This Is an excellent way to solve the aesthetic problem of having an antenna sticking up in the air. In addition, we have terrible cell phone coverage in Neighborhood 11 and around the Golf Club at Vistoso so this will help solve the problem. The original proposal was to have the flagpole by the cart barn at the Golf Club at Vistoso. Tynan Group proceeded to process a variance far the flagpole and received it from Oro Valley. That is about when I became involved and realized that Tynan wanted the flagpole to be a permanent structure which would be there for 20-30 years. This will not work since the cart barn is temporary and may be moved after a permanent clubhouse is built. What I would like to get approved is the relocation of the flagpole and the operations shed down to the Golf Course maintenance building off Pebble Creek Drive_This way, the flagpole and the maintenance shed can be incorporated In with a permanent building and would be easier to blend in with existing facilities. Would it be possible to transfer the flagpole approval from the Golf Club cart barn to the Golf Club maintenance building without going through a new variance request? Please give me a call at 602-541-1198. DESERT SKY CLUB, #2, ORO VALLEY, AZ 85737, REQUEST FOR A VARIANCE TO INCREASE THE HEIGHT FOR A FLAG POLE/ANTENNA INSTALLATION IN A PLANNED AREA DEVELOPMENT ZONE TO A HEIGHT OF 50'. SUBJECT PROPERTY: LOCATED AT THE VISTOSO GOLF MAINTENANCE FACILITY, 955 W. PEBBLE CREEK, ORO VALLEY,AZ 85737. As part of the AT&T Wireless Service's (ATTWS) ongoing network and service improvement, engineers at ATTWS have identified the need for a Personal Communications Service facility to serve the Rancho Vistoso Neighborhood 11 area. Under current zoning regulations for flagpole installation, the code states that the maximum height can not exceed 1.25 x the height of the adjacent structure. The minimum height necessary for the facility is 50' requested by the engineers. The height of the Maintenance Facility is not greater than 20', which would dictate a flagpole not to exceed 25'. Subject property location, The Vistoso Golf Maintenance Facility, 955 W. Pebble Creek,Oro Valley,AZ 85737. REQUEST SPECIFICS: As part of the AT&T Wireless Service's (ATTWS) on going network and service improvement, engineers at ATTWS have identified the need for a Personal Communications Service facility to serve the Rancho Vistoso area. Under current zoning regulations for flagpole installation, the code states that the maximum height can not exceed 1.25 x the height of the adjacent structure. The Vistoso Golf Maintenance facility is approximately 22', which would dictate a flagpole not to exceed 27.5'. The applicant states that 50' is necessary in order to provide an adequate height for the telecommunication facility. The applicant has not addressed the finding in their application, but will be present at the hearing. SITE LOCATION: To reach the requested location, drive from either direction on Rancho Vistoso Boulevard around to Vistoso Highlands Drive, turn west, the first street to the south (left) is Hidden Springs Drive turn left. The first street to the west is Pebble Creek follow until you arrive at the Maintenance facility(955 W. Pebble Creek). Take your detailed map for on site location. NOTIFICATION: All property owners within 300 feet of this property have been notified of this hearing. The property has been posted with a Notice of Hearing and the Hearing Notice has been advertised in the Daily Territorial newspaper. At the time of report preparation, staff had received one letter from Lanna Conrad in opposition and Dick Maes with Vistoso Partners has supplied a letter in support,no other comments in support for or in opposition to this request have been received. SITE ANALYSIS: The area surrounding the Flagpole/Antenna site is all Planned Area Development; the Maintenance facility is within the Vistoso Golf Course; to the south high density residential Neighborhood 10, Parcels O&P; on the north is Vistoso Golf Casitas II and the northeast is Vistoso Resort Casitas. PLAN ANALYSIS: The applicant is proposing to install a flagpole/antenna (antenna camouflaged as a flagpole, know as stealth antenna, cell tower). This site was chosen because it is a permanent maintenance facility. The Rancho Vistoso Partners have given approval for this as a permanent location. The facility is meant to serve customers in and around the site location. SUMMARY: Staff finding of facts: • The Golf Maintenance Facility is not greater than 22' in height, zoning allows a maximum height of 27.5', AT&T is asking for an additional 22.5' above maximum allowed and 28' above the adjacent building. • The flagpole/antenna location is approximately 400'to the nearest residence. • The site location requested for variance, sits 10' below grade of Vistoso Highlands Drive. • If this variance request is approved, the applicant will then need to submit to the Development Review Board for approval. • The residents of the area may benefit from the telecommunication facility; the findings have not been meet. The Board of Adjustment should consider the following fmdings in making its decision: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. That special circumstances were not created by the owner or applicant; and C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property,to the neighborhood or the public welfare in general. SUGGESTED MOTION: 2 The Board may wish to consider the following motions: I move to approve OV 10-00-11,a request to allow a stealth antenna installation(cell tower) as a flagpole. OR I move to approve OV 10-00-11,as submitted by the applicant with the following stipulations: (Staff does not have any stipulations to offer) OR I move to deny OV 10-00-11, fmding(Board to state reason why the variance cannot be granted) that: . The flagpole will provide a vertical structure in which the antenna for a new telecommunication facility will be mounted. Approval of a height variance for the flagpole would allow ATTWS to develop a new wireless facility with the least obtrusive and most aesthetically pleasing installation possible while also providing quality service coverage to the residents of Oro Valley. Identify difficulties or problems that would result from complying with the present zoning requirements. As part of the AT&T Wireless Services's (ATTWS) ongoing network and service improvement, engineers at ATTWS have identified the need for a Personal Communications Services (PCS) facility to serve the Stone Canyon / Rancho Vistoso area. Based on a computerized engineering study considering the local population density and topography, engineers at ATTWS have issued a "search ring" identifying the necessary location for a PCS facility in the area. This search ring represents an area in which a facility must be located to allow it to function as an integral unit in the PCS system. PCS facilities are laid out in a grid pattern and the spacing, height and location of this component site is critical for the successful operation of the overall system. The proposed flagpole antenna installation adjacent to the Vistoso Golf Course Maintenance facility meets the engineering criteria. The immediate area of the search ring for Stone Canyon is residential and resort / club in character and offers no opportunity for collocating on an existing structure. In order to meet the engineering height requirement, a structure was needed on which the antennas could be mounted. Utility poles and light standards as well as flagpoles have been used by the carriers to meet the height requirement. These installations are stealth in nature defined as the camouflaging of an antenna array to integrate the antenna with the structure in terms of design, color and material. In this case, the antenna is fully contained within the structure of the flagpole Under current zoning regulations for flagpole installations, the code states that the maximum height can not exceed 1.25 x the height of the adjacent structure. The Vistoso Golf Maintenance facility is estimated to be approximately 20' which would dictate a flagpole not to exceed 25'. If built according to current zoning regulations, the flagpole would not provide the required height for the telecommunication facility. AT&T Wireless Services requests that a height variance be granted for the proposed flagpole / antenna installation. The minimum height necessary for the facility is 50'. This height is necessary to have the antennas "clear" the adjacent two story apartment complex. If a height variance is granted for the flagpole, the proposed telecommunication facility, defined as a Minor Facility, will be reviewed by the Design Review Board for final zoning approval. 