C NC NA Design Guidelines Sec. 16-103 pp.16-1 through 16-9 Architectural design should consider the climate and energy conservation. Design solutions include: a. Provide shade for exterior walls. C NC NA b. Use roof overhangs, exterior shading devices or inset windows. C N C Comments 3 NA c. Design outdoor spaces so they are protected. C NC NA d. Use materials and colors that minimize heat absorption without reflecting. C N C NA Design should consider the historic context. The history is closely related to the climate; therefore, southwest themes are consistent with the character of the area, but are not intended to limit the architectural vocabulary Historic styles include: a. Southwest Traditional c. Pueblo e. Other b. Territorial d. Spanish Colonial The scale of Oro Valley is low profile and oriented to human scale. This can be maintained. by: a. Design buildings at the ground or pedestrian level that express human scale. This can be done by using the appropriate sizing of openings, level of detail, articulation. and use of textures. C N C NA b. Design buildings to be compatible with appropriately scaled surrounding or adjacent structures. C N C NA c. Compatibility with the natural environment is encouraged. Building should not dominate the land, but conform to th.e natural. landscape. C N C NA. d. Integrate building design with the design of street, hardscape, and landscape elements, so that the building and grounds present a natural, integrated appearance. C NC NA /14'. Project design should consider and integrate all elements. a. Design buildings with consideration given to all sides of a building. C NC NA b. Coordinate accessory structures (structures other than the primary building/s, such as, screen walls, gas station canopies, signage structures) so that they reflect the character of the primary building/s in terms of scale, materials, colors and style. The color of carports should be coordinated with primary structures. C NC NA Substantial earth-tone materials should be used. C NC NA a. Use exterior materials such as stucco, brick, adobe, natural stone. C NC NA b. Discourage undesirable materials such as pre-fabricated metal wall panels and smooth faced concrete. C NC NA y3'. Variations in rooflines should be used to add interest and to reduce the scale of larger buildings. Roofs should consist of one or a combination of the following: Comments 4 • • a. Low sloping roofs C NC NA b. Parapets to conceal flat roofs and roof-top equipment. C NC NA c. Overhanging eaves. C NC NA . Diversity in the design of homes and neighborhoods is encouraged for residential subdivisions and planned communities. C NC NA Create a design theme identified by materials, colors, roof types, etc., for larger projects/neighborhoods. C NC NA De-emphasize garages on street frontages. Techniques for varying garage treatments include: The garage should consist of not more than 50% of the total building frontage. C NC NA i!S At least 50% of garage doors should be flush with or recessed from the front of the house. C NC NA )) Garages may project no more than five (5) feet in front of the house. C NC NA ,P'' Garages for three cars should have the third portion offset from the other two. C NC NA v,K Side entry garages should have articulation (e.g. windows) on the side facing ' the street. C NC NA i.) Recess garages from living areas. C NC NA vii.) Placement of garage at rear of lot. C NC NA viii.) Type of garage door(door with windows, vary styles). C NC NA //' Vary the street appearance by providing different rooflines and shapes. There should be no visible rooftop mechanical equipment. Solar panels must be integrated into the design of the building and conform to roof slope. C NC NA 0 Provide multiple floor plans and at least two elevations for each plan. Elevations should vary in use of accent colors. At least two color schemes should be provided for building and roof colors. C NC NA ../ Encourage the use of porches. C NC NA Articulate windows (pop-outs, recessed and/or accented sills or lintels) on elevations visible from a street or pathway. This is optional on other elevations. C NC NA '.' Vary second story treatments: Comments 5 • The second story should have less area than the first so as to provide some setbacks from the first to the second story in order to reduce building mass. C NC NA )el? Second story setbacks and articulation are required for corner lots and for lots with exposure to arterial and collector streets. C NC NA Building projects that are proposed within existing context of buildings will be compatible with the existing structures, where a consistent context exists. This does not apply when there is an intended change of character due to redevelopment or rehabilitation. Compatibility will consider the following: XRoof Shape: The intent is not that all roof shapes will be the same, but if there is a predominant shape existing, then the new building should have a similar shape. This also applies to type and pitch. C NC NA )3s ' Proportion and Scale: Proportion deals with the relationship of the height to the width and the relationship of each part to the whole. Scale is the relation of each building to other buildings in the area. Proportion and scale will be