ORO VALLEY PLANNING AND ZONING DIVISION BOARD OF ADJUSTMENT REPORT CASE NO: OV 10-05-05 Hearing Date: June 28, 2005 Agenda Item No.: 1 Prepared By: Dee Widero, Senior Zoning Inspector REQUEST: CURTIS & TRESTA ANDERSON REQUEST FOR A VARIANCE TO ENCROACH INTO THE REQUIRED SIDE AND REAR YARD SETBACK FOR RANCHO CATALINA SUBDIVISION, LOT 208. SUBJECT PROPERTY: 8390 N. RANCHO CATALINA AVENUE,ORO VALLEY,AZ 85704 (PARCEL 225-17-2080). REQUEST SPECIFICS: Curtis & Tresta Anderson are requesting to encroach by 7.5 feet, into the required 15 foot side yard, and into the required 40 foot rear yard setback by 33 feet to allow construction of an attached bedroom, two-car garage and storage to the side of the existing home. SITE LOCATION: This site is located in the Rancho Catalina subdivision, and can be reached by traveling from Magee Road north on Oracle Road to Catalina Shadows Boulevard; turn east (right); follow to the first street intersection, which will be Rancho Catalina; continue straight, you will reach Rancho Catalina again at the next street intersection; turn north (left); the first home on the right side just after the wash is the subject property. A notice of hearing is posted at the driveway entrance. NOTIFICATION: All property owners within 300 feet of this property were notified by mailing of this hearing. The property is posted with a notice of hearing and the hearing was advertised in the Daily Territorial. At the time of this report preparation, staff has heard and received a letter from Carla Peterson(her letter is included); she is not in support of this project. No other neighbors have made comment in support of or in opposition to the request. SITE ANALYSIS: Subject property is a 33,088 square foot corner lot. The property is relatively flat. The grade raises gradually about 13 feet from south to north, the lowest portion being at the driveway area (southwest corner of lot). Natural vegetation to the rear of the lot, behind the home has been disturbed, with the exception of a row of trees along the north property line. Rancho Catalina subdivision was recorded as a CR-1 zone by Pima County in 1972. The Town of Oro Valley annexed this portion of the subdivision in 1984, translating the zone to R1-36. Surrounding properties are: North—R1-36, Single Family Residential District South—R1-144, Immaculate Heart West—a mix of C-1; R-6 and R1-144 off Oracle Road East—CR-1 (in Pima County) Single Family Residential District PLAN ANALYSIS: The applicant is proposing to attach the addition to the southern most portion of the existing house, encroaching into the southwestern section of the side and rear yard setback requirements. The setbacks for R1-36 are front 30', side 15', and rear 40'. The original setbacks for the home from Pima County were front 30', side 10' and rear 40'. This addition would not meet with those standards nor did the existing original home, which has a 25' rear yard setback and should have had a 30' setback. The current driveway which used to access up and into what in now labeled "existing house — new construction", is proposed to have direct access into the garage. During staff review with the applicant, we discussed the option of placing the addition to the west side of the home or behind the home. The applicant felt it would be less obtrusive to the neighbors in the proposed location. SUMMARY: Staff finding of facts: • The original plat designated where the access to this property would be, which is off of N. Rancho Catalina. That access is what determines the front yard from side or rear, not how the home is located on the lot. The result is a shallow, wide lot. • The existing home does not currently meet Pima County and/or Oro Valley rear yard standards. • The addition could be placed elsewhere on the lot to meet code standards, and would not disturb any natural vegetation, as the entire lot at some point has already been disturbed. The Board of Adjustment should consider the following findings in making its decision: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and 7 B. That special circumstances were not created by the owner or applicant; and C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. SUGGESTED MOTION: The Board may wish to consider the following motions: I move to approve OV 10-05-05, a request to encroach into the side yard by 7.5 feet from the required 15 and rear yard setback by 33 feet from the required in order to construct a garage, bedroom and storage. OR I move to approve OV 10-05-05 as submitted by the applicant with the following stipulations: (Staff does not have any stipulations to recommend). OR I move to deny OV 10-05-05 finding that: (Board to state reason why the variance cannot be granted). ATTACHMENTS: 1. BOA application/appendices 2. Location map 3. Site plan 4. Peterson 414) r 1 2 Oro Valley, Arizona 85704 v5 May 11, 2005 Ms. Dee Widero Senior Zoning Inspector Oro Valley Board of Adjustment 11000 North La Canada Oro Valley, Arizona 85737 Dear Ms. Widero, This is a request for your attention regarding a variance application submitted by Curtis and Tresta Anderson, 8390 North Rancho Catalina Ave. They are requesting the variance in order to build a garage and storage addition. It will be helpful for you to have a little background so you can understand my contacting your office. I bought my home 4 years ago. The location and unob- structed views were its best assets. At that time it was apparent that it needed a great deal of work to bring it up to fit into the surrounding area. Most of the work is done. Many hours of hard work, and a considerable amout of money, have increased its