3 TOWN OF ORO VALLEY TOWN COUNCIL COMMUNICATION MEETING DATE: MARCH 4,2009 TO: HONORABLE MAYOR AND COUNCIL FROM: Sarah S. More, Planning and Zoning Director SUBJECT: Public Hearing, Ordinance (0) 09- 02 , OV3-08-11, Effective Signs representing Innovation Corporate Center, LLC., requests approval of a PAD Exemption for Innovation Corporate Center East, Lots 1-6, Rancho Vistoso Neighborhood 3, Innovation Corporate Center-East, located NE of the intersection of Innovation Park Drive and Tangerine Road. EXECUTIVE SUMMARY OF APPLICATION: The site currently consists of several completed office buildings with more planned within the development. The applicant's proposal is for an exemption from the sign standards of the Rancho Vistoso Planned Area Development(PAD). Other PAD Exemptions for signs have been granted in the area, including Ventana Medical, Oro Valley Hospital, and Oro Valley Marketplace. The exemption would enable construction of two 42 square foot monument signs and two 31 square foot directory signs. The design of the monument signs is different from other monument signs within Rancho Vistoso;however, it includes elements such as Vistoso Stone. Currently,Rancho Vistoso does not have a design for a directory sign. DEVELOPMENT REVIEW BOARD ACTION: At their regularly scheduled meeting on January 13,2009, the Development Review Board(DRB) voted(4-0)to recommend that Town Council approve the requested exemption from the Rancho Vistoso Sign Standards. One citizen voiced opposition to the proposal because it lacked consistency within Rancho Vistoso PAD. The citizen was also opposed to the freestanding sign being illuminated. BACKGROUND: Nature of Application: The applicant is requesting exemption from the sign standards of the Rancho Vistoso PAD,which is enabled by OVZCR Chapter 28.2.C. Please see the attached applicant's letter of request. The aim is to utilize the Oro Valley Zoning Code Revised (OVZCR) standards. In terms of process, the (DRB) must review an exemption request and forward its recommendation to Town Council. Town Council makes the final determination. Current Site Conditions: The site has been graded into individual building pads and roads have been installed. A few buildings have been completed, and several others are in the process of obtaining building permits and certificates of occupancy. Overview of Site Improvements: • Lots 1 &2: Zoned C-1; 12 office buildings, totaling 100,000 square feet. 11 one-story buildings with a maximum allowable building height of 34'. Office 12 will be one or two story. Lot I will be platted as office condominiums. TOWN OF ORO VALLEY TOWN COUNCIL COMMUNICATION, OV3-08-11 Page 2 • Lots 3 - 6: Zoned CPI,the maximum allowable building height is 36' and three stories. The development of each parcel will require a separate Development Plan, Landscape Plan, and architecture review. • Multiple tenants are anticipated, including medical offices and related or complimentary uses. Approvals to Date • On November 14,2006,the DRB approved the architecture and landscape plans for Innovation Corporate Center. • On December 20,2006,the Town Council approved the development plan for Innovation Corporate Center. • On October 13,2008,the Vistoso Community Association approved a revision to the Vistoso PAD Sign Standards for Innovation Corporate Center. • On January 13,2009,the DRB voted(4-0)to recommend that Town Council approve a PAD exemption for Innovation Corporate Center. The DRB also voted(4-0)to conditionally approve a sign criteria for this center. The Rancho Vistoso PAD Sign Standards were created and adopted in the late 1980's. Over time, several PAD exemptions have been granted by Town Council. The Rancho Vistoso PAD Sign Standards were created and adopted in the late 1980's. Since that time, Town Council has granted the following PAD Exemptions: • Ventana Medical Systems approved in 2002 • Northwest Hospital approved in 2003 • Innovation Park Monument approved in 2005 • Oro Valley Marketplace approved in 2006 Surrounding Land Uses Orientation Rancho Vistoso PAD Zoning Land Use North CPI Vacant parcels South CPI Vacant parcels East CPI Vacant parcels West Hospital Northwest Medical Center-Oro Valley OVZCR AND PAD ANALYSIS The applicant requests approval to use the signage options specified within OVZCR Chapter 28, which enables more types of signs, larger sizes, and greater flexibility. The following is a synopsis of standards within the Rancho Vistoso PAD: I. Walls Signs: o The sign area shall not occupy more than 10%of the frontage wall area o Prohibits the use of white faces o Internal and white halo illumination is permitted } 1 TOWN OF ORO VALLEY TOWN COUNCIL COMMUNICATION, OV3-08-11 Page 3 II. Freestanding Signs: o No tenant panels permitted o Rectangular Monolith structure mounted on 2 feet of red sandstone veneer base o Maximum height is 8 feet o Internal and white halo illumination is permitted III. Entry-way Signs: o Concave (bowed in) shape o No tenant panels o Materials: Brushed Brass, Brushed Copper, and/or Copper Patina o Single line of copy IV. Vehicle Directional Signs: o Established shape and style o Dimensions: 8' in height by 6' in width by 1' deep o Colors: Tan(Dunn Edwards PC 2490) Green(Dunn Edwards 425 U1/Jewel) Maroon(Frazee(AC 117N/French Red) The following is a summary of the applicant's