considered in the evaluation of compatibility. C NC NA , Rhythm of Openings: The number, size and spacing of windows and doors in a façade should be similar to other buildings in the area. C NC NA Ar Massing: Massing deals with volume created by sections of a building. The massing of existing buildings should be respected. C NC NA 0 Materials, colors and detailing: Sameness is not required, but similarity should be considered in determining compatibility. C NC NA General Plan Conformance Land Use Element 1. Goal 1.1 - Preserve Oro Valley's natural Sonoran Desert environment and scenic resources which are an important part of the community's quality of life. C NC NA 2. Policy 1.1E-View protection shall be an essential aspect of Oro Valley's community design review and project approval. C NC NA Housing Element 1. Policy 4.2A- Encourage the provision of a variety of housing choices matched to employees within a reasonable proximity of employment sites. C NC NA Safety Element 1. Goal 7.4.1 —To promote high quality residential neighborhoods. C NC NA Community Design Element 1. Goal 9.1 —To ensure that the built environment is aesthetically pleasing and compatible with the natural surroundings. C NC NA 2. Policy 9.1 D - All development proposals should attempt to arrange buildings, massing of buildings, and/or arrangements of lots to preserve views from adjacent properties and streets while providing privacy for residents. C NC NA Comments 6 3. Policy 9.1E -All development proposals should show design strategies used to minimize changes to existing topography and the disturbance of existing vegetation. C NC NA 4. Policy 9.1F_-All sides of buildings may impact their surroundings and should be coherently designed and treated. C NC NA 5. Policy 9.1G- In order to maximize integration of the built environment with the natural environment, and minimize distractions of the built environment, all new development proposals should incorporate means of reducing the apparent size and bulk of buildings. C NC NA Overlay Districts A. Tangerine Corridor Overlay District (TRCOD) Regulations/Guidelines; Section 10-002, p.10-0.1 The District shall include lands located between Naranja Road and Moore Road, or their alignments, within the corporate limits of the Town of Oro Valley(the"Corridor"); and shall be applied to all properties lying within the Corridor at the time of this Ordinance adoption; and to such lands within the Corridor which may, from time to time,be annexed into the Town. C NC NA 1. Applicability. Overlay District regulations, as stated herein, apply to all property within one- quarter mile of the Tangerine Road centerline (the"Target Area", as defined in the Tangerine Road Corridor Specific Plan). Overlay District guidelines pertain to all uses in the Corridor. Construction, addition to or remodeling of individual residences within the Target Area shall require only observance of frontage tract and setback standards (unless nonconforming building lines exist, in which case the Board of Adjustment may consider granting a variance) and of non-access provisions. C NC NA 2. Exemptions. Development plans, preliminary plats or final plats approved prior to the adoption of this Ordinance and still in effect, and individual residences on single lots are exempt from the requirements of this Article. a. The adopted Rancho Vistoso PAD, having addressed, met or exceeded certain standards of this Overlay District, is exempt from the following requirements of this Ordinance: Section 10-004.A.1.; and Sections 10-005.A.2., 10-005.A.5; 10-005.B.3., and 10-005.C.3, except that the allowances of B.3.b shall be applicable. b. The adopted Rancho Vistoso PAD design guidelines shall prevail, where they conflict with the guidelines in Section 10-006. However, large expanses of glass or other materials of high reflectivity should not be used. In addition, residential developments, which may be impacted by noise from Tangerine Road, should include the noise mitigation provisions of Section 10-006. Comments 7 3. Residential Development Regulations—Sec. 10-005,pp.10-0.8 through 10-0.9. Construction in any residential zoning classification shall comply with the following provisions in addition to the applicable regulations of the underlying zoning district: a. Required Setbacks. Setback standards of the applicable, underlying zoning district shall be provided in addition to the reserved easement tract. Undulating setback distances may be approved in planned developments to provide variety and visual interest. C NC NA b. Density. Coverage, density and open space requirements of the underlying zoning district shall apply to individual lots or dwelling clusters. C NC NA i.) Lots including frontage tracts are entitled to include the tract area in meeting these requirements. C NC NA ii.) Planned residential developments may compute perimeter tracts for open space and dwelling unit density yield. C NC NA iii.) Minimum lot areas of the applicable residential zoning district may be reduced by as much as twenty percent for lots clustered in the interior of the development to take advantage of frontage tract area reservations. C NC NA iv.) No lot of reduced area, however, may be sited adjacent to a residence existing