Subject property: Oro Valley United Church of Christ, 1401 E.El Conquistador Way,Oro Valley,AZ 85737. REQUEST SPECIFICS: Cricket Comfortable Wireless has identified the need for a Minor Communications Service facility to serve in La Reserve Planned Area Development (PAD). The proposed equipment will be located below the existing detention basin at the northwest corner of the Church site, as shown on page C 1 of the site plan. The Oro Valley United Church Chapel at Pusch Ridge is located within the La Reserve Planned Area Development District C. Development on this parcel is governed by the development standards of the Private Schools and Churches (PS&C) district, section 8-401 of the Oro Valley Zoning Code Revised (OVZCR). The standards from this zone require a 40' setback from all property lines. The applicant is requesting a reduction of these setbacks to 15' from the west and 25' from the north for the equipment cabinets. SITE LOCATION: To reach the site location, turn east from Oracle Road on El Conquistador Way, follow the road around, you will arrive at the Guard House at La Reserve the Church site entrance is to the north (left)posted with an Oro Valley Public Notice. NOTIFICATION: All property owners within 300 feet of this property have been notified of this hearing. The property has been posted with a Notice of Hearing and the Hearing Notice has been advertised in the Daily Territorial newspaper. At the time of this report preparation Mr. Ray Marks had called with concerns of drainage, his home lies below the detention basin and drain area. No other calls or letters with comment have been received in support for or in opposition to this request for variance. The applicant has met with some homeowners of The Ridge at La Reserve (included are results from that meeting). SITE ANALYSIS: The three-acre site for the proposed facility is located east of the El Conquistador patio homes and south of the Ridge at La Reserve, a single-family residential neighborhood. At the northwest end of the main parking area is a detention basin with chain link fencing surrounding. Just beyond is a 5' retaining wall (see the attached exhibit A). Some of the homes at the Ridge at La Reserve above the proposed site may be able to look down upon the site, but their primary views are horizontally over the site. The site is above and visible from some backyards of the El Conquistador patio homes. The equipment will be approximately 100' from the closest backyard. PLAN ANALYSIS: Cricket Comfortable Wireless proposes to place a 10' x 19' concrete slab and 6'8" tall equipment cabinets on the flat area just west of the existing retaining wall. One foot of height would be added to the existing wall. The existing chain link fence would be painted a dark matt green and Mesquite trees would be planted on the north side and desert shrubs along the west boundary of the detention basin to further screen the chain link fence. This was an agreement made between Cricket Comfortable Wireless and the surrounding neighbors, at a recent neighborhood meeting. As shown in exhibit B & C,the cabinet equipment will be screened with a 10' wall. That wall is to be camouflaged with multiple-desert colors (greens and browns). Mounted flush to the decorative (camouflaged) masonry wall, will be three 6' long antennas. An earth berm will be constructed with rock and vegetation, in order.to extend the existing drainpipes for adequate drainage, and to further blend the structures into the landscape. SUMMARY: Staff fmding of facts: • The property is more sloped than other properties in the district and the high location eliminate obstructions for the communication facility. • The site will be noticeable from some adjacent properties, especially those below it that look up past it to mountain views. • If this variance request is approved, the applicant will then need to submit an application to the Development Review Board for approval. The DRB is required to consider visual impacts and ensure the emissions meet Federal standards. • If this variance is approved the applicant will need to ensure that the drainage changes do not affect downstream properties. The Board of Adjustment should consider the following findings in making its decision: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. That special circumstances were not created by the owner or applicant; and 2 C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property,to the neighborhood or the public welfare in general. SUGGESTED MOTION: The Board may wish to consider the following motions: I move to approve OV10-00-15,a request to reduce the setbacks from 40' to 25' from the north and 15' from the west of the detention area to property lines. OR I move to approve OV10-00-15, as submitted by the applicant with the following stipulations: OR I move to deny OV10-00-15, finding (Board to state reason why the variance cannot be granted) that: ATTACHMENTS: 1. EL CONQUISTADOR WAY B/A SETBACK VARIANCE Cell phone antennas require a location that is high with no obstructions within their radio frequency "sight lines". Two highnon-residential within Oro Valleyeast of Oracle -- n residential sites exist Rd. the Sheraton El Conquistador Hotel and the United Church of Christ. The Hotel declined to lease space Communications. The Church is willingto lease a p to Cricket suitable location. The United Church of Christ Site The lowest point of the Church Campus is at its southwest corner just the parking lot where there exists a drainage detention basin. About 3beyond 3 1/2 feet west of the basin is a flat area already graded comprising several hundred square feet. This graded area has unobstructed views of Oro Valleyto the west. The detention basin itself is enclosed by a chainlink fence that would remain and be painted dark matt green at the request of the residents of The La Reserve. Mesquite trees would beplanted on theRidge at north side also at the request of these residents to further screen the entire detention basin from homes on the north within The Ridge at La Reserve. The Ridge at La is located approximately 30' above the Church. Reserve Desert shrubs would be added along the west boundary of the detention basin to further screen the chain link fence from the north as well as from h on the west within the El Conquistador Patio Homes subdivision. homes Conquistador Patio Homes is located approximately El pp imately 30' below the Church. A 5' retaining wall already exists about 3.5' west of the detention basin fence. Cricket proposes to add 1' of height to this wall. Immediately this retaining wall, a 10' x 19' concrete slab and 6'8" west of would be placed on the flat area and on fill dirt as showntall equipment cabinets on Sheets Al and A2 of the Zoning Drawings. This slab would be constructed within a 12' x 20' equipment compound (lease area). 