OR I move to approve OV 12-94-10, the recreation area/final landscape plans for Rancho Vistoso, Neighborhood 5, Parcel T, finding that I move to deny OV 12-94-10,the recreation area/final landscape plans for Rancho Vistoso,Neighborhood 5, Parcel T, finding that 12-94-21\psrept.rec 2 ORO VALLEY PLANNING & ZONING DEPARTMENT DEVELOPMENT REVIEW BOARD MEETING DATE: September 6, 1994 TO: DEVELOPMENT REVIEW BOARD FROM: Jonathan Crowe, Planner I SUBJECT: OV 12-94-21- Rancho Vistoso, Neighborhood 7, Parcel G, RECREATION AREA LANDSCAPE AND DEVELOPMENT PLAN BACKGROUND: New World Homes, owners of this 5.4 acre parcel located at the southeast corner of Arrowsmith Drive and Woodburne Avenue, requests approval for this Recreation Area Landscape and Development Plan which will serve Parcel G. This property, part of the Rancho Vistoso Planned Area Development, is abutted on the north by Desert Rose subdivision, on the east by Parcel G, and to the south and west by Parcel F. LANDSCAPE AND DEVELOPMENT PLAN: The site is gently sloped and undisturbed, with heavier density riparian vegetation associated with the major wash which runs generally along the eastern property line. A smaller wash and associated vegetation runs north-south through the proposed ball field. Proposed facilities include a baseball field, 18 space parking lot, sand volleyball court, basketball half- court, sand tot lot, rest rooms, five picnic areas, pedestrian trail and open space. All elements of the plan are proposed to be field located to minimize or avoid disturbance of existing trees and vegetation. However, staff finds that the current design places portions of the volleyball court and the basketball court within the riparian area and, it appears, within the 100-yr flood limits. The plan also locates a retention basin berm such that flooding is possible in the tot lot, the baseball field, and some of the pedestrian trails, including access to the basketball court. In comments to the project landscape architect, Staff raised a concern about the location of the baseball field diamond next to the Desert Rose subdivision. It appears that home plate is located approximately 40 feet from some of the rear lot lines. The DRB may wish to consider requiring the ball field to be moved further away from the adjacent Desert Rose subdivision. Staff also suggested that a shade structure be installed over at least a portion of the tot lot to make it usable year round. The applicant • has not addressed this issue to ; 's satisfaction. The Parks and Recreation Board reviewed this plan on September 1 and the Town Manager has prepared a memo which reflects their comments and/or recommendations. RECOMMENDATION: Given the concerns raised, Planning staff recommends continuance of the Recreation Area Landscape and Development Plan for Rancho Vistoso, Parcel G to allow the applicant additional time to resolve Staffs concerns. They will be discussed in study session on September 6th and during regular session that same evening, the DRB may take action on same, if desired. The original recreation plans for these four projects were submitted for Staff review some time ago and our comments were relayed to the project engineer on August 19th. Plans prepared in response to our comments were received in our office on September 2nd. Time did not allow for Staff review and report preparation prior to packet distribution, because these plans have been accelerated in the review process by one week. In lieu of said reports, we are sending you a copy of our transmittal to the project engineer, including Staff's initial comments on these plans, to give you some indication of our concerns. We do plan an in-depth review of the revised recreation area plans and will attempt to have staff reports ready for your review at, or before, meeting time. ovcases\recpin.drb 09-06-94 DEVELOPMENT REVIEW BOARD MEETING MINUTES PAGE 2 OV 12-94-21 RANCHO VISTOSO, NEIGHBORHOOD 7, NEIGHBORHOOD RECREATION CENTER, PARCEL G (AND TRAIL PLAN) The staff report was read by Jonathan Crowe. Walt Wind asked for questions of staff. There were none. He then asked for comments from the petitioner. Tim Ensign, The WLB Group, was present. He was not in agreement with the tot lot shade. Staff suggested that a portion be shaded but was questioning the entire tot lot area be covered with some type of shade structure. Walt Wind was in agreement with the covering. Richard Underwood said being familiar with county parks, i.e., Children's Memorial Park could not recall a shaded park. Staff member, Jonathan Crowe stated staff's opinion as this being a feasible proposal. Richard Underwood said the Children's Memorial Park has grass around the sand area and there are trees planted which will provide some natural cooling but almost any shade structure requires railroad ties or something obtrusive. Richard Underwood was concerned with the 100 year floodplain issue and its importance. Mr. Crowe referred this to the Public Works Department. Joanne Homer said this particular area is serving retention needs for other subdivisions in the area and as part of those subdivision's approvals, they were to provide .73 acre feet of retention. Engineering staff requested additional information from the engineer to explain exactly how they are going to meet that requirement and how this works in with the recreational plans. 09-O6-94 DEVELOPMENT REVIEW BOARD MEETING MINUTES PAGE 3 Therefore, staff recommended a continuance at this time. Earl McCamic asked staff to clarify their recommendation of "a portion." Mr. Crowe said, another way to address this concern is to assure that the tot lot is not placed in an area that is exposed in the middle of an area and does not have any kind of landscaping or trees. Staff would like some type of visual and environmental relief. Richard Underwood suggested incorporation of a sprinkler system. Staff replied that this would be a possible solution. Bill Adler asked what type of ball would be played, i.e., softball or hardball. Mr. Ensign said it is suitable for both, although it is smaller than regulation (not for league play). Bill Adler was concerned with errant balls hitting homes or parked cars. He said another option would be to have the diamond at the opposite end of the area, looking north. Mr. Ensign said the town could limit usage to softball only and state that as a condition. He offered a backstop facility and would work this out with staff. Richard Underwood stated that ball fields are in great demand and you will find leagues practicing wherever a field is available. He suggested a backstop be installed and this would alleviate danger to the homes. Bill Adler said that tends to work for balls hit directly back, but foul balls hit beyond the backstop will still pose a problem. He again suggested movement of the diamond to the opposite end which would, in his opinion, solve the problem. Mr. Ensign said he was confident that he was willing to work with staff on other issues. Walt Wind asked for input from the Parks Advisory Board. Ms. Baker was in support of this plan. Walt Wind opened the study session to the public. There were no comments from the audience. He then moved on to the next item. ( 6-94 DEVELOPMENT REVIEW BOARD MEETING MINUTES PAGE 7 OV12-94-21 RANCHO VISTOSO, NEIGHBORHOOD 7, NEIGHBORHOOD RECREATION CENTER, PARCEL G (AND TRAIL PLAN) The staff report was read by Joanne Homer of the Public Works Department. Tim Ensign stated that he had no problem with staff recommendations. He requested approval subject to staff conditions. Shirley Lee asked staff to clarify the amendment to the shade structure. Staff agreed with trees being used as a substitute for the shade structure. Bill Adler requested clarification regarding the floodplain issues, and if this was still an issue. Jonathan Crowe said this is still a concern and has not been resolved. Joanne Homer said she would like to see this item continued, and, if the board votes to approve she suggested that the plans be approved by staff prior to going to council. Shirley Lee stated that too many issues are unresolved. Bill Adler said it is a question of whether they can stipulate that these matters can be resolved along with the board's approval to stipulate these prior to going to council; or continue it. The Chairman entertained a motion. Shirley Lee MOVED to CONTINUE OV 12-94-21 RANCHO VISTOSO, NEIGHBORHOOD 7, NEIGHBORHOOD RECREATION CENTER, PARCEL G (AND TRAIL PLAN) to the September 13 DRB meeting. This property, part of the Rancho Vistoso Planned Area Development, is abutted on