at the time of platting. C NC NA b. Building Height. Structures within one hundred feet, and visible from the TangerineRoad right-of-way, shall not exceed eighteen feet in height; except, where the natural grade of the structure's site is below that of Tangerine Road's proposed profile grade, the structure may be built to the lesser of eighteen feet above the proposed roadway grade or the maximum height of the applicable zoning district. C NC NA c. Tangerine Road Corridor District Design Guidelines. Sec. 10-006, pp. 10-0.13 through 10-0.14. i.) Distinctions by use type are organized according to the underlying zoning district classifications cited in Section 10-005 for Residential, Commercial and Employment/Institutional uses. C NC NA 4. Architectural Design Buildings constructed in the Tangerine Road Corridor should be low and of colors, materials and textures, which blend with natural desert vegetation, leaving large areas of open space between developments. Where taller structures are permitted, the massing of their elevations should provide relief and interest, avoiding unbroken, massive expanses of structural walls, and creating interesting variations of light and shade. C NC NA 5. Building Materials The use of large expanses of glass or metallic material (e.g. constituting forty percent or more of a building face) is discouraged; highly reflective glass (exceeding twenty percent reflectivity) is discouraged, due to the obtrusive glare and low energy efficiency. C NC NA 6. Building colors should relate to one another and the natural environment on the basis of a. pigment, color value and/or intensity C NC NA 7. Residential Design Guidelines Sec. 10-005,pp.10-0.14 through 10-0.15. Comments 8 J - a. Consistent, finished rooftop treatments, without visible roof-mounted equipment. C NC NA b. Subdued or managed lighting C NC NA c. Safety and crime prevention C NC NA 8. Residential Style Considerations. The following criteria, pertaining to appearance and environmental compatibility, are expected to be met for the approval of any residential development plan: a. Only indigenous desert colors (the earth, vegetation, rock outcropping) are permitted; variations within developments are to be transitional, rather than abrupt. C NC NA b. Materials, textures, and rooflines included in residential structures are to observe Southwest rural ranch architectural themes. C NC NA c. Residential siting anticipates the integration of natural features such as existing vegetation, boulders, drainageways. C NC NA d. Noise Mitigation is addressed by masonry construction, double-paned windows and limited openings and recreational yard uses facing Tangerine Road. C NC NA e. Further considerations: i.) Desert/mountain colors that blend with the natural background are encouraged. C NC NA ii.) Xeriscape groundcover, earthen berms screening access or frontage roads and parking visible from Tangerine Road, and structural integration with terrain, such as building lower floors into slopes. C NC NA f. In architectural design terms, there should be: avoidance of boxlike structures and reflective materials; vertical elements in walls of greater than 50' length; and subdued lighting for entries, signage and parking areas C NC NA B. Oracle Road Scenic Corridor District Regulations/Guidelines Sec. 10-401,p.10-25 1. Applicability—The provisions of the Oracle Road Scenic Corridor Overlay District apply to development in the area shown on the Oracle Road Scenic Corridor Overlay District Map. Exceptions: Rooney Ranch PAD, La Reserve PAD, Steam Pump Ranch PAD. 2. Architectural Design Guidelines a. Architectural Design. Within the Oracle Road Scenic Corridor, buildings should be low and clustered, with varied setbacks, leaving large areas of open space between developments. Buildings should seem to be a part of, or in,the landscape rather than Comments 9 appearing to be an imposition on the site. The buildings should follow the natural contours of the existing topography. Building heights should be limited, in most areas of the Corridor,to two floors. The building elevations should provide relief and interest, reflecting the topography by stepping buildings up and down hillsides. The massing of the elevations themselves should also provide relief and interest. Such a massing scheme provides interesting shadows which are not possible on large, unbroken expanses of wall. Flat, undistinguished elevations should be discouraged. C NC NA b. Building Materials. The predominant building materials used in the Oracle Road Scenic Corridor should be masonry and/or wood frame with a masonry or stucco exterior finish. The use of large expanses of glass, particularly highly reflective glass, is discouraged, due to the obtrusive glare and low energy efficiency. C NC NA c. Building Colors. Building colors should relate to one another and the natural environment on the basis of pigment, color value and/or intensity. C NC NA FINAL STEPS 7. Contact applicant and find out if architecture has previously been approved for another Oro Valley location or in the Tucson metro area. C NC NA 8. Discuss all conditions with the applicant prior to the meeting. C N C NA *Adjacent—shall mean the condition of being near to or close