ORO VALLEY PLANNING & ZONING DEPARTMENT DEVELOPMENT REVIEW BOARD MEETING DATE: January 9, 2001 IFEEO PY TO: DEVELOPMENT REVIEW BOARD FROM: Robert Conant, Planner II SUBJECT: OV13-00-78 MONTEREY HOMES REQUEST FOR ARCHITECTURAL APPROVAL — MODEL HOME LOCATED IN VISTOSO HIGHLANDS, RANCHO VISTOSO NEIGHBORHOOD 11 PARCEL H BACKGROUND: Monterey Homes has presented a plan for a model home to be located in Vistoso Highlands within Rancho Vistoso Neighborhood 11. Vistoso Highlands covers a gross area of 43.85 acres and consists of 89 lots. Monterey Homes purchased lots 1-9 and 30-34. The subdivision is located on the north side of Vistoso Highlands Drive west of Rancho Vistoso Boulevard. On November 14, 2000, Monterey Homes received DRB approval for two model plans, each with three elevations. The models previously approved will be constructed on the above mentioned 14 lots as will the present request. The current request is in addition to the previous approval. SUMMARY: The plan presented is a single story structure of 3030 square feet. The elevations may be described as Southwest Contemporary (the developer refers to the elevations as Spanish (colonial), Craftsman and Italian). All elevations are finished in stucco, wood fascias, decorative shutters (Spanish and Craftsman), aluminum window frames and gabled and hip tiled roofs. The `B" elevation varies from the other two by adding stone veneer on the front façade(Craftsman). Each plan has a three car garage, two front on and the third (one car) turned ninety degrees to the house. The one car bay may be built as a room, leaving the house with a two-car garage recessed from the front façade. The roof material is concrete tile available as flat or "S" style in a choice of two colors (Charcoal Brown and Estancia Brown), that will complement the house in style and color. The color palette has been provided, each palette compliments the other, along with the wood fascias, and the stone on the `B" elevation(color name Desert Blend Cobblefield). The color themes are attached. GENERAL PLAN COMPLIANCE: The models comply with the General Plan's Community Design Element policies in that the design and color scheme will blend with the build environment. In addition, all four sides of the models have been "coherently designed and treated." ZONING COMPLIANCE: The project is in compliance with the Rancho Vistoso PAD, for Medium Density Residential with the following setbacks: Front: 20 feet Side: 5 feet Rear: 10 feet Maximum Building Height: 30 feet The model will fit all of the lots. PUBLIC PRESENTATION: Pursuant to Resolution (R) 98-31, "all presentation before Boards, Commissions and Council of rezonings, subdivision plats, development plans, and planned area developments must be formatted to be shown on the Town's projection system or overhead system. The "Planning and Zoning Administrator"; however, may exempt certain projects." A presentation must be designed to insure that the audience, staff, and voting body can view the graphics. Examples of acceptable computer formats are Power Point, Arc View, a videotape presentation and/or overhead transparences. The applicant is responsible for the development, presentation, and coordination of all presentation materials. If an applicant does not conform to the aforementioned resolution, the item may be continued due to non-compliance. RECOMMENDATION: Staff recommends approval of the architecture for the model home to be constructed in Vistoso Highlands as presented by Monterey Homes. SUGGESTED MOTIONS: The DRB may wish to consider one of the following motions: I move to approve OV 13-00-78, Monterey Homes, architecture for a model home to be constructed in 2 Vistoso Highlands, subject to the conditions listed in Exhibit"A" attached, herewith. OR I move to approve OV 13-00-78, Monterey Homes, architecture for a model home to be constructed in Vistoso Highlands, subject to the conditions listed in Exhibit "A" attached herewith and the followed condition(s): OR I move to deny OV 13-00-78, Monterey Homes, architecture for a model home to be constructed in Vistoso Highlands finding that: Attachments: 1. OV13-01-05, CUSTOM HOME, LOT 92 IN CATALINA SHADOWS, REQUEST FOR ARCHITECTURAL APPROVAL David Ronquillo introduced the staff report into the record. Staff recommended denial, as it does not comply with the OVZCR design guidelines. The main