The project site is zoned PAD, Rancho Vistoso land use designation of Community Commercial, with a 34-foot maximum building height limitation. SUMMARY: The 4,497 square foot building consists of the bank and drive through tellers. The exterior colors match the existing color palette and materials of the shopping center. The north and south facades of the building, which face the parking area and the entrance drive, are the longest expanse of building, but are broken with glass and stone veneer with a gabled roof line. The front elevation which faces the entry drive and the Safeway gas station consists of an aluminum storefront system with insulated glass. This façade also includes the ATM machines which have been intergraded into the building design. The rear façade faces the parking area and All About Running and Walking and is a blank wall enhanced with stone veneer and enhanced landscaping to soften the blankness of the wall. This elevation does not have any fenestrations, because it is the back room of the bank. The canopy for the drive through tellers is a flat roof matching the color of the building and accented with stone veneer, the landscaping will soften this protrusion from the building. The east and west facades face Rancho Vistoso Boulevard and the center parking area. The east façade includes glazing and enhanced landscaping, while the west façade is hidden under the drive through teller canopy, but has the service window for the operation of the drive through. This façade faces Rancho Vistoso Boulevard, but is hidden because of the 6-8 foot elevation difference between the street and the building pad. All mechanical equipment will be roof mounted and screened by the parapet. Design Guidelines: The following Design Guidelines apply to this project: Section 16-103(B)(3)(a)Design buildings at the ground or pedestrian level that express human scale. • TOWN OF ORO VALLEY DEVELOPMENT REVIEW BOARD STAFF REPORT Page 2 The building has been designed to a pedestrian level. The ceiling of the entry canopy is at 12-feet which creates a good pedestrian feel. Section 16-103(B)(4)(d)Encourage wall mass over glass area. Because of the nature of the building, there is more wall mass than glazing which conforms to the sprit of the design guideline. The wall mass; however, is softened by the landscaping. • The bank design has employed the use of CPTED (Crime Prevention Through Environmental Design), by the placement of glazing and doors. The ATM's have been positioned in accordance with CPTED principals of being free of landscaping and are well lit. Also by their positioning good surveillance is obtained from different angles of the front parking area of the bank and from the entrance drive and center parking PAAL of the shopping center. ZONING CODE COMPLIANCE: The project is in compliance with the OVZCR and the Rancho Vistoso PAD. GENERAL PLAN COMPLIANCE: The proposed architecture for the branch bank building complies with the General Plan by promoting Policy 9.1A, which incorporates "Architectural themes are intended to blend the built environment with natural surroundings." This project integrates into the Safeway Vistoso Plaza by designing the building in a similar style to the built plaza. Also, all four sides of the building have been comprehensively designed and treated. PUBLIC PRESENTATION: Pursuant to Resolution (R) 98-31, "all presentations before Boards, Commissions and Council of rezonings, subdivision plats, development plans, and planned area developments must be formatted to be shown on the Town's projection system or overhead system. The Planning and Zoning Administrator; however, may exempt certain projects." A presentation must designed to insure that the audience, staff and voting body can view the graphics. Examples of acceptable computer formats are Power Point, Arc View, a videotape presentation and/or overhead transparences. The applicant is responsible for the development, presentation and coordination of all presentation materials. If an applicant does not conform to the aforementioned resolution the item may be continued due to non- compliance. RECOMMENDATION: It is recommended that the DRB approve the architecture for the Bank of America, subject to the conditions in Exhibit A. TOWN OF ORO VALLEY DEVELOPMENT REVIEW BOARD STAFF REPORT Page 3 SUGGESTED MOTIONS: The DRB may wish to consider one of the following suggested motions: I move to approve OV13-04-13, the Bank of America architecture, subject to the conditions listed in Exhibit A, attached herewith. FIRST AVENUE, PARCEL #224-02-170A, 224-02-170B AND 224-02-170C. Robert Conant gave the staff report. Roxannne Fields, Evergreen Devco, 2920 East Camelback, Number 100, Phoenix, Arizona 85016, stated that Wells Fargo gave her their ideas for the signage from the First Avenue and Oracle location. The use of red and yellow looks good and they do not think it will take away from the development; therefore, they do not want to limit its use. Mr. Nodine replied to Member Weatherford that staff negotiated with Wells Fargo and they were to comply with the Rooney Ranch sign criteria; however, there was a threat of a lawsuit and it went to Council. Ultimately, the sizes of the logo were pulled down and they were allowed to have the ATM signs. The signs were smaller then originally proposed, but they were allowed the red, yellow, white and black colors. They do not have the yellow Wells Fargo across the