to, but not necessarily having a common dividing line(e.g. two properties that are separated only by a street or alley shall be considered as adjacent to one another. Comments 10 If TOWN OF ORO VALLEY STAFF REPORT TO DEVELOPMENT REVIEW BOARD MEETING DATE: March 9,2004 TO: DEVELOPMENT REVIEW BOARD FROM: David Ronquillo, Planner I SUBJECT: OV13-04-03, TUCSON MATHER PLAZA LLC, OWNER/APPLICANT, REQUESTS ARCHITECTURAL APPROVAL FOR VILLA HOME WITHIN THE SPLENDIDO RETIREMENT COMMUNITY IN RANCHO VISTOSO NIEGHBORHOOD 5 PARCEL A, PARCEL 219-216527B BACKGROUND: The subject property consists of approximately 35 acres and the zoning is Planned Area Development, High Density Residential within the Rancho Vistoso Planned Area Development(PAD). The Development Plan for this project was approved by Town Council on November 5, 2003. It consists of a Care Center, Individual Living Care Units (ILU's) and Villa (casita) homes. The plan designates a total of 47 Villa pads on the site (94 individual units). The Villa homes are located throughout the perimeter of the site creating a transition between the Care Center and Living Care Units. A Development Plan and Landscape Plan were also approved for the sales and marketing trailer on this site. SUMMARY: The proposed Villa home (Type 2) will be built within the Splendido Retirement Community. The Villa consists of two living units approximately 4,054 square feet in size. The Villa home is intended to serve as a sample for the Splendido Community and in the future will be utilized as a residence. The proposed Villa home features a southwestern contemporary style architecture with a combination of flat rooflines and segments of pitched roof. An adequate combination of architectural treatments have been provided on all four elevations. Overall, the home is compatible with the existing homes and the surrounding area. This design will set the precedence for additional models in this community. Currently, the Development Plan for this project has not been certified as complete. Staff is unable to certify the plan until the landscape plan has been reviewed and approved by the Development Review Board. To date, only a preliminary landscape plan has been submitted for review. The improvement plans which include, paving, grading and sewer have also not been submitted. A Type I grading permit will only be required for the construction of the Villa Home, which has been submitted to the Engineering Department for review. Furthermore, this is the only architecture that has been submitted for the entire site. Additional review will be required for the various models and the other facilities throughout the site. OVZCR Design Guidelines Compliance The proposed Villa home compiles with the OVZCR Design Guidelines as follows: F:\OV\O V 13\2004\13-04-03\DRBreport.doc STAFF REPORT TO DEVELOPMENT REVIEW BOARD Section 16-103(E)(3)(b)(2) At least 50% of garage doors should be flush with or recessed from the front of the house. The two-car garage for each Villa is less than 50% of the front facade. Each is positioned on the opposite side of each unit to avoid the appearance of one massive garage area. Section 16-103(E)(3)(b)(3) Garages may project no more than five (5)feet in front of a house (unless side- entry) and must have an entry feature or porch to moderate the visual impact of the garage. The garage is setback from the house approximately 5' and an entry feature is provided. Additional Model Villas A total of 47 Villa pads are specified on the Development Plan and the applicant has advised Staff that in the future additional Villa homes and elevations will be submitted for review. This would include models with a two-car front garage and a two car side entry garage. Based on the Design Guidelines, Staff will recommend for the additional models to encourage diversity in the design and color of each. The proposed Villa home will only be built once. If the Villa home is built in other locations then additional elevations and architecture review will be required to insure a variety of streetscape etc. Setbacks/Maximum Building Height The proposed Villa pads were approved as part of a development plan for this site. The homes are not categorized as a subdivision and there are no property lines to separate each Villa pad. Overall, the development meets the required setbacks as specified in the PAD, which are as follows; Front: 20, Side 5' and Rear 5'. The maximum building height is thirty (34') feet and three stories. The Villa home has a maximum building height of 20'-7". This compiles with the height limit imposed by the PAD. Color Palette The applicant has submitted the exterior color palette for this home, which consists of natural desert colors. The color's are in compliance with the OVZCR Design Guidelines and compatible with the adjacent homes. GENERAL PLAN COMPLIANCE: The proposed house complies with the General Plan's Community Design Element, by Policy 9.1 F, "all sides of buildings may impact their surroundings and shall be coherently designed and treated. " All four sides of the Villa home are treated equally and are consistent with each other. PUBLIC PRESENTATION: Pursuant to Resolution (R) 98-31, "all presentations before Boards, Commissions and