concern was the twelve-foot distance between the front of the house and the garage. Bill Dolan, the applicant, provided a revised plan for his home and presented it to the Board. Member Underwood felt this project could be approved if Mr. Dolan wanted to work with staff to make the changes necessary to soften the front and perhaps shorten the length of the distance between the house and the garage. Mr. Dolan said he was willing to work with staff. Chair Vogelsberg asked Staff and Mr. Dolan to go work out the details and when they are through the Board would review it and make a decision. Chair Vogelsberg announced that this item would be considered further at the end of tonight's agenda. OV13-01-07 UNO PIZZERIA CHICAGO BAR& GRILL, LOT 6 WITHIN THE SAN JOSE PLAZA REQUEST FOR ARCHITECTURAL APPROVAL Bayer Vella introduced the staff report into the record. Staff recommended approval. Kim Acorn of Acorn Associates was present for questions. He briefly reviewed what is planned for the site and also provided color renderings of the building. Hearing Opened: Richard Feinberg, 1451 E. Triton Place, expressed his concern about the color arrangement; he felt more consideration should be given to this project as it sets precedence for future projects. He asked is this project compatible with what we like to see in Oro Valley? Jeff Weir, Economic Development Administrator, commented that he felt this would be a welcome addition to the community, yes it's a little different, but the applicant has worked very hard to make this 02-13-01 Development Review Board Minutes Page 4 compatible and still retain their identity. MOTION: Moved, seconded (Baiocchetti/Underwood) and carried by a 6-0 vote (Eager absent) to approve OV13-01-07, Uno Pizzeria Chicago Bar & Grill,Lot 6 within the San Jose Plaza. Roll Call Vote: Baiocchetti-yes, Bell- Yes, Chair Vogelsberg- Yes, Mager- Yes, Weatherford- Yes, Underwood- Yes STAFF CONDITIONS: 1. A cap must be placed over any spark arrestors; however, all vents and chimneys must terminate per appliance manufacturer listings. The fixture is subject to review by Planning & Zoning and the Town Building Official. 2. A wall to provide visual screening shall enclose ground mounted mechanical equipment. Furthermore, all roof-mounted equipment must be concealed from view from all sides of the building pad. 3. To augment design compatibility, all Uno Pizzeria landscaping, screening, and signage must be similar to existing uses within San Jose Plaza. OV12-99-01A VILLAGES OF LA CANADA BLOCK A LANDSCAPE PLAN AMENDMENT Member Underwood excused himself due to conflict of interest. Bryant Nodine introduced the staff report into the record. Mr. Nodine stated that the proposed landscape plan revision does not meet the Code and therefore recommends denial. Brian Catts, President of Homeowners Association, expressed their opposition to the imposition of a children's playground and urged the DRB to accept the alternative plan proposed by Kaufman and Broad. 02-13-01 Development Review Board Minutes Page 5 Howard Meyers, representing the applicant, Kaufman and Broad, expressed his concerns of how this could affect potential buyers. He would like to see this issue settled as he feels Kaufman and Broad has been put in the middle of this. Charles Hulsey, of the WLB Group, commented that this issue is holding up sales for Kaufman and Broad. He further commented that the Homeowners Association should be the one going before Council for a variance. Brian Catts, stated the Homeowners Association does not need a variance as they are willing to put in a recreation area, but it needs to be utilized to some extent by the adults or by the children. He commented that if it were for the children it would be grossly undersized, as this is the only recreation area that has been required for this subdivision. He also commented that the liability for a playground would be enormous as opposed to a fitness facility. Member Bell commented to Mr. Catts, putting the code aside, is there any other playground facilities in the Villages? Mr. Catts replied no. Member Bell then asked Mr. Catts was he speaking for all the homeowners of the Villages? He replied basically yes, but to please understand we are not anti-kid. The playground facilities were not wanted and families moving into this subdivision understood that. Member Bell asked Mr. Catts about the new homes being built, were they being marketed by the real estate agencies as being kid friendly? Mr. Catts replied he had no knowledge about that, but he did advise Kaufman and Broad sales staff that before they ever built a home there, it would be foolish to suggest there would be a playground in that area. Member Weatherford asked Mr. Nodine had the interpretation of the code been discussed with the Town Attorney? Mr. Nodine replied no. Member Mager commented she did not feel comfortable making a decision she felt this should item be continued. Chair Vogelsberg requested a recess. 