2. Identify and explain all unique and particular circumstances that would prevent you from complying with the present zoning requirements on your property in regard to the following areas (slope, narrowness, shallowness, irregular shape, location, washes, vegetation, and easements, etc.). The location of the flagpole at the front of the Maintenance facility has been selected to be fully integrated in the design and function of the existing facility. As previously stated, the request variance of 50' would allow the antennas to send a clear signal over the adjacent two story apartment complex. 3. Identify and explain any particular conditions in the surrounding area, which would keep you from complying with the present zoning requirements. There are no existing structures with the required height for the collocation of antennas for a new ATTWS facility within the surrounding area. PCS facilities are designed to cover a small geographic area, frequently a two to four mile radius from the site. The proposed site is designed to provide coverage to the immediate area. Residents in and around the site location as well as patrons of the golf course and clubhouse facilities will be direct beneficiaries of the improved communication services. Cellular phones are no longer considered to be a luxury but a necessary service for residents. The use of cellular phones has become an effective tool in emergency situations. 4. Provide the following: Current list of property owners See attached Thirteen Copies of dimensioned preliminary site plan See attached Thirteen Copies of dimensioned floor plan N/A An estimate of the incremental cost of the change in, or additions to, the property, such as estimated cost to be endorsed as accurate by licensed contractor or engineer. Administrative Secretary Dan Dudley, Town Attorney Dee Widero, Sr. Zoning Inspector Shirley Gay, Assurances Clerk Melissa Shaw.Planner 11 Bayer Vella, Senior Planner MINUTES A MOTION was made by Member Bill Adler and seconded by Vice Chairman Thresher to approve the minutes of June 27, 2000. Motion carried 3-0. Chairman Swan moved Item #2 forward on the agenda with Item #1 to follow. 2.OV10-00-11 AT&T WIRELESS PCS SERVICES,INC.REQUEST A VARIANCE TO INCREASE THE HEIGHT FOR A FLAG POLE/ANTENNA INSTALLATION IN A PLANNED AREA DEVELOPMENT ZONE TO A HEIGHT OF 50'. LOCATED AT THE VISTOSO GOLF MAINTENANCE FACILITY,955 WEST PEBBLE CREEK Bryant Nodine,Planning and Zoning Administrator explained that there were a couple of issues surrounding the request for a variance for the height of a flagpole/cell antenna. The issues have been discussed with the Town Attorney. One is whether this will be classified as a major or a minor facility. He explained that if this is classified as a major facility, staff would not be able to handle the request for variance the way it has been presented at this time. The seconded is determining the zoning or parcel on which the 7/25/2000 Minutes,Board of Adjustment 2 facility is located. He stated that for these two reasons staff is recommending that this item be continued until the next meeting. MOTION: Vice Chairman Thresher MOVED to CONTINUE Item Case No. OV10- 00-1 l to the August 22"d meeting. Member Adler SECONDED the motion. AMENDED MOTION: Chairman Swan MOVED to POSTPONE the motion until after the petitioner has spoken. Motion SECONDED by Vice Chairman Thresher. Motion carried 3-0. Chairman Swan swore in the petitioner that was intending to testify. Martha Kuenhold, Tynan Group, Representing AT&T Wireless Services stated the following: • The code as it is currently written is difficult to work around; it is also difficult for the carriers to work through the code if they are not getting a clear direction on which way to proceed. • This request would also include a height and parking variance for a future flagpole. Mr. Nodine reiterated that it had not been determined whether the structure was a major or minor facility, therefore staff could not specifically create a variance. Member Adler explained that because of the lack of information available on the subjects discussed.the Board will be unable to make a decision at this time. MOTION: Vice Chairman Thresher MOVED to CONTINUE Case No. OV I 0-00-1 I to the next meeting of the Board of Adjustment on August 22"d. Member Adler SECONDED the motion. Motion carried, 3-0. 1.OVI0-00-10 LEWIS & ROCA LLP LAWYERS,REPRESENTATIVES FOR EVERGREENS DEVCO,REQUEST FOR VARIANCE FORM SECTION 10- 004.A.1 OF THE ORO VALLEY ZONING CODE REVISED TO ALLOW A SECOND CURB CUT ON TANGERINE ROAD. SOUTHWEST CORNER OF TANGERINE AND FIRST AVENUE Dee Widero, Senior Zoning Inspector, reviewed the staff report. She reported that the applicant has requested a variance from the Tangerine Corridor Overlay District section l 0-004.A. Evergreen Development would like two access points along Tangerine Road, approximately 300 feet from one another. The easterly curb cut on Tangerine Road will be limited to right-in/right-out only. Staff findings of fact: • The special circumstances would be the size of the site, and location in conjunction with the arterial intersection of Tangerine Road and First Avenue. • Special circumstances are due to type of development. • Authorizing this variance will improve traffic circulation for the general public as 7/25/2000 Minutes,Board of Adjustment well as retail deliveries. • Variance approval will grant special privileges • Allowing this variance will not be materially detrimental to the surrounding vicinity. • This will be a long-term temporary access, by the year 2015 the road and intersection improvements must be complete. Chairman Swan swore in the petitioner. Keri L. Silvyn,Lewis and Roca Law Firm, representing Evergreen Devco, Inc. Ms. Silvyn explained that the property consists of approximately 11.18 acres, zoned C-2. Evergreen intends to develop the commercial center in two phases. Phase 1 will include the Walgreens store, landscape, frontage improvements, curb cuts and access driveways. The construction of the remainder of Phase 1 and Phase 2 would take place at a later date. Evergreen is currently seeking a Conditional Use Permit(CUP) and has begun to process a Development Plan for the property. Ms. Silvyn explained that because of the Tangerine Overlay District, Evergreen has had extensive conversations with the Town of Oro Valley Public Works Department and Arizona Department of Transportation (ADOT)to discuss the number of access points and any restrictions along Tangerine Road. Neither ADOT nor the Town had a problem with the two access points as shown on the Development Plan. In conclusion, she explained that the property is being developed as a cohesive commercial center with five relatively small buildings along the perimeter of the site and one 28.000 square foot office building. The parking and traffic circulation for each structure are not independent of one another. The development shares parking and circulation as one center. In order for traffic to enter and exit safely and for traffic to maneuver within the commercial center safely, two ingress/egress points need to be available along Tangerine. Staff has requested and Evergreen has agreed to a condition to limit the easternmost curb cut on Tangerine to a right-in/right out only turning movement. Chairman Swan swore in the petitioner that was intending to testify. Keri Silvyn and Greg Albert, representatives for Evergreen gave and overview of the site plan. Chairman Swan asked if the widening of Tangerine Road and First Avenue intersection had been discussed. Mr.Nodine explained that the Development Plan was under review in terms of any traffic improvements and off site improvements that would be required. He explained that the right-in/right outs have been discussed and additional lanes are being considered. The only issue that is in question is whether there would be a left turn lane not an acceleration/deceleration lane. 7/25/2000 Minutes,Board of Adjustment 4 Member Adler stated that he was not convinced that the access was necessary for public safety internally or externally. He felt that this would be a detriment and not an asset. Ms. Silvyn explained that as part of the Development Plan process, a traffic engineer was hired to prepare an extensive traffic impact analysis for the property. She stated that the report concludes