the north by Desert Rose subdivision, on the east by Parcel G, and to the south and west by Parcel F. The DRB, on September 6, voted 5-1 to continue this case based on drainage concerns. An excerpt from these minutes is provided as an attachment to this report. On September 15, the DRB again voted 7-0 to continue this item to allow the applicant more time. The applicant is currently working with Engineering staff to resolve these concerns. Another issue has been raised by the Desert Rose subdivision architect who is concerned about the close proximity of the baseball field to five lots in the Desert Rose subdivision. Staff acknowledges that the baseball field is located approximately 40 feet from the rear lot lines of these lots. However, Staff finds this recreation area to be an amenity, especially to prospective h'_me buyers with children. Given that there are only five lots located close to the baseball field, Staff does not recommend moving the ball field from its present location. Staff notes that the present location minimizes disturbance of riparian vegetation. LANDSCAPE AND DEVELOPMENT PLAN: The site is gently sloped and undisturbed, with heavier density riparian vegetation associated with the major wash which runs generally along the eastern property line. A smaller wash and associated vegetation runs north-south through the proposed ball field. Civil Engineer SUBJECT: OV12-94-21 RANCHO VISTOSO NEIGHBORHOOD 7 LANDSCAPE/DEVELOPMENT PLAN (PARCEL G) SUMMARY The first Engineer's Report to the DRB, presented September 6, 1994, recommended continuance so that nine conditions could be addressed by WLB. Subsequent to the September 6th DRB meeting, WLB has addressed most of these conditions to the satisfaction of the Public Works Department. There still remains one significant issue related to the proposed retention basin. The plat for Parcel G was approved on the condition that the retention requirements of that plat would be met within the proposed recreation area. To date, the Public Works staff has not received adequate information to show that the retention basin as proposed will indeed meet the 0.73 acre-feet retention requirement for the Parcel G plat. Staff has spoken to WLB and we are awaiting hydrologic information from WLB to verify the effectiveness of this retention basin as designed. RECOMMENDED CONDITIONS OF APPROVAL Public Works Staff has reviewed the above subject development. Because of the critical nature of the retention requirements, Public Works staff recommends continuance of this landscape/development plan in order for the following conditions to be addressed: 1. A drainage statement shall be provided to the Town of Oro Valley Public Works Department and shall contain the following information: a. All pre- and post-development 100-year flows which enter the retention basin. b. Richard Stakey made a brief presentation. Walt Wind asked what the landscape package consisted of? Mr. Stakey said they offer a choice of two or three packages: 1) a natural desert landscape package that would include native plants and cacti; and 2) a non-traditional landscape package which includes two 15 gallon trees. The homeowner has a choice. Most of the homeowners choose the desert package because of the low water use. Walt Wind asked if a irrigation system is included with the package? Mr. Stakey said, not with the desert package; but it is an option. Richard Underwood informed Mr. Stakey that a drip irrigation system is needed until the trees are established. Mr. Stakey agreed. This property, part of the Rancho Vistoso Planned Area Development, is abutted on the north by Desert Rose subdivision (21 lots approved), on the east by Parcel G (122 lots approved), and to the south and west by Parcel F (vacant, 244 lots planned). The DRB, on October 11, voted 6-0 to continue this case based on drainage concerns. An excerpt from these minutes and previous Staff reports are provided as attachments to this report. The applicant is currently working with Engineering staff to resolve drainage concerns. Another issue which was raised by the Desert Rose architect is the close proximity of the baseball field to five lots in the Desert Rose subdivision. The applicant has moved the ball field approximately 150 feet south from its former location. A revised plan was submitted on October 24, 1994. LANDSCAPE AND DEVELOPMENT PLAN: This park will serve Neighborhood 7 and portions of Neighborhood 5. This neighborhood has a projected population of approximately 4,600 people. 861 lots have been built or approved to date, yielding a population of approximately 1,908 people. The site is gently sloped, with dense riparian vegetation associated with the major wash which runs generally along the eastern property line. A smaller wash and associated vegetation runs north-south through the proposed ball field. The plan indicates that the smaller wash will be filled. Proposed facilities include a baseball field, 20 space parking lot, sand volleyball court, basketball half- court, sand tot lot, rest rooms, five picnic areas, pedestrian trail and open space. All elements of the plan are proposed to be located to minimize or avoid disturbance of existing trees and vegetation. The Parks and Recreation Board reviewed this plan on September 1 and has not yet voiced any opposition to this development plan and landscape plan. • RECOMMENDATION: Planning staff recommends continuance of the Recreation Area Landscape and Development Plan for Rancho Vistoso, Parcel G, to allow the applicant additional time to address the following conditions: 1. Provide additional screening (trees, berm, and/or wall) along Woodburne Ave. to screen the re-located volleyball court from the street; 5. Provide inventory of native plants, both those to be saved in place and those to be salvaged and relocated on-site; 6. Provide approximate area in drainageways, natural open space, and developed (graded) areas; 7. Show parking space calculations; 8. Provide additional screening between the parking area and Woodburne Ave., which shall include a landscaped berm no less than three feet in height, a three foot high masonry wall, or a combination thereof. On October 24, 1994, Staff received a drainage report from WLB which analyzed the retention requirements for the proposed recreation plan. RECOMMENDED CONDITIONS OF APPROVAL Public Works Staff has reviewed the above subject development and would not object to the approval of this landscape/development plan provided that the following conditions are met: 1. All revisions and corrections as noted on the drainage report shall be addressed to the satisfaction of the Town Engineer. A resubmittal of the landscape/development plan and revised drainage report addressing all these conditions shall be submitted to the Town of Oro Valley on or before November 23, 1994 in order to be scheduled for the December 7, 1994 Town Council Meeting. f:\...\12-94-21\drbrpt3.pwd 11-08-94 DEVELOPMENT REVIEW BOARD MELTING MINUTES 9 3. OV 12-94-21 RANCHO VISTOSO, NEIGHBORHOOD 7, RECREATION AREA PLAN The staff report was read by Kevin Kish. Joanne Homer presented the Engineer's report. The petitioner present was Tim Ensign of the WLB Group representing Rancho Vistoso Partners. Tim said he had reviewed the staff comments and has no problems with meeting conditions. Walt Wind said the plan he was looking at shows the volleyball court further south than what was displayed. Tim Ensign said this reflects the revisions made when he received comments yesterday from staff. Bill Adler asked what the distance is of the volleyball court from the property line to the adjacent property. Tim Ensign said staff requested that the court be moved about 100 feet further to the east which this revised plan reflects. Bill Adler was concerned with the noise level. He was also concerned with the juxtaposition of the basketball court to the baseball field. He asked if people playing basketball could be hit by foul balls. Tim Ensign said the way the field has been arranged, this would be impossible. Richard Underwood stated that the odds of foul balls are very slim. Shirley Lee pointed out that the tot lot has a wrought iron fence around it. Bill Zadina introduced himself to the board. Mr. Zadina lives in the neighborhood and suggested some minor changes. He said there is no lighting specified in this document, therefore, he requested that some safety lighting be placed around the parking lot and the restrooms, and around the volleyball court. He said volleyball is basically a daytime sport, but it may be played towards the sunset times. He asked if lighting could be added to the facility and make it a useful facility for evening use. He also stated that this lighting would be helpful for police patrol. 