8:40 the meeting resumed. Member Baiocchetti was excused due to conflict of interest. Chair Vogelsberg suggested a motion to continue this case, as he was not sure of the legal ramifications, that perhaps the Town Attorney should be present. MOTION: Moved, seconded (Vogelsberg/Weatherford) and carried by a 4-0 vote (Baiocchetti/Underwood excused, Enger absent) to continue of OV12-99-01A Villages of La Canada Block A Landscape Plan Amendment due to outstanding issues. Discussion of Board Members: Chair Vogelsberg stated he was not comfortable making a decision, he suggested the Town Attorney be present for any legal questions or concerns the Board Members had. Member Mager agreed. OV13-01-05, CUSTOM HOME, LOT 92 IN CATALINA SHADOWS CONTINUED. 02-13-01 Development Review Board Minutes Page 6 David Ronquillo informed the Board that Staff and Mr. Dolan had come to an agreement. Mr. Ronquillo provided details of the revised plan as well as added conditions and advised the DRB that Staff recommended approval. MOTION: Moved, seconded (Underwood/Baiocchetti) and carried by a 6-0 (Enger absent) to recommend approval of OV13-01-05, Custom Home, Lot 92 in Catalina Shadows request for architectural approval subject to staff conditions listed in Exhibit A stipulating delete item 6 and the added conditions must provide a courtyard wall starting at 5'in height on the east side of garage extending across the front yard entry sidewalk and terminating at bedroom 2. The height may be reduced to 3'on the east side of the sidewalk. Condition 7-Provide low lying vegetation at consistently short intervals along the outer edge of the wall. Condition 8-Add a clear story window on the east side of the garage. STAFF CONDITIONS: 1. A cap must be placed over the spark arrestors; however, all vents and chimneys must terminate per appliance manufacturer listings. The fixture is subject to review by Planning & Zoning and the Town Building Official. 2. Windows shall utilize pop-outs,or be recessed on all sides, except where under porches. 3. A wall to provide visual screening shall enclose ground mounted mechanical equipment and noise mitigation. 4. All flat-roofed segments of the home must have roof coatings painted to match the stucco. 5. The left elevation will include three(3) 9"x 9" square windows in the bedroom. 6. Low-lying vegetation must be added at consistent short intervals along the outer edge of the courtyard wall. 8. A clearstory window must be added to the east side of the garage. GRADING EXCEPTION REQUEST FOR THE ORO VALLEY COMMUNITY LIBRARY, OV 13-01-02 Brent Sinclair, Community Development Director, introduced the staff report into the record. He briefly reviewed what was discussed at the Town Council meeting back in October 18, 2000. Town Council granted approval with a condition that the access to the library be moved to Naranja Drive which would require an exception to allow a maximum depth of cut of up to eight feet and a maximum depth of fill of twelve feet instead of the six feet allowed by the ordinance. Mr. Sinclair stated this would require an additional $275,000.00 and time to design this. 02-13-01 Development Review Board Minutes Page 7 Craig Civalier, Engineer PE, explained to the Board what a cut and fill was. He pointed out to the DRB the areas that would require the cut and fill. He briefly reviewed the criteria used to evaluate grading exceptions. He commented that the granting of the grading exception requested by staff would allow for an access to be safe, aesthetically pleasing and ADA compliant. Member Underwood commented that this is a wonderful project and we all want it. However, the owner, who is the Town of Oro Valley, wants the egress and ingress on Naranja and he feels that the project doesn't meet