Council of rezonings, subdivision plats, development plans, and planned area developments must be formatted to be shown on the F:\OV\OV 13\2004\13-04-03\DRBreport.doc STAFF REPORT TO DEVELOPMENT REVIEW BOARD Town's projection system or overhead system. The Planning and Zoning Administrator; however, may exempt certain projects." A presentation must be designed to insure that the audience, staff, and voting body can view the graphics. Examples of acceptable computer formats are Power Point, Arc View, a videotape presentation, presentation boards and/or overhead transparences. The Applicant is responsible for the development, presentation, and coordination of all presentation materials. If an applicant does not conform to the aforementioned resolution, the item may be continued due to non-compliance. RECOMMENDATION: It is recommended that the DRB approve the architectural for the Villa home, subject to the conditions listed in Exhibit"A". Member Weatherford moved to approve Consent Agenda Items B and C. Member Kunisch seconded the motion. Motion carried 6-0. REGULAR AGENDA A. OV13-04-03, TUCSON MATHER PLAZA LLC, OWNER/APPLICANT, REQUESTS ARCHITECTURAL APPROVAL FOR TWO MODEL HOME CASITAS TO BE BUILT WITHIN THE SPLENDIDO RETIREMENT COMMUNITY IN RANCHO VISTOSO NIEGHBORHOOD 5 PARCEL A, PARCEL 219-216527B Vice Chair Caswell addressed staff on whether or not there was a notation on the development plan that stated they would be approving, prior to DRB getting architectural plans for the entire site a model home or casita. And, if the Board considered approving this project, they would be giving total approval for the rest of the architecture to be based on this particular model home? Bayer Vella replied that the development plan did not specify that only one individual casita would be reviewed by the DRB for architectural approval. Mr. Vella stated that any large single project should be reviewed comprehensively and that ideally all of the structures are reviewed at one time. He also disclosed that the applicant is requesting to build one casita to function as the model home. In essence, it would be part of the sales office. The applicant intends to begin construction in 2006 and Mr. Vella explained that in this case, there is a small casita surrounded by other casitas and other larger buildings and one of the conditions of approval was that this is a one time deal. The little homes can only be built once; any additional development will have to come in for additional architecture review. Mr. Vella concluded by saying that one of the concerns was we did not want to see the same casita model design built over and over again we wanted to see variety and elevations. F:\Minutes\DRB\2004`3-09-04 DRB Minutes.doc Approved April 13,2004 2 3/09/2004 Development Review Board Minutes Page 3 Chairman Vogelsberg articulated his concern over the Town being locked into one particular model, although he believes the model looks good. Vice Chair Caswell asked Mr. Vella if they could put a condition on this project, that whatever the DRB approves, design wise, that when the whole plan comes back as an architecture design for DRB approval, if the design does not match that particular aesthetics that it be converted to match. Mr. Vella replied that was an approach. Member Culver pointed out that this is a large project and how do they insure compatibility if they don't have any idea of what the major buildings are going to look like? Chairman Vogelsberg asked the Board, perhaps they were making more out of this, acknowledging the applicants desire to proceed in getting something off the ground so that they can walk customers through, but also considering that the customer would like to have some assurance that the outside would be able to be replicated like Splendido. Chairman Vogelsberg asked if the Board was satisfied with this model and if they will allow this design then be duplicated through the project. Member Culver asked the Chairman what sort of precedence the board would be setting. Chairman Vogelsberg stated that he believes this project is "putting the cart before the horse," more often than not they have the whole package in front of them with all of the elements. Member Culver expressed concern over where the models exact location. Mr. Vella referred the Board to the project layout plans and identified lots 445 and 446 as the location. Member Culver asked if that information was in the staff report and Mr. Vella responded that it was not in the staff report. Member Culver asked Mr. Vella if he was sure of the location and he answered affirmatively. Chairman Vogelsberg greeted the applicants and explained that the project was pulled from the consent agenda and put on the regular agenda and they were discussing how this model home will interface with the entire scheme and with the ultimate architectural plan for the club house and the other buildings. Brent Kendall, representing Tucson Mather Plaza, made a presentation to the Board. Mr. Kendall explained to the Board that it was important from a schedule standpoint to proceed ahead and get the model built ahead of schedule. What they propose tonight is just one of the plans and assured the Board they will see the remaining plans in