proposed freestanding and directory signs: • Freestanding Signs o Two signs, one at each entrance, 7' in height x 21' in length o Faux rust background o Vistoso stone and slump block o White routed letters o LED internal illumination • Directory Signs o Two signs Iocated inside the development o Non illuminated o 4 feet 10 inches in height, 6 feet 4 inches in length o Vistoso Stone The applicant's proposal to use the OVZCR would result in a combined use of the Rancho Vistoso PAD materials and integrate some of the materials from the surrounding buildings, providing a unique look for this corporate center and allowing flexibility for the tenant signs. The OVZCR has been modified over the years in an attempt to address expectations and tenant signage requirements; whereas the Rancho Vistoso PAD has not been modified. As previously mentioned, several PAD Exemptions have been granted in this area. Retail centers that currently follow the Rancho Vistoso PAD Sign Standard are the Safeway Center (Northeast corner of Rancho Vistoso Boulevard and Tangerine Road) and the Rancho Vistoso Center(Northwest corner of Rancho Vistoso Boulevard and Oracle Road). Each of these centers has a single anchor tenant with a few national tenants as well as small shop tenants. PUBLIC NOTICE AND COMMENT Notices have been sent to all home owner associations within the area. With the exception of a citizen's comments at the DRB meeting, staff has not received any comments from neighbors or concerned residents regarding the applicant's proposal. TOWN OF ORO VALLEY TOWN COUNCIL COMMUNICATION,OV3-08-11 Page 4 SUMMARY OF FACTORS Findings in Favor 1) The Rancho Vistoso PAD sign standards do not adequately address the needs of corporate centers of this magnitude 2) The PAD criteria have not been updated and reflect 1987. trends 3) The OVZCR Standards better reflect current community values and development needs 4) Use of OVZCR Standards will enable development of a specific identity for Innovation Corporate Center 5) Vistoso Community Association approval 6) DRB recommendation that Town Council approve the PAD Exemption Findings Against 1) Use of the OVZCR is a departure from the PAD's intent to create uniform signage throughout Rancho Vistoso 2) One citizen's concern that the exemption deviates from the PAD design standards SUGGESTED MOTIONS: The Town Council may wish to consider one of the following suggested motions: I move to[approve, approve with conditions, OR deny] Ordinance (0) 09- 02,OV3-08-11,Effective Signs representing Innovation Corporate Center,LLC.,requests approval of a PAD Exemption for Innovation Corporate Center East, Lots 1-6, Rancho Vistoso Neighborhood 3, Innovation Corporate Center-East, located NE of the intersection of Innovation Park Drive and Tangerine Road. The Vistoso Community Association's Architectural and Landscape Review Committee has reviewed the submittal and has found the signage meets the standards and expectations of the Vistoso Community and the intent of the Rancho Vistoso Design Guidelines for Commercial Development; therefore, the Monument and Directory Signs are approved as follow: > This signage was previously reviewed for"location only"as part of the Master Sign Program submittal that was previously approved by the Declarant. The approved locations were as follow: one monument is to be located at the southeast entry to the complex from Vistoso Park Road: a second monument was originally approved at the northeast side of the entry located off Innovation Park Drive; and the third monument was approved located at the intersection of Vistoso Park Road and innovation Drive where it was to be incorporated with the Public Art component for the complex. The current submittal proposes that the monument on Innovation Park Drive be relocated to the southwest side of the entry. The Committee approved this modification of the originally submitted location for this entry Entry Monuments: o The monuments at each entry are to be identical. o The sign plate is double sided with a 1/8*thick aluminum face plate on each side. The lettering is to be routed into the plate and illuminated with white LED fighting that is concealed within the sign. Applicant proposes to install clear acrylic over cut-out sections to reduce maintenance effort. o The sign plate is 21'L. X 2'H.and is anchored on the right end in a buttress veneered in _ :. Vistoso Stone. A 4'W. X 7'H.perforated metal accent is mounted inside the frame and is to incorporate white LED lighting concealed within the accent piece. o The light emitted from the sign plate is to be comparable to that emitted from one 100- watt light bulb so that the sign glows with indirect lighting. o The perforated metal panel will have lighting inside its perimeter which will have the intensity approximately equal to a 40-watt Incandescent bulb. o The bottom of the sign plate is supported by 4" slump block walls that are two feet in height. The cantilevered portion of the sign is 7'6"in length. o The text on the sign occupies approximately 15.1 sq.ft. (Guidelines allow a maximum of 40 sq.ft) Innovation Corporate Center Monuments and Directory Signs Vistoso Community October 13,2008 Page 2 o Letterkig is to be 11.5"high(Guidelines allow a maximum of 3 ft.) o The sign plate and metal accent are to be painted"Faux Rust" > Directory