1 residents of The Ridge at La Reserve resulted in a decision by the Church Board to proceed no further with a lease to Cricket rooftop location. In this case, Cricket was able to comply for the with zoning setback requirements. Therefore, if a setback variance is not granted by the B/A, Cricket would not be able to locate anywhere on the Church of Christ ro e p pny. 2. Identify and explain all unique and peculiar circumstances would prevent you from complying with thethat Y g present zoning requirements on your property in regard to the following areas (slope, narrowness, shallowness, irregular shape, location, washes, vegetation and easements, etc.). This 3 acre parcel is already fully developed. An alternative location in the parking lot would result in the loss of critical parkingspacesforh Church and its community worship functions. the Finally, if this proposed equipment compound was moved east of its proposed location a distance sufficient to meet the 40' setback requirements, the integrity of the existing, regulatory detention basin would be compromised because the equipment would have to be located within the basin itself 3. Identify and explain any peculiar conditions in the surrounding area, which would keep you from complyingwith the present zoning requirements. Mountains exist to the east and south of this site. Therefore, the only population required for radio frequency "vision" from this site is developed area of Oro Valleyto the west. A the site on the east end of the Church campus would then be meaningless and serve no function. The neighbors on the north from The Ridge at La Reserve opposed a rooftop location on the west building and, therefore, the Church h declined to lease a rooftop space to Cricket Communications even though this location was approved by the Town of Oro ValleyDRB (0V13-00-50) and met setback requirements. The only remaining, functional site then is on the west slope of the Churchf campus in front 3 The entire compound would be surrounded bythe exi a new 10' masonry wall (6' above oun sting wall (now 6') and wall will d level). Because of the topography, this new masonry screen all but 8" of the 6'8" equipment cabinets. The new 10' wall would be painted multiple-desert colors browns) which will truly camouflage the (greens and g equipment compound from the views along El Conquistador Way, from the residences below and from the residences above on the north. Pleaseon the west exhibits which illustrate existingsite refer to the 3 photo conditions, show the various phases of construction and, finally, simulate the finished development. Please notice even further that after the new 10' decorative masonry wall is constructed and painted, three 6' long antennas would be the wall with "sight" lines to the northwest, flush mounted to west and southwest well above existing perimeter development. Finally, on the north side of the proposed equipment berm would be constructed with rocks and p compound, an earth the hillside and which will, therefore, vegetation that already exist on reflect existing desert colors. The existing 8.5' long 12' drain pipes will be extended 13' west to draining the detention basin. continue This location and its stealth design features have been developed conversation with representatives of The Ridge in Conquistador Patio Homes and the at La Reserve, El United Church of Christ. 1. Motion carried 5-0. Chairman Swan moved Item 1 forward to be preceded by the nomination of the Chair and Vice Chair to the Board of Adjustment. 1. OV-10-00-15 RON ASTA FOR CRICKET COMFORTABLE WIRELESS, REQUEST FOR A VARIANCE FOR A PROPOSED MINOR COMMUNICATION FACILITY TO REDUCE THE REQUIRED 40 FEET SETBACK TO 15 FEET FROM THE WEST AND 25 FEET FROM THE NORTH PROPERTY LINES. SUBJECT PROPERTY: ORO VALLEY UNITED CHURCH OF CHRIST, 1401 EAST EL CONQUISTADOR WAY, ORO VALLEY,ARIZONA 85737 Dee Widero, Senior Zoning Inspector reviewed the report. She explained that Cricket Comfortable Wireless has identified the need for a Minor Communications Service facility to serve in La Reserve Planned Area Development(PAD). The proposed equipment will be located below the existing detention basin at the northwest corner of the Oro Valley United Church Chapel at Pusch Ridge. The development on this parcel is governed by the development standards of the Private Schools and Churches (PS&C) district. The standards from this zone require a 40 feet setback from all property lines, 11/28/00 MINUTES,BOARD OF ADJUSTMENT 2 The applicant is requesting a reduction of these setbacks to 15 feet from the west and 25 feet for the equipment cabinets and the equipment will be approximately 100 feet from the closest backyard. Ms. Widero explained that there is a three-acre site for the proposed facility located east of the El Conquistador Patio Homes and south of The Ridge at La Reserve, a single- family residential neighborhood. At the northwest end of the main parking area is a detention basin surrounding with chain link fencing. Just beyond is a 5-foot retaining wall. Some of the homes at The Ridge at La Reserve above the proposed site may be able to look down upon the site, but their primary views are horizontally over the site. The site is above and visible from some backyards of the El Conquistador Patio Homes. Ms. Widero reported that she has received(2) calls of concern