11-08-94 DEVELOPMENT REVIEW BOARD MEETING MINUTES 10 Tim Ensign favored some low intensity perimeter lighting of the parking lot (bollards/low intensity) lighting and for the volleyball court. Maybe some with a 90% cut-off fixture would be acceptable. Bill Adler was concerned with the lights affecting homes. Mr. Zadina said, as a homeowner it was his opinion that lighting is a plus. He said the homeowner is either positively attracted to it or not.. Richard Underwood said the spirit of cooperation between the developer and the homeowners should make a good project. Richard Underwood MOVED TO APPROVE OV12-94-21 RANCHO VISTOSO, NEIGHBORHOOD 7, RECREATION AREA PLAN subject to staff conditions: 1. Drainage issues shall be addressed to Engineering staff's satisfaction; 2. Add pre- and post-development flood limits; 3. Re-locate the sand volleyball court (and associated grading) approximately 100 feet west and 50 feet north of its present location to remove it from the floodplain and associated riparian area, as required by the Zoning Code, Sec. 4-504.D.13; 4. Also, with the request of the homeowners regarding the lighting per discussion tonight consistent with the Town Code. Walt Wind SECONDED. MOTION CARRIED 6-0. ti ORO VALLEY PLANNING & ZONING DEPARTMENT COUNCIL COMMUNICATION MEETING DATE: December 7, 1994 TO: HONORABLE MAYOR & COUNCIL FROM: Linda Frew, Planner I SUBJECT: OV 12-94-21 Rancho Vistoso, Neighborhood 7, Neighborhood Recreation Center (in Parcel G) SUMMARY: In accordance with the adopted master plan for Rancho Vistoso, a portion of Parcel G, Neighborhood 7, has been set aside to serve as a recreational facility to serve a projected population of approximately 5,000 people. The project engineers, WLB, on behalf of the property owner, New World Homes, have presented a landscape/development plan for a 5.4 acre parcel of land, which is located on the east side of the Woodburne Ave. alignment, west of New World's future project in Parcel G. The recreational facility, as proposed, features a baseball field, a 20 space parking lot, sand volleyball court, a basketball half-court, sand tot lot, restrooms, five picnic areas, pedestrian trail and open space. The DRB reviewed and recommended approval to Council of the revised plans, as submitted, with one added condition relating to security/night lighting, as set forth below. The DRB reviewed at least two versions of the recreation area plan and, ultimately, voted to recommend approval, with the condition listed below, on November 8, 1994. It should be noted that the Parks Advisory Board has also reviewed the plan and voiced no objection to it, as submitted. RECOMMENDATION: All Engineering concerns have been addressed and the Town Engineer has no objection to approval of this plan. Finding that the recreational area for Parcel G, and the proposed amenities therefor, meet the intent of the adopted Rancho Vistoso PAD and the Town's requirement for the provision of recreational areas, Planning Staff recommends approval of the plan dated October 24th, as submitted, with DRB's added condition below: "Lighting, which conforms to the Oro Valley Lighting Code (Article 6-7, Oro Valley Town Code), with the lowest standard height and intensity possible, shall be provided for security in the parking lot, and to light the sand volleyball court for night-time use." SUGGESTED MOTION: The Council may wish to consider one of the following motions: I move to approve OV12-94-21, Rancho Vistoso, Neighborhood 7, Recreation Area Plan (Parcel G) as submitted on October 24, 1994, and as forwarded by the DRB, with the following added DRB condition: "Lighting, which conforms to the Oro Valley Lighting Code (Article 6-7, Oro Valley Town Code) with the lowest standard height and intensity possible, shall be provided for security in the parking lot, and to light the sand volleyball court for night-time use." OR I move to approve OV 12-94-21, Rancho Vistoso, Neighborhood 7, Recreation Area Plan (Parcel G) as submitted on October 24, 1994, and as forwarded by the DRB, with the DRB condition listed above and the following added conditions: OR I move to deny OV12-94-21, Rancho Vistoso, Neighborhood 7, Recreation Area Plan (Parcel G), finding that: ATTACHMENTS: 1. This came as a result of trying to minimize the amount of bank protection required along the east property line. On Friday, December 9, 1994, we submitted the altered landscape and development plan for Rancho Vistoso, Neighborhood 7, Parcel G Recreation Center. Hydraulically, this represented a minor change in the drainage concept in that the basin configuration and location were altered from the drainage report, as submitted on October 24, 1994. The new configuration for the basin was analyzed to determine whether the volumetric capacity of the basin was adequate relative to the overall regional retention requirements as reported in the "Summary of Retention Basins in Rancho Vistoso, Neighborhoods 5, 7 and 10" revised October 26, 1994. It was determined that the retention volume for the new configuration had not changed from that which was reported in the drainage report for the Parcel G Recreation Center (0.95 ac-ft) . Furthermore, a basin routing was performed to determine the maximum water surface elevation for the 100-year event. The weir invert was set at 2802 and the maximum 100-year water surface elevation in the weir was 2802. 19. Please find attached a copy of the flood routings for the 2- and 100-year events through the basin, as well as a map showing the location and configuration of the retention basin, as proposed in the landscape and development plan, submitted on December 9, 1994. It should be noted that the original hydraulic intent for the drainage relative to the Rancho Vistoso Neighborhood 7, Parcel G Recreation Center has not been altered or compromised. Therefore, a 10 percent reduction in the rate of discharge will not be necessary. Due to the proposed density (4.2 R.A.C. ) , this project falls into the criteria for 2-year threshold retention as established within Pima County' s retention/ '' detention manual . It will be required to retain the difference in volume between the developed and the existing 2-year events. C CONTOUR INTERVAL 1' gieB our • ORO VALLEY PLANNING & ZONING DEPARTMENT COUNCIL COMMUNICATION MEETING DATE: December 21, 1994 TO: HONORABLE MAYOR & COUNCIL FROM: Linda Frew, Planner I SUBJECT: OV 12-94-21 Rancho Vistoso, Neighborhood 7, Neighborhood Recreation Center (in Parcel G) SUMMARY: In accordance with the adopted master plan for Rancho Vistoso, a portion of Parcel G, Neighborhood 7, has been set aside as a recreational facility to serve the present and future residents of that neighborhood. The project engineers, WLB, on behalf of the property owner, Rancho Vistoso Partners, have presented a landscape/development plan for a 5.4 acre parcel of land, which is located on the east side of the Woodburne Ave. alignment, west of New World's future project in Parcel G. The neighborhood recreation plan in Parcel G was reviewed by Staff, and by the DRB on several occasions, and it has been revised at least four times, based on concerns expressed. The recreational facility, as now proposed, features a baseball field, a 20 space parking lot, sand volleyball court, a basketball half-court, sand tot lot, restrooms, four picnic areas, a pedestrian trail and open space. On November 8, 1994, the DRB reviewed and recommended approval to Council of a revised plan dated October 12, 1994, as submitted, with one added condition relating to security/night lighting. Per the DRB's request, lighting standards, 30 feet in height, have been provided in the parking lot and adjacent to the sand volleyball court. Subsequent to the November 8th DRB meeting, the project engineer made further revisions, minor in Staff's opinion, in response to Staff concerns. These changes included relocation of the volleyball and basketball courts out of the area where drainage was an issue and elimination of one picnic node. It should be noted that the Parks Advisory Board also reviewed the same plan the DRB approved and voiced no objection to it, as submitted. Engineering Staff is satisfied with the December 8th recreation plan resubmittal, but requests that a revised drainage report be filed with the improvement plans for this project. Planning Staff questions the need for such a