that the Development Plan presented is a sound traffic engineering plan for both Tangerine Road and First Avenue, particularly for public safety. She proceeded to give an overview of the Development Plans. Mr.Nodine explained that if this were a street without an overlay district, it would meet all engineering standards. He explained that staff was not looking at this as being a permanent access onto Tangerine Road and when the limited access roadway is created, these access points will be re-directed to a frontage road. Members Adler stated that unless the road is dramatically improved the intersection would be very dangerous. Ms. Silvyn explained that Evergreen was working with ADOT and the Town to create a left-hand turn that would not be a hazard to sight visibility. Member Adler asked if it was appropriate to approve and add conditions to the variance before the improvements are complete and sight visibility was insured. Dan Dudley, Town Attorney explained that as long as the applicant and the members of the body do not appeal, anything is permissible. Chairman Swan opened the public hearing. There being no speakers, Chairman Swan closed the public hearing. MOTION: Member Adler MOVED to APPROVE Case No. OV10-00-10 as submitted by the applicant with the following stipulations: the westerly curb cuts applied for will not be opened for use until the improvements of Tangerine Road are completed and has met the condition by ADOT and/or the Town Engineer. Vice Chairman Thresher seconded the motion. ROLL CALL VOTE Member Adler—aye Vice Chairman Thresher—aye Chairman Swan—aye Motion carried, 3-0. 7/25/2000 Minutes,Board of Adjustment c 3. OV10-00-12 LANTANA CORPORATION REQUEST A VARIANCE TO THE NARANJA RANCH PLAT FOR THE REQUIRED FRONT& REAR YARD SETBACKS IN ZONE R-4. 11789 NORTH VIA DE LA VERBENITA,LOT 97 OF NARANJA RANCH I SUBDIVISION Dee Widero, Senior Zoning Inspector reviewed the staff report and gave an overview of the lot using the overhead projector. She reported that the applicant is proposing to reduce the front yard setback from 20 feet to 15 feet and the rear yard setback from 25 feet to 10 feet. Due to the shallowness of this corner lot,the approved model #2218 is the closest fit for this lot and will need a variance approval in order to comply. Staff finding of facts: • The shape of lot creates special circumstances or conditions. • The applicant or owner did not create the circumstance or condition. • The approved model home coincides with the other homes being built for the Lantana Corporation and in the surrounding lots of the subject property, for the preservation and enjoyment of substantial property rights. • The subdivision is in the final phase Member Adler asked if it was possible that the home be re-positioned to avoid the request for variance. Ms. Widero stated that she did not know if this was possible or not. Mr. Nodine added that this was the most shallow home in the subdivision. Chairman Swan expressed his concerns regarding the lot and the extreme setbacks. He stated that he was unsure if any home could be built on the lot. Mr. Nodine concurred and stated that this was a very peculiar lot. He further explained that he believed the area was originally designed to access onto Via de la Verbenita, but the access was shifted off that road to provide a safer access onto the cul-de-sac,therefore leaving the lot to remain the same. Chairman Swan opened the public hearing. There being no speakers. Chairman Swan closed the public hearing. MOTION: Member Adler MOVED to DENY the Case No. OV 10-00-12 application for variance finding that in the absence of the petitioner's testimony, he has no reason to believe that a home could not be designed successfully to fit the lot. It is the builder's responsibility to design such a home to fit adequately on the lot and be in compliance with the ordinance. Motion SECONDED by Chairman Swan. 7/25/2000 Minutes.Board of Adjustment 6 ROLL CALL VOTE Member Adler—aye Member Done—aye Vice Chairman Thresher—nay Chairman Swan—aye Motion carried, 3-1. the request for a variance was denied. Vice Chairman Thresher opposed. Discussion: Vice Chairman Thresher stated that the applicant had the right to build the home. 4. OV10-00-13 ARCOS ARCHITECTURE & PLANNING REQUEST A VARIANCE TO RELOCATE THE EXISTING ENTRY-WAY SIGN ON THE SOUTHWEST CORNER OF ORACLE ROAD AND GREENOCK DRIVE. 10195 NORTH ORACLE ROAD Ms. Widero. Senior Zoning Inspector, reviewed the staff report. She reported that the Arcos Architecture representing the El Conquistador Executive Plaza, requests a variance to relocate the entryway sign to the northwest corner of the property, and reduce the setback from the allowed 5 feet to 1 foot 8 inches. The OVZCR Sec. 12-502.B2 requires the sign shall be located at the entrance, Sec. 12-502.B.4 requires the setback to be a minimum of 5 feet from the property line, and Sec. 12-502.B.7 requires only one sign permitted per street frontage. Arcos Architecture is requesting a variance for the following reasons: 1. Lack of visibility limiting referrals and admissions contributing to financial difficulties. 2. Subject property is located below grade from Oracle Road. The existing sign is obstructed from view by vegetation. 3. The site is located on a curve of Oracle Road and the speed limit is 50 mph. This combination creates a hazard to southbound travelers who must locate the site, slow down, and turn safely_ Ms. Widero reported that at the time of the report preparation, staff had received three phone calls with questions and two walk-in visits to review the site plan. Comments have not been in support of this request. The following findings exist: • Because of the topography or below level grade, special conditions do exist. • The owner of applicant did not create the condition. • A variance to increase the height of Clare Bridge sign (next property to the south) was granted in 1999. Chairman Swan swore in the petitioner. 7/25/2000 Minutes.Board of Adjustment 7 Raul Reyes, 5821 East Paseo Busanic, project architect and owner of Arcos Architecture. gave an overview of the site. He explained that moving the sign to the corner of Greenock and Oracle would provide more visibility to better identify the project. He said that this would also benefit the residents in the area by reducing the traffic flow. Chairman Swan asked if the building was fully functioning at the present time. Mr. Reyes explained that this was a brand-new building that had not opened yet, but should be open in about one month. He explained that Arcos proposes to build an identical sign on the new corner with an additional directional arrow located beneath the sign. Chairman Swan asked how many tenants would occupy the building after the completion. Mr. Reyes explained that this was a 20,000 square foot building and the typical tenant capacity in the market place would be about eight professional tenants. Chairman Swan opened the public hearing. Chairman Swan swore in the witnesses that were intending to testify. The following citizens opposed the installation of the new sign and stated that the structure would definitely affect the resident's privacy and increase the traffic flow in the area. • Laurie Stark, 10210 North Valle • Mary Lou Thomas. 10250 North Valle del Oro • • Otto J. Putz, 46 West Oro Place Vice Chairman Thresher asked if the additional arrow that was to be added to the new sign would alleviate the problem. Mr. Putz replied "no." Bart Heins, 6841 North Skyway Drive. He explained that the developer intends to focus on the following issues: • Redirecting the traffic flow in the residential area • Safety • Profit of businesses being brought into the complex. He proceeded to give an overview of the 2 signs to be used on the site using the overhead projector. He explained that if the traffic flow can be directed away from Greenock. it would help the people living behind the property and simultaneously help the businesses and ownership groups of El Conquistador Executive Plaza. Mr. Reyes suggested that the developer install a sign at Greenock and the alleyway entrance to say"entrance to this project" or"no through traffic". 