all the criteria for an exception. He further commented that we have never hesitated to reject an exception to the private developer that did not meet the criteria and he stated that he could not support this exception for the Town. Member Weatherford commented that with what staff has been given to work with, he felt it was a good design. Member Mager commented that she was not happy with this plan. Member Bell agreed and felt she could not justify the amount of money that would be spent on this project. Member Vogelsberg felt it did not meet the six criteria. Mr. Sinclair addressed the issue of safety, and explained that is why the Council felt Naranja Drive would be a better design was because of the safety issue. Traffic studies show that the Naranja access would be safer. Member Underwood commented that the cost is not the issue. The issue is -- this does not meet the criteria, which are the Town's rules, and we should abide by them. MOTION: Moved, seconded (Baiocchetti/Mager) to deny the grading exception request for the Oro Valley Community Library, OV13-01-02. Motion failed: 3-3 vote Discussion: Roll call vote: Baiocchetti - yes, Bell - yes, Chair Vogelsberg -No, Mager-yes, Weatherford -no, Underwood -no. Motion failed: 3-3 Roll call vote: Baiocchetti - no, Bell -no, Chair Vogelsberg- yes, Mager-no, Weatherford -yes, Underwood - yes. Bayer Vella suggested forwarding this issue to Town Council with no recommendation but with the DRB's comments. MOTION: Moved, seconded (Baiocchetti/Bell) to recommend forwarding this to Town Council with no recommendation but with DRB comments. Motion failed: 3-3 02-13-01 Development Review Board Minutes Page 8 Roll call vote: Baiocchetti -yes, Bell -yes, Chair Vogelsberg- no, Mager- no, Weatherford -no, Underwood - yes UPDATE ON PROPOSED AMENDMENTS TO THE GRADING CODE, OVZCR CHAPTER 15,AND THE NATIVE PLANT SALVAGE AND LANDSCAPE PLAN REQUIREMENTS, CHAPTER 14 Member Baiocchetti excused. Bryant Nodine introduced the staff report into the record. Mr. Nodine reviewed the six standards the DRB uses to make a decision and then reviewed the standards the Board of Adjustment uses; which is to consider all six findings rather than meet all six findings. He stated that the purpose of this proposal is to simplify the review process, reconsider which subdivisions should be able to mass grade lots, and to amend the grading waiver requirements. Mr. Nodine asked for comments from the DRB members. Member Underwood commented that the proposed conditions are one's he could support. He describes them as a more realistic approach. Chair Vogelsberg was in agreement. Mr. Nodine continued his review of the Native Plant Salvage and Landscape plan requirements. He stated the objective is to allow administrative approval of salvage plans. Furthermore, staff proposed an amendment allowing DRB approval of landscape plans rather than sending the plans to DRB for a recommendation and then to Council for approval. Mr. Nodine stated that the proposed change will not shorten overall times for projects because landscape plan review and approval is run concurrently with plats or development plans. Member Underwood commented he thought the changes were a good idea. Other DRB members were in agreement. Hearing Opened: Mr. Charles Hulsey, 11361 N. Twin Spur Court, commented that he did not like the six-foot limitation on the cut and fill. Furthermore, he asked that on the salvage plan if they did not like staffs decision, could they have the right to appeal to DRB or Council? Mr. Nodine said it could be set up that way. Mr. Hulsey addressed the mass graded lots. He felt that with the market that he is seeing in Oro Valley and the requests that he is getting in his office, there is not enough of a building pad on some lots. On a 17,000 square foot lot, he is only allowed to disturb 12,000 square feet. He commented that he couldn't fit a 3,500 square foot house with a garage and driveway and a pool in the backyard. The requests will continue to come forward that more space is needed to build. Hearing closed: Member Underwood commented that he would like to complement staff on the hard work they put into this much-needed process. 02-13-01 Development Review Board Minutes Page 9 STAFF REPORT Mr. Vella just wanted to remind the Agenda Review Committee that it would meet at 5:45 to look at the Osco Architecture.