tall lighting standard in the parking lot area, as we have been informed by the Building Official that a 20 foot standard would suffice and would be preferable, since the parking lot abuts residential lots. We suggest that the parking lot standard be 20 feet in height and that all light fixtures be fully shielded in accordance with Article 6-7 of the Oro Valley Outdoor Lighting Code. Secondly, Staff has concerns regarding plant salvage on this site. The Town's Zoning Inspector, Mr. Manny Padilla, visited the site and identified approximately five trees which he feels are significant. Staff requests that the project landscape architect meet with Mr. Padilla to discuss the fate of these trees and, if required by the Planning and Zoning Director, they be saved in place or transplanted. Further, Planning Staff requests that the open space at the eastern border of this site be protected with temporary fencing during the grading operation. RECOMMENDATION: Finding that the recreational area for Parcel G, and the proposed amenities therefor, meet the intent of the adopted Rancho Vistoso PAD and the Town's requirement for the provision of recreational areas, Planning and Engineering Staffs recommend approval of the revised plan dated December 8, 1994, with the Staff conditions listed on Exhibit "A" attached herewith. SUGGESTED MOTION: The Council may wish to consider one of the following motions: I move to approve OV 12-94-21, Rancho Vistoso, Neighborhood 7, Recreation Area Plan (Parcel G) dated December 8, 1994, as forwarded by the DRB, with the Staff conditions listed in the attached Exhibit "A" OR I move to approve OV 12-94-21, Rancho Vistoso, Neighborhood 7, Recreation Area Plan (Parcel G) dated December 8, 1994, as forwarded by the DRB, with the Staff conditions in Exhibit "A" and the following added conditions: OR I move to deny OV12-94-21, Rancho Vistoso, Neighborhood 7, Recreation Area Plan (Parcel G), finding that: ATTACHMENTS: 1. The approved facilities include a baseball field, 20 space parking lot, sand volleyball court, basketball half-court, sand tot lot, rest rooms, five picnic areas, pedestrian trail and open space. All elements of the plan were proposed and are located to minimize or avoid disturbance of existing trees and vegetation. This 5.4 acre parcel is located at the southeast corner of Arrowsmith Drive and Woodburne Avenue, and is part of the Rancho Vistoso Planned Area Development, is abutted on the north by Desert Rose subdivision (21 lots approved), on the east by Parcel G (122 lots approved), and to the south and west by Parcel F (vacant, 244 lots planned). The park will serve Neighborhood 7 and portions of Neighborhood 5. This neighborhood has a projected population of approximately 4,600 people. 861 lots have been built or approved to date, yielding a population of approximately 1,908 people. SUMMARY: Rancho Vistoso Partners, the owners, request architectural approval of a ramada and restroom for the Recreation Center located in Neighborhood 7, Parcel G in Rancho Vistoso. The proposed architecture for the ramada and restroom facility can be described as contemporary. The exterior of both facilities will be of natural stone, with colors to match with the existing structures in the surrounding area. Roof treatment is comprised of flat concrete roof tile with a metal fascia. All the elevations contain some architectural details in the form of stone accents in the form of center score C.M.U. and split face C.M.U. blocks. RECOMMENDATION: Planning Staff has no objection to the approval of the architecture for the ramada and restroom facilities, as presented. SUGGESTED MOTION: I move to recommend approval of OV12-94-21, the Rancho Vistoso, Neighborhood 7, Parcel G, Recreation Center Ramada and Restroom Architecture. OR I move to recommend approval of OV12-94-21, the Rancho Vistoso, Neighborhood 7, Parcel G, Recreation Center Ramada and Restroom Architecture, subject to the following added conditions: OR I move to recommend denial of OV12-94-21, the Rancho Vistoso,Neighborhood 7, Parcel G, Recreation Center Ramada and Restroom Architecture, finding that Attachments: 1. REGULAR AGENDA: C. OV 13-95-55 PULTE HOMES REQUEST FOR PERMANENT SIGN APPROVAL, RANCHO VISTOSO, NEIGH. 5, PARCEL H Kevin Kish presented the staff report. He noted the memo distributed by Linda Frew which stated that the Rancho Vistoso PAD established guidelines for signs. Walt Wind asked why the sign was so large. Ms. Frew answered that entry way signs could be up to 50 feet and this sign met the requirements of the Oro Valley Sign Code. Bill Adler stated that guidelines and standards were used interchangeably in the PAD and he felt the Board should discuss how they were to interpret the two terms. He felt standards were definite and allowed no latitude and suggested this interpretation be used by the Board in reviewing signage. iz S" I13 ft T cos-IG• ----- --'.----- ------- '..---ffIF --ri 1-- - j_ t cl 1.1 .--r,.6.1.... r-/ci,,i., II 8x8XiG r T f T > .M v. - 7 I 1v11'E L L(,/c}2 O a r — 1 I t w I I' 1 i I - , ' - H ter'—"SABxl P-tt' 1 . Ramada Bathrooms and parking lot will be completed by September 15th_ Softball field lighting, and irrigation will be completed by October 15th. We presently have a $121,000 cash bond in place for re-seeding the golf course and the entry road. I would be willing to leave, that bond in place to secure the improvements that we are doing at the park. I know we are behind schedule on completing the park before 40% of the permits were pulled and I apologize for our failure to compete our obligation. We intend to complete the park as quickly as possible and to build a facility that the property owners as well as the Town can be proud of I want to thank you for working with us while we are catching up on our obligations_ I will be out of town from July 8th to Jury 12th but will be available July 15th. According to the adopted PAD ordinance, the master developer (currently Vistoso Partners) is responsible for the installation and construction of these private recreation areas. Upon installation, the operation and maintenance of these facilities becomes the responsibility of the master homeowner association (presently known as the Vistoso Community Association). BACKGROUND: Construction of homes commenced in Neighborhood 7 during the late 1980s. A number of homebuilders, including US Home and Vision began construction in the area during that time. According to these original homebuyers, a number of representations were made that the Neighborhood 7 Recreation Area would be installed "soon." After the Rancho Vistoso PAD was purchased from bankruptcy, a number of new subdivisions were granted approval to develop within Neighborhood 7. Due to the fact that the Recreation Area had not yet been constructed, each of these approvals contained a plat restriction indicating that no more than 40% of each subdivision could be constructed until the Recreation Area was complete. Approved subdivisions that include this plat restriction are Neighborhood 7, Parcel C (UDC Homes), Neighborhood 7, Parcel H (Pulte Homes), and Neighborhood 7, Parcel G (New World Homes and Canoa Homes). Each of these subdivisions have currently reached 40% of their buildout, or are rapidly nearing buildout. CURRENT STATUS: The Recreation Area site is being prepared for construction. Native plant salvage has occurred on the site, the site has been grubbed, and some very preliminary grading work has taken place. The Town Engineer has approved, in concept, a temporary gravel roadway and paved asphalt sidewalk to access the site from Arrowsmith Drive. A great deal of concern has been expressed by both the current homeowners and the builders who are not eligible to receive any further building permits. Although construction has now commenced on the TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 2 of 3 Recreation Area site, there are no guarantees in place to ensure that the facility will be completed in a timely fashion. POSSIBLE SOLUTIONS: The requirement to construct recreational facilities relates to the Town's concern that safe and sufficient recreational amenities be provided to its residents. The Town of Oro Valley has adopted standards that guide the number of acres and facilities that are to be provided for our population. Further, the standards of the various codes strive to ensure that these facilities are constructed in a safe manner. Given the fact that Vistoso Partners has, thus far, failed to provide a recreation area as provided by the PAD ordinance, the Town Council may wish to consider the following solutions: 1) Vote to stay the consideration of any further plats or plan amendments within the Rancho Vistoso PAD. For example, Parcels H and N on this evening's agenda could be continued until such time as the Recreation Area in Neighborhood 7 is complete. 