There were two amendments (a) reducing setbacks for homes with side entry garages and (b) exchange of PAD designated open space in Parcel C (area in the southeast corner of this plat). The following conditions that impact architectural review were approved: 1. No more than two (2) reduced setback homes shall be built next to each other. 2. Two-story homes shall be restricted as follows: • No more than two shall be built adjacent to each other along major streets. • No more than three shall be built adjacent to each other along interior streets. • Shall not be built on all corner lots. • Shall not be built along the golf course 3. The front setback will vary for two (2) abutting houses. 4. The side entry garages shall have an articulation (e.g. windows) on the side facing the street. 5. The garages for three cars shall have the third portion offset from the other two. 6. The front garage(s) shall not consist of more than 50% of the total building frontage. 7. The garages shall not project more than 5-feet in front of a house (unless side- entry). 8. The second story must have less area than the first story in order to reduce the building mass. 9. Reduced setbacks only apply to homes with a side-entry garage. For additional background information regarding this item, please see the attached December 16,2004 staff memorandum to the Development Review Board(DRB). F:\OV\OV 13\2004\13-04-26A\DRBreport.doc TOWN OF ORO VALLEY DEVELOPMENT REVIEW BOARD STAFF REPORT Page 2 This item, previously identified as OV 13-04-26A, was denied by the Development Review Board on December 16, 2004. The following is a synopsis of discussion and motion excerpt from the draft minutes: The applicant, Allan Kennedy from Pulte Homes, 6893 North Oracle Road, Suite 121, explained the items used to create the houses and disguise the 50%garage issue. Member Kunisch stressed that the homes were part of a large community. It was too massive for all the homes to have majority garages; therefore, he wanted the applicant to bring the item back. Member Panas agreed with Member Kunisch. MOTION: Member Kunisch MOVED to deny OV13-04-26, Pulte Homes Models 2100, 2160, 2623, 3061,finding that it did not meet the 50% garage requirement. Member Panas SECONDED the motion. Motion carried 4-0. In sum, the Development Review Board was primarily concerned that the following PAD requirements had not been met: • The front garage(s) shall not consist of more than 50% of the total building frontage. • The garages shall not project more than 5-feet in front of a house (unless side- entry). NEW INFORMATION The applicant has amended the four model plans — which have three elevations each. The following is a description of styles and layout and specific amendments: Styles Original submittal: • Elevation A— Craftsmen style with gables and use of a variety of claddings such as stucco and cement—based siding. Tile roof. • Elevation B—Spanish Colonial with finials(medallion like application). Tile roof. • Elevation C—Tuscan Hacienda with extensive use of stone work. Tile roof. Current Submittal: No changes to proposed styles and colors(see attached color pallet). Furthermore, the effort to bring the living area forward has made the garage appear secondary — which is the intent of the requirement. Upon further discussions with the applicant regarding design, the idea of providing windows in the garage door as an option surfaced. A condition has been added to Exhibit A to insure the availability of windows for homebuyers. GENERAL PLAN COMPLIANCE: The proposed model homes comply with the General Plan's Community Design Elements. In particular Policy 9.1F, "all sides of building may impact their surroundings and shall be coherently designed and treated". The elevations are consistently designed and treated on all four sides. PUBLIC PRESENTATION: Pursuant to Resolution (R) 98-31, "all presentations before Boards, Commissions and Council of rezonings, subdivision plats, development plans, and planned area developments must be formatted to be shown on the Town's project system or overhead system. The "Planning and Zoning Administrator"; however, may exempt certain projects." A presentation must be designed to insure that the audience, staff, and voting body can view the graphics. Examples of acceptable computer formats are Power Point, Arc View, a videotape presentation and/or overhead transparences. The applicant is responsible for the development, presentation, and coordination of all presentation materials. If an applicant does not conform to the aforementioned resolution, the item may be continued due to non-compliance. RECOMMENDATION: It is recommended that the Development Review Board approve Pulte Homes Models 2100, 2250, 2623, and 