Dear Laura, A special session of the Development Review Board (DRB) sub-committee on signs was held on September 30, 2008 to discuss your proposed changes to the aforementioned project. The DRB members present at the meeting were Thomas Gribb and Ray Shelton. Both members stated that they understood the design and need for the entryway signs and for a"symmetrical" look. The members presented the following comments to mitigate the impact of the additional three- entryway signs: • Reduce the number of multi-tenant freestanding signs from five to three. • Prohibit wall signs on east elevation on the back of buildings along the east side of the property. In order to present a more cohesive criteria, by eliminating some vague language within the master sign program, staff is proposing to remove the following sentence under the heading, "Building Wall Mounted Signs": Any variations from these standards are at the Evergreen's discretion Please resubmit 10 copies of your proposal by October 15, 2008. Presently, staff has scheduled another meeting with the DRB sub-committee on sign for October 22, 2008 at 3pm in the Kachina Room, Administration Building. If you have any questions regarding this submittal, please feel free to contact me at(520) 229- 4853 or at jlew@orovalleyaz.gov. More,FAICP, Planning and Zoning Director SUBJECT: OV3-08-07, Public Hearing, Laura Swan representing Evergreen Devco Inc., requests approval for a revision to the Steam Pump Village Master Sign Program in order to add three additional entryway signs and amend other provisions, located on the west side of Oracle Road, across the street from Honeywell. EXECUTIVE SUMMARY The applicant is requesting approval for three additional entryway signs to the existing Steam Pump Master Sign Program. This would bring the total number of freestanding/entryway signs to ten for the entire development. At staff's request, the applicant has made additional changes to the text of the Master Sign Program (MSP). The changes include consolidating landlord tenant agreement provisions into one section, making the text of the MSP into an outline format (for easier referencing) and updating the Oro Valley Zoning Code Revised References from Chapter 12 to Chapter 28. The applicant has also agreed to remove the following two sentences, "Any variations from these standards are at Evergreen's discretion" and "Sign Area: Aggregate sign area permitted for each business as defined in this Master Sign Program". Both sentences are vague and could cause confusion on the exact standards of the MSP. Review Process and Criteria The applicant is requesting approval of a Master Sign Program (MSP). OVZCR Chapter 28.2.B.2 defines MSP as, "an alternative to the sign regulations...which provides latitude in order to achieve variety and good design...MSP requires review by the Development Review Board(DRB) and approval by the Town Council." Per the OVZCR,Master Sign Program review shall be guided by the following criteria: • Overall presentation of the entire development, including landscaping, architecture, topography, uses and design. • Compliance with the Design Guidelines Addendum A.C.4 and the purpose statements of OVZCR Chapter 28 Signs. • Any other applicable information that may be useful in the overall presentation of the proposed criteria for the development. A Master Sign Program is a site-specific design that allows the applicant a certain degree of latitude to achieve a unique design that would otherwise not be possible within the standards of OVZCR Chapter 28 Signs. Per OVZCR 28.2.B.2.b, "MSP...allow adjustments to the standards...provided they are justifiable." The attached table provides a summary of requested exceptions to particular standards of the OVZCR and the existing signage. It is important to note that an MSP is not intended to simply provide a means to obtain a variance from zoning requirements. A variance request entails Board of Adjustment review and a unique evaluative criteria. The intent of an MSP is to enable superior design that may be otherwise constrained by code. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD, OV3-08-07 Page 2 of 6 DRB SUBCOMMITTEE DISCUSSION: The DRB Sub-Committee on Signs met with the applicant on September 30, 2008. To mitigate the increase in signage, the Sub-Committee proposed reducing the amount of wall signs allowed within the center. The applicant has resubmitted without the requested mitigation. The Sub-Committee members met again with the applicant on February 6, 2009. Both the applicant and the Sub-Committee members agreed that a site tour would be helpful. Staff has scheduled the site tour for April 13, 2009. No agreement on mitigating the increase in signage was reached; however, the Sub-Committee members agreed that the proposal should proceed to the full DRB for consideration. BACKGROUND Current Site Conditions: Approximately half of the site has been graded with parking and utilities installed. A traffic light along Oracle Road has also been installed. Two of the planned five buildings in phase 1 have been completed. Phase 2 of the development has three buildings completed with one additional office building to be built. Approvals to Date: 1996: Town Council approved a revised Planned Area Development for this site that excluded the historic ranch site. May 2004: Town Council approved a development plan for phase 1. August 2005: Town Council approved a PAD Exemption, which allows Steam Pump Village to function under the OVZCR sign standards. Town Council also approved a Master Sign Program for