value and beauty. The neighbors will agree. I am writing to submit my deep concerns regarding the location of the proposed addition. From the list of 13 neighbors contacted, my property is the only one that abuts the Anderson's lot. The requested location would be at the corner of my backyard and would, in effect, be part of my permanent view from from any spot therein. This would be distressful in that I spend 80% of my time out there. Further, my views of the city, its lights and all the mountains would be severely restricted. Also of grave concern is the certainty that there would be a decrease in the value of my property. It is important to note that the Andersons have a large open area at the rear of their house. This alternate site would not impact any neighbor nor would it require a variance from your office. In speaking with Mr. Anderson about why he prefers building in his front yard rather than this large open area, his response was that it would be in view of his parent's home which is situated on the corner of East Windward Place some distance back. Ms. Dee Widero -2- May11 ,2005 The Andersons have an attractive home. It abuts my side wall and is somewhat higher. To compensate for this I have added some trees, trellises with vines and a privacy screen to block out their lights. None of these items interfere with their view or mine. Please know that the Andersons are friendly and a nice family. This is not a personal issue. I have stated my concerns to them and I cannot justify the reasoning for the current proposal. In closing, I would welcome someone from your office to drop by and see exactly why this request is being submitted. Enclosed are some photos for your re- view. I thank-you for your consideration and look forward to hearing from you. Sincerely, Carla H. Peterson enclosures } A . ,...., . ii , ,..... .‘, • -,. ., ..., A ,. OV10-05URTIS & TRESTA ANDERSON, REQUEST A VARIANCE TO ENCROACH INTO THE REQUIRED SIDE AND REAR YARD SETBACK FOR RANCHO CATALINA SUBDIVISION,LOT 208. SUBJECT PROPERTY (PARCEL #225-17-2080) 8390 N. RANCHO CATALINA AVENUE, ORO VALLEY, AZ 85704 Curtis Anderson, 8390 North Rancho Catalina Ave, requested a variance for an additional bedroom and garage because his growing family needs more space. Member Schannep explained that there was nothing about the property that would lead the Board to believe the property was in a special situation. He stated that there were alternatives to building the addition that would accommodate the needs of the Andersons and would allow the home to remain aesthetically pleasing. Vice Chair Kessler agreed. Dee Widero, Senior Zoning Inspector reviewed the report. She reported that the Andersons were requesting to encroach by 7.5 feet into the required 15 foot side yard, and into the required 40 foot rear yard setback by 33 feet to allow construction of an attached bedroom, two-car garage and storage unit. She reported that the applicant was proposing to attach the additions to the 06/28/05 MINUTES, BOARD OF ADJUSTMENI 2 REGULAR MEETING southern most portion of the existing house, encroaching into the southwestern section of the side and rear yard setback requirements. The setbacks for R1-36 are front 30 feet, side 15 foot, and rear 40 feet. She explained that the original Pima County setbacks for the home were front 30 feet, side 10 feet and rear 40 feet. She reported that this addition would not meet with those standards nor did the existing original home, which has a 25 feet rear yard and should have a 30 feet setback. She explained that the current driveway which used to access up and into what iS now labeled "existing house—new construction", is proposed to have direct access into the garage. She reported that during staff review with the applicant, staff discussed the option of placing the addition to the west side of the home or behind the home; however, the applicant felt it would be less obtrusive to the neighbors in the proposed location. Staff finding of facts: • The original plat designated where the access to this property would be, which is off of North Rancho Catalina. That access is what determines the front yard from side or rear, not how the home is located on the lot and the result is a shallow, wide lot. • The existing home does not currently meet Pima County or Oro Valley rear yard standards. • The addition could be placed elsewhere on the lot to meet code standards, and would not disturb any natural vegetation, as the entire lot at some point has already been disturbed. Chair Adamson opened the public hearing. Carla Peterson, 522 East Windward Place, was not in support of the variance because it would obstruct her views from her backyard. She suggested that the addition be reversed and constructed on the opposite side of the home. Mr. Anderson reported that if he were to build a detached addition it would not alleviate the problem of obstructing Ms. Peterson views. Chair Adamson closed the public hearing. MOTION: Vice Chair Kessler moved to DENY Case No. OV 10-05-05, finding that the variance does not meet the criteria. Member Schannep SECONDED the motion. Motion carried, 3-0. Member Schannep stated that with the proper assistance and guidance, he was confident a solution would be found. 2. BOARD OF ADJUSTMENT RULES AND OPERATING PROCEDURES Discussion and possible action on the Rules and Operating Procedures Bryant Nodine explained that at the previous meeting, the Board identified items to be revised and that the revisions have been incorporated. He suggested the Board move forward and submit the Rules and Operating Procedures document to the Town Council for approval.