3061, subject to the conditions listed in Exhibit"A". La Canada Drive Oro Valley, AZ 85737 November 10, 2004 Dear Board Member, I wanted to include a letter that outlines our efforts to overcome the PAD condition—the front garage(s) shall not consist of more than 50%of the total building frontage. I have worked closely with Bayer Vella, Senior Planner with The Town of Oro Valley, in an effort to provide architecture elements and landscaping that offer an appealing streetscape that allows us overcome the garage dominance concern. Pulte Homes contracted architect David Gibson from Gilbert to help us accomplish a goal that meets the Town's needs. We have elected to change many of our standards in an effort to meet this concern. Our efforts to reduce the impact of the garage dominance concern are outlined below. 1. We have elected to use a superior garage door that replicates a carriage door. The door is much more expensive than a typical door(about $1,800 versus $385), but offers a much stronger curb appeal. We will have 3 different garage door styles (based on elevation themes), available in 3 different colors. We will be using United Door Technologies (UDT) garage doors as demonstrated in the attached brochure. The entire garage door has a wood grain embossment as well as decorative hardware offering an authentic carriage door look. The paint scheme of each door will be completed in a manner consistent with the style of a carriage door(see UDT brochure). Each garage door on every home will be placed 8" behind the garage wall face in order to offer shading to the door. This will enhance the overall look of the garage surface and offer architectural relief. As I mentioned earlier, we chose David Gibson to assist us because he is a registered architect and DRB member for The Town of Gilbert. David indicated that Gilbert has a garage dominance rule that can be overcome by using an appealing garage door like the one we are planning to use at Parcel "B". David led us to UDT as a supplier of the door we intend to use. David Gibson can be reached at(480) 330-7192 to discuss the matter if anyone is interested in talking with him. I called The Town of Gilbert and spoke with Maria Cadavid, a senior planner, to validate David's statement. 2. We have elected to include a garage door opener, as a standard feature, on every home so that customers will be more compelled to close their garage doors. We believe that we can have a more appealing community if we enable customers to have ease in closing their garage doors. In communities where garage door openers are not a standard feature, doors tend to be left open fairly often—allowing passersby to see the clutter of occupants' garages. 6893 North Oracle Road,Suite 121 Tucson,Arizona 85704 Contractor License#064206-079383 520-229-6000 520-229-6001 (fax) TM e aihri 3. We are offering front yard courtyard space that extends 9+feet from the front of the home. This space will allow the customer to enjoy semi-private space. The area will be landscaped and will provide enough space for the occupants to place a table and chairs if they desire. The courtyard will also be gated with 2 different style gates available that match the architectural theme of each home—one style gate that is flat across the top and one style gate that is arched across the top. This courtyard element will better enable neighbors within the community to get to know one another and create a greater sense of neighborhood. 4. We chose more accent colors, for homes in this neighborhood, than we typically would and chose colors that are richer and offer more contrast. The greater contrast in color allows us to accentuate our architectural details and to draw onlookers' attention toward those elements. 5. We have added architectural elements that add charm to each home and the community in whole. Some of the elements, based on varied elevations, included in this community are as follows: • Varied colored pop outs around windows • Faux shutters on sides of windows • A spire or finial on the front corner of the home—based on selected elevation • Stone accents on the home and courtyard walls • Wood grain 4"X 6"rafter tails (under overhang)painted an accent color • Corbels under barge rafters • Decorative tile on gables for architectural enhancement • Architectural wrought iron details • Varied front setbacks (2'-0")throughout the community(alternating homes) 6. Landscaping that minimizes garage dominance. This effort will be achieved by placing a tree and/or large shrub, which is part of the landscaping plan, to appropriately interfere with the view of the garage. We have met with our landscaper to explain our goal of placing these plantings, in the front yard, from a perspective of driving