2) Require that a bond, or bonds, be collected to cover the cost of construction. Mr. Dick Maes has indicated verbally that the total construction cost will be between $300,000 and $400,000 for the facility. If a bond, or bonds, are collected, a time frame of four months could be established to complete construction. If construction is not complete in that time period, then the monies would be claimed and the Town would contract to have the facility completed. If a bond, or bonds, are collected, staff would support releasing the homebuilders to continue construction. As the future of the Recreation Area would be secured by the bond, there would be no reason to deny construction during this four month period. RECOMMENDATION: Representatives from Vistoso Partners, UDC Homes, Pulte Homes, and New World Homes will be in attendance at this evening's meeting to discuss the situation. We recommend that the issue be discussed with these representatives and homeowners. Staff finds that alternative #2, above, would provide the optimal solution, ensuring the eventual completion of the facility. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 3 of 3 ;1,frita.)-1`14;10 1l SUGGESTED MOTION: • ' ° I MOVE to REQUIRE that a bond(s) in the amount of$ 7(.O b 10 , be posted with the Town DI Ao of Oro Valley for the construction of the Neighborhood 7 Recreation Area, with the understanding that this V bond will be held for a period of four months. If the Recreation Area is not complete at this time, the Town will claim the bond(s) and contract the construction of this facility. Upon posting of this bond, building permits may be issued for Parcels C, H, and G of Neighborhood 7. ATTACHMENTS: 1. As you know, the Council's action also requires that $60,000 of the golf course bond be transferred over to secure the recreation improvements, bringing the total security to $360,000. Although I see no reason to delay issuance of permits while we deal with the $60,000, we should come to some understanding about how we are going to deal with it. As I understand it, the $60,000 is part of a $121,000-plus certificate of deposit. I propose the execution of a simple document or documents by VISTOSO PARTNERS, the TowN OF ORO VALLEY, and the bank acknowledging the handling of the funds, similar to the documentation which was prepared concerning the $300,000 certificate of deposit. Kyrene Road Tempe, AZ 85283 Dear Mr. Maes: Thank you for meeting with several members of the Vistoso Community Association Park Advisory Committee this evening at the information Center in Rancho Vistoso, concerning the park. As per our meeting, please find a copy of the petition signed by 183 (out of 187) surveyed residents of Rancho Vistoso Neighborhood 7. This petition includes 22 of the 34 members of the Vistoso Community Association Park Advisory Committee, (with several members still unavailable). As we discussed last night, we can not accept the Wildlife Ridge Park (Neighborhood 7 Park) until the park is completed, per the petition (with exception to Item 4). Last night's meeting raised another concern regarding the restroom locks, or lack there of. After exploring many options at one of our P.A.C. meetings, in keeping the restrooms "private", Mark suggested "coded door locks" and explained why it would best serve our needs. We agreed that this added amenity would ensure both privacy and security, as well as reduce the overall maintenance costs. Please refer to the P.A.C. update, dated August 20, 1996 "item b." in which the number coded door and push bar were approved by the VPLLC (enclosed). Thank you in advance for your prompt attention to these concerns, which represent the feelings of 183 of the Association's residents. The following items are a requirement of the approved development plan and under the responsibility of the Planning and Zoning department to monitor for compliance. As of December 20, 1996, these items were not in compliance. Mr. Jim Dawson, a representative of Vistoso Partners met with me on December 20, 1997 for an on-site compliance inspection of the park. Jim and I finished our inspection with the understanding that items not in compliance would have to brought into compliance or a revised development plan submitted to the Town for review. He said he put together a revised development plan and submit to the Town. The last communication on this matter with Jim Dawson was on December 24, 1996 and he indicated he was still working on the revisions and would submit them later. In reference to Ms. Abbott's list of items not in compliance, the following are under Planning & Zoning requirements: * No lines on BB court = Required on sheet L-5,9 of the development plan. * Trash cans sb concrete = Required on sheet L-5,9 of the development plan. 5r Also, apart from the issues raised by Ms. Abbott, the attached memo dated , 1996 indicates items found not in compliance on December 20, 1996 and have not been approved by the Town. 1 MEMORANDUM TO: DON CHATFIELD, PLANNING DIRECTOR FROM: CHUCK SWEET, TOWN MANAGER DATE: JANUARY 8TH, 1997 SUBJ: PAULA ABBOTT PHONE CONVERSATION I talked with Paula Abbott yesterday regarding her concerns about what is left to be finished with the Vistoso Neighborhood Park in Unit #7 . As a member of the Association Parks Advisory group, she wanted to make sure that the Town still understood their position, especially as their position relates to the detention pond. Their position as stated before is still that it should not function with a electrical pump. I have shared that information with David Hook and asked him to speak with his staff about this matter and where we are at on resolving it with Vistoso Partners . Personally, I don' t think the town should settle for anything less than a retention/detention pond that functions as it was approved - with a gravity flow outlet . Paula Abbott also mentioned this "Grand Opening" event that she understood was expected to take place in the next couple of weeks . I informed her that Town was concerned that the park was still unfinished, the detention pond was unresolved, yet people were using the park! I think we need to make some noise on this situation and get a letter off to Mr. Maes regarding the Town' s position on this park. Please see me regarding this matter. Also, at the end of the conversation Paula Abbott shared with me the following items that they feel are yet to be completed by Vistoso Partners : • No Timer for Lights on BB court • No lines on BB court • Parking Lot lights not working • Timer in the Restr oms • Number lock on Women RR broken • Swing Set missing • Partition missing in RR • Trash Cans sb concrete • ADA entrance to Tot Lot missing • Bases for Softball missing • Berm by BB court needed • No ADA access to BB court • 3-WAY STOP AT ARROWSMITH &. WOODBURNE ? I share the above list with you in case some of these items are also a requirement of the town' s inspection of this project . Talk with you later about this project . Chuck Sweet, Town Manager 4 Date: December 5, 1996 TO: Richard Maes, Rancho Vistoso Partners VIA: Don Chatfield, Planning and Zoning Director, AICP FROM: Manuel Padilla, Zoning Inspector RE: RANCHO VISTOSO NEIGHBORHOOD 7, PARCEL G, RECREATIONAL PARK, COMPLIANCE INSPECTION A compliance inspection by the Town of Oro Valley was conducted on November 26, 1996 and found the following requirements not in compliance, they were either in progress or not in place at the park. Landscape requirements: 1. No hydro-seeding in place, Retention basin area required by plan to by hydro-seeded. 2. Trees between baseball field and retention basin not completed, in progress. 3. Retention basin berm not in place as per page L-2 of landscape plan. Requires riprap to be placed on both sides of berm with top soil on top and hydro-seeded. Currently riprap on outside only, no top soil or hydro-seed. 4. Pedestrian trail not completed as required on landscape plan. In some places the trail is in place with DG and then stops, no indication where the trail will pick up again. Also, pedestrian trail is being constructed east of the baseball field, in the natural area and goes through the sandy bottom of the wash. 5. Picnic areas are in place, with the required picnic tables and barbecue grills, but no trash containers as required by the landscape plan are in place on any of the four picnic areas. r Park compliance inspection page 2 6. Bike racks are not designed as shown on page L-8 of the landscape plan. Also, the bike racks (two) on site are portable and not anchored as per plan to concrete. 