7/25/2000 Minutes.Board of Adjustment 8 Member Adler stated that a reasonable and appropriate alternative would be to install a double faced sign at the location or an angled sign that would cover both directions rather than having 2 signs at two different locations. He said that this compromise would not require a variance. Mr.Nodine explained that the purpose for taking the sign off of Greenock was to alleviate some of the traffic flow in the area. He explained that the visibility of any sign at this location would be weak. Chairman Swan closed the public hearing. Vice Chairman Thresher agreed with the idea of having an angled sign but had concerns with the fact that if the Board denied the variance. the secondary sign would still exist. Member Adler suggested relocating the Greenock sign to the main entrance and make it a part of the double-face sign, therefore. combining the two signs in one location facing both directions. MOTION: Member Adler MOVED to DENY Case No. OV l 0-00-13. finding that an alternative sign construction is possible to achieve both proper identification for the building and to appease the concerns of the neighbors. Vice Chairman Thresher SECONDED the motion. Discussion: Member Adler felt that there were other alternatives for the sign construction that would consolidate these signs into one location and believes that this should be pursued by the applicant and by staff. Vice Chairman Thresher stated that if the request for variance was denied, the applicant has a right to leave the sign in its current location. He did not believe that the secondary sign would resolve the problem. I see that Board of Adjustment meetings are at 3 pm. I really can't make that, working where I do. Could you please tell me where I should send a letter, and when, to ensure that the Board of Adjustment has a copy in time for their August meeting? Thanks. Michael Michael Carroll Oro Valley, AZ 85737 1 NOTICE OF PUBLIC HEARING BEFORE THE ORO VALLEY BOARD OF ADJUSTMENT In accordance with Sec. 1-708 of the Oro Valley Zoning Code Revised and Arizona Revised Statutes Sec. 9-462.06, NOTICE IS HEREBY GIVEN that the Oro Valley Board of Adjustment will hold a public hearing on Tuesday, August 22, 2000, commencing at or after 3:00 p.m. The meeting will be held at the Oro Valley Town Hall, 11000 N. La Caflada Drive and the subject matter will be as further described below: OV10-00-11: CONTINUED FROM JULY 25, 2000 PUBLIC HEARING AT&T WIRELESS PCS SERVICES, INC., REQUEST A VARIANCE TO INCREASE THE HEIGHT FOR A FLAG POLE FROM THE ALLOWED 27.5' TO A 50' HEIGHT. IF FLAGPOLE IS APPROVED A REQUEST FOR A MAJOR COMMUNICATION FACILITY USING THE FLAGPOLE AS A CAMOUFLAGE BY THE STEALTH APPLICATION FOR AN ANNTENNA. The height of the Maintenance Facility is 22', which would dictate a flagpole not to exceed 27.5'the request is for an additional 22.5' in height. If the flagpole is approved, in order to apply an antenna, this will be considered a Major Communication Facility project and will require a variance to the required setback. The communication tower has a required setback of 1.25 times its total height. The allowed height of the flagpole/antenna being 50', plus 1.25 times equaling 62.5', to meet compliance the Flagpole/Antenna must be setback 62.5' the required setback is currently 20', the approved flagpole is setback 34.1' they are asking to reduce the setback by 28.4'. Site plans are available for review during normal business hours at the Oro Valley Town Hall, Community Development Building. La Canada Drive Oro Valley, Arizona 85737 RE: OV 10-00-11 AT&T Wireless Proposed Facility Golf Maintenance Yard Dear Mr. Nodine and Ms. Wdero: Please accept the attached as an amendment to the pending application for review by the Board of Adjustment. The original application was continued from the July 25th public hearing due to confusion over the definition of the proposed site as a Major vs. Minor Communication Facility. It has been determined that the site, as designed, falls within the scope of a Major Communication Facility. The first step in obtaining approval for the proposed facility is for the Board of Adjustment to review the application for a variance for the height of the flagpole. A second variance is now required for the facility — a variance for the required setback for a Major Communication Facility. As outlined in Section 9-117 A.1., a communication tower must be setback from the nearest property line, building, and overhead wire, a distance at least equal to 1.25 times it s height. If both the variance for the height of the flagpole and the setback for the "communication tower" are granted, the proposed facility would be reviewed according the regulations for obtaining a Conditional Use Permit. This is a unique situation that does not neatly fall within any existing code definitions. I thank you for your help and continue to appreciate your diligence in finding a resolution to this matter. Identify difficulties or problems that would result from corn I i present zoning requirements, P Y n9 with the As part of the AT&T Wireless Services's (ATTWS) ongoing network and service improvement, engineers at ATTWS have identified the need for a Personal Communications Services (PCS) facility to serve the Stone Canyon / R anc area. Based on a computerized engineering study considering the local h P o Vistoso density and topography, engineers at ATTWS have issued a "search ring" id pulationentifying he necessary location for a PCS facility in the area. This search ring represents an area in which a facility must be located to allow it to function as an integral unit in in system. PCS facilities are laid out in a grid pattern and the spacing, height and toca PCS of this component site is critical for the successful operation of the overall system. The proposed flagpole antenna installation adjacent to the Vistoso Golf Course Man nane facility meets the engineering criteria. ce The immediate area of the search ring for Stone Canyon is residential and resort / club ) in character and offers no opportunity for collocating on an existing structure. to meet the engineering height requirement, a structure was needed on which the antennas could be mounted. Utility poles and light standards as well as flagpoles have been by the carriers to meet the height requirement. These installations are stealth inused defined as the camouflaging of an antenna array to integrate the antenna nature structure in terms of design, color and material. In this case, the antenna is the contained within the structure of the flagpole fully Under current zoning regulations for flagpole installations, the code states that the maximum height can not exceed 1.25 x the height of the adjacent structure. Vistoso Golf Maintenance facility is estimated to be approximatelyu 22' whicThe dictate a flagpole not to exceed 27.5'. If built according to current zoningre would the flagpole would not provide the required height for the telecommunication facility. ons, AT&T Wireless Services requests that a height variance be granted for the proposed flagpole / antenna installation. The minimum height necessary for the facilit s This height is necessary to have the antennas "clear" the adjacent two sto a a 50'. complex. ►y p rtment If a height variance is granted for the flagpole, the proposed telecommunication facility as defined as a Major Communication Facility will require an additional variance for the required setback. As outlined in Section 9-117 A.1., a communication tower must be setback from the nearest property line, building, and overhead wire a distance equal to 1.25 times the proposed height. The maximum allowed height according to th e underlying zoning is 50' and would require a setback of 62.5'. The site is currently design with a setback of 34.1. The ATTWS construction costs for this site are estimated to be: Equipment Shelter and facade $35,000 Flagpole $20,000 Site Work $40,000 Installation of Antenna $15,000 AT&T WIRELESS SERVICES APPLICATION FOR VARIANCE PROPOSED NEW TELECOMMUNICATION FACILITY Golf Maintenance Yard BACKGROUND INFORMATION According to recent reports, approximately one out of four Americans (more than 85 million people) use wireless phones and that thousands sign up for new service each day. It is the goal of AT&T Wireless Services to work hand in hand with the Town of Oro Valley in the development of their wireless network and continue to provide quality service to the residents. The Town of Oro Valley has recognized the need for communication facilities as a service for it's citizens and has defined guidelines for the appropriate installation of facilities in Article 13-7 Communication Structures and Facilities. There are two definitions for telecommunication facilities found in Section 13-703: a Minor Facility and a Major Facility. A Minor Facility is one that meets the following criteria: shall be constructed using stealth