regarding the drainage in the area. No other calls or letters with comment have been received in support for or in opposition to the request for variance and the applicant has met with some of the homeowners of The Ridge at La Reserve. Staff finding of facts: • The property is more loped than other properties in the district and the high location eliminate obstructions for the communication facility. • The site will be noticeable from some adjacent properties, especially those below it that look up past it to mountain views. • If this variance request is approved, the applicant will then need to submit an application to the Development Review Board(DRB) for approval. The DRB is required to consider visual impacts and ensure the emissions meet Federal standards. • If this variance is approved the applicant will need to ensure that the drainage changes not affect downstream properties. Chairman Swan swore in the witness that was intending to testify. Ron Asta, 3661 North Campbell Ave.,#108, explained that at the request of Member Adler, he had brought an exhibit of the actual antenna that would be used on the site, and proceeded to review the site plan using the overhead projector. Chairman Swan asked if staff was satisfied with the drainage system to adequately handle the extension of the existing detention outfall pipe. Chairman Swan swore in the witness that was intending to testify. Craig Civalier, Senior Engineer, stated that he had not reviewed the drainage system report, but would request that a review of the site be done. He said that his concern was the velocity of the water not being slowed down enough. He explained that after the pipe was extended, the water could run further downhill. . 11/28/00 MINUTES,BOARD OF ADJUSTMENT 3 Member Done suggested that the (3) towers behind the wall are moved back, leaving the structure out of sight of the neighboring homes and possibly using a different color scheme. Mr. Asta explained that the color scheme could be reviewed and approved by the Town before the structure was painted. He added that the equipment could be moved slightly to the east. Member Adler felt that there were other alternatives. He stated that a variance could be avoided by having an antenna install that was acceptable, this would avoid using the Zoning Code to accommodate a commercial business. Mr. Asta stated that if the unit were mounted on the wall of the church, it would not provide the coverage needed. He said the neighbors have already opposed placing the antenna on the rooftop. He explained that if adequate coverage were not provided, the consumer would experience fallout in communication and the only solution would be to find another site. Member Suozzi asked if there were other alternatives. Mr. Asta explained that Cricket Communications had approached the hotel about installing an antenna, but the hotel was already leasing equipment and antenna space to Sprint Communications. Chairman Swan opened the public hearing. Chairman Swan swore in the witness intending to testify. John Clarke, 1172 East Camino Diestro, stated that he wanted to clarify that the El Conquistador Homeowner Association had not approved the installation of the antenna nor have they objected, but felt that a 10 foot retaining wall would deprive the look of the area. Chairman Swan swore in the witness intending to testify. Margaret Frank, 1246 East Camino Diestro, stated that she had received a letter from the Town regarding the matter, but had not received any information from Cricket Communications. She felt that approving the variance would set the precedent for other companies wanting to do business in Oro Valley. Chairman Swan swore in the witness that was intending to testify. Art Segal, 10148 North Bighorn Butte Drive, was in support of the development of the site. His only concern was if the facility would have a negative impact in terms of radiation in the area. 11/28/00 MINUTES,BOARD OF ADJUSTMENT 4 Mr. Asta gave the following explanation for various questions raised by the Board regarding the site: • If trees were planted in front of the wall, it would block the line of sight. • Desert shrubs could be added to the bottom 4 feet, leaving a 6-foot wall in view. • There would be no new grading for roadways. • There is no available space for additional minor communication facilities in the area. • The facility would cover a 3-mile radius. • Cricket Communication has looked at the possibility of other site's but has had difficulties with timing. Member Suozzi asked staff if there was another location to place the antenna that would be less obtrusive to the homeowners in the area. He asked if staff had any recommendation. Ms. Widero stated that there were no high locations available that would accommodate Cricket Communications at this time. Bryant Nodine explained that with the direction of the town attorney, staff was required to provide only the "finding of fact." Member Adler stated that he did not see the Town having the responsibility to bend the rules to allow a commercial enterprise to do business or more business in the Town. He said that in his opinion the variance process is designed not to make this kind of accommodation. He said, "even though it is a neat convenience, it is not essential." MOTION: Member Adler moved to DENY OV 10-00-15, finding that there are other locations for an antenna,be it less than perfect or less than 100%coverage which do not require a variance. It is in my opinion to allow a variance for this use is inconsistent with the zoning requirements. Motion SECONDED by Member Done. Member Done stated that she believed in free enterprise, but felt there had been several cellular services presenting their case over past the 3 months, and that the situation was getting increasingly out of hand for variances for the Town to accommodate these types of services. Member Suozzi stated that he had concern that the homeowner's did not have much input and he felt uncomfortable that there weren't any alternatives. He felt that it would have been appropriate to place the unit in a commercial use area.
