ORO VALLEY PLANNING AND ZONING DIVISION
BOARD OF ADJUSTMENT REPORT
CASE NO: OV 10-03-04
Hearing Date: August 26, 2003
Agenda Item No.: 1
Prepared By: Dee Widero, Senior Zoning Inspector
REQUEST: MONTEREY HOMES, 4742 N. ORACLE ROAD, SUITE 111, TUCSON, AZ
85705, REQUEST FOR A VARIANCE TO REDUCE THE REQUIRED
FRONT YARD SETBACK FOR MIRA VISTA SUBDIVISION, LOT 23.
SUBJECT PROPERTY: 11968 N. THORNBUSH DRIVE, ORO VALLEY, AZ
85737.
REQUEST SPECIFICS:
Monterey Homes, request to reduce the front yard setback from 25' to 19.5'. Model #2010 is the
smallest of the approved models for Mira Vista Subdivision.
SITE LOCATION:
This site is located in the Mira Vista subdivision. The site can be reached by traveling north on La
Canada Drive to Tangerine Road turn west(left)travel approximately%2 mile, turn south(left)to the
first street which is Thornbush Drive, turn left follow three lots to the subject project located on the
north side of Thornbush Drive..
NOTIFICATION:
All property owners within 300 feet of this property were notified by mailing of this hearing. The
property is posted with a notice of hearing and the hearing was advertised in the Daily Territorial. At
the time of this report preparation, staff received a phone of concern from Alan Lather and Mr.
Schroeder representing Mira Vista residents, has questions on how to petition in opposition to this
request.
SITE ANALYSIS:
Mira Vista is a 60-lot subdivision, recorded in October of 2000, and is zoned RI-10. It lies south of
Tangerine Road. To the east lies Verde Ranch, zoned R1-7, southwest is Naranja Ranch zoned R-4,
south is Copper Ridge II zoned R1-7 and the west is Copper Ridge I zoned R 1-10.
PLAN ANALYSIS:
The applicant is proposing to reduce the front yard setback from the required 25' to 19.5' from the front
property line for a portion of the third car garage. Lot 23 consists of 13,523 square feet in total area; the
subject model is 3335 square feet.
SUMMARY:
Staff finding of facts:
• Model 2010 could be built without the 3rd car / bonus room or the 3rd car located next to the
two car garage. Either way would require a model revision review.
• The model could be turned at a different angel to fit the lot.
The Board of Adjustment should consider the following findings in making its decision:
A. That there are special circumstances or conditions applying to the property referred to
in the application including its size, shape, topography, location or surroundings
which do not apply to other properties in the district; and
B. That special circumstances were not created by the owner or applicant; and
C. That the authorizing of the variance is necessary for the preservation and enjoyment
of substantial property rights; and
D. That any variance granted imposes such conditions as will assure that the authorizing
of the adjustment shall not constitute a grant of special privileges inconsistent with
the limitations upon other properties in the vicinity and zone in which such property
is located; and
E. That the authorizing of the variance will not be materially detrimental to persons
residing in the vicinity, to adjacent property, to the neighborhood or the public
welfare in general.
SUGGESTED MOTION:
The Board may wish to consider the following motions:
I move to approve OV10-03-04, a request to reduce the front yard setback from the required 25 feet
to 19.5 feet.
OR
I move to approve OV10-03-04 as submitted by the applicant with the following stipulations:
(Staff does not have any stipulations to recommend).
OR
I move to deny OV10-03-04 finding that: (Board to state reason why the variance cannot be granted).

Re: Zoning Variance Request
Monterey Homes
Mira Vista, Lot 23
Respected Members of the Board:
Mira Vista is an existing community located off of Tangerine Road in Oro Valley. The
subdivision plat was recorded in July of 2000 and the community consists of sizeable
lots (average lot size of 12,800 square feet) offering residents mountain views and
dedicated open space. During our marketing period, we offered ten floor plans ranging
in size from 1,900 square feet to 3,200 square feet with average sales prices exceeding
$300,000.
Contained herein, I would like to present some additional information, which I believe is
crucial in your consideration of this variance request. The information is as follows:
Monterey Homes is asking for a very minor setback variance, which simply consists of
placing a small corner (approximately 3'4") of the front, side-load garage into the
existing setback area as dedicated by the recorded final plat. It is our belief that by
granting the requested variance, this will enable us to maintain the streetscape, curb
appeal and integrity of the community. Please refer to the enclosed exhibits illustrating
the elements of the requested variance should you grant approval.