down the street. We intentionally left the trees off of the attached rendering because we wanted to be able to allow you see the full elevation of the homes presented. I believe it's noteworthy to discuss a couple of points that offer a better understanding of our position and efforts. In discussions with Bayer, he indicated that we should consider side (or hook) garages as an option in this community. We understand the architectural appeal of this style and offer hook garages in a number of our communities including parcel AC in Village 10, but we also understand that our customers would suffer in the long run if this were attempted on a 45' wide lot. Although our competitors may be able to do this on a 45' wide lot, we can't because of what we know about garage depths and turning radii of vehicles. To start, most all our competitors build their homes with 19' deep garages; we build ours 21' 6893 North Oracle Road,Suite 121 Tucson,Arizona 85704 Contractor License#064206-079383 520-229-6000 520-229-6001 (fax) i di, te TM deep at a minimum. We started this practice in the mid-1990's because of complaints from customers that their SUV wouldn't fit into their 19' deep garage. Additionally, when side (or hook) garages are built, you must, at a minimum, provide 22' (preferably 25') of driving surface to make the 90-degree turning radius into and out of the garage. Even if we utilized a minimum 22' driving surface (concrete drive) and 19' deep garage we wouldn't have enough room on a 45' wide lot. With a 22' driving surface (3' from property line for yard drainage), and 5' side set back for the garage, the deepest garage we could provide would be 15 feet; far too shallow for what our customers would be willing to accept. The PAD note that the front garage(s) shall not consist of more than 50%of the total building frontage was one that unfortunately took us by surprise. The brief history behind our purchase of Village 10 is as follows: We entered into a Letter of Intent with Vistoso Partners sometime in 2001 planning on 50' minimum lot widths for 2 different product lines in Neighborhood 10. At some point during 2001 we elected to drop our purchase option in this neighborhood and cancelled our contract with Vistoso Partners. Vistoso Partners continued to process a plat for this neighborhood as the master developer. We re-entered into negotiations for purchase of the property in 2003. After entering into a contract, we learned that the plat was being developed with 45' wide lots, forcing us to utilize 35' wide product. We were unaware that this specific PAD condition still existed with the 45' wide lot, and unfortunately assumed that Vistoso Partners and their civil engineers solved the garage dominance concern. From my point of view, it is physically and mathematically impossible to produce a 35' wide home on a 45' wide lot that meets the 50% garage rule unless it is a single car garage. We make no excuses for our ignorance, but hope that you understand the dilemma that we are now faced with. Thank you for your consideration. We believe that this site; with the attractive carriage style garage door, architectural flair, front courtyards and strategically placed landscaping plan (please see attached colored streetscape rendering) will represent a site that Oro Valley can point to for other builders to follow. We are very excited about this project and the product we are offering in Village 10 and believe that there is a large group of consumers that want to live in a Pulte Home in Oro Valley.aSincerel /Za5- Alan Kennedy VP Construction Pulte Homes—Tucson 6893 North Oracle Road,Suite 121 Tucson,Arizona 85704 Contractor License#064206-079383 520-229-6000 520-229-6001 (fax) p,LLEY 116 t,r DEC 3 04 ` Planning &Zoning Division 11000 N. La Canada Drive Oro Valley, AZ 85737 Re: New DRB architectural elevations; Rancho Vistoso PAD Neighborhood 10, Lots 107-299 VIA: HAND DELIVERY Dear Board Members: Thank you for your comments during Pulte Home Corporation's ("Pulte") DRB presentation on December 16, 2004 in Case #0V13-04-26 in connection with Pulte's request for approval of architectural elevations for Lots 107 through 299 in Rancho Vistoso PAD Neighborhood 10 ("Neighborhood 10"). Pulte has evaluated the DRB's comments and focused specifically on the concern about 2002 Rancho Vistoso PAD Amendment("PAD Amendment") Condition 6 that states: "The front garage(s) shall not consist of more than 50% of the total building frontage." Based on that input, Pulte's operating team met to brainstorm ideas to address this concern. We developed the following proposals for your review and consideration, and ask for your approval of these proposals. First, Pulte proposes two alternative methods of calculating