the future. Mr. Kendall showed the Board the site plan, floor plan and elevations to give them a general sense of the flavor of the character of the project. Vice Chair Caswell explained that her concern was that a full package has not come before the DRB. She inquired if the Board should end up making some changes in this particular model and was to become different from the rest of the project, would will they be willing to come into compliance with what the DRB approves as a total? Mr. Kendall stated that he was not in a position to answer that question, however suggested that Mr. Stimel could. Mr. Kendall stated that if it was color changes or something like that. Tom Stimel representing Tucson Mather Plaza stated that this submission was originally supposed to be for all of the villas as a separate package. Due to the requirement for three T':\Minutes\DRB\2004\3-09-04 DRB:M inutes.doc Approved April 13,2004 3 3/09/2004 Development Review Board Minutes Page 4 different elevations to be demonstrated and that they were not prepared for that, they withdrew the balance of the casitas and made it a model submission due to their timing issues, but stated that they would comply with DRB suggestions. Vice Chair Caswell stated it was a great package, but was concerned that there would be one casita that would not be in balance with the rest. Mr. Stimel mentioned the upgrade program and they will leave it up to the resident on the how they would like the exterior to appear. The next package of the balance of the casitas will have more features to show how they can enhance the appearance of the casitas. Mr. Stimel explained that he can give no assurance that the resident would choose to upgrade the exterior appearance. Mr. Kendall added that in this package he wanted to make it clear to the Board, they felt at this point, since they are working on some of the other elements they wanted to submit the least that they would do with the expectation that they will come back to enhance this further. Chairman Vogelsberg commented that it could only go up from there and asked the Board if there were any questions. MOTION: Member Kunisch moved to approve subject to the conditions listed in Exhibit A, Member Caswell seconded the motion, motion carried 7-0 to approve. Staff Conditions for Exhibit"A": 1. A Wall to provide visual screening and noise mitigation shall enclose all ground-mounted mechanical equipment. 2. All windows shall utilize pop-outs or be recessed on all sides of the buildings, except under porches. 3. The proposed Villa home must only be built once. If the Villa home is to be built in other locations additional elevations and architecture review by DRB will be required. 1. REVIEW AND POSSIBLE ACTION REGARDING AMENDMENTS TO THE DRB BY-LAWS Bayer Vella presented the Board with possible changes to the by-laws. The major points raised by the Board were: Membership—Two year term limit and the term of all members shall extend until their successors are appointed. Mr. Vella pointed out sections under"Membership"that have been deleted. These sections include the appointment of a member by the Planning and Zoning Commission, missing three or more consecutive meetings and Chairman shall sign all reports that go to Town Council. Mr. Vella touched upon a membership concept that is used in Scottsdale. This concept requires a certain number of design professionals who reside in the jurisdiction to be included on the Board. F:\Minutes\DRB\2004\3-09-04 DRB Minutes.doc Approved April 13,2004 4 3/09/2004 Development Review Board Minutes Page 5 For example, there could be a requirement or guideline to include at least one engineer, an architect, and/or a landscape architect who are citizens of the Town. Mr. Vella asked the Board for an opinion on this concept. Vice Chair Caswell stated that she feels the Board could put a requirement for two,but not to exclude citizen participation. Member Reddin agreed with Chair Caswell and stated that the Board should look at diversity. Member Culver said she would hesitate to make it a requirement, pointing out if an engineer was to volunteer they should also be required to go through the CPI class. Member Kunisch agreed with Member Culver and explained when asking people to dedicate time it may not be appealing to some professionals, however if they are willing then they should have to take the CPI class. Mr. Vella stated that the CPI is a requirement per Resolution. Member Feinberg stated the process is good and the people that are appointing new members are outstanding, but feels the downside of requiring an Architect or Engineer to be on the Board is pushing the edge of having developers moving into the DRB. He likes the process the way it is and feels that there is a good cross section with dedicated people. Member Weatherford stated that the Board is lucky to have diversity and good balance between professions, however he is concerned if the requirement for an Architect or Engineer is put into writing then the Town would be focusing on finding an Architect or Engineer. Member Weatherford feels that the Board should stay away from putting the requirement in writing. Mr. Vella explained to the Board that there is an interview process that