Foran 4/22/01 A variance from the provisions of this Code shall not be authorized unless the Board shall find upon sufficient evidence: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in this district; and (see B.) ANSWER : 1. Size- A reduction in the size of the building site would reduce the type of wood working available for use. Large pieces of plywood or molding would have to be precut, causing a financial impact to the property owner. Also the distance between equipment ( band saw, belt sander, grinder, and drill press) would be impacted causing a possible hazardous environment for personnel using this equipment. 2. Shape - The shape of the of the lot offers 2 alternative sites : a.) Extend existing garage - 3 existing grapefruit trees and an existing pool would be destroyed for part of pouring a new concrete foundation. This site is on an elevation 2 foot lower than the garage slab. A new concrete slab would have to be poured to match the existing foundation. This would involve considerable cost. This may cause structural impact to the existing garage foundation. An architect would have to be hired at considerable cost to review a structural and aesthetic modification to the house (garage is enclosed as part of the house). b.) Build on sand volleyball court. This alternative impacts three areas: 1.) Gate access - the sand volleyball court is impacted by lack of a gate. Materials could not easily be brought back and forth to the workshop. 2.) Elevation - This elevation is in a higher area that the basketball court. It would significantly impact their mountain view. 3.) Foundation - The existing basketball court has a concrete slab foundation.. While this workshop will have concrete supports on the outside of this slab for structural support, the existing slab can be used to secure the woodworking equipment and provide an existing floor. Findings Timothy R. Foran 4/22/01 Section 2 b (continued) 3.) (Continued) The sand volleyball court has no foundation. A new foundation would have poured at considerable expense. 3. Topography - The alternative sites have higher elevations impacting the neighbor's mountain view. 4. Location - The proposed site has access to an existing gate. The alternative sites do not. 5. Surroundings - The existing pool, trampoline, sand volleyball court, and landscaping are surroundings which are unique to this lot. B. That special circumstances were not created by the owner; and (see C.) ANSWER : The surroundings (pool, sand volleyball court, trampoline, and basketball slab) and landscaping were installed by the previous owner. C. That the authorizing of a variance is necessary for the preservation and enjoyment of substantial property rights; and (see D.) ANSWER: The right to pursue a leisure time activity is consistent with woodworking activities that retired individuals pursue in Tucson and Oro Valley. In addition, our 14 year old daughter has expressed a strong interest in learning woodworking. The pursuit of this activity is a powerful deterrent against peer pressure with the influences of drugs and alcohol. D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and (see E.) ANSWER: No significant impact to other properties in the area. The walls of this workshop are 8 feet high, and the proposed site elevation is at a lower elevation point on the property than the 2 alternative sites. The preexisting surroundings (pool trampoline, sand volleyball court , and landscaping) are a condition not shared with the neighbor's lots. Therefore, this request is not a special privilege. Findings Timothy R. Foran 4/22/01 E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. ANSWER : Adjacent neighbors on either side of the property have signed statements offering no objections. Neighbor on left hand side (# 133 Lot 101) has a shed in the same property line area as this proposed site. All personnel using this workshop have agreed to abide by the noise and lighting requirements of Oro Valley. No pollutants will be produced by activities in this workshop.
