F:IAdmin PZIFORMSIShannon Project Subdivision Development HandoutlDRBPROJARCHAPP.doc TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD MEETING DATE: May 13, 2003 TO: DEVELOPMENT REVIEW BOARD FROM: Robert Conant, Planner II SUBJECT: OV13-03-18, BROCK QUALLS REQUESTS ARCHITECTURAL REVIEW OF A MODEL HOME, LOTS 7, 10, 11 AND 13 FAIRWAY VILLAGE WITHIN THE EL CONQUISTADOR COUNTRY CLUB PAD, PARCELS 224-240-440, 224-240-470, 224- 240-480 AND 224-240-500 BACKGROUND: The El Conquistador Country Club PAD was adopted by Town Council in November 1983 and the Plat for Fairway Village was recorded in October 1987. The area is zoned PAD. The lots contain land areas as follows: Lot 7 8,492 square feet Lot 10 7,077 square feet Lot 11 6,936 square feet Lot 13 7,061 square feet The lot, including the entire subdivision was mass graded at the time the map was recorded (1987). The lots listed above are only remaining vacant lots within this subdivision. The following setbacks are applicable: Front: 20-feet from the street Side: 5-feet with 10-feeet between structures Rear: The PAD gives no guidance or requirements for the rear setback. SUMMARY: The applicant Brock Qualls proposes to construct this model home on Lots 7, 10, 11, and 13 of Fairway Village. The models will be located along Broadstone Drive and will be two stories in height. The height of the house from finished grade will be 27'-6.5", which is below the maximum height of 38-feet allowed by the El Conquistador Country Club PAD. The house can be characterized as being in the Queen Anne cottage style, which is similar to the surrounding homes in the neighborhood. The following describes each of the elevations: Front: This elevation consists of the garage, front entry and a bay window element. The garage extends beyond the house by about two feet and is a front on three car garage, typical of the neighborhood. The second story is above the garage with an extended dormer, with a gabled roof. The glazing within the dormer is a pair of French doors which create a balcony when opened. TOWN OF ORO VALLEY DEVELOPMENT REVIEW BOARD STAFF REPORT Page 2 Rear: This elevation consists of a covered patio within the roof line of the house. The elevation also has a dormer matching the one in the front. Right Side: The elevation has glazing in the living room and kitchen which take up this side of the house. A single French door leads from the Master Bedroom to the covered patio. Left Side: The elevation has glazing in the Master Bathroom and Bedroom 2, there is no glazing in the garage which makes up the remainder of this elevation of the house. The roof material is clay barrel tile and the color palette is attached for review. GENERAL PLAN COMPLIANCE: The model complies with the General Plan Design Elements. In particular all four sides are treated comprehensively and the model is similar to the surrounding environment. ZONING COMPLIANCE: The model complies with the zoning setbacks and building height as set forth in the El Conquistador Country Club PAD and the OVZCR Design Guidelines. PUBLIC PRESENTATION: As established in Resolution (R) 98-31, "all presentations before Boards, Commissions and Council" must be formatted to be shown on the Town's projection system or overhead system. A presentation must be designed to insure that the audience, staff and voting body can view the graphics. Examples of acceptable computer formats are Power Point, Arc View, videotape, presentation boards and/or overhead transparences. This item will be placed on the consent agenda. If the Development Review Board moves this item to the regular agenda, the applicant must be prepared to provide a presentation. The applicant is responsible for the development, presentation and coordination of all presentation materials. If an applicant does not conform to the aforementioned resolution, the item may be continued due to non-compliance. RECOMMENDATION: Staff recommends that the Development Review approve the architecture for Lots 7, 10, 11 and 13 Fairway Village, subject to the conditions listed in Exhibit A. SUGGESTED MOTION: The DRB may wish to consider the following suggested motion: I move to approve OV13-03-18, Model Home, lots 7, 10, 11 and13 Fairway Village, subject to the conditions listed in Exhibit A, attached herewith. Member Kunisch recommended that the applicant have more contact with the neighboring residences in order to satisfy their concerns. Vice Chair Mager felt that the grading exception was a precursor to a zoning change, and commented that she would not be in favor of a zoning change. Chairman Vogelsberg observed that a grading exception would need to be approved in order for a zoning change to be successful, but noted that the applicant had not submitted a development plan nor gone through the rezoning process. He stated that he did not believe that the property could not be developed as zoned without the grading exception. MOTION: Vice Chair Mager moved to deny OV9-02-06 Grading Exception. Member Caswell seconded the motion. Motion carried 6-0. 