this development. September 2005: Town Council approved a development plan for phase 2 of the development. May 2008: Town Council approved a development plan for phase 3 of the development. Summary of Approved Master Sign Program Freestanding and Entryway Sign Standards: Freestanding Signs • 8 feet in height • 44 square feet • Internal illumination • Copper top with a sandstone base • Five freestanding signs will be placed along Oracle Road along with five entryway signs for a total of ten signs. (Code allows a combination of three freestanding and entryway signs for any single development). • See page 9 of the applicant's proposal for location • See page 10 and 11 of the applicant's proposal for the design Entryway Signs • 6 feet in height • 32 square feet TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD, OV3-08-07 Page 4 of 6 • White halo illumination • Convexed (bowed out) shape with a sandstone base • Two will be placed along Oracle Road • See page 9 of the applicant's proposal for the locations • See pages 12-14 of the applicant's proposal for the design The following elements of the approved MSP exceed code requirements: 1. Use of seven freestanding/entryway signs versus three permitted by code. 2. 1.5 square feet of signage for every linear foot of frontage for tenants with more than 10,000 square feet and 160 feet from the east property line. (Code allows the 1.5/1 allowance only for tenants greater than 300 feet from the street.) 3. For in-line retail shop tenants, if a business is not identified on a separate identification sign then the total wall sign area on up to two building walls may be increased by 10%, but may not exceed a maximum of 150 square feet per building frontage. Code does not permit this adjustment to the wall sign standards. ANALYSIS A. General Plan Policy 2, Signage: Increased commercial activity has added signage throughout the Town. Signage controls have to balance citizen concerns about the increasing level of signage with the needs of businesses to attract customers. The applicant's proposal includes textual changes that clarify the signage requirements for the development; however, the addition of signage needs to consider citizen's desires to reduce the amount of signage within the community. Within an MSP, applicants may request adjustments to the sign standards specified in Chapter 28 of the OVZCR"when justified". The Town can then request some form of mitigation to reduce the impact of the increased standard. B. OVZCR Compliance Justification for exceeding OVZCR Requirements 2. The proposed development shall promote a desirable relationship of structures to one another, to open spaces and topography both on the site and in the surrounding neighborhood. The applicant's proposal would add signage to existing and proposed entryway features. The proposal would add an element to an essentially blank surface. This application does have functional merit; however, it also increases the amount of signage for the site (see item number four). 3. The character of the proposed design shall be in harmony with, and compatible to, those structures and signs in the neighboring environment and the design character adopted for any given area avoiding excessive variety or monotonous repetition. The applicant's proposed additional entryway signs would match the existing entryway signs. This achieves a level of consistency and symmetry. The proposal meets this design guideline. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD, OV3-08-07 Page 5 of 6 4. In order to protect the visual serenity of the Town, design of signage should be based on trying to get the information across with the least signage possible. The applicant has proposed adding three additional entryway signs to the MSP. One concession that the applicant has made is to remove the following sentence from the MSP which could result in a slightly lower amount of signage: "If a business is not identified on a separate identification sign then the total wall sign area on up to two building walls may be increased by 10%, but may not exceed a maximum of 150 square feet per building frontage." However, the sentence only applies to in-line retail shop tenants, which would potentially add 5-10 square feet of wall signs to the existing calculations. This allowance already exceeds code. In sum, the applicant's proposal does not meet this design guideline. 7. Sign designs shall be in compliance with the purpose statements established in Chapter 28. All components of a development shall be in compliance with Addendum A Design Guidelines. Addendum A, Design Guidelines are written to reflect the purpose statements in Chapter 28, Signs. Both areas of the code address uniqueness, character, compatibility and the use of materials and colors that appear natural to the environment and surrounding community. ENGINEERING COMMENTS Traffic & Safety The Town of Oro Valley's Public Works Department has reviewed the placement of the sign. The proposed sign is not within any sight visibility triangles and does not pose a safety risk to the public. SUMMARY OF FINDINGS Findings in Favor 1. The applicant's proposal meets design guidelines related to appearance and design. 2. The proposal does not impose a traffic safety hazard. 3. The proposed changes to the text of the MSP would help clarify the content of the MSP and removes vague and confusing language. Findings Against 1. The proposal deviates from the standards listed in Chapter 28 of the OVZCR. 2. The proposal increases the amount of signage without proposed mitigation. 