BOARD OF ADJUSTMENT REPORT
CASE NO: OV10-00-15
Hearing Date: November 28,2000
Agenda Item No.: 1
Prepared By: Dee Widero, Senior Zoning Inspector
REQUEST: Ron Asta for Cricket Comfortable Wireless, request a variance for a Minor
Communication Facility to reduce the required 40' setback to 15' from the west
and 25' from the north property lines. Subject property: Oro Valley United
Church of Christ, 1401 E.El Conquistador Way,Oro Valley,AZ 85737.
REQUEST SPECIFICS:
Cricket Comfortable Wireless has identified the need for a Minor Communications Service
facility to serve in La Reserve Planned Area Development (PAD). The proposed equipment will
be located below the existing detention basin at the northwest corner of the Church site, as shown
on page C 1 of the site plan. The Oro Valley United Church Chapel at Pusch Ridge is located
within the La Reserve Planned Area Development District C. Development on this parcel is
governed by the development standards of the Private Schools and Churches (PS&C) district,
section 8-401 of the Oro Valley Zoning Code Revised (OVZCR). The standards from this zone
require a 40' setback from all property lines. The applicant is requesting a reduction of these
setbacks to 15' from the west and 25' from the north for the equipment cabinets.
SITE LOCATION:
To reach the site location, turn east from Oracle Road on El Conquistador Way, follow the road
around, you will arrive at the Guard House at La Reserve the Church site entrance is to the north
(left)posted with an Oro Valley Public Notice.
NOTIFICATION:
All property owners within 300 feet of this property have been notified of this hearing. The property
has been posted with a Notice of Hearing and the Hearing Notice has been advertised in the Daily
Territorial newspaper. At the time of this report preparation Mr. Ray Marks had called with
concerns of drainage, his home lies below the detention basin and drain area. No other calls or
letters with comment have been received in support for or in opposition to this request for variance.
The applicant has met with some homeowners of The Ridge at La Reserve (included are results
from that meeting).
SITE ANALYSIS:
The three-acre site for the proposed facility is located east of the El Conquistador patio homes
and south of the Ridge at La Reserve, a single-family residential neighborhood. At the northwest
end of the main parking area is a detention basin with chain link fencing surrounding. Just
beyond is a 5' retaining wall (see the attached exhibit A). Some of the homes at the Ridge at La
Reserve above the proposed site may be able to look down upon the site, but their primary views
are horizontally over the site. The site is above and visible from some backyards of the El
Conquistador patio homes. The equipment will be approximately 100' from the closest
backyard.
PLAN ANALYSIS:
Cricket Comfortable Wireless proposes to place a 10' x 19' concrete slab and 6'8" tall
equipment cabinets on the flat area just west of the existing retaining wall. One foot of height
would be added to the existing wall. The existing chain link fence would be painted a dark matt
green and Mesquite trees would be planted on the north side and desert shrubs along the west
boundary of the detention basin to further screen the chain link fence. This was an agreement
made between Cricket Comfortable Wireless and the surrounding neighbors, at a recent
neighborhood meeting.
As shown in exhibit B & C, the cabinet equipment will be screened with a 10' wall. That wall is
to be camouflaged with multiple-desert colors (greens and browns). Mounted flush to the
decorative (camouflaged) masonry wall, will be three 6' long antennas. An earth berm will be
constructed with rock and vegetation, in order to extend the existing drainpipes for adequate
drainage, and to further blend the structures into the landscape.
SUMMARY:
Staff finding of facts:
• The property is more sloped than other properties in the district and the high location
eliminate obstructions for the communication facility.
• The site will be noticeable from some adjacent properties, especially those below it that look
up past it to mountain views.
• If this variance request is approved, the applicant will then need to submit an application to
the Development Review Board for approval. The DRB is required to consider visual
impacts and ensure the emissions meet Federal standards.
• If this variance is approved the applicant will need to ensure that the drainage changes do
not affect downstream properties.