building frontage that would result in mathematical compliance to Condition 6. These methods include (1) Determining the relative garage width based on the garage door only; and (2) Determining the overall building frontage in two dimensions (calculating the area of the building frontage using both height and width) instead of in one dimension (calculating the building frontage using a single horizontal width measurement). Using either alternative calculation,Pulte's architectural elevations would meet Condition 6 and the garage frontage would equal or be less than 50% of the total building frontage. Pulte especially supports the second alternative as more truly representative of the impact of building frontage as a whole on the streetscape and on passersby. We provide documentation of this second alternative with Pulte's models in Neighborhood 10 attached to this letter. Second,Pulte consulted further with architect, David Gibson, to design models that physically meet the 50% garage frontage requirement of Condition 6 using the Town's 6893 North Oracle Road,Suite 121 Tucson,Arizona TALL 2 Contractor License#064206-079383 520-229-6000 520-229-6001 (fax) r , ., i _ , ,,,,,a,,,,teM '' 4 ra 41/1'''' ''1) current method of measurement on a horizontal plane. This design now provides for a new architectural element, a porte cochere. With the porte cochere, the garage frontage is now measured at 17.5 lineal feet with a total building frontage of approximately 35 lineal feet. This makes the garage frontage no greater than 50% of the total horizontal building frontage. Pulte next met with Town planner Bayer Vella and presented the new porte cochere design for his evaluation. He determined that the porte cochere design mathematically satisfied Condition 6. Based on Town staff review of the new porte cochere design, Pulte has redesigned each model floor plan and elevation to meet Condition 6—50% garage frontage requirement. Attached for your review is a street rendering depicting the new porte cochere elevations. Third, Pulte commits to providing the enhanced architectural elements presented at the December 16, 2004 hearing that are designed to reduce garage dominance. These items include, among others: • Superior carriage style garage door with hardware, including standard garage door opener on every home. • Courtyard space on the front of every home, enclosed with painted, stuccoed masonry wall. • Stone accents on the home and courtyard walls • More mature than typical landscaping (including a 24"box tree) on each lot. Pulte requests that the DRB approve Pulte's architectural elevations for Neighborhood 10 Lots 107 to 299 with the new porte cochere design element in satisfaction of Condition 6. He added Condition Number 8 to Exhibit A to include all commitments made by the applicant in their letter dated December 30, 2004. F:\Minutes\DRB\2005\01-11-05 DRB Minutes Approved on 2/8/05 I;'20O> Development Review Board Minutes Page 3 of 12 Member Sturmon asked if the item in Exhibit A, Condition 7, would return to the Development Review Board (DRB). He noted that there was a recalculation on the 50% garage issue and asked if that would set a precedent to the DRB with future homes on 45 foot lots. Mr. Vella responded that the item in Exhibit A, Condition 7 would return to staff not to the DRB. He further stated that the calculations used would set a legitimate standard that works and the applicant was meeting the 50% requirement. The applicant's attorney, Mary Beth Saval with Lewis and Roca, 1 South Church Avenue, Suite 700, representing Pulte Homes, provided slides on the overhead of the original floor plans and elevations and the amended floor plans and elevations. The applicant, Allan Kennedy with Pulte Homes, 6893 North Oracle Road, Number 121, continued with overhead slides. Ms. Saval indicated that the applicant agreed with the conditions. Member Panas acknowledged their work to accomplish the 50% garage issue. Member Feinberg asked if the internal garage size was decreased or if the six inches was moved from one side of the garage to the other. He indicated that the applicant may have started a new design. Mr. Kennedy responded that the internal size was the same. He did not think the movement of six inches would create problems for home owners. Vice Chair Glueck was concerned with the dark colors of the homes. Mr. Kennedy indicated that the color copies they received may not be accurate; however, they do not allow two homes with same color next to one another. Member Kunisch recognized the applicant's good job and thought it looked a lot better. Member Reddin warned that more developers would want to use the 45 foot wide lots because of the resolution and he did not want to see