3. The DRB Sign sub-committee was concerned about the lack of compromise with the applicant for mitigating the amount of signs. RECOMMENDATION Staff finds that the text amendments and design of the new entryway signs are acceptable;however, the addition of more signage has not been adequately justified or mitigated. Staff recommends that DRB forward a recommendation for approval to Town Council for the applicant's proposed revisions, but not allow the addition of more entryway signs. A condition has been added to Exhibit A to reflect the current number of entryway signs. It is important to note that an MSP is not intended to simply provide a means to obtain a variance from zoning requirements. A variance request entails Board of Adjustment review and a unique evaluative criteria. The intent of an MSP is to enable superior design that may be otherwise constrained by code. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 2 of 6 DRB RECOMMENDATION: On April 13,2009,the DRB held a site tour of the Steampump Village Center. At their regularly scheduled meeting on April 14, 2009,the DRB voted(6-0) to recommend that Town Council approve the applicant's request for more entryway signs, with the condition that the number of freestanding signs be explicitly stated within the Master Sign Program to a maximum of five. Comments made during the DRB meeting directly referenced site conditions observed during the site tour. The applicant has made the aforementioned change and included a letter providing an explanation for the proposed change. April 2009: DRB recommended that Town Council approve the revised Master Sign Program for Steam Pump Village. • See page 9 of the applicant's proposal for location • See page 10 and 11 of the applicant's proposal for the design Entryway Signs • 6 feet in height • 32 square feet TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 4 of 6 • White halo illumination • Convexed(bowed out)shape with a sandstone base • Two will be placed along Oracle Road • See page 9 of the applicant's proposal for the locations • See pages 12-14 of the applicant's proposal for the design The following elements of the approved MSP exceed code requirements: 1. 4. The applicant's ability to alter the sign standards through discretionary authority, "Any variations from these standards are at Evergreen's discretion." ANALYSIS A. The addition of the signs provides greater visible identification for the development. 3. The character of the proposed design shall be in harmony with, and compatible to, those structures and signs in the neighboring environment and the design character adopted, for any given area avoiding excessive variety or monotonous repetition. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 5 of 6 The applicant's proposed additional entryway signs would match the existing entryway signs. This achieves a level of consistency and symmetry. The proposal meets this design guideline. 4. In order to protect the visual serenity of the Town, design of signage should be based on trying to get the information across with the least signage possible. The applicant has proposed adding three additional entryway signs to the MSP. One concession that the applicant has made is to remove the following sentence from the MSP which could result in a slightly lower amount of signage: "If a business is not identified on a separate identification sign then the total wall sign area on up to two building walls may be increased by 10%,but may not exceed a maximum of 150 square feet per building frontage." However, the sentence only applies to in-line retail shop tenants, which would potentially add 5-10 square feet of wall signs to the existing calculations. This allowance already exceeds code. The applicant has also agreed to remove the following two sentences, "Any variations from these standards are at Evergreen's discretion" and"Sign Area: Aggregate sign area permitted for each business as defined in this Master Sign Program". Both sentences are vague and could cause confusion on the exact standards of the MSP. 5. The applicant's proposal is unique and meets both the purpose statements of Chapter 28, Signs and Addendum A, Design Guidelines. ENGINEERING COMMENTS Traffic& Safety The Town of Oro Valley's Public Works Department has reviewed the placement of the sign. The proposed sign is not within any sight visibility triangles and does not pose a safety risk to the public. The inclusion of clear and identifiable signage is better for traffic safety. The applicant's proposal accomplishes this objective. SUMMARY OF FINDINGS Findings in Favor 1. The applicant's proposal meets design guidelines related to appearance and design. 2. The proposal does not impose a traffic safety hazard. 3. The addition of more signs would enable drivers to identify the center sooner, thus creating less of a traffic hazard. 