3. Member Caswell inquired how long modular buildings are allowed to be up. Bryant Nodine answered that they are allowed during construction for the purposes of handling the uses of the site until the final building is constructed. David Ronquillo stated that it was his understanding that the proposed modular buildings would be used as temporary classrooms. F:\Minutes\DRB\2003\5-13-03 minutes.doc Minutes approved 6-10-03 5 5/13/2003 Development Review Board Minutes Page 6 Chairman Vogelsberg asked what the lifespan of an approved development plan was. David Ronquillo answered that, once construction has begun, development plans do not expire. Citizen Elwood Mayberry requested fencing between the trailhead and the proposed parking area. Louise Benneckar, representing Pusch Ridge Estates HOA, expressed concerns over the modular buildings, outdoor lighting, parking lot, and storage trailers. Bill Hallinan, representing the Pusch Ridge Christian Academy, explained that the modular buildings are existing, and that possibly two more modular buildings will be added later if needed. He stated that an improved circulation route would be added during Phase One, which would improve access to the ball field. Additionally, he reported that no lighting was planned for the ball field. Member Kunisch inquired if the additional modular buildings would be the same color as the existing ones, which was answered affirmatively. Also, he asked if it would be possible to add fencing between the trailhead and the parking area. It was answered that the improved circulation route should resolve the problem, making fencing unnecessary. Chairman Vogelsberg questioned if the Development Review Board would review the architecture of the modular buildings, which was answered affirmatively. Additionally, he affirmed that any outdoor lighting added at a later date would be required to adhere to the lighting code. Staff recommended that DRB recommend to Town Council approval of the Development Plan subject to the conditions listed in Exhibit A. Staff Conditions: 1. All conditions of the Grading Exception approved by Town Council on March 5, 2003 and attached hereto shall be conditions of the Development Plan. These shall be added as General Notes on the Development Plan. 2. All outdoor lighting shall be in compliance with Chapter 17 of the OVZCR except that all parking lot light standards shall not exceed eighteen (18') feet in height, and all patio lighting in building 1, 2, 9 and 10 shall be fully shielded. 3. Public Art shall be reviewed and approved by the Town Council and shall be installed prior to the issuance of a certificate of occupancy for any building on the site. 4. Note 34; list the units that will be ADA accessible. 5. First flush system maintenance; add verbiage stating method of cleaning the debris out of the basin itself. 6. The cross slope in the PAAL between buildings 6 and 9 exceeds 5%. Check elevations in this area. 7. Ensure that the scuppers are at the lowest elevation in the PAALs or parking areas so that drainage does not run down the access drive to the water well site. 8. Explain the purpose of the ADA ramps to the back of shops 2. Neither of them meets ADA standards. Check the cross slope grade of 5% in the PAAL behind shops 2. The spot elevations do not agree. 9. Label concentration point 2 and show the value of the 100-year expected flow. 10. Show the design of the landscape berm along Lambert Lane. 11. Provide a revised drainage report. Tom Tracey, representing the Beztak Companies, made a presentation. Michael Franks, of Seaver- Franks Architects, gave an overview of the project and responded to the Board's comments. Member Feinberg commented that he didn't see many changes with the new plan. He observed that, though the ends of Buildings 7 & 8 had been reduced to two stories, additional units had been added onto the building overlooking the golf course; it was his understanding that this building was to remain two stories to preserve views. Michael Franks responded that the massing of the three F:\Minutes\DRB\2003\5-13-03 minutes.doc Minutes approved 6-10-03 7 5/13/2003 Development Review Board Minutes Page 8 story buildings had been broken up per the Board's suggestion, and that the design of the architecture was improved as a result. He added that density was critical. Member Feinberg and Michael Franks agreed that the six foot wall between the restaurant and Building One would not prevent aromas from traveling. It was confirmed that all buildings would be ADA accessible. Member Weatherford