Monterey Homes further understands that we could fit the home on the site without
asking for any consideration from the Board of Adjustment, however, by disallowing this
variance request and placing the home this way would be unorthodox as well as
inconsistent with the existing appearance of the community. Furthermore, this
placement is liable to adversely affect the appearance of the adjacent homes. Please
refer to the enclosed exhibits illustrating the elements of the requested variance should
you deny approval:
Exhibit 2A Side facing photograph of actual lot (taken 8/15/03)
Exhibit 2B Footprint illustrating allowable placement of house without
variance
Exhibit 2C Simulated representation of lot illustrating allowable
placement of house
Monterey Homes respectfully requests the Board's thorough consideration and
subsequent approval of the above-proposed variance request.
Thanking you in advance for consideration of this variance request. Should any
questions or concerns arise during the review process, please do not hesitate to contact
me at (520) 292-2082.

ORO VALLEY BOARD OF ADJUSTMENT
AUGUST 26, 2003
ORO VALLEY TOWN HALL COUNCIL CHAMBERS
11,000 N. LA CARADA DRIVE
CALL TO ORDER: 3:03 p.m.
ROLL CALL
PRESENT: Bill Adler, Vice Chairman
Lyra Done, Member
Bart Schannep, Member
Colleen Kessler, Member
EXCUSED: Cindy Lewis, Chairperson
MINUTES: Approval of the May 27, 2003 minutes.
MOTION: Member Done moved to approve the May 27, 2003 minutes
with the corrections noted. Member Schannep seconded the motion.
Motion carried, 4-0.
ELECTION: Election of the Chair and Vice Chair
Vice Chairman Adler moved the election of the Chair and Vice Chair to
follow Item 2.
1. CASE NO. OV10-03-04 MONTEREY HOMES, 4742 N.
ORACLE ROAD, SUITE 111, TUCSON,AZ 85705, REQUEST
FOR A VARIANCE TO REDUCE THE REQUIRED FRONT
YARD SETBACK FOR MIRA VISTA SUBDIVISION, LOT 23.
SUBJECT PROPERTY: (PARCEL #214-08-3340) 11968 N.
THORNBUSH DRIVE, ORO VALLEY, AZ 85737
Vice Chairman Adler swore in the witness that was intending to testify.
Rudy Carrillo, representing the applicant, explained that Monterey Homes
11/10/2003
Message Page 2 of 6
was requesting a zoning variance for Lot 23 located in the Mira Vista
Subdivision in regards to the front yard setback. He explained with out the
variance the home would encroach into the front yard setback
approximately 4 feet creating a 21 feet front yard setback. He proceeded to
use photos and charts depicting the current layout of the proposed home
with the proposed revisions that would be made to the plot plan.
Vice Chairman Adler explained that the 5 standards were critical to the
Board in making their decision and the standards must be met in order for
the Board to grant a variance. He asked if the applicant would take a
moment to elaborate on the explanations given on the application that
addressed the 5 standards.
Mr. Carrillo explained that in his opinion the configuration of Lot 23 would
be the special circumstances because the shape of the property does not
allow the home to be placed in a manner that would be aesthetically correct
and consistent with the neighborhood.
Dee Widero, Senior Zoning Inspector, reported that Monterey Homes
explained that the applicant was proposing to reduce the front yard setback
from the required 25 feet to 19.5 feet from the front property line. She
added that model#2010 was the smallest of the approved models for the
Mira Vista Subdivision. She reported that at the time of the report
preparation, staff received phone calls and letters of concern from a Mr.
Lather, Mr. Schroeder and Mr. Austin , who were in opposition to the
request.
Staff finding of facts:
• Model 2010 could be built without the 3rd car garage or the 3rd car
garage could be placed near the two car garage portion of the home.
She added that in either case the modification would require a model
revision review by the Development Review Board.
• Staff clarified that the model could not be turned at a different angel.
Member Kessler pointed out that after reviewing the report, there were no
models available that would fit the lot. She asked if model #2010 was the
smallest model in square footage that could be used on the lot.
Ms. Widero replied, "That is correct."
Member Done pointed out that according to the design created by
Monterey Homes, the matrix reflects that there was no model available that
would fit on Lot 23.