a trend set. MOTION: Member Feinberg MOVED to approve OV 13-04-26A, Pulte Home Models 2100, 2250, 2623, 3061, subject to the conditions listed in Exhibit A and the following added condition of all commitments made by the applicant in their letter dated December 30, 2004. Member Panas SECONDED the motion. Discussion: Member Feinberg indicated that the buildings accomplished the 50% garage issue but the use of material, products, additions, and amenities enhanced the project. Motion carried 6-0. F:\Minutes\DRB\2005\01-11-05 DRB Minutes Approved on 2/8/05 1 i t NOS Development Review Board Minutes Page 4 of 12 2. OV12-04-16, THE WLB GROUP, REPRESENTING THE ORO VALLEY COUNTRY CLUB, REQUESTS APPROVAL OF A DEVELOPMENT PLAN FOR A NEW CLUBHOUSE FACILITY, LOCATED ON THE NORTHWEST CORNER OF VALLE DEL ORO ROAD AND GREENOCK DRIVE, PARCELS, 224-34- 1650, 224-35-0810, 820, 830, 350, 360, 370 & 910 David Ronquillo introduced the staff report into the record. Vice Chair Glueck asked what the Conditional Use Permit (CUP) conditions were and would it affect the Development Plan proposed. Mr. Ronquillo indicated that there were two conditions in the CUP. First, the applicant must work with the neighbor to the north to address the proximity of the pool location and noise nuisance. Second, the proposed parking lot configuration in the select areas must be redesigned to accommodate additional planting area for preservation of selected trees. The resolution of the CUP could change the pool configuration and parking set up. The applicant, Steve Oliverio with WLB Group, 4444 East Broadway, recapped the staff report and gave a description of new clubhouse facilities. Michael Franks from Seaver Franks Architects, 2552 North Alvernon Way, described how the plan has revolved. Member Reddin asked if there was an alternative area for the pool. Mr. Franks responded that they did consider other options; however, the proposed golf area would use all of that space provided. The swimming pool was related to the fitness center and was a reason to keep them together. Member Kunisch asked if the golf carts on the site were electric and if he had a sub-pump with back-up electric power in case of a flood and power outage in the basement. Mr. Franks confirmed that the golf carts were electric and the basement did have protection from flood and/or power outage. Mr. Oliverio was concerned with Exhibit A, Condition 8 that required an approval letter from the owner of lot 189 for the proposed channel. He stated that there was a Letter of Dedication that indicated plans for a new clubhouse. The Letter of Dedication noted a drainage way of 20 feet needed to be installed with half on lot 189 and the other half on the clubhouse property. They agreed to put the entire 20 foot drainage on clubhouse's property. He did not think they needed an approval letter from the neighbor concerning the drainage issue. He indicated they had several meetings with the neighbors and three meetings with the owners of lot 189. They would provide a wall to help reduce the noise. He continued to explain the zoning and read the neighborhood C.C. & R. into the record. F:\Minutes\DRB\2005\01-11-05 DRB Minutes Approved on 2/8/05 I'l 1/2005 Development Review Board Minutes Page 5 of 12 Member Feinberg thought that the applicant was in conflict with the Parks open space compliance of 50 feet from the property line. Mr. Franks replied that because of the zoning, the open space compliance did not apply. Mr. Vella indicated that the CUP and Development Plan go through their processes at the same time to save the applicant time. Without any large issues, the system worked fine. In this case the CUP could change the Development Plan significantly; therefore, staff recommended a continuance. Member Feinberg clarified that Town Council will determine the CUP and it heavily relates to the Development Plan. Mr. Oliverio noted that they have complied with the Planning and Zoning Commission's conditions. Mr. Civalier would like the Town Attorney's review of the Letter of Dedication concerning the drainage channel. Recess: 7:18 p.m. Reconvene: 7:26 p.m. CALL TO AUDIENCE Opened at 7:26 p.m. Duane West, 350 West Atua Place, stated his support for the new clubhouse at the Oro Valley Country Club (OVCC). Ron O'Neil, 740 West Bangalor, indicated his support for the new clubhouse. He noted there were over 450 OVCC members and the majority was strongly supportive of the new clubhouse. More than 300 of the OVCC members were Oro Valley residents. Ken Muldoon, 30 East Stonewood Place, noted that a few years ago there was a plan to build 100 apartments by El Conquistador Way and Valle Del Oro. During that time, 300 people contested the property use for apartments; however, the