7. Three feet wrought iron fence around sand tot lot not in place. 8. Niche lights for ramada are not as shown on plan, but are located inside the ramada, in the ceiling area. 9. Park lights for; parking area, sand tot lot, basketball court, pedestrian trail, volleyball court, and bathrooms not in place. First poles were being installed on November 26, 1996. Grading/paving requirements: 1. Seat walls as shown on grading plan are not in place. This seat walls were to be located adjacent [northern side] to the bathrooms and a second seat wall that was to be located just west of baseball back stop. 2. Retaining wall between Woodburne Ave and the parking area not installed. Sheet 3 of the grading plan shows a berm toward Woodburne Ave., and a 36" retaining wall facing the parking area. Instead of a retaining wall, there is a berm only between Woodburne Ave and parking area. 3. A underground drain pipe is shown on the grading plans to be installed from Woodburne Ave [underneath the entrance to the parking area], passes just north of the ramada and drains into the retention basin. On-site, this underground drain pipe has be installed at Woodburne Ave at a point between the tot lot and the basket ball court, goes underneath directly east and drains into the retention basin. This drain pipe from Woodburne Ave was installed in an area that is outside the approved grading limits of the grading plan. 4. Ramps required on two handicap parking spaces may not be in place. Temporary fill is being used in this area to provide access to small loader into park area. Handicap spaces in place with sidewalk from spaces to ramada and bathroom. Ramps needed from parking space onto sidewalk may be buried underneath temporary ramp. 5. Handrail between pedestrian trail and steep slope behind baseball back stop not in place. 6. Access [sidewalk] in place from park, north along Woodburne Ave to Arrowsmith Drive, no curb or paving on Woodburne Ave. No sidewalk or paving on Woodburne Ave south of park. EY qR 0 ry TOWN OF ORO VALLEY 11000 N. LA CANADA DRIVE f* 1 ORO VALLEY ARIZONA 85737 s w Administrative Offices(520)297-2591 Fax(520)297-0428 SUNDEO\ January 14, 1997 Mr. Dick Maes Vistoso Partners 5 861 S. Kyrene Rd Tempe AZ 85283 RE: Recreation Area Completion, Rancho Vistoso Neighborhood 7 Dear Mr, Maes: During late 1996, staff members from the Town's Planning and Zoning Department and Department of Public Works completed inspections of the current state of improvements at the Recreation Area in Neighborhood 7 of Rancho Vistoso. According to our records, the following items remain to be completed: Retention Pond 1. The outlet pipe structure from Woodburne Avenue is installed. The invert of the outlet is at the bottom of the retention pond rather than 2.5 feet above at the same elevation as the proposed bleeder pipe. I am concerned about the potential for ponding on Woodburne Avenue. 2. All sideslopes appear to be steeper than 3:1. The retention pond shall be constructed to meet all Pima County/City of Tucson Stormwater Detention/Retention Manual construction and safety standards for a multi-use retention pond. 3. No erosion control or aesthetic treatment has been applied to the inside slopes of the retention pond. 4. The filter fabric under the riprap on the outside of the berm/weir is not keyed into anything. It appears that there is a good opportunity for erosion under the fabric when the weir is overtopped. 5. The bleeder pipe has not yet been installed. If the bleeder pipe is installed into the riparian area east of the retention pond, a Riparian Area Mitigation Plan will be required. This plan must he considered by both the Development Review Board and the Town Council. ry Mr. Dick Maes Neighborhood 7 Recreation Area Page Two 6. The retention pond appears to be 7 to 8 feet deep, yet the approved plan calls for the depth of the pond to be no more than 5 feet. 7. There is evidence of ponding within the wash/riparian way easterly of the pond. The ponding appears to have been created by the subgrade for Woodburne. At a minimum, a temporary bleeder pipe of sufficient size shall be installed to allow the wash to drain. 8. We have not received any information indicating a percolation rate test has been done for the pond bottom. We will require a copy of the percolation test results for our files. Landscape Installation 1. No hydro-seeding is in place. The retention basin area is required by plan to be hydroseeded. 2. The trees between the baseball field and retention basin have not been installed. 3. The retention basin berm is not in place as per page L-2 of the landscape plan. The plan requires riprap to be placed on both sides of the berm with topsoil on top and hydroseeded. There is currently riprap on the outside only, with no topsoil or hydroseed. 4. The pedestrian trail is not completed as required on the landscape plan. In some places the trail is in place with DG and then stops, no indication where the trail will pick up again. Also, a pedestrian trail is being constructed east of the baseball field, in the natural area and goes through the sandy bottom of the wash. 5. The four picnic areas are in place, with the required picnic tables and barbecue grills. None of the trash containers have been provided at these areas, as required by the landscape plan. 6. The bike racks are not designed as shown on page L-8 of the landscape plan. Also, the bike racks (two) on site are portable and not anchored as per plan to concrete. 7. The three (3) foot wrought iron fence around the sand tot lot has not been installed. 8. Recreation area lights for the following area are not in place: • parking area, • sand tot lot, • basketball court, • pedestrian trail, Mr. Dick Maes Neighborhood 7 Recreation Area Page Three • volleyball court, and • bathrooms. Grading and Paving Requirements 1. The seat walls as shown on the approved grading plan are not in place. These seat walls were to be located adjacent [northern side] to the bathrooms and a second seat wall that was to be located just west of the baseball back stop. 2. The retaining wall between Woodburne Avenue and the parking area has not been installed. Sheet 3 of the approved grading plan shows a berm toward Woodburne Avenue, and a 36" retaining wall facing the parking area. Instead of a retaining wall, there is a berm only between Woodburne Avenue and the parking area. 3. An underground drain pipe is shown on the grading plans to be installed from Woodburne Avenue, passing just north of the ramada and draining into the retention basin. On-site, this underground drain pipe has been installed at Woodburne Avenue at a point between the tot lot and the basketball court. The installed pipe goes underground in an easterly direction and drains into the retention basin. This drain pipe from Woodburne Avenue was installed in an area that is outside the approved grading limits of the grading plan. 4. The ramps required on the two handicap parking spaces may not be in place. Temporary fill is being used in this area to provide access for a small loader into the recreation area. Handicap spaces are in place with a sidewalk from the spaces to the ramada and bathroom area. Ramps are needed from the parking space onto the sidewalk. These may be buried underneath the temporary ramp. 5. The handrail between the pedestrian trail and the steep slope behind the baseball backstop is not in place. 6. An access sidewalk is in place from the recreation area, north along Woodburne Ave to Arrowsmith Drive. No curbing or paving has been provided on Woodburne Avenue. No sidewalk or paving has been provided on Woodburne Avenue south of the recreation area. Per prior approval by the Department of Public Works, at a minimum, a stabilized gravel surface must be applied to Woodburne Avenue and appropriate signage must be installed. Per Council action, and agreement by Vistoso Partners, this recreation area facility was scheduled for completion on November 20, 1996. We are now approaching two months beyond that deadline date, with a substantial number of items to be completed. Mr. Dick Maes Neighborhood 7 Recreation Area Page Four The Town of Oro Valley will require a final inspection on Friday, January 31, 1997. If the above items are not satisfactorily resolved by that point in time, the following action will be taken: 1. No further building permits will be issued in Rancho Vistoso Neighborhood 7, until such time as the recreation area amenities are complete. 