Ron Teaney, 1581 East Deer Shadow Lane, a representative from
Monterey Homes, explained that the matrix information submitted may
have been done incorrectly because there was 1 plan that would fit the lot,
but the information might have slipped through the cracks.
11/10/2003
Message Page 3 of 6
In answer to a question from Vice Chairman Adler, Joe Andrews explained
that regardless of any information possibly slipping through the cracks, the
Board of Adjustment would only need to address and focus on the 4 foot
setback request for variance.
Vice Chairman Adler opened the public hearing and swore in the witness
that was intending to testify.
Frank Combs, 11905 North Thornbush, had concern that the value of his
property might depreciate because of the revisions and setback made to the
home on Lot 23; and whether Model #2010 was the smallest home
available. He felt that the home demographics would be significantly
different from the other homes in the neighborhood.
Vice Chairman Adler swore in the witness intending to testify.
Linda Hatheway, 1726 West Copper Sky Drive, opposed the construction
of the home and stated that if the builder had a problem with the model
fitting, the builder should have offered a smaller
home. She agreed that demographics of the home would not be copasetic
with other homes in the neighborhood. Vice Chairman Adler swore in the
witness intending to testify.
Bill Austin, 11916 North Thornbush, had concerns that some of the
residents within 300 feet had not received proper notice of the hearing. He
stated that Monterey Homes knew that there would be problems with the
lot and should have made allowances for a home that would fit on the lot
without a variance. He stated that he was opposed to moving the home
forward and asked that the Board deny Monterey Homes the variance as
well as any other alternative revisions.
Vice Chairman Adler swore in the witness intending to testify.
Alan Lathrem, 1750 West Tangerine Road, had mixed feelings about the
variance request felt feel the builder should have done their homework and
realized that there would be problems designing a home to fit on Lot 23.
Also, he agreed that the Town had not done a very good job in notifying
the residents in the surrounding area.
Vice Chairman Adler swore in the witness intending to testify.
Margaret Lujan, 11880 North Thornbush, suggested placing a smaller
home on the lot, otherwise the Board should deny the request for a
variance.
Vice Chairman Adler swore in the witness intending to testify.
Tom Snider, 11972 North Thornbush Drive, explained that he had not
received notification of the hearing and was opposed to the change in
setbacks.
11/10/2003
Message Page 4 of 6
Vice Chairman Adler closed the public hearing.
MOTION: Vice Chairman Adler moved to DENY the request for
variance for Case No. OV 10-03-04, finding that the request failed to meet
finding#1 that addresses the special circumstances on the property.
Member Schannep SECONDED the motion.
Discussion: Member Done stated that it was questionable that Item B in the
application had been met as well since the developer had platted the land in
the beginning of the development plan for the subdivision.
Motion carried 4-0 to deny Case No. OV 10-03-04
2. REQUEST TO THE TOWN ATTORNEY FOR
CLARIFICATION ON THE ORO VALLEY ZONING CODE
REVISED SECTION 1-709.A, FINDINGS. Specifically, does the
term "property", and by extension the term "special
circumstances or conditions", in the referenced section apply to
just the land or does it include improvements.
Joe Andrews, Civil Attorney, informed the Board that Town Attorney
Mark Langlitz was unable to attend the meeting to address their questions
regarding this matter and has requested that this item be continued to a later
date.
MOTION: Member Done moved to CONTINUE Item 2 to the next
regularly scheduled meeting. Motion SECONDED by Member Schannep.
Motion carried, 4-0.
ELECTION OF THE CHAIR AND VICE CHAIR
MOTION: Vice Chairman Adler suggested rotating the positions of the
Chair and Vice Chair
between the Board members so that each member would be given an
opportunity to have the
experience of running a regular meeting, special meeting or study session.
Member Done announced that she would be unable to continue to serve on
the Board of
Adjustment. She explained that she would be serving on the Budget and
Bond Committee, but
would attend the Board of Adjustment meetings as long as necessary until a
new member was
appointed.
AMENDMENT TO MOTION: Member Schannep suggested that the
board assign a new
chair and vice chair for each regularly scheduled meeting by using the first
11/10/2003
Message Page 5 of 6
letter in their last
name and placing them in alphabetical order. He recommended that the
same strategy be used
for the vice chair rotation as well. He inquired if there would be a point
when the chair person
would be required to attend any functions as a representative of the Board.