includes the Chairman, a staff liaison and a Council representative. He suggested if the DRB wishes they can express their ideas to the Chairman. Member Kunisch opposes the term limits. He stated that term limits are not a good thing. He pointed out that they currently have members that have a lot of experience and willing to give their time, but also understands that there are people that want to come on board. Site Tours-Mr. Vella addressed the Board regarding site tours. Per Resolution(R)03-26—Site tours are about fact finding, not to hear arguments from staff or applicants. Members can only listen to information. Call to Audience-Member Feinberg suggested the Board study the Call to Audience and get it put into the by-laws. Vice Chair Caswell stated that it was important to hear from the public. Member Culver pointed out that the Call to Audience could be put on the order of business on the agenda. Mr. Vella explained that the Call to Audience is not to be used to address any item on the agenda. It is the ability to address issues that are not being heard at that time, it is not an agenda item. Mark Langlitz,Town Attorney stated that the Call to Audience for the Board should really be on matters in their jurisdiction,it should be limited to something that pertains to the DRB. Mr. Langlitz explained that the law is very specific when responding to a Call to Audience. First, any response has to be at the end of the Call to Audience, for example,if there are three speakers that are called to the audience and the Board wants to respond to the first speaker they must wait until the last speaker is finished. Second, individual members can respond to criticism or ask that a matter be placed on a future agenda. It is important that the request be from less than a quorum of F:\Minutes\DRB\2004\3-09-04 DRB Minutes.doc Approved April 13,2004 5 3/09/2004 Development Review Board Minutes Page 6 the Board, because if all of members make the same request it would be considered a legal action on an item that was not on the agenda. Normally if a member wants an item to be placed on the agenda, they would direct a request to the Chair and the Chair would indicate to staff to place the item on a future agenda. Third, an individual member can ask staff to look into a particular matter that maybe raised on the Call to Audience, a Board member should direct the request to the Chair and the Chair would then direct staff to look into a particular matter. Member Feinberg inquired if it would be appropriate for a Board member to ask the person speaking a question for clarification. Mr. Langlitz stated that the statute says that a member can respond in one of three ways and thinks it is fair for the member to ask for clarification if needed. Mr. Langlitz advised the members that they need to try to avoid a dialog with the speaker. Member Reddin asked if the Board can add back to the by laws? Mr. Vella replied that Member Culver had a good idea to put in order of business. Mr. Langlitz suggested to the Chairman that if the Board was going to add the call to audience they need to make a motion. Mr. Vella replied that they would do that as one big motion at the end. Ex Parte Guidelines—A discussion regarding the word"citizen"in Item#1,the Board felt that it was their duty as Board members to be able to meet with citizens. The Town Attorney suggested that the word citizen be changed to interested party, meaning someone that has involvement or something to gain from the project. Chairman Vogelsberg opened the meeting to public comment for Agenda Item 1. Bill Adler, 10720 N. Eagle Eye Place in Oro Valley, addressed the board, stating that he had a couple of suggestions. 1. Mr. Adler stated that the Chairman should be able to reopen a public hearing,to allow the public to comment on any new information that is presented to the Board after the public hearing is closed. 2. Being fair to the public,if the Board will engage the speaker, not like in the Call to the Audience. If questions are asked of the speaker for clarification,he feels this adds an element of fairness and the member of the public feels that they have had an opportunity to explain, clarify and expand to the Board's satisfaction point by point what they feel is important. Mr. Adler pointed out the Board asks the applicant questions and for clarification, but he does not hear them asking the public for clarification and feels all Boards should. 3. Call to the Audience, the Attorney General has explained to Mr.Adler that criticism is not limited to just a personal attack. Mr.Adler explained that criticism has a wider definition and criticism can be in a form of a suggestion. 