voiced his concerns about traffic cutting through the residential area. Member Kunisch applauded the addition of a playground area for children. He also questioned, and it was answered, that all mechanical units would be located on the rooftops and would not be visible. Citizens voicing concerns included: • Bob Oro • E. W. Shaffer • Max Dickerson • Conny Culver • Terry Parish • Bill Adler • Paul Schloss • Fran LaSala Issues discussed included: • Landscaping to screen views • Heights and appearance of buildings • Mixed Use Development and lack of guidelines • Overcrowding of site • Traffic & safety concerns • Negative impact on adjoining neighborhoods • Crime • Impact on schools • Underground parking • Market feasibility Stephanie Athey spoke in favor of the proposed apartments, and cited the success of the Golf Villas, which she manages. Mark Simon, representing the applicant, addressed their right to build apartments on the site based on the current zoning. MOTION: Vice Chair Mager moved to continue OV 12-02-06 Development Plan. Member Kunisch seconded the motion. F:\Minutes\DRB\2003\5-13-03 minutes.doc Minutes approved 6-10-03 8 5/13/2003 Development Review Board Minutes Page 9 The Development Review Board individually complimented the architect on the design of the buildings. Member Weatherford expressed concerns regarding the circulation of traffic, overcrowding of the site, and the proximity of the restaurant to residential units. Member Feinberg commented that he did not see the point of extending the review any further. He expressed that the site was overcrowded and therefore could not provide sufficient greenbelts and buffers. He felt the project was not in harmony with surrounding neighborhoods, and was not confident that mixed use development would have a positive impact on the community. Member Kunisch questioned the safety of the traffic flow, the health of the residents who are subject to the smell of the restaurant and car fumes from the commercial development, and the welfare and happiness of the future residents. Member Caswell reported on her search for a definition of mixed use development; it is defined by Atlanta Quality Growth as "...a coming together of differing yet complimentary activities of commercial, recreational and cultural". She asserted that this project did not meet such standards. She agreed with Member Feinberg's findings. Vice Chair Mager maintained that the proposed development is inferior in design to the development plan that she originally approved. She analyzed the comparison to the Golf Villas, with its rolling hills and grassy areas, and asserted that they would not be comparable. In addition, circulation and child safety were of great concern to her. Chairman Vogelsberg inquired if it would be appropriate to continue the item. Member Weatherford expressed doubt that any further suggestions would promote progress. Continuing the item was advocated by Vice Chair Mager because she did not feel that it was ready to go to the Mayor and Town Council for approval. Chairman Vogelsberg perceived that the Board would be doing the applicant an injustice to continue the item without including more instruction. Member Kunisch questioned what guidelines the DRB should follow for mixed use development, and whether they should table the item until the General Plan is approved. Member Feinberg remarked that he did not see any substantial changes in the plan since the last time they reviewed it, and questioned if any progress would be made upon a continuance. Member Weatherford recommended denial based upon safety issues related to the internal circulation, and aesthetic issues due to the overcrowding of the site. The undercurrent of unhappiness of the surrounding neighbors would be expressed to Town Council by Chairman Vogelsberg. Staff recommended that the DRB recommend approval to Town Council, unless the sign package was changed to meet code, in which case staff would recommend that the DRB approve the sign package. Richard Curtis, representing Fluoresco, addressed the Board. He stated that he did not have the authority to change the monument sign from 8 feet to 6 feet, but that he believed it could be done if wall heights did not interfere with views of the sign. Vice Chair Mager inquired about the placement of the signs, and how they would be affected by a new development plan. Bryant Nodine answered that none of the signs would be placed until the development plan is approved; the comprehensive sign package would be used to review the Bank One sign package. MOTION: Member Weatherford moved to recommend to Town Council approval of OV13-03-16 Comprehensive Sign Package, unless the applicant agrees to lower the free standing signs from 8 feet to 6 feet, in which case the motion is for DRB to approve.