Vice Chairman Alder explained that a member of the Board would not be
considered or invited
to participate in any outside activities other than the Board of Adjustment
meetings.
The Board agreed that the rotation would occur only for regularly
scheduled meetings.
Vice Chairman Adler suggested that the minutes of each scheduled regular
meeting reflect who
would be serving as chair and vice chair at the next meeting.
MOTION carried, 4-0.
Vice Chair Adler announced that a special meeting would held in
September to
address Item 2 - Request To The Town Attorney For Clarification On The
Oro Valley
Zoning Code Revised Section 1-709.A, findings. Specifically, does the
term "property", and by
extension the term"special circumstances or conditions", in the referenced
section apply to just
the land or does it include improvements.
PLANNING AND ZONING UPDATE
No report.
ADJOURNMENT
MOTION: Member Done moved to ADJOURN the meeting at 4:39 p.m.
Member Schannep
SECONDED the motion. Motion carried, 4-0.

RE: Case No. OV10-03-04, Parcel#214-08-3340, Monterey Homes request for variance
approval to reduce the front yard setback for lot 23 at Mira Vista Subdivision.
Dear Mr. Carrillo & Mr. Teaney:
At their regular meeting of August 26, 2003, the Board of Adjustment voted to deny your
variance request for the subject parcel. The motion was as follows:
MOTION: Vise Chairman Adler moved to deny the request finding that the request
fails to meet finding #1 of which addresses the special circumstances on the property.
Stating that the property is not imposing the special circumstances but the design of the
home but has failed to be met, therefore, it would be impossible to make a motion
otherwise.
Additional information on the action will be available when the minutes have been prepared
by the Clerk's office. Please contact Linda Hersha at 227-4700 regarding the minutes and
contact me if you have any other questions or concerns, at 229-4812, I would be happy to

DEVELOPMENT REVIEW BOARD REPORT
MEETING DATE: Dec. 12,2000
TO: DEVELOPMENT REVIEW BOARD
FROM: Michael Shanley, Planner I
SUBJECT: OV13-00-72 MODEL HOME ARCHITECTURE, MIRA VISTA, LOCATED
SOUTH OF TANGERINE ROAD BETWEEN LA CANADA DR AND LA
CHOLLA BLVD.
BACKGROUND:
Mira Vista is south of Tangerine between La Canada and La Cholla Drives. The area was rezoned
from R1-144 to R1-10 in conformance with the General Plan, resulting in lots with a minimum size
of 10,000 sf._ The property was rezoned and platted in 1999 with 60 lots and several common areas
on 32.88 acres. Setbacks are 25 ft. front and rear, and 10 ft. for the side yards. This subdivision is
abutted on the south by Copper Ridge II subdivision, zoned R-7, and on the west by Copper Ridge
I, zoned R1-10. The land on the east and north is undeveloped property, zoned R1-144.
The subdivision lies within the target and peripheral zone of the Tangerine Road Corridor Ovelay
District (TRCOD). Overlay district regulations apply to all property within 1.0 mile of the
Tangerine Road centerline. The conditions of rezoning and subdivision plat approval included
methods for alleviating adverse visual impacts created by developments visible from the Tangerine
Road public ROW. In particular, a 100 ft. wide additional ROW was required by the final plat, and
50 ft. Landscape Buffer. This additional buffer will help preserve the views along the corridor.
SUMMARY:
The Monterey Homes Company has proposed architecture for nine (9) model homes. The
proposed structures are single story homes and three 2-story homes that range from 1,980 to 3,211
sf of living area plus entry, garage and patios. The heights from grade to the highest roof ridge
range from 16 to 24.5 ft. The builder has constructed a few of the models in Sweetwater Reserve
(Pima Co., east of 1-10)and Sabino Valley, which is in eastern Tucson.
OVZCR Design Guidelines, Sec. 16-103E. Residential Guidelines, encourages diverse street
character to create interest and variety while maintaining the harmonious context of a
neighborhood. This may be accomplished in various ways such as landscaping treatment, setbacks,
and architectural themes. Staff has met with the applicant and agreed to modify some of the model
architecture, supplement the standard front yard landscaping with added elements such as boulders,
and also to vary the setbacks in an attempt to avoid a"tunnel affect" streetscape that is dominated
by garages. Conditions have been included in Exhibit "A" that address this modification, and are
summarized as follows:
Modifications as conditions of approval
Model Plan Size. Added requirements for approval
1 story Extend covered porch 7ft along
1020 1980 sf garage wall to meet
Design Guideline Sec.