application, and must be located on an existing structure (building or pole), or shall be ground mounted up to a maximum of 20' in height. A Major Facility would encompass all other site designs. A Minor Facility application requires the review and approval by the Development Review Board. Major Communication Facilities require a Conditional Use Permit, which may be granted by the Town Council after a hearing at the Planning and Zoning Commission. If the CUP is granted, the DRB must also approve the application for final approval. The proposed facility at the Golf Maintenance Yard was initially defined as a Minor Facility consisting of a stealth collocation on an existing structure (the flagpole) but has been re-defined as a Major Facility. Additionally, the proposed site design requires both a variance for the height of the flagpole as well as the granting of a variance for the minimum setback requirement for a Major Telecommunication Facility. FINDINGS A. That there are special circumstances or conditions applying to the property including its size, shape, topography, location, or surroundings which do not apply to other properties in the district. AT&T Wireless Services has identified the Town of Oro Valley as a priority for the development of new facilities to increase both the existing coverage and expand the service area. As the demand for communication services increases and more users access the network, additional sites are required to handle the load. The Town of Oro Valley, particularly Rancho Vistoso, is an area of intense growth and the growth is reflected in the increased demand for wireless service. Wireless communications sites must be considered as part of a network, not as a single individual site. Communication facilities can be compared to links in a chain, one link adds to the next making the network design longer. Like a link in a chain, a telecommunication facility has a limited range and must be connected to other links. Topography is a major factor affecting the area covered by a communication facility. Wireless is a low power, line of sight broadcast technology meaning that it will transmit only as far as there is a clear path without obstruction such as hills, bluffs, or buildings. If the area is hilly, as found in the Rancho Vistoso area, the radio waves may be absorbed by the surroundings similar to way a carpet would absorb the sound of a stereo system. The actual area covered by an individual facility is a function of height and power. Because wireless technology operates at a low power, the area covered is usually between one half and ten square miles. The process of identifying the location for a new facility is quite lengthy. It begins with the RF engineers issuing a "ring" or geographic center point for the facility that will connect with the existing sites (or links in the chain.) AT&T Wireless representatives must then identify a specific parcel that is adequate in size and shape and can meet all requirements for the zoning district. A lease agreement must be negotiated with the landlord granting their approval of the initial design as well as authorizing AT&T to proceed with zoning application and approvals. The Town of Oro Valley presents a unique challenge to the acquisition and design process as described above. Opportunity for stealth collocation and applications are limited and required a creative approach to meet both the network requirements for AT&T and character and code restrictions of the Town of Oro Valley. Great care was given to the selection of this location and the site design. B. That special circumstances were not created by the owner or applicant No special circumstances as described in the above response have been created by the owner or applicant. C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. Everyday in United States more than 100.000 emergency calls reach 911 from wireless phones. These emergency calls include phone calls from cars reporting accidents, drunk drivers, medical emergencies and other roadside hazards. Wireless phones play a critical rose in enhancing emergency services by providing vital communications during times of emergency or disaster. Although no consistent market evidence has been established, the proposed AT&T Wireless facility will not adversely affect the preservation of property values of the adjacent parcels and may in fact, positively impact the value of the home and property. Letters of support have been forwarded demonstrating the ever increasing dependence on cellular phones for daily use as well as emergency situations. D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone. Wireless carriers have a legally mandated responsibility to the FCC to provide wireless services to your Town. There are many wireless carriers building new wireless networks as well as continually expanding their existing networks. Each carrier is assigned a separate frequency, much like a television or radio station that each have their own unique frequency. Wireless carriers have different network designs as well as equipment which impact their coverage and service areas. The granting of a variance for the proposed facility does not constitute a special privilege. E. That authorizing the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property,to the neighborhood or the public welfare in general. Much has recently been written on the health and safety of wireless technology. Wireless technology is low power radio signals transmitted over an assigned set of radio frequencies. It operates by transmitting radio waves through the air. The digital / analog information contained in these transmissions is converted into voice, data, fax, email and other types of electronic information. More than a hundred studies have been conducted over the last forty years and experts have determined that there are no harmful effects associated with low power radio transmissions like those used in wireless communications. AT&T Wireless antenna facilities comply with all applicable federal, state, and local safety guidelines. The Telecommunication Act of 1996 gave the Federal Communications Commission (FCC) authority to establish rules to limit public exposure to radio signals from wireless communication facilities. The proposed AT&T facility will meet or better these established FCC guidelines and rules. OV I 0-m00 1E1 I /(4( _.. La Canada Drive Oro Valley,AZ 85737 RE Need For Communications Structures and Facilities in the Rancho Vistoso Area Dear Members: Based upon frequent comments and concerns expressed by residents of, and visitors to, the Rancho Vistoso area, the Vistoso Community Association wishes to convey support for additional communications structures and facilities to service our community. All those who depend upon cellular telephone technology on a daily basis frequently experience, also on a daily basis, "dead"areas, cut-off calls, poor reception, etc. Such interruptions in service constitute a hardship, as they disrupt business, keep families out of touch and, potentially, delay responses In emergency situations. To further amplify the seriousness of potential problems, which can be caused by poor cellular transmission, examples of how cellular phones are utilized in daily life in Rancho Vistoso are cited below: Doctors and other professionals depend upon cellular telephones to receive emergency calls and important business communications when it is necessary to be away from the office. Likewise, expectant fathers, relatives and employees of persons with medical problems need to be mobile in their daily lives, yet In a position where they can respond promptly to medical emergencies. As many children are raised in households with two working parents, it is important for the child to be able to reach a parent in an emergency, and just as important for a parent to be able to monitor a child's activity and location. Rancho Vistoso and its environs invite hikers, both young and old,to get out onto the trails and partake of the beauty the area has to offer. Many folks from Sun City frequent the trail system within Rancho Vistoso Itself_ Those who carry cell phones when they hike do so, because they want the comfort of knowing help can be summoned In case they get lost, suffer an injury or some other type of medical problem. Similarly, those who enjoy golf as their primary source of recreation and exercise often feel more comfortable with a cell phone to keep them in touch and provide them with the security of knowing help will be nearby in case of an