The Board of Adjustment should consider the following findings in making its decision:
A. That there are special circumstances or conditions applying to the property referred to in
the application including its size, shape, topography, location or surroundings which do
not apply to other properties in the district; and
B. That special circumstances were not created by the owner or applicant; and
2
M N
C. That the authorizing of the variance is necessary for the preservation and enjoyment of
substantial property rights; and
D. That any variance granted imposes such conditions as will assure that the authorizing of
the adjustment shall not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which such property is
located; and
E. That the authorizing of the variance will not be materially detrimental to persons residing
in the vicinity, to adjacent property, to the neighborhood or the public welfare in general.
SUGGESTED MOTION:
The Board may wish to consider the following motions:
I move to approve OV 10-00-15, a request to reduce the setbacks from 40' to 25' from the north and
15' from the west of the detention area to property lines.
OR
I move to approve OV10-00-15, as submitted by the applicant with the following stipulations:
OR
I move to deny OV10-00-15, finding(Board to state reason why the variance cannot be granted)

To the Town of Oro Valley:
This statement is to confirm the proposed Cricket Communications of Arizona; site
TUS-003B meets all FCC MPE requirements.
Power density is calculated at 42.2 uW/cm2 at the foundation of the building'
This level is 4.29% of the FCC limit for uncontrolled environments.
The composite power is calculated at 120 Watts to the antenna.
The FCC limits for uncontrolled environments are:
1000 uW/cm2
Meeting the above requirements also mean that this site is exempt from routine RF
exposure analysis by the FCC.

VISUAL IMPACT STATEMENT
The Town of Oro Valley DRB approved a minor communication facility last
September. The proposal proposed a stealth church steeple with the antennas
located within the steeple.
However, the United Church of Christ did not execute a lease with Cricket
Communications due to opposition from the neighbors from the north in the
residential area known as The Ridge at La Reserve.
This proposal, however, has been developed with these same neighbors who
will not oppose the required approval from their Architectural Review
Committee, which must authorize this facility as part of their CCR's. Those
CCR's apply to the Church property as well as the residences.
So here is the proposal: The lowest point of the Church Campus is at its
southwest corner just beyond the parking lot where there exists a drainage
detention basin. This site remains below the residences at La Reserve to the
north but remains some 30' above El Conquistador Way and some 40' above
the residential rooftops beyond the west boundary of the Church.
There exists a flat area a few feet west of the detention basin. The detention
basin itself is enclosed by a chainlink fence that will remain and be painted
dark matt green. Mesquite and Palo Verde trees will be planted on the north
side of the basin to further screen the chain link fence, and desert shrubs will
be added along the west boundary of the detention basin to further screen the
chain link fence from the north and west.
A few feet further west of the desert shrubs exists a 5' retaining wall. 1' of
height will be added to this wall. Immediately west of the retaining wall, a
concrete slab and 6'8" equipment cabinets will be placed on the flat area and
on fill dirt as shown on Exhibit A2 of the Zoning Drawings.
The width of the equipment compound is proposed at 12' and its length is
20'. The entire compound will be surrounded by a new 10' masonry wall
except for the gate on the south. Because of the topography, this new 10'
masonry wall will screen all but 8" of the equipment cabinets.
The new 10' wall will be painted multiple-desert colors (greens and browns)
which will truly camouflage the equipment compound from El Conquistador
Way, the residences below on the west and the residences on the north.
Please refer to the 3 photos which present existing conditions, the various
construction phases and the finished development.
Please notice even further that after the new 10' decorative masonry wall is
constructed and painted, 3 - 6' deep antennas will be flush mounted to the
wall with "sight" lines to the northwest, west and southwest over existing
perimeter development. Though the photo simulation shows these antenna
colored desert brown, they are only shown as that color so that the DRB can
see where they will be installed. They will be camouflaged with
multiple-desert colors as well.
Finally, on the north side of the proposed equipment and antenna compound,
an earth berm will be constructed with rocks and vegetation that already exist
around the perimeter which will reflect the existing hillside desert colors.
And a canopy tree will be planted in the berm to shield the exposed 8" of the
equipment cabinets from the residents on the north.
A building setback variance was filed with the Town of Oro Valley (Ms. Dee
Widero) on November 6, 2000 and the public hearing before the Board of
Adjustment is scheduled for November 28.
