CALL TO ORDER
Chair Clark called the meeting to order at 6:00 p.m.
ROLL CALL
Present: Robert Kellar, Commissioner
Joe Nichols, Commissioner
Philip Zielinski, Commissioner

Absent: William Thomas, Commissioner
Sandra Wilson, Commissioner
Kimberly Outlaw Ryan, Vice Chair
Staff Present: Michael Spaeth, Principal Planner
Joe Andrews, Chief Civil Deputy Attorney
Attendees: Melanie Barrett, Town Council Liaison
PLEDGE OF ALLEGIANCE
Chair Clark led the Commission and audience in the Pledge of Allegiance.
CALL TO AUDIENCE
There were no speaker requests.
COUNCIL LIAISON COMMENTS
Council Liaison Melanie Barrett spoke about previous and upcoming Town Council agenda items as related to
Planning. She also spoke about sessions related to Planning that she attended at the recent Arizona League
and Cities conference.
SPECIAL SESSION AGENDA
1.REVIEW AND APPROVAL OF THE JUNE 17, 2025 SPECIAL SESSION MEETING MINUTES
Motion by Commissioner Philip Zielinski, seconded by Commissioner Robert Kellar to approve the
meeting minutes as written.

Vote: 4 - 0 Carried
2.PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION REGARDING PROPOSED CODE
AMENDMENTS TO TOWN CODE ARTICLE 10-1-4, NOISE, AND ZONING CODE SECTION 27.9,
GRADING, TO REFLECT RECENT STATE LAW CHANGES REGARDING PERMITTED
CONSTRUCTION HOURS
Principal Planner Michael Spaeth provided a presentation that included the following:
- Purpose
- Background
- Proposed amendments
- Summary
Discussion ensued among the Commission and staff.
Chair Clark opened the public hearing.
There were no speaker requests.
Chair Clark closed the public hearing.
Motion by Commissioner Joe Nichols, seconded by Commissioner Robert Kellar to recommend
approval of the proposed code amendments included in Attachment 1 to reflect recent state law changes
regarding permitted construction hours within the Town.
Vote: 4 - 0 Carried
3.DISCUSSION AND POSSIBLE ACTION ON THE COMMUNITY COMMENT (60%) DRAFT OF THE
COMMUNITY'S NEXT 10-YEAR ACTION PLAN, KNOWN AS OV'S PATH FORWARD
Principal Planner Milini Simms provided a presentation that included the following:
- Purpose
- Phase 2: "Let's Think"
- Going from a 30% to a 60% draft
- 1. Clarify and broaden
- 2. Land use map
- 3. NCO designation and amendment process
- 4. Building height guiding principle
- The BIG community review
- Next steps
- Summary and possible motion
Discussion ensued among the Commission and staff.
Motion by Chair Anna Clark, seconded by Commissioner Robert Kellar to recommend acceptance of
OV's Path Forward Community Comment Draft, with Option 3 for the height guiding principle for the
community to consider as part of their review.
Vote: 4 - 0 Carried

4.STUDY SESSION: DISCUSSION REGARDING PROPOSED ZONING CODE AMENDMENTS TO
REFLECT RECENT STATE LAW CHANGES REGARDING THE REQUIRED APPROVAL PROCESS
FOR "NON-DISCRETIONARY" DEVELOPMENT AND DESIGN REVIEW APPLICATIONS
Principal Planner Michael Spaeth provided an update that included the following:
- Purpose
- Application types
- Anticipated code amendments
- Summary
Discussion ensued among the Commission and staff.
PLANNING UPDATE (INFORMATIONAL ONLY)
Principal Planner Michael Spaeth commented on the next Planning and Zoning Commission meeting, the
upcoming Community Academy, and the recent state Planning conference. He also introduced the newest
Planner, Michael Garcia.
ADJOURNMENT
Chair Clark adjourned the meeting at 7:00 p.m.