front. F:\Minutes\DRB\2004\5-20-04 Minutes.doc Approved on 7/13/04 2 5/20/2004 Development Review Board Minutes Page 3 David Thorn, representing Wells Fargo, 100 West Washington, Suite 1430, Phoenix, Arizona, affirmed that all of the signs were registered corporate logos. Mr. Nodine replied to Member Weatherford that Wells Fargo is able to use the ATM wall logo or the yellow Wells Fargo, if it is a registered trademark, as long as it is held to the eight square foot size. Steve Markovich, 3162 East 47th Street, with Pearson Signs, built the signs at the First Avenue and Oracle Road Wells Fargo location. He asked the staff when does business identification become a logo and is limited to eight square feet. The ordinance does not state that. The logo they are asking for is on the direction or on the cabinet wall signs. Mr. Nodine stated that staff considers something the business uses for identification as a logo. Also, when a business uses the sign criteria and copper patina it is treated like text or wall sign, not a logo; therefore, they can go to the full text size. MOTION: Member Weatherford MOVED to conditionally approve OV3-04- 03, Sign Criteria for Placita De Oro, subject to the condition in Exhibit "A". Member Kunisch SECONDED the motion. Motion carried 5-0. 3. OV12-03-26, BAKER ENGINEERING, REPRESENTING NEW WORLD DEVELOPMENT, REQUESTS APPROVAL OF A PRELIMINARY PLAT FOR 105 SINGLE-FAMILY LOTS, LOCATED ON THE SOUTH SIDE OF TANGERINE ROAD JUST NORTH OF THE NARANJA TOWN SITE, PARCEL 224-018-270 Robert Conant presented the staff report. Member Weatherford inquired about the future road planning of Tangerine Road. He noted that there are a lot of access roads connecting to Tangerine because of the subdivisions. He understood that east of First Avenue is state highway and the remaining portion is a state route. At one point he knew there was talk about eight lane control access on Tangerine Road. Mr. Civalier responded by stating that he thought it could become six lanes. There is enough room on the sides for a four lane divided highway for 20 years. Mr. Andrews was unaware the land was part of a bond package and would look into it for Member Kunisch. Mr. Nodine affirmed that the bonds have been approved; they are being set up with the County, and would enter into negotiations with this property owner. Until then, they look at it as moving forward if it meets code. If this does not meet code or information is missing, it can be continued. F:\Minutes\DRB\2004\5-20-04 Minutes.doc Approved on 7/13/04 3 5/20/2004 Development Review Board Minutes Page 4 Member Kunisch was concerned that the lots of these houses are small and it will look cluttered as you come into the Naranja Town Park. He would-also like the subdivision park moved so it is more secure for the children that will play in the park. Mr. Civalier stated that the Applicant is dedicating the property along the west side lots. It is a four lane road with a sidewalk on the east side. The west side drops to the wash toward the eastside to create a slope. Mr. Conant informed that staff came up with the park's location because it can be seen on the way to the Naranja Town site. After discussions with the developer, this was considered the best site. Martin Magelli, Applicant, 1636 North Swan Road, Suite 200, answered Member Culver that they looked into coving for meandering streets; unfortunately, there was not enough room. Member Culver said the homes will be for families with children and the straight streets are invitations for fast driving. It would also be a more attractive layout with the curves. With coving, you will not lose lots but it would be more work. Member Weatherford asked why they chose to push Street `B" through to intersect with Street "A" instead of intersecting with Streets "E" or "F"? The subdivisions main intersection would be too close to Tangerine Road. Mr. Magelli responded that initially there were too many lots per street and the setback requirements forced them to use Street`B"to intersect with Street "A". Bill Adler, 10720 North Eagle Eye Place, acknowledged the piece of land is sloped with rolling contours. It is important to split up the cookie cutter look, and flow with the rolling contour and enhance the views. Maybe in time, the Town will quit doing Pre-Annexation agreements where it exempts people from applying the Town's rules and requirements. To enhance views, the lots can be rotated to face the mountains. You want a project that can endure people to become long- term residents. MOTION: Member Culver MOVED to recommend to Town Council to approve OV 12-03-26, with the following conditions: 1) Applicant to work with the staff to implement at least some of the coving techniques and improve the streetscape (be respectful of the existing contours and realize that you are permitted masquerading; and 2) Orientation of the homes on the plat, the direction it will be facing and are aisles on the park will be made available for review before presenting the item to the Council (with homes facing the park so children can be observed in the recreation area.) Member Weatherford SECONDED the motion. Discussion: Member Weatherford was apprehensive about the motion because the conditions completely change the plat; therefore, DRB would be approving something and the Applicant would take something completely different to Council. It should be continued or denied. F:\Minutes\DRB\2004\5-20-04 Minutes.doc Approved on 7/13/04 4 5/20/2004 Development Review Board Minutes Page 5 Mr. Andrews confirmed to Member Kunisch that if they deny this Item, it can go to Council for appeal. AMENDMENT TO MOTION: Member Culver MOVED TO AMEND THE MOTION to continue OV 12-03-26, with the following conditions to implement coving techniques, improve the streetscape, use the existing contours, and have some houses facing the recreational area. Member Weatherford SECONDED the motion with an additional amendment that the intersection of Street "A" and Street "B"be moved further south. Member Culver accepted the additional condition. Mr. Conant confirmed to Member Culver that the changes could be accomplished by the July meeting. Motion as amended carried 5-0. 