4. Site tours-Mr. Adler believes there should be a public participation opportunity at the end of the site tour and the public should be able ask questions for clarification to the developer. Suspend staff recommendations—Mr. Adler requests the Board to discuss suspending staff recommendations at the next DRB meeting.Mr. Adler feels that once staff takes a position on a project recommending approval, they are no longer an advocate for the citizens who are opposing the project, thus compromising"neutrality". Member Feinberg recommended to Chairman Vogelsberg to have the points that Mr. Adler mentioned be put on the agenda for the next DRB meeting. Member Feinberg believes that Mr. Adler brought up some valid points. And he also feels that if they are going to do by-laws it would be the proper time to get all of the ambiguity taken out and get everything as clear as possible so that they don't have to keep "reinventing the wheel" every time they come across a situation that is not clarified. Member Feinberg considers some of the things that were said are an enhancement on all the things that the board has been discussing. Chairman Vogelsberg stated that there were a lot of things that were discussed, some with merit and some perhaps, not. But he does not feel that any of those were captured. Bayer Vella addressed the Board for clarification. Mr. Vella reviewed Mr. Adler's five points and stated that three of Mr. Adler's points already exist today. The first point of being able to reopen the public meeting, the Chair already has the discretion to reopen the meeting. The point about clarification, the Board has the same ability to ask the speaker questions like they do the applicants. The definition of criticism, referred to the Town Attorney. Mr. Vella stated that public participation at site tours is up to the Town Council and it is up to the DRB as far a staff making recommendations. Mark Langlitz, Town Attorney disagreed with Mr. Vella's last point and stressed that it is not up to the DRB what the role of staff is, it is up to Council and it's direction is how staff will present matters to the DRB. The DRB does not direct staff and does not have authority to direct staff, only Council can do that. Mr. Langlitz said that some of the other points can be put on the agenda;however they may not be proper subjects for the DRB. He will have to review the subjects if they come before the DRB. Mr. Langlitz also stated that he would have to make a recommendation as to whether the DRB has authority in a particular area. Chairman Vogelsberg amended Member Feinberg's request and asked the Town Attorney provide the DRB with an opinion or legality of those points. Chairman Voglelsberg stated that he is also intrigued with the recommendation and it is a universal thing in government for staff to make recommendations to Board or Commission and would like Mr. Langlitz to give the Board an opinion at the next meeting. MOTION: Staff recommends continuing this item to the next meeting,Member Feinberg seconded the motion, motion carried 7-0 to continue. DISCUSSION AND POSSIBLE APPOINTMENT OF A DRB REPRESENTATIVE TO ADDRESS TOWN COUNCIL REGARDING THE CAPIN CAR CENTER SIGN CRITERIA APPEAL Bayer Vella informed the Board that the code specifically lays out the ability of the DRB to appoint a representative to address the Town Council. The code recommends giving the representative specific direction in terms of the points being covered. Mr. Vella strongly advised that whoever is recommended as the representative should stay within a script that would comply with the 3 minute time limit. Member Kunisch recommended Member Culver to represent the DRB at the Town Council meeting;he commented that she seems to be the driver in this case. Chairman Vogelsberg agreed and recognized that she seems to be the most passionate about this.Member Weatherford stated that it is important that the Board goes to Council to insure that the DRB has been heard and the intention of the Board trying to get everyone in the annexed area to match with Oro Valley. Chairman Vogelsberg stated that compatible is not what is out there but what is here in Oro Valley, and also mentioned that the key is compatibility and the definition as we see it is compatible with the Town. Member Kunisch pointed out that Member Culver would be listening to the tape and making corrections to the minutes and suggested that she use the minutes as a script. Member Reddin stated that this would be a problem since the Board had not yet approved the minutes. Member Culver suggested that she draft something and send it to Mr. Vella for review and then have him send it to the other members. Mr. Vella commented that this was possible but it would have to be noticed as a meeting. Member Caswell suggested presenting a clear message about pre-annexation agreements. Chairman Vogelsberg disagreed with Member Caswell. Member Kunisch inquired as to whether they should approach the Mayor and ask if the DRB members could give their three minutes to Member Culver. Member Feinberg informed the Board that the Mayor does not allow that and suggested it would be better to ask if she could extend her minutes to five minutes. Member Culver stated that she will list everything they considered and why they went that way. Chairman Vogelsberg replied as long as it is from the transcript,he also confirmed with Member Culver that she was going to listen to the tape and draft something up and send it to Mr. Vella for review. Chairman Vogelsberg inquired if that was legal. Member Culver confirmed that it was legal as long as it was noticed. MOTION: Member Kunisch recommended appointing Member Culver as the DRB representative at the March 17, 2004 Town Council Meeting, Vice Chair Caswell seconded the motion. Motion carried 7-0.