2. If amenities are not complete by March 1, 1997, the Town of Oro Valley will claim the remaining assurance bond and contract the completion of the work. In the meantime, please be advised that the Town of Oro Valley considers this recreation area to be incomplete and unsatisfactory for public use. The Town requires that barricades be installed to prevent access to the parking lot. Further, signage must be erected, indicating that the recreation area is closed until improvements are complete. The barricades and signage must be in place by January 17, 1997. Please contact my office if you have any questions. T i ie site ui the trencher will require trimming the limbs of the trees along the alignment. An aerial photograph of the proposed trench alignment has been inciuded which shows the existing riparian habitat. The trenching operation will cause a limited amount or disturoance to the surface of the ground along with the aforementioned tree limb trimming. i ne deveioper is proposing to "hand-dig"those portions of the trench where it passes through the most sensitive areas. Additionally, the alignment will be marked with surveyors tape and each at the workers assigned to the project will be directed to refrain from disturbing any areas outside the limits of the trenching operation. The wash and riparian areas are surrounded by residential development to the east and me park to the west. No additional buffering is being proposed. Due to the limited construction being or000sed there is no anticipated need for irrigation or passive water harvesting. The or000sed trench construction does not destroy any habitat and therefore has no need for a replacement or recreation policy. ITT TA * w Date: January 28, 1997 TO: Don Chatfield, Planning and Zoning Director FROM: Manuel Padilla, Zoning Inspector RE: INSPECTION OF RV NEIGHBORHOOD 7,PARCEL G, RECREATION PARK On January 28, 1997 Steve Faaborge and I visited the park to inspect the progress of items listed on the Vistoso Partner's letter dated, January 20, 1997. Jim Dawson from Vistoso Partner was there and helped identify the progress of each item in review. I informed Jim Dawson that any item not in conformance with the approved landscape plan or development plan, requires an "as built" plan to indicate changes submitted to the Town. He said by when, and I said I didn't know, but would try to let him know by Wed. or Thurs. [ Don, after your meeting with Chuck Sweet]. The update is as follows: Landscape installation: 1. Use of grass in basin, instead of hydroseed. PROGRESS = Grass not in place. Jim Dawson said it will be the last work to be completed within the basin. They first have to bore a hole through the dam/dike, reshape the slope of the basin, plant trees along the upper edge of the basin, and then plant the grass. NEED TO SHOW ON "AS BUILT" PLAN. 2. Trees along the edge of the basin. PROGRESS = Trees not in place. See above, item # 1. I explained to Jim D. that until these trees are in place, the landscaping is not considered to in compliance. NEED TO SHOW ON "AS BUILT" PLAN. 3. Grass on inside slopes of basin. PROGRESS = Grass not in place. See item # 1, and this is a Public Works issue to resolve. RV Park pg. 2 4. The existing ped. trail was built [not per plan]. PROGRESS = Almost finished, different from approved development plan. NEED TO SHOW ON "AS BUILT" PLAN. 5. Concrete trash containers. PROGRESS = Not in place, are ordered and waiting for delivery. Temporarily, Jim has placed metal trash cans with hold downs in place. PERMANENT CONTAINERS MAY NOT BE IN PLACE BY JANUARY 31, 1997. 6. Bike racks; Progress = Bike racks in place and bolted to concrete slab. Design is different from the development plan. The bike racks are white and will be painted green before the park opens. NEED TO BE SHOWN ON "AS BUILT" PLAN. 7. Wrought iron fence for tot lot. PROGRESS = Not in place. Instead a natural berm has been used and palo verde trees planted west and just beyond the tot lot. NEED TO BE SHOWN ON "AS BUILT" PLAN. 8. Lighting for park. PROGRESS = Lights in place. Location of ground cover lights along ped. trail slightly different from development plan. Don, you indicated at our 1/28/97 meeting that the issue of light location would not be a problem. Grading and Pacing 1. Seat walls: PROGRESS = Seat wall completed, not per approved development plan. Seat wall was incorporated onto the base of the ramada. NEED TO BE SHOWN ON "AS BUILT" PLAN. 2. Retaining wall along the west end of parking area to screen parking spaces. PROGRESS = Retaining wall not in place, instead a berm was built up and landscape to serve as screening of parking spaces from WoodBurn Ave. NEED TO BE SHOWN ON "AS BUILT" PLAN. 3. Underground drain pipe next to Gazebo. PROGRESS = This issue is for Public Works to resolve. 4. Two handicapped parking spaces and access. PROGRESS = Two handicap parking spaces installed. Access for handicap person from parking spaces not stripped. Jim explained that their design of the handicap access is for the person(s) to start at the handicap parking space, travel toward the back of the space, around behind the two handicap spaces, through the driveway leading to the parking area and onto the concrete apron that is off the driveway an at "grade", with a slight slope up to the ramada area. No stripping to indicate to vehicle traffic that this is a shared blacktop/pavement for handicap persons [wheelchairs]. I originally interpreted the development which indicates a space between the two handicap spaces as being a ramp onto the sidewalk that is available to non-handicap persons, in front of the parking spaces and leading to the ramada. It seems that Jim Dawson interpreted this same space as the area to be stripped, extra space that is required between handicap spaces. So I don't know which is correct. Steve Faaborg does not support the existing path for wheelchair access and told Jim Dawson of his disapproval. Unfortunately for us, Steve believes it's a planning issue. My opinion is that for very little time and money, a ramp could be constructed within the existing space that was created between the handicap spaces and provide safe access onto the sidewalk. Sidewalk already in place in front of these two handicap spaces. Your's and Chuck Sweets interpretation, but if access is OK as Jim described, do you want this on the "as built" plan or leave out completely, as in compliance? 5. Handrail behind baseball diamond. PROGRESS = Not in place, OK by your previous, administrative approval. 6. Concrete sidewalk. PROGRESS = A concrete sidewalk exists from the intersection of WoodBurn Ave and Arrowsmith to the parking lot area. I believe this has been previously approved. The following items from previous memos on this matter, not addressed by the Vistoso Partner's letter of January 20, 1997. 1. Basketball stripping; PROGRESS = Not in place. Jim Dawson said one quote for this work was around $ 600.00 . He said he was going to strip it himself. I don't believe this will be completed by 1/31/97. 2. With the on going work for the basin, landscaping, DG, and hydroseeding has not been installed west of the basketball court,[ temporary access into the basin from Woodburn Ave. Until the work is completed within the basin, these items can not be completed. I do not believe these items will be installed by the 1/31/97 deadline. VISTOSO PARTNERS, LLC 5861 S. Kyrene Rd., Suite 1 Tempe, AZ 852283 February 12, 1997 Don Chatfield TOWN OF ORO VALLEY 1000 N. C: Chuck Sweet, Town Manager CONSENT ITEM A TOWN OF ORO VALLEY DEVELOPMENT REVIEW BOARD REPORT MEETING DATE: March 11, 1997 TO: DEVELOPMENT REVIEW BOARD FROM: Linda Frew, Planner I SUBJECT: OV12-94-21 Rancho Vistoso, Neigh. 