4. OV12-03-26, ACUNA COFFIN LANDSCAPE ARCHITECTS, REPRESENTING NEW WORLD DEVELOPMENT, REQUESTS APPROVAL OF THE LANDSCAPE PLAN FOR 105 SINGLE-FAMILY LOTS, LOCATED ON THE SOUTH SIDE OF TANGERINE ROAD JUST NORTH OF THE NARANJA TOWN SITE, PARCEL 224-018-270 Robert Conant presented the staff report. Mr. Adler recalled that eight years ago it was passed that an acre of recreational space needed to be established per 85 houses. Instead of this park being 10,000 square feet, it should be an acre and a half. If DRB reconsidered the plat it would be responsible that they look at the park's location and size. MOTION: Member Kunisch MOVED to continue OV 12-03-26 to the July meeting with the recommendation that they move the park to a different location where everyone can use it, and it can be enlarged. Member Reddin SECONDED the motion. Motion carried 5-0. 5. OV12-04-04, MITTELSTAEDT COOPER ASSOCIATES, REPRESENTING THE BANK OF AMERICA, REQUESTS APPROVAL OF A DEVELOPMENT PLAN FOR A BANK BUILDING AT THE SAFEWAY VISTOSO PLAZA, LOCATED ON THE NORTHEAST CORNER OF TANGERINE ROAD AND RANCHO VISTOSO BOULEVARD, PARCEL 220-020-340 F:\Minutes\DRB\2004\5-20-04 Minutes.doc Approved on 7/13/04 5 • , 5/20/2004 Development Review Board Minutes Page 6 Robert Conant gave the staff report. Member Culver was concerned about the fuel truck's entrance and exit while making deliveries to the gas station, and for the safety of persons using the blind intersection. Mr. Civalier showed on the map the route the fuel truck makes around the bank. He continued that they have discussed different routes for the truck; however, they will not go in front of the grocery store. Tenants in the shopping center want stop signs. When future property opens they will need to move paths and loading zones. Bruce Patton, 1745 East River Road, Suite 11, thanked staff and approved of their conditions. Bill Adler, 10720 North Eagle Eye, was also concerned about the circulation issues and danger. The fuel truck could go behind the store to increase circulation. He thought the bank should be moved to another Pad. The congestion of the gas, bank and retail would not be resolved by putting a mirror at the intersection nor will someone be able to predict speed or accuracy. It would not be advisable to increase traffic to an unsafe area. David Newbaker, 4130 East Van Buren, Phoenix, Arizona 85008, appreciated Mr. Adler's comments. The safety concerns did motivate an alternate site for the drive thru by lengthening the corridor and putting it into the interior. The modified plan would dramatically reduce the traffic because the banks entire traffic would be contained. It would provide 18 feet per parking space and 24 feet of drive aisle with plenty of room for vehicles to back up. Mr. Andrews replied to Member Culver that DRB can give the owner information on traffic problems, but we cannot put the burden on the bank. He was unsure if something needs to be recommended by staff or the DRB. Even though Mr. Civalier said there was a danger; however, there was not a study or an expert stating so. This was not on the agenda this evening; therefore, no action can be taken. Mr. Nodine stated that it could be made part of the record and staff can convey that record. Mr. Conant added that he had conversations with the owner of the center and they have insured they will install two stop signs. Staff took all the action they could and this was why the condition listed in Exhibit A is repeated. Mr. Civalier suggested giving the stop signs a chance and restricting loading and unloading zones. Member Kunisch asserted if there was a restriction on the loading zone, it would put a burden on the businesses. An alternative would be for the property owner of Safeway to buy a chunk of the northern boundary land to expand the driveway. Member Reddin indicated the issues they were discussing do not relate to the bank's site and needed to be addressed in a different forum. F:Wlinutes\DRB\2004\5-20-04 Minutes.doc Approved on 7/13/04 6 5/20/2004 Development Review Board Minutes Page 7 Member Culver agreed; however, she wants the patrons of the bank to be safe. Mr. Conant confirmed that the Pad is owned by Bank of America and not by the shopping center owners. MOTION: Member Kunisch MOVED to recommend that the Town Council approve OV 12-04-04, Development Plan for the Bank of America, subject to the conditions listed in Exhibit A striking out the last sentence in Item 2, "The intersection improvements shall be made prior to the issuance of a Certificate of Occupancy for All About Running and Walking and Bank of America." Mr. Newbaker asserted that normally the back of a bank is flat with no dimension. In Elevation B, the trees and greenery were added.
