Jonathan Lew Planning Technician Town of Oro Valley (520) 229-4853 (520) 742-1022 (fax) 11/18/2008 M 1 - TOWN OF ORO VALLEY STAFF REPORT TO DEVELOPMENT REVIEW BOARD MEETING DATE: DECEMBER 9, 2008 TO: DEVELOPMENT REVIEW BOARD FROM: Sarah S. More, Planning and Zoning Director SUBJECT: OV3-04-03B, Fluoresco Lighting and Signs, representing property owners CTVV- FTP LLC, requests approval to amend the sign criteria for Placita De Oro Plaza, located at the Southwest corner of Tangerine Road and First Avenue, Parcel # 224-02-170A. EXECUTIVE SUMMARY OF APPLICATION The applicant is requesting to amend the Sign Criteria for Placita De Oro Plaza by changing the number of tenant panels on the freestanding signs from three to five. BACKGROUND: Process Under Oro Valley Zoning Code Revised (OVZCR)chapter 28.2.B, a sign criteria is an official document that regulates all signage within a development. Per section 28.2.B.1, "Sign Criteria shall be written in compliance with the provisions of Chapter 28 and Addendum A design guidelines...Sign Criteria require the approval of the Development Review Board (DRB)." The applicant's proposal is to amend this criteria which requires DRB approval. Approvals to Date The Placita De Oro Plaza development plan was approved by Town Council in November, 2000. The site currently has Ace Hardware, Wells Fargo, Walgreens and space for various other tenants. The site has a total area of 11.18 acres. • On May 20, 2004, the DRB approved a sign criteria for the plaza. The sign criteria includes the following noteworthy items: 1. Color Pallete: a. Copper Patina or Mission Patina b. Black Anodic (41-335) c. White Acrylic (015) d. Dark Bronze (41-313) 2. Halo Illumination using white neon, white or amber LED 3. Sign area is determined by Chapter 28 of the OVZCR. Currently the OVZCR restricts the size of wall sign as follows: a. Tenants within 300 feet from the street are permitted 1 square foot of signage per linear foot of building frontage, not to exceed a maximum of 150 square feet. b. Tenants with building elevations greater than 300 feet from the street are permitted 1.5 square feet of signage per linear foot of building frontage, not to exceed a maximum of 200 square feet. 4. Maximum size of logos is limited to 8 square feet. 5. Overall height of any letter or logo is restricted as follows: a. Leased area up to 2,000 square feet: 24" maximum letter height b. Leased area 2,001 —6,000 square feet: 36" maximum letter height c. Leased area 6,001+ square feet: 48" maximum letter height TOWN OF ORO VALLEY 2 of 3 STAFF REPORT TO DEVELOPMENT REVIEW BOARD 6. Two freestanding monument signs, with a maximum of three businesses on each sign. On March 14, 2006, DRB approved an amendment to the sign criteria that increased the maximum letter height permitted to 61" for tenants with more than 12,001 square feet of tenant space. The proposal also maintains the approved color palette of copper patina. Surrounding Land Uses Direction Zoning Land Use North Rancho Vistoso PAD Currently Vacant Land South R1-36 Tangerine Hills Subdivision East R1-36 Currently vacant land West R 1-3 6 Tangerine Hills Subdivision DRB SUB-COMMITTEE ON SIGNS MEETING On November 17, 2008, the members of the DRB sub-committee on signs individually notified staff that the applicant's proposal is straight-forward and can proceed without objection. The members expressed that a sub-committee meeting was not necessary for this application. ANALYSIS OF OVZCR 22.6.B DEVELOPMENT REVIEW CRITERIA In considering any application, the DRB shall be guided by the following criteria: The proposed design shall promote a desirable relationship of structures to one another, to open spaces and topography both on the site and in the surrounding areas: Internal Compatibility The applicant's proposal keeps the existing color and illumination method of the freestanding signs. The proposal meets this design guideline. The character of the proposed design shall be in harmony with, and compatible to, those structures and signs in the neighboring environment and the design character adopted for any given area avoiding excessive variety or monotonous repetition: External Compatibility The area surrounding the Placita De Oro Plaza is predominately residential. The Safeway Vistoso Plaza is located on the Northwest corner of First Avenue and Tangerine Road. The plaza currently has one freestanding sign with six tenant panels. The applicant's proposal would mimic the existing effect of halo illuminated tenant panels within the Safeway Vistoso Plaza. In sum, the applicant's proposal meets this design guideline. Signs, ingress, egress, internal traffic circulation, off-street parking facilities, loading and service areas and pedestrian ways shall be so designed as to promote safety and convenience: TOWN OF ORO VALLEY 3 of 3 STAFF REPORT TO DEVELOPMENT REVIEW BOARD Location, colors and illumination has been restricted in a manner to provide safety, proper visibility and convenience in regards to flow of traffic. In order to protect the visual serenity of the Town, design of signage should be based on trying to get information across with the least signage possible: The applicant's proposal would increase the number of tenants on the existing freestanding signs from three to five tenants. Thus, the proposal does not meet this design guideline; however, the impact of more tenants is mitigated because the overall size and area of the panels will remain the same or less. Sign designs shall be in compliance with the purpose statements established in Section 28.1.A: All components shall be in compliance with Addendum A, Design Guidelines: Addendum A, Design Guidelines is written to reflect the purpose statements in Chapter 28, Signs. Both areas of the code address uniqueness, character, compatibility and the use of materials and colors that appear natural to the environment and surrounding community. These issues have been previously discussed. SUMMARY OF FACTORS Findings in Favor 1. The size of the signage conforms to existing OVZCR standards. 2. The DRB Sub-committee on Signs expressed no objection to the applicant's proposal. 3. Proposed change does not increase the overall area of the sign or impact the color. Findings Against 1. The proposal would increase the number of tenants on the freestanding signs. RECOMMENDATION: Staff recommends approval of the revision to the Placita De Oro Sign Criteria. The proposal conforms to the OVZCR requirements, General Plan, and all but one design guideline specification. SUGGESTED MOTIONS: I move to [approve, approve with conditions, OR deny] OV3-04-03B, Revision to the Placita De Oro Sign Criteria to allow a maximum of five (5) tenant panels on each freestanding sign. MOTION carried, 5-0. 2. Discussion and possible recommendation to Town Council of proposed change to board and commission appointments. Chairman Gribb stated the proposal would allow each Council Member to make political appointments to each board and commission. Town Councilman Kunisch affirmed the proposal and stated he was looking for feedback. Mr. Kunisch stated the term of the appointees would expire when the Council Members term expired. Member Schoeppach stated his discomfort with the proposal. Member Anderson stated she could not support the proposed change without answers as to why the change is being requested. Member Shelton stated what is happening is a group wants to change the process but they are not interested in telling us why. Member Schoeppach stated if this process gets political, it will disempower citizens from wanting to participate in its government because the chances of being able to be active would require you to know or be known by a Council Member. It will not open voices, it will close voices and it would be a real loss to the citizens of this town. Member Buette, Anderson and Shelton agreed with Member Schoeppach. The Members agree to draft a document to be presented at the Council Meeting in January. Member Schoeppach will draft the document and additional discussion will take place at the next DRB meeting on January 13, 2009.