emergency. i t J2 Letter to Board of Adjustment August 1.2000 Page 2 Cellular phones are widely used by people within the service industry to keep in touch with their personnel, dispatch calls, locate customers. etc. Poor reception, or lack of facilities within a service area, can result in lost time, wasted fuel and delayed service to customers. As cellular technology improves, some residents are opting to reject"hard-wired"phone service for their homes entirely In favor of cellular phone service. For these folks, cell service is the only method for communication with the outside world, so it becomes even more important that the service be reliable. In researching the reason for cellular transmission problems in the Rancho Vistoso area, several providers were contacted. The response was the same from all of them. Rancho Vistoso's location with respect to the Catalina Mountains, the local topography and the Inability to gain line of sight with existing cellular transmission facilities from numerous points in the community all add to frequent disruptions in service and poor quality transmissions. Calls to the Association regarding transmissionlreceptlon problems in cellular service are increasing exponentially. The perception is that, while Rancho Vistoso Is attempting to be on the leading edge of high technology development and services, it is, in actuality, rather "low tech" when it comes to cell service, with some of the poorest service In southern Arizona. it is the Association's hope that Town of Oro Valley officials will be pro-active in making decisions pertinent to new communications facilities and technology to serve Its citizens, so that all who reside in, do business in, or visit the Rancho Vistoso area can be confident that they will be able to"stay in touch" with the outside world. It just gets more complicated each day! Would you please review the accessory building setback for both the Wapa ground equipment and the ground equipment location for the flagpole installation at the Maintenance Yard. Over the weekend I prepared CUP applications for both of the proposed facilities to be reviewed as Major Communication Facilities. As I understand the process today and if they are approved by the Board of Adjustment on August 22nd, Planning and Zoning will review the applications on September 5th. A review by the DRB follows on September 12th with a final review by Council on October 18th. Whew! I really will need desk space and covered parking at the Town offices for the next two months! I have attached the narratives I prepared for the CUP applications for your review. I thought they might be helpful in preparing the staff report for the variances. I am still working on the "Findings" which I am "finding" hard to justify. I will try to have them to you tomorrow. Please do not hesitate to give me a call if you have any questions or suggestions on how better to present the applications. Again, my sincere thanks. La Canada Drive Tucson,AZ 85737 To Whom It May Concern: I am in opposition to the request by AT&T Wireless PCS Services, Inc. for a variance to increase the height for a flag pole/antenna installation in a Planned Area Development (PAD) zone to a height of 50'.The subject property location is The Vistoso Golf Maintenance Facility, 955 W. Pebble Creek, Oro Valley,AZ 85737. The Vistoso Golf Maintenance Facility is a single story building that is nestled into the golf course. 1. This flagpole would be an eyesore jutting up 125% higher than the Maintenance Facility. 2. This request is asking to double the maximum height allowed. This is not a request for one or two feet, but 28 feet! 3. If the American Flag was kept raised 24 hours a day, illumination would be required, it would take away the beauty of our nighttime desert sky. 4. It would take away the natural look of the Tortolita Mountain Range. A manmade pole sticking out of the mountains would mar sunsets. 5. There are many other locations that would be more suitable. 6. Why not place the antenna on an existing flagpole? Many residents of our community are away for the summer and are not aware of this variance request. I received my notice today. I would like to speak to the board on this matter. Please consider postponing any decision on this matter until the fall. Sincerely, '271,„„/„.„)6 6.60,e,d-a Margaret A. Chairman Swan closed the public hearing. ' r 08/22/00 Minute,Board of Adjustment 3 MOTION: Member Suozzi moved to ACKNOWLEDGE and WITHDRAW Item 3, AT&T Wireless PCS Services, Inc.,request for a height and parking space variance located at Honeybee Ridge from the agenda. Motion SECONDED by Vice Chair Thresher. Motion carried, 4-0. 1. OV10-00-11a AT&T WIRELESS PCS SERVICES,INC. REQUEST A VARIANCE TO INCREASE THE HEIGHT FOR A FLAGPOLE INSTALLATION IN A PLANNED AREA DEVELOPMENT ZONE TO A HEIGHT OF 50'. LOCATED AT THE VISTOSO GOLF MAINTENANCE FACILITY, 955 WEST PEBBLE CREEK Dee Widero, Senior Zoning Inspector, reviewed the staff report. She explained that AT&T Wireless Services has identified a need for a Personal Communications Service facility to service the Rancho Vistoso Neighborhood 11 area. Under the current zoning regulations for flagpole installation(Sec 13-304),the code states that the maximum height can not exceed 1.25 x the height of the adjacent structure. She explained that the purpose of this code requirement is to ensure that flagpoles are compatible in scale with adjacent buildings. She said that according to AT&T engineers, the minimum height necessary for the facility is 50 feet. The height of the maintenance facility is 22 feet, which would dictate a flagpole not to exceed 27.5 feet. The request is for an additional 22.5 feet in height. Ms. Widero stated that staff has received several letters opposing the request for a flagpole from citizens living in the community and one letter in support of the variance. She explained that the applicant is proposing to install a flagpole at the Golf Maintenance Facility in Neighborhood 11 and that Rancho Vistoso Partners has given their approval. Staff finding of facts: • The Golf Maintenance Facility is not greater that 22 feet in height. The zoning code allows a maximum height of 27.5 feet for the proposed flagpole, AT&T is asking for an additional 22.5 feet above the maximum allowed and 28 feet above the adjacent building. • The flagpole location is approximately 400 feet to the nearest residence. • The site location requested for variance, sits 10 feet below grade of Vistoso Highlands Drive • If this variance request is approved, the applicant will then move forward on to agenda Item#2 OV 10-00-11 b, to reduce the setback for a Major Communication Facility for an antenna application to the approved flagpole. Ms. Widero, reviewed the supplemental report for Case No. OV 10-00-11 a& OV 10-00- 11b. She explained that the Planning staff has utilized the Rancho Vistoso (RV)Planned Area Development(PAD) and the Oro Valley Zoning Code Revised(OVZCR). The proposed Major Communication Facility will be located in the Rancho Vistoso Planned Area Development (RVPAD) Recreation Area/Golf Course land use designation. Since there are no guidelines specified in the RVPAD for the Recreation area/Golf Course designation, the staff utilized (as interpreted by Bryant Nodine, Planning and Zoning 08/22/00 Minute,Board of Adjustment 4 Administrator)RV PAD's Resort district for design guidance, as it is intended to provide for recreation and golf uses. She explained that under the permitted uses section in the Resort District, the RV PAD refers to the permitted uses in the R-4R Resort district of the OVZCR, Sec 7-203. A Major Communication facility is allowed with a conditional use permit(CUP) in the R-4R district. The height restriction for a Major Communication Facility is 50 feet in R-4R zoning district. Vice Chair Thresher expressed concerns with the project being categorized as a "flagpole." He said that he considered the pole to be a cellular telephone antenna and would prefer that it be referred to as such. Chairman Swan swore in Bayer Vella, Senior Planner. Bayer Vella, Senior Planner explained that the usage proposed is for a flagpole, but is also a communications facility which is addressed in two separate sections of the Town Code and with the Town Attorney's consent, staff has taken a conservative approach. He explained that the applicant would need to address all sections of the code that pertains to the application. He stated that there was no question that the purpose for the flagpole would be to create a communications facility. Chairman Swan asked who recommended making it i.e. a flagpole rather than a communications pole. Mr. Vella replied "the petitioners, for the purpose of establishing a communications facility." Member Suozzi inquired as to why the antenna would meet the code and the flagpole would not. Mr. Vella explained that in order for the antenna to meet the Major Communication Facility Code Requirements, it has to be stealth. Meaning, it has to appear to be something it isn't to blend in. He explained that the applicant has proposed using a flagpole to store the communications device because the code has been oriented to hiding this type of facility. Member Suozzi asked if the height would be a problem if the project were classified as an antenna. Mr. Vella explained that if the project were classified as an antenna, the height would become an issue, however since the project has been identified as a flagpole there are specific code references that restrict the height of a flagpole. Chairman Swan stated that if the variance were rejected, it would be rejected for two reasons, (1) height and (2) unable to meet the stealth requirement. 