4. The proposed changes to the text of the MSP would help clarify the content of the MSP and removes vague and confusing language. Findings Against 1. The proposal deviates from the standards listed in Chapter 28 of the OVZCR. TOWN OF ORO VALLEY COUNCIL COMMUNICATION Page 6 of 6 RECOMMENDATION Staff finds that the text amendments and design of the new entryway signs are acceptable and recommends that Town Council approve the proposed revisions without any conditions. Lti \H\ April 21, 2009 i Mayor Paul Loomis I a Town of Oro Valley b 11000 N. La Canada Dr. Oro Valley, AZ 85737T9. mil Re: Revision to the Steam Pump Village Master Sign Program—OV3-08-07 Dear Mayor Loomis and Members of the Town of Oro Valley Town Council: Evergreen Devco Inc. is requesting a revision to the Steam Pump Village Master Sign Program to allow for the addition of three entryway signs for Steam Pump Village. On April 14th, members of the Development Review Board approved our request 6-0 after an onsite meeting on Monday, April 13th Steam Pump Village is a very unique site for many reasons. First of all, Steam Pump Village is a long and narrow site with over 3/4 mile of frontage along Oracle Road with six curb cuts. Second, Steam Pump is an unanchored center. Unlike other projects such as the "Target Center" or the "Walmart Center" we are Steam Pump Village and therefore need to identify our center. We are requesting three additional entryway signs so we will have mirroring signs at the intersection of Oracle and Steam Pump Way and also at the main curb cut (full turning intersection) in Phase 3. Currently, the lack of symmetry at the intersection makes the entryway appear unfinished. At this time, we are allowed two entryway signs, one of which is installed at the intersection of Oracle and Steam Pump Way with the other to be installed at the north end of the site in Phase 4. The identification signs are angled towards Oracle Road. The sign in front of Chili's can only be seen by traffic traveling north on Oracle. An additional sign would not only complete the symmetry at the intersection but it would also provide identification for those passengers travelling south. The same situation occurs at the full-turning curb cut in Phase 3. The northern most sign planned for Phase 4 is essential in identifying the project since it is the first opportunity for those driving south on Oracle to see Steam Pump Village. As we all know, the retail market is struggling all over the country. We are working hard to attract, and more importantly, retain, our tenants. The cost of retrofitting the existing wall sign at the intersection and building the additional signs (rather than just building entry walls) exceeds $65,000 which Evergreen would pay for completely, not passing on any expenses on to our tenants. We also spent over $1,500 for temporary signage in anticipation of the DRB Hearing because we really believe the entryway signs will help our tenants now and in the future. Based on comments from the Town Staff, we believe the design of the signs provide an effective form of identification while still preserving the beauty of the surrounding environment. In an effort to work with the Town staff regarding the Master Sign Program revisions, Evergreen agreed to remove the line "Any variations from these standards are at Evergreen's discretion", eliminating a vague sentence that created difficulties for Staff as they went to approve sign packages from individual tenants. Also, we removed the section in the wall sign areas that gave tenants the right to increase their signage by 10% if they chose not to participate with a panel on the monument sign. At the request of Staff, we rewrote the sign program in an outline form, making it easier for Staff to reference a portion of the plan. Evergreen Devco and our tenants hope you will consider following in the footsteps of the Development Review Board and approving our revision to the Master Sign Program for Steam Pump Village. Now more than ever we must work to help our tenants weather the current state of the economy until business picks up again. Please let me know if you have any questions. We look forward to presenting our revisions to you and the Council in the near future. Thank you for your time and consideration. Sincerely, do A,,, Laura Swan Evergreen Devco, Inc. enclosures e MASTER SIGN PACKAGE FOR Steam Pump Village BY EVERGREEN DEVCO, INC. 2390 East Camelback Road, Suite 410 Phoenix, Arizona 85016 _ - QT:ED\SIE71 Adopted by Mayor and Council , ' r;NF? 3 M August 3 2005 OV3-05-04 JLJ9WnO"JrD E' 1.:: 7 As Amended: , 2009 Revised: OV3-08-07 APPROVR23Y paDRB/BOA DAT er, /L i ''P ROJECT MANAGER OV3-08-07 1 I. She then reported that with adjustments made to the budget line items, there is currently a surplus of$450,998 in the General Fund, $108,475 in the Highway Fund and in the Bed Tax fund there is a surplus of$63,439. Mayor Loomis opened the floor for public comment. Jacob Maish, non-Town resident, Oro Valley Police Department dispatcher, expressed concerns with the proposed changes. He commented that proposals such as a 1% decrease in wages, an increase in health care and possible furloughs would greatly affect the employees. He asked the Town Council to be cautious and responsible when making these considerations. He also noted that employees need to feel that they are valued and appreciated. Chris Palic, non-Town resident, President of the Oro Valley Police Officers Association (OVPOA), commented that some issues being discussed are under the current Memorandum of Understanding (MOU) with the Police officers. He also stated that there are some upsetting items such as giving money away for community funding or for property but still considering taking away from employees. He asked that the Council keep the employees and their current pay/benefits and not give money away. He stated that he hoped that everyone could work proactively together and in good faith. http://orovalley.granicus.com/MinutesViewer.php?view_id=2&clip_id=643 07/09/2009 .Town Council Page 16 of 17 ADJOURNMENT MOTION: A motion was made by Council Member Latas and seconded by Council Member Garner to adjourn at 12:20 a.m. and to move the remaining agenda items to the next available meeting (May 27th).