apartments were built. In this case, one person was creating a problem to stop a beneficial clubhouse. He did not think that one person should prevent the new clubhouse. The clubhouse was deteriorating. Since the announcement of the new clubhouse there has been a waiting list. The membership fee was increasing from $10,000 to $23,500. Melody Weber, 10000 North Roxbury Drive, supported the OVCC. It would be a great asset to the Town of Oro Valley. Dale Fogelstrom, 265 West Greenock (lot 198), stated his opposition to the new clubhouse and that he was not the only one. The apartment complex mentioned before had changes created F:\Minutes\DRB\2005\01-11-05 DRB Minutes Approved on 2/8/05 1111/2005 Development Review Board Minutes Page 6 of 12 from resident's input. He wanted the input of the new clubhouse given to the DRB. His family wanted to see changes in the plan as recommended by staff. He recommended the DRB await Town Council's decision upon the CUP. Faye McConnelly, 9916 North Calle Loma Linda, watched the development of Oro Valley since 1993. The beautiful buildings in the Town were a great asset. The building she played golf at was deteriorating. Lois Anne Nagy, 245 West Greenock Drive, has resided at the address since 1970. She had two concerns. Her first concern was with the placement of the wall, by the pool, on the property line of lot 189. She would like to see at least a 50 foot setback. Her other concern was upgrading the tennis court lights because they were installed in the 1970's. Gary Dill, 398 East Desert Golf Place, supported the new clubhouse. He thought the problems with the neighbors could be worked out. Joan Dill, 398 East Desert Golf Place, supported the new clubhouse. Jeanne Tearse, 260 West Greenock, was a member of the OVCC and was looking forward to the new facilities. There were important issues that needed to be resolved, such as: o The drainage area, retaining wall in relation to the property line, and select trees o The pool and fitness center setbacks from the property line o Location of pool equipment, snack bar, and grill o Noise, odors, lights, overall activities generated by pool and fitness center, potentially until 8:00 p.m. She indicated that she requested a meeting with Town staff and a club representative to resolve her concerns. She believed approving the plan was premature. T.J. Jack Kibler, 1061 West Calle Bonita, was a member of OVCC. He felt very strongly that the plan should be accepted. It would be a great asset and good for economic development. Dennis Cummings, 775 Landoran Lane, was a member of the OVCC, the Board of OVCC, and the Building Committee for OVCC. It seemed to him that ultimate fairness of the situation was negotiable. As a member of the Building Committee, he believed earnestly it was their intent to negotiate fairly with the north neighbor. They want to ensure they have the proper room, drainage was taken care of, the wall design was appropriate, and the landscaping was nice to look at. His concern was cheating the other OVCC members to enjoy a new clubhouse if the project was not approved. It was a conservative club. He asked for fairness of the 340 members and the north neighbor. He thought a 35 foot setback was an adequate amount. Ruthann McGowan, 55 West Oro Valley Drive, supported the OVCC. Bill McGowan, 55 West Oro Valley, Drive, was a member of the OVCC. He asked for the approval of this project so it could move forward. It meant a lot to a lot of people. F:\Minutes\DRB\2005\O1-11-05 DRB Minutes Approved on 2/8/05 I/11/2005 Development Review Board Minutes Page 7 of 12 Peter Carli, 1113 West Mulligan Drive, elaborated that they have tried to meet with everyone in the area. A general meeting was broadcasted to residents from La Canada to Oracle Road. At that time, nobody said anything negative about the project. The water issue was taken care of. The noise issue was taken care of with the Planning and Zoning Commission. They were being bombarded by another set of rules and regulations. He did not know when they would stop. Anne Britt, 9601 North Calle Buena Vista, was the President of the home owner's association. There has been open communication and hoped to resolve the residents concerns. She did support the new clubhouse and felt it would be a great amenity to community. CALL TO AUDIENCE Closed at 7:47 p.m. Mr. Oliverio stated that they made agreements and changes to the plan based on the Planning & Zoning Commission's decision and neighbors feedback. He displayed the grading plan on the overhead. Mr. Vella indicated the pool issue was identified by staff and notified the applicant in the beginning. Member Kunisch asked what would happen if they approved the item prior to the CUP decision. Mr. Vella