08/22/00 Minute,Board of Adjustment 5 Mr. Vella explained that the issue that has been brought before the Board is strictly the height of the flagpole and that there were definitely other options that had not been explored. Chairman Swan asked if the pole would be less obtrusive and noticeable with or without a flag as it relates to the general conception of what people will see as they drive by. Mr.Vella replied "because it is higher than your average flagpole it would probably be less noticeable without the flag." Mr. Suozzi explained that the report states that this type of facility only services a geographical area of a 2 to 4 mile radius in order to be effective. He asked if this would set the precedent for more flagpoles or poles in the area if the variance were approved. Mr. Vella explained that cases are reviewed on a case-by-case basis. He said there had not been any focus toward reviewing the accumulative impacts of the placing of poles in close proximity. He said, "staff is planning to review and revise the code regarding accumulative impacts. And in terms of the visual and aesthetic impacts, it is certainly an issue that is under the purview of the Development Review Board, who reviews both Minor and Major Communications Facilities." Member Adler explained that it was his understanding of 1 l a, that the Board review the application for the flagpole not a communications facility and determine whether the flagpole by its own definition warrants a variance. He stated that he would like to hear the petitioner's justification for a variance. Chairman Swan swore in the witness that was intending to testify. Martha Kuendhold, 1 East Desert Sky Club#2 stated that this was a complicated situation and gave the following overview and reasons for the choices made regarding the site plan. • Originally, when the site was designed, it was understood that it would be reviewed as a Minor Facility. The definition of a Minor Facility would be one in which the antenna is co-located or attached to an existing structure • The flagpole is the structure to which AT&T was to attach the communications device placing it under the Stealth Communication Minor facility. This definition was challenged and the facility was redefined as a Major Communications facility, which would require rezoning or permitting it twice. First, permitting it as a Minor Communications Facility and second permitting it as a Major Communications Facility to meet both criteria. She explained that it gets very complicated to separate the two. AT&T has worked hard and long to find a suitable place to co-locate the antennas and integrate them into the surrounding area • Initially AT&T had considered co-locating the antenna, but the Resort Golf Casita's was not a willing landlord because of the requirements of ground space AT&T Wireless needed for the equipment • AT&T has received a letter of support from the adjacent property 08/22/00 Minute,Board of Adjustment 6 She said that it had been a difficult task to find a functional site for AT&T Wireless and meet the zoning requirements. Chairman Swan asked if the 50-feet height was the minimum height needed for the facility. Ms. Kuendhold replied"drop dead minimum." Member Adler stated that it seemed contradictory that an operator would be supportive of having improved service but unwilling to participate in the accomplishment. He explained that he understood the point about taking the flagpole matter in 11 a as a part of the communications requirement, however, the Board is being precluded from doing so because of the way the report had been presented. He said that the flagpole is being presented as needing a variance for a height increase because it is in violation of the portion of the Code that deals with flagpoles, therefore, it is not being presented as a Minor Communications Facility. Ms. Kuenhold stated, "it is our belief that the flagpole installation is suitable to the Golf Maintenance Facility and its surroundings. That would be my defense of having a flagpole at that particular location. It does blend in and compliments the facility. If AT&T is not successful today, the proposal could not move forward under the guide of a Major Facility and Conditional Use Permit." Chairman Swan asked if it was her understanding that the reason for the variance for the flagpole would be to meet the stealth requirement of the Code. Ms. Kuenhold replied"truthfully, I had not thought of it that way because my thinking is much more defined as minor or major. Member Suozzi asked what were the dimensions of the flag. Ms. Kuenhold replied"unfortunately I do not have the dimensions but it would be a rather large flag." Chairman Swan inquired if a variance would be necessary for stealth purposes if the request was for an antenna with the 50-foot height. Mr. Vella replied "yes." Member Suozzi expressed concerns regarding the height of the pole from a safety standpoint. Mr. Vella explained that prior to the construction the applicant has to submit structural engineering plans that would be reviewed by staff to ensure that it met all Uniform Building Codes. 08/22/00 Minute,Board of Adjustment 7 Chairman Swan opened the public hearing. Dick Maes, 945 West Vistoso Highland Drive, representing Rancho Vistoso Partners, Stone Canyon and President of Rancho Vistoso Homeowners Associations was very much in favor of the installation of the communications facility. Member Adler stated that he wanted to be sure that this matter had been researched and investigated thoroughly to find other options or alternatives for a 50-foot flagpole, and that all citizens in the area were contacted. He said, "the Board should be aware of the options whether they exist or not." Ms. Kuenhold stated that she had been in communication with The Resort Castias and if the variance were approved she would be moving forward with the Development Review Board and various other boards to provide an opportunity for their participation at a greater level. Chairman Swan closed the public hearing. Member Adler stated that he would not substitute common sense of what 11 a represents to him. He stated that he appreciated Ms. Kuenhold and Mr. Maes recommendation of moving the tower to the second location that it seemed sensible. But in his view, that was not what had been presented before the Board. Therefore,he stated he would limit his vote to the 50-foot height consideration and not to the extraneous considerations to what had been presented in 11 a. Vice Chairman Thresher expressed concerns with the combination reference of the project as a"flagpole/antenna tower" and felt the Board would be out of its jurisdiction if it were to approve the request. Member Suozzi expressed concern regarding the height and the accumulation of poles erected in the area. He added that he had not heard much discussion regarding alternatives or options. Chairman Swan asked if the applicant was requesting a variance for a flagpole because they could not meet the stealth qualifications under the normal antenna structure. Mr. Vella replied "that is correct."He explained that staff recognized the lack of these types of facilities in the Town. He reported that staff is visited frequently by communications facility providers weekly and that staff has definitely taken a conservative approach in terms of how to establish a precedent for development. Mr. Suozzi stated that it would make more sense to add to the existing poles in the area to avoid having so many different poles. Chairman Swan stated that the hardship that the petitioner was experiencing was a result of the Town Code Stealth requirements; isolating the antenna as such is impossible 08/22/00 Minute,Board of Adjustment 8 because of the auxiliary needed for the equipment to function properly, therefore the applicant request for a flagpole was reasonable. MOTION: Member Adler moved to DENY OV 10-00-11 a, finding that the variance request does not meet the criteria and that there are alternative ways that the antenna can be mounted so that a flagpole may not be necessary. Motion SECONDED by Vice Chair Thresher. Discussion: Member Suozzi agreed with Member Adler and said there may be a better alternative and agreed with the motion. Vice Chair Thresher call for the question. ROLL CALL VOTE Member Adler—aye Member Suozzi—aye Vice Chairman Thresher—aye Chairman Swan—nay Motion carried, 3-1, Chairman Swan opposed. 