7, Parcel G, REVISED RECREATION AREA PLAN BACKGROUND: In accordance with the adopted master plan for Rancho Vistoso, a portion of Parcel G, Neighborhood 7, was set aside as a recreational facility to serve the present and future residents of that neighborhood. The plan was approved by the Council, based on DRB's recommendations, in 1994. The recreation area, which is 5.4 acres in size, is located on the east side of the Woodburne Ave. alignment, west of New World's future project in Parcel G, and south of Arrowsmith Drive. The park, as it exists today, includes both active and passive types of recreation, i.e. picnicking, a ball diamond, sand volleyball court and one-half basketball court and a tot lot. At this time, the park is nearly complete but, during the course of construction, some deviations from the approved park plan were noted. These changes are depicted on an "as-built" plan, which is before the DRB for a recommendation this evening. SUMMARY: The applicant, Mr. Dick Maes, Rancho Vistoso Partners, has annotated a set of plans I, II and III, to indicate the locations of the "as-built" changes: Rather than the wrought iron fence, which was to partially encircle the tot lot, the applicant has installed a walkway around the play area with bench seating, a convenience for parents who may wish to "get in" some walking exercise, or to simply have a comfortable place to sit, while supervising their youngsters' activities. The aforementioned walkway interconnects all major activity areas within the park, as built. A hydroseeded berm with a "natural hedge" and spaded trees separates the tot lot from Woodburne Ave. II. A wall designed to provide bench-type seating near the back stop area of the ball diamond was deleted and wall seating was installed near the ramada area. It is the applicant's contention that, from this vantage point, near the ramada, good visibility is provided to all activity areas in the park. III. A retaining wall, along the west side of the parking lot area was deleted in favor of a larger (i.e. wider) undulating landscaped berm. RECOMMENDATION: Planning Staff has received information that this park is currently being well-utilized by area residents and we have had no complaints regarding its layout or these specific changes to the original plans. Staff finds that the changes described above meet the intent of the originally approved plan and, in essence, will make the park more user-friendly for parents and children alike. As such, we recommend approval of the "as built" park plans for Rancho Vistoso, Neigh, 7, Parcel G. SUGGESTED MOTION: The DRB may wish to consider one of the following motions: I move to recommend approval of OV12-94-21, the revised recreation area plan for the Rancho Vistoso, Neigh. 7, Parcel G recreation area, as presented. Most all items from previous letters have been addressed. Below are some items that still need clarification. 1 . How will benching in the pond be accomplished. Will fill be brought in? If so, will the appropriate storage volume still be available? Will inlet and outlet pipes have to be extended? 2 . There will be 0 . 9 feet between the inverts of the 6 inch bleeder pipe and the 8 inch bleeder pipe in the catch basin. Therefore there will likely be 0 . 9 feet of standing water within the pond that must infiltrate into the ground. How long will there be standing water in the basin until it all percolates into the ground? If you have questions or comments for me, please call . I can be reached at 797-2442 . Planning and Zoning staff inspected the Park for landscape compliance on February 27, 1997 and reviewed the outcome of the inspection with Jim Dawson of Vistoso Partners. A landscape compliance report was addressed to Bryant Nodine, Senior Planner on February 28, 1997 (attached). The report outlines the status of work completed and work not in compliance. The report also has the approximate dollar value to complete the work not in compliance as provided by Jim Dawson of Vistoso Partners. Based on the request by Mr. Maes to reduce the revegetation bond, a follow-up landscape inspection was conducted on March 28, 1997. The inspection found no further work improvements or compliance different from the status as outlined on the February 28, 1997 memo. Mr. Maes's letter addresses four items and its associated cost to complete. There is a discrepancy on item # 1 on the cost to complete work. Mr. Dick Maes calls out the cost to be $1500.00 to put turf in the detention basin. Mr. Jim Dawson provided staff with a dollar amount of $5000.00 to complete same work. RV Bond page 2 Therefore, if the Department of Public Works is satisfied their requirements are in compliance, the Planning & Zoning department recommends the Town not reduce the revegetation bond to less than $8000.00. This is based on the fact the revegetation bond used to satisfy bond requirements at Neighborhood 7, Park is a roll over from a bond on Neighborhood 11 golf course. The golf course is not in compliance, there is no permanent irrigation system on holes 11 and 12 as required by the approved landscape plan. The Town is holding $8000.00 until the golf course is in compliance. The following is a break-down of items not in compliance. ITEM LOCATION DOLLAR AMOUNT TO COMPLETE 1. Turf in ret. basin Neighborhood 7, Park $5000.00 2. Stripping of BB.Court Neighborhood 7, Park $100.00 3. Hydro-seed wash Neighborhood 7, Park $500.00 TOTAL $5600.00 The recommended amount of bond money to be held for Neighborhood 7, Park is $5600.00, plus 120 percent of the actual cost,= $5600. X 120. The minimum to be held for Neighborhood 7, Park until it is in full compliance is = $6720.00. The recommended amount of bond money to be held for Neighborhood 11, golf course, holes 11 & 12 (lack of a permanent irrigation system) is $8000.00. In the event Neighborhood 7, Park is brought into compliance, $8000.00 dollars need to be held as a roll over back to Neighborhood 11, for golf course holes # 11 & 12 for lack of permanent irrigation system as required by the approved landscape plan for the golf course. F:\DATA\WP\MSP\RVBOND.PRK • 7 ' TOWN OF ORO VALLEY COUNCIL COMMUNICATION MEETING DATE: April 2, 1997 TO: HONORABLE MAYOR & COUNCIL FROM: Linda Frew, Planner I SUBJECT: OV 12-94-21 Rancho Vistoso, Neighborhood 7, Parcel G, Revised Recreation Plans BACKGROUND: In accordance with the adopted master plan for Rancho Vistoso, a portion of Parcel G, Neighborhood 7, was set aside as a recreational facility to serve the present and future residents of that neighborhood. The plan was approved by the Council, based on DRB's recommendations, in 1994. The recreation area, which is 5.4 acres in size, is located on the east side of the Woodburne Ave. alignment, west of New World's residential project in Parcel G, and south of Arrowsmith Drive. The park, as it exists today, includes both active and passive types of recreation, i.e. picnicking, a ball diamond, sand volleyball court, a one-half basketball court and a tot lot. At this time, the park is nearly complete but, during the course of construction, some deviations from the approved park plan were noted. These changes are depicted on an "as-built" plan, which is before the DRB for a recommendation this evening. SUMMARY: The revised park plans include the following changes: • Rather than the wrought iron fence, which was to partially encircle the tot lot, the applicant has installed a walkway around the play area with bench seating, a convenience for parents who may wish to "get in" some walking exercise, or to simply have a comfortable place to sit, while supervising their youngsters' activities. The aforementioned walkway interconnects all major activity areas within the park, as built. A hydroseeded berm with a "natural hedge" and spaded trees separates the tot lot from Woodburne Ave. • A wall designed to provide bench-type seating near the back stop area of the ball diamond was deleted and wall seating was installed near the ramada. It is the applicant's contention that, from this vantage point, near the ramada, good visibility is provided to all activity areas in the park. • A retaining wall, along the west side of the parking lot area was deleted in favor of a larger (i.e. wider) undulating landscaped berm. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 2 of 2 DEVELOPMENT REVIEW BOARD ACTION: The Development Review Board approved the above-referenced changes as a part of its consent agenda on March 11, 1997 with no discussion. The only question that I am aware of is whether or not the bond should be released because we did not install an irrigation system on the revegetation portion of a couple of holes. There is no question that the revegetation is equally developed on all holes throughout the golf course both irrigated and non-irrgated, and has thoroughly grown in to a point that irrigation is not a factor in keeping the desert vegetation alive. Please release the remaining bond, or give me direction as to going back before the council to verify the fact that we have met the revegetation requirements for all areas within the golf course corridors. If there are any questions, call me so that we can resolve this issue. Sincerely, \q/ Dick Maes DMljlr 5861 S.