indicated that they could recommend approval of the Development Plant and it would appear on the same Town Council agenda as the CUP. If Council approved the CUP it would create significant changes in the Development Plan. Then, Council would decide whether to continue the Development Plan for the changes or send it back to the DRB for changes. If DRB wanted to review the Development Plan after the CUP decision, it would need to continue it. Member Feinberg stated that the applicant did good diligence by communicating with the people effected. One person's quality of life was always important even if they were out numbered. In addition, he did not feel comfortable recommending approval to Town Council and not have the opportunity to be able to discuss the Development Plan after the CUP decision. MOTION: Member Feinberg MOVED to recommend a continuance of OV12-04-16, Development Plan for a new clubhouse facility until the conditional use permit was approved by Town Council. Member Sturmon SECONDED the motion. Discussion: Member Reddin noted that the new exhibits that Mr. Oliverio displayed on the overhead were not reviewed effectively. Until he had a complete packet and the CUP was decided, he thought the continuance was in order. Vice Chair Glueck confirmed there was not a concern with the new clubhouse, but the issue was the changes the CUP could create. Motion carried 6-0. The applicant, Valerie Feuer with MMLA Psomas, 800 West Wetmore, Suite 110, would comply with the conditions. Member Kunisch was concerned with the town homes meeting the 50% garage guideline. He was also concerned that since the homes were small, people would use their garages as living space. Ms. Feuer replied that the units were attached, had an archway and meet the 50% requirement. Mr. Vella indicated that the use of the garage as living space would be addressed with the home owner's association's C.C. & R.'s. The design was established with the rezoning over a year ago. The park area was already approved by Town Council. The Town Attorney would need to address a plat condition to limit the use of the garage. Member Reddin recalled that two of the four models have already been reviewed. Member Sturmon asked how the emergency exit would be regulated. Mr. Civalier responded that the gate was only accessible to emergency vehicles. MOTION: Member Panas MOVED to recommend approval of OV 12-04-28, Preliminary Plat for the Desert Sky Subdivision, with the conditions specified in Exhibit A. Member Reddin SECONDED the motion. The applicant, Eric Barrett with TMHS Associates, Inc., 5515 East Grant Road, Number 100, stated that they would comply with the conditions. There was a concern between lots 22, 23, and 24. There were trees to preserve so he asked to reduce that wall as needed. Mr. Civalier asked for a condition requiring the applicant to apply for a right of way license agreement approval. MOTION: Member Kunisch MOVED to approve OV 12-04-28, Landscape Plan for the Desert Sky Subdivision with the conditions specified in Exhibit A and the following additional condition that the applicant must apply for a right of way license agreement approval. Member Sturmon SECONDED the motion. Member Feinberg added a friendly amendment to maintain the landscape on lots 22, 23, and 24 to allow the landscaper to adjust the height of walls, as needed, to preserve trees subject to the Planning and Zoning Administrator's approval. Member Kunisch accepted the friendly amendment. Motion carried 6-0. 6. Jonathan Lew introduced the staff report into the record. Member Feinberg asked Mr. Lew to explain why the sub committee allowed the two signs instead of the normal one. Mr. Lew explained that originally the building was to have four tenants and now will only have one; therefore, staff was allowing the two signs on the building in lieu of one sign and a directory sign. Member Kunisch asked if the blue "e" in the Bed Mart sign was a corporate logo. Mr. Lew indicated that the applicant was in the process of establishing a registered trademark. Mr. Vella explained that it was a corporate logo but not a registered trademark. The applicant, Jerry Jepson with Fluoresco Lighting and Signs, 5505 South Nogales, indicated that they were asking for the current code for a single tenant building and the sign would be smaller than the maximum size allowed. Member Reddin noted that without a registered trademark, the DRB normally would not approve the use of color. F:\Minutes\DRB\2005\01-11-05 DRB Minutes Approved on 2/8/05 Ill 1/2005 Development Review Board Minutes Page 11 of 12 Mr. Vella indicated that every application was different and if they were to approve the sign, it would not enforce future applications. The sub committee generally