2. She added that she appreciated the Board's time and obvious attention to this matter. PLANNING AND ZONING UPDATE Dee Widero, Senior Zoning Inspector had no report. Dan Dudley, Town Attorney suggested having an executive session/study session at or before the next meeting to review the legal aspects relating to certain issues that will come before the Board. Discussion: Member Adler expressed concern regarding the notice of hearing to the property owners within the 300 feet radius. He asked that the Planning and Zoning Commission be asked to insert a review of the public notification limits or boundaries in their work plan. i 08/22/00 Minute,Board of Adjustment 9 Member Suozzi suggested that the letter of notification be made more personable. He felt that this would get the attention of the reader. Member Adler expressed concern regarding variances that did not fit the plot plan. He suggested that there be a requirement that when the developer is submitting elevations to the Development Review Board (DRB)that at least one of these elevations is certified and fit on the plan. Member Adler expressed concerns with"staff finding of facts"and asked if it was necessary to include this section in the staff report. He suggested that this be reviewed at the executive session/study session. ADJOURNMENT MOTION: Member Adler moved to adjourn the meeting at 4:45 p.m. Motion seconded by Vice Chairman Thresher. Respectfully submitted, i a Hersha, Secretary II ORO VALLEY PLANNING AND ZONING DIVISION BOARD OF ADJUSTMENT REPORT CASE NO: OV10-00-11a Hearing Date: August 22,2000 Agenda Item No.: 1,Continued from July 25 meeting. Prepared By: Dee Widero, Senior Zoning Inspector REQUEST: AT&T Wireless PCS Services, Inc., request a variance to increase the height for a flag pole installation from the allowed 27.5 to a 50' height. Subject property location, The Vistoso Golf Maintenance Facility, 955 W. Pebble Creek, Oro Valley, AZ 85737. REQUEST SPECIFICS: As part of the AT&T Wireless Service's (ATTWS) on going network and service improvement, engineers at ATTWS have identified the need for a Personal Communications Service facility to serve the Rancho Vistoso Neighborhood 11 area. Under current zoning regulations for flagpole installation (sec.13-304), the code states that the maximum height can not exceed 1.25 x the height of the adjacent structure. The purpose of this code requirement is to ensure that flagpoles are compatible in scale with adjacent buildings. According to AT&T engineers the minimum height necessary for the facility is 50'. The height of the Maintenance Facility is 22', which would dictate a flagpole not to exceed 27.5'. The request is for an additional 22.5' in height. Take your detailed map for the on-site review. NOTIFICATION: All property owners within 300 feet of this property have been notified of this hearing. The property has been posted with a Notice of Hearing and the Hearing Notice has been advertised in the Daily Territorial newspaper. At the time of report preparation, staff had one letter from Eugene Nielsen in opposition to this request (letter included with report). At the time of last months public hearing we had received one letter from Lanna Conrad, also one from Carol & David Bueker in opposition. Dick Maes with Vistoso Partners has supplied a letter in support, no other comments in support for or in opposition to have been received, and staff has not received any comment in support for or in opposition to this request for variance. ORO VALLEY PLANNING AND ZONING DIVISION BOARD OF ADJUSTMENT REPORT -SUPPLEMENT A Report Supplement to: CASE NO: OV10-00-11a & OV10-00-11b Hearing Date: August 22, 2000 Agenda Item No.: 1 & 2, Continued from July 25 meeting. Prepared By: Dee Widero, Senior Zoning Inspector REQUEST: AT&T Wireless PCS Services,Inc., request a variance to increase the height for a flag pole installation from the allowed 27.5 to a 50' height. If the height variance is approved a second variance request for a Major Communication Facility using the flagpole as a camouflage by the stealth application for an antenna to reduce the required setbacks from the required 62.5' to 34.1'. Subject property location, The Vistoso Golf Maintenance Facility, 955 W. Pebble Creek, Oro Valley,AZ 85737. REQUEST SPECIFICS: Planning staff has for the above referenced projects, utilized the Rancho Vistoso (RV) Planned Area Development (PAD) and Oro Valley Zoning Code Revised(OVZCR). The proposed major communication facility will be located in the RVPAD Recreation Area/Golf Course land use designation. Since there are no guidelines specified in the RVPAD for the Recreation area/Golf Course designation, the staff utilized (As interpreted by Bryant Nodine) RV PAD's Resort district for design guidance, as it is intended to provide for recreation and golf uses. Under the permitted uses section in the Resort district, the RV PAD refers to the permitted uses in the R-4R Resort district of the OVZCR, Sec 7-203. And a major communication facility is allowed with a conditional use permit(CUP) in the R4-R district. The height restriction for a major communication facility is 50 feet in R4-R zoning district. SITE ANALYSIS: The area surrounding the Flagpole site is all Planned Area Development; the Maintenance facility is within the Vistoso Golf Course;to the south high density residential Neighborhood 10, Parcels O&P;on the north is Vistoso Golf Casitas II and the northeast is Vistoso Resort Casitas. The closest public street use is the street directly adjacent to the purposed location, Pebble Creek Drive. This street currently ends at the facility so traffic is minimal. In the future this street will be complete and serve future subdivisions. The site is also within the view of the rear units of the Resort Casitas (approx. 600' distance from flagpole) and the Golf Casitas (approx. 400' distance from flagpole site). However this site is at least 10' lower than these properties. PLAN ANALYSIS: The applicant is proposing to install a flagpole at the Golf Maintenance Facility in Neighborhood 11. This site was chosen because it is a permanent maintenance facility. The Rancho Vistoso Partners have given approval for this flagpole structure to be placed at their maintenance facility location. SUMMARY: Staff finding of facts: • The Golf Maintenance Facility is not greater than 22' in height. The zoning code allows a maximum height of 27.5' for the proposed flagpole, AT&T is asking for an additional 22.5' above maximum allowed and 28' above the adjacent building. • The flagpole location is approximately 400' to the nearest residence. • The site location requested for variance, sits 10' below grade of Vistoso Highlands Drive. • If this variance request is approved, the applicant will then move forward on to agenda item#2 OV 10-00-11 b, to reduce the setback for a Major Communication Facility for an antenna application to the approved flagpole. The Board of Adjustment should consider the following findings in making its decision: A. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. 2 SUGGESTED MOTION: The Board may wish to consider the following motions: I move to approve OV 10-00-1 la,a request to allow a height increase to a flagpole from the allowed 27.5' to 50'. OR I move to approve OV 10-00-1 la,as submitted by the applicant with the following stipulations: (Staff does not have any stipulations to offer) OR I move to deny OV 10-00-1 la, fording(Board to state reason why the variance cannot be granted) that: ATTACHMENTS: 1.