16-103E.3
2 story Add popout columns on the lower
1030 2372 sf corners of the garage to
1040 2684 sf provide setback relief
1050 2899 sf
All models in the neighborhood. 9 models Supplement the standard OVZCR
Front and side yards of individual as needed requirement of 2 trees in the front yard
lots need to vary street character. with additional themes to include rock
boulders, sideyard'shrubs, ground cover.
All models in the neighborhood 9 models Every house to be offset by one (1)ft.
as needed from the adjacent house. If not possible
due to setback limitations, exceptions to be
reviewed and granted by the P&Z Adm.
Each model has 4 elevations available that may be described as a Southwest Traditional style,
finished in stucco, with a two-car garage and an optional third garage on the larger plans. All
models feature pitched roofs, covered entries, and sectional metal garage doors, which are
available with or without windows, depending on the selected elevation.
The four elevations are available for all nine models and include twelve (12) different color
schemes. Generally, the colors are darker than houses built in the adjacent subdivisions and include
4 - 6 colors for each of the elevations. There are three (3) color schemes available with curved roof
tile, and there are nine (9) color schemes of concrete flat shingle tile. Please refer to the packet
material for the proposed color schemes.
Elevations A,B,& C, incorporate a 4 inch wide "stucco popout accent" located 6 feet above grade.
Additional 10 inch wide stucco offsets are included above the garage. Elevation "D" also includes
a beige flat stone accent around the garage and entryway. The two story homes will have added
popout columns on the garage corners to produce an offset. Exhibit "A" adds this condition to
include garage corner columns.
SITE CONDITIONS:
The site is not yet developed and the second submittal of the grading plan is being reviewed
presently. The plans have been checked against the plat to assure that these house sizes will meet
the setback requirements for all lots. Some of the plans do not fit the 10,000 ft. lots in terms of
building height and setbacks. In order to avoid future variance requests, a condition has been
established to restrict specific models to specific lots. Monterey Homes has created a matrix that
depicts which model(s) may be built on a specific lot. The matrix has been incorporated into this
report as Exhibit`B", Table of Lot Fit Analysis.

TANGERINE ROAD CORRIDOR OVELAY DISTRICT(TRCOD):
Impacts of the development visible from Tangerine Road can be avoided in accordance with Sec.
10-006C (OVZCR),Residential Style Considerations. These criteria include low profile rooflines,
indigenous colors, and materials of construction such as masonry to mitigate noise. Additionally,
adverse visual impacts have been partially accomplished during platting through dedication of an
additional 100 ft. of ROW and provisions for a 50 ft. Landscape Buffer. The buffer includes the
use of indigenous desert plants.
All structures within 100 ft. of the Tangerine Road centerline shall not exceed 18 ft. in height per
OVZCR 10-005A. Per the Plat General Note No. 10, lots 4, 5, 21 through 24, 39 and 40 are
restricted to 18 ft. Only single story models may be built on these lots. Models 1030, 1040 and
1050 are the only 2 story models and the Table shown as Exhibit "B" correctly reflects this
information. A condition in Exhibit"A"is included to assure compliance with height limits.
PRESENTATION REQUIREMENTS:
As established in Resolution No. (R) 98-31, "all presentations before Boards, Commissions, and
Council" must be formatted to be shown on the Town's projection system or overhead system. A
presentation must be designed to insure that the audience, staff, and the voting body can view the
graphics. Examples of acceptable computer formats are PowerPoint, ArcView, videotape of
presentation boards, and/or overhead transparences. The applicant is responsible for the
development, presentation, and coordination of all presentation materials. If an applicant does not
conform to the aforementioned resolution, the item may be continued due to non-compliance.
GENERAL PLAN COMPLIANCE:
This request for approval of the nine (9) models complies with the General Plan's Community
Design Element policies, and specifically Policy 9.1 A, in that, the color scheme will make use of
tones that will blend the built environment with the natural surroundings. In addition, all four sides
of the home have been"coherently designed and treated".
RECOMMENDATION:
Planning Staff finds that the architecture proposed is compatible with other homes in the
surrounding subdivisions. The proposed architecture complies with the OVZCR and General Plan.
As such, we recommend approval of this request as part of this evening's agenda, with the
conditions in Exhibit"A".