supported the blue color and did not think it was offensive. Member Reddin asked if the blue was in the Big"0" Tire color palette. Mr. Vella replied that the blue was not in the color palette. Member Kunisch was not comfortable approving the blue "e"prior to the registered trademark's approval. Member Feinberg asked the intent of the applicant to have the logo trademarked and if it was just for the Oro Valley location or for all locations. Mr. Jepson responded that it was a new logo and once they received approval within 20 days, all locations would have the new trademark. Member Kunisch asked if the registered trademark would be green with blue. Mr. Jepson indicated that all other Bed Mart locations would be red with the blue "e" and the night cap above the "e". Member Reddin noted that they could make a condition to allow the use of the blue "e" if the registered trademark was approved. Member Kunisch asked why the applicant would use the copper patina when the surrounding buildings use a variety of colors. Mr. Vella indicated that the sign criteria required the building to use copper patina for its signs. He restated that the applicant applied to use the copper patina with the blue "e" with or without the registered trademark or corporate logo. Mr. Jepson confirmed with Mr. Vella and indicated they were asking to carry their image with the blue "e". MOTION: Member Feinberg MOVED to approve OV3-03-06A, amendment to the sign criteria for the Big "0" Tire Service Center to allow 2 wall signs to be placed on separate elevations and to allow the use of Bed Mart's blue logo and subject to the conditions in Exhibit A. Member Kunisch SECONDED the motion. Member Panas added a friendly amendment that the use of the blue logo was subject to the registered trademark's approval. Member Feinberg accepted the friendly amendment. Motion carried 6-0. Any vents and chimneys must terminate per manufacturer listing and are subject to review by Planning and Zoning and the Town Building Official. 3. All models must comply with the PAD amendment conditions specified on page 1 of the staff report. 4. No three exact elevations may be placed adjacent to one another on the same side of a street. 5. Approved models are subject to the lot fit analysis provided by the applicant. 6. All models must include options for garage windows that include multiple window styles. www.townoforovalley.com 7. The applicant must resubmit plans to satisfy condition#6. As we discussed previously, the plans will need to be resubmitted to provide for condition#6. You may provide a palette of various window styles rather than assigning just one style to each model. This is an item that will be reviewed administratively. You will need to provide a copy of an architectural approval letter with the building permit submittal. I look forward to helping you complete this project. If you have any questions, please feel free to contact me at 229-4810. Pulte has evaluated the DRB's comments and focused specifically on the concern about 2002 Rancho Vistoso PAD Amendment ("PAD Amendment") Condition 6 that states: "The front garage(s) shall not consist of more than 50% of the total building frontage." Based on that input, Pulte's operating team met to brainstorm ideas to address this concern. Using either alternative calculation, Pulte's architectural elevations would meet Condition 6 and the garage frontage would equal or be less than 50% of the total building frontage. Pulte especially supports the second alternative as more truly representative of the impact of building frontage as a whole on the streetscape and on passersby. We provide documentation of this second alternative with Pulte's models in Neighborhood 10 attached to this letter. Second,Pulte consulted further with architect, David Gibson,to design models that physically meet the 50% garage frontage requirement of Condition 6 using the Town's 6893 North Oracle Road,Suite 121 Tucson,Arizona 8 667pp446 22 Contractor License#064206-079383 520-229-6000 520-226-60401 (fax) ;s ,w TM il „Are7- m- ed_,,,, ,.. ii e----) current method of measurement on a horizontal plane. The front to back roof over the entry on the 'C' elevation was not able to be constructed per the original submittal. The tower would have had to be raised an addition 30" to allow the cricket behind the tower to hit the wall and this was determined not to be architecturally pleasing. I was not here during the initial DRB submittal but my understanding was that we agreed to add the court yard entry towers on all 4 plans / all 3 elevations instead of the entry tower over the entry. We can change the roof directions on the court yard entry tower to mimic the original submittal if requested by the review board.