Signs: . o The submittal provides for Nvo directory signs as located on the submitted Site Plan. o The directory sign is to be mounted on a 410"H.X 4'10*W.pedestal with a brick cap. o The left side of the pedestal is flanked by a 3'4"H.buttress veneered in Vistoso Stone. o Acrylic panels are layered over an aluminum reverse pan channel panel painted gray. Map layers are back routed and painted to identify addresses giving the sign a three dimensional look. o It is the Committee's understanding that this sign is not to be illuminated. > it is understood that the Monument Signage to be located at the intersection of Vistoso Park Road and Innovation Park Drive is still in the Design Development Stage and will be submitted at a later date when the design is complete. In addkion the following specific stipulations shall apply; > The monument signs should be located 5'-0-behind the right-of-way line and 20%0"from the entrance driveway." > One(1)double-faced monument per entrance is allowed. > All plant material should be in scale with the monument. Flowering ground cover should be used around the base. If plant material used around the monument is not chosen from the Rancho Vistoso Boulevard Approved Plant List, a plant palette for that area must be submitted for the Committee's consideration. In addition, all applicable provisions of the Rancho Vistoso All Non-Residential, MuRi-Famity and Commercial Development Design Guidelines and the Rancho Vistoso Master Planned Community Sign System Guidelines apply. Please be advised that the following submittals will be required when completed. • Exterior Light Fixtures and Site Lighting Public Art Component If you have any questions or require additional information, please call. More, Planning and Zoning Director SUBJECT: Public Hearing, OV3-08-11, Effective Signs representing Innovation Corporate Center, LLC, requests approval of a PAD Exemption for Innovation Corporate Center East, Lots 1-6, Rancho Vistoso Neighborhood 3, Innovation Corporate Center-East, located NE of the intersection of Innovation Park Drive and Tangerine Road. EXECUTIVE SUMMARY OF APPLICATION: Nature of Application: The applicant is requesting exemption from the sign standards of the Rancho Vistoso Planned Area Development (PAD), which is applicable to this center. The applicant's proposal is to utilize the sign standards of the Oro Valley Zoning Code. The Development Review Board is charged with reviewing the applicant's proposal and forwarding a recommendation to Town Council. Town Council will make the final decision regarding the proposed exemption. The applicant has also applied for Sign Criteria. The Sign Criteria will be considered at the January 13, 2009, DRB meeting. A complete description of the Sign Criteria has been provided as part of the OV3-08- 10 staff report. Current Site Conditions: The site has been graded into individual building pads and roads have been installed. A few buildings have been completed. Overview of Improvements: • Lots 1 & 2: Zoned C-1, 12 office buildings, totaling 100,000 square feet. 11 one-story buildings and a maximum allowable building height of 34'. Office 12 will be one or two story. Lot 1 will be final platted as office condominiums. • Lots 3 - 6: Zoned CPI, The maximum allowable building height is 36' and 3 stories. The development of each parcel will require a separate Development Plan, Landscape Plan, and architecture review. • Multiple tenants are anticipated, including medical offices and related or complimentary uses. • An open space trade is proposed, which will result in a gain of 5.8 acres of open space. • The open space realignment will result in a park-like amenity/drainage running longitudinally through the property, similar to Woodshade Park in Rancho Vistoso. • An improved trail system with pedestrian linkages will be provided throughout the site. • Proposed traffic calming devices include landscaped roundabouts. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD,OV3-08-11 Page 2 BACKGROUND Approvals to Date On November 14, 2006, the DRB approved the architecture and landscape plans for Innovation Corporate Center. On December 20, 2006,the Town Council approved the development plan for Innovation Corporate Center. Surrounding Land Uses Orientation Rancho Vistoso PAD Zoning Land Use North CPI Vacant parcels South CPI Vacant parcel East CPI Vacant Parcel West HOSPITAL Northwest Medical Center-Oro Valley OVZCR AND PAD ANALYSIS The applicant requests approval to use the signage options specified within OVZCR Chapter 28. The OVZCR offers more types of signs, larger sizes, and greater flexibility. For example, the exemption would permit Entry signs with tenant panels, which, the applicant explains, is a basic marketing need of a regional center. The PAD excludes use of tenant panels at project entries. The following is a synopsis of standards within the Rancho Vistoso PAD: • Walls Signs: o The sign area shall not occupy more than 10% of the frontage wall area. o Prohibits the use of white faces. o Internal and white halo illumination is permitted. • Freestanding Signs o No tenant panels permitted. o Rectangular Monolith structure mounted on 2 feet of red sandstone veneer base. o Maximum height is 8 feet. o Internal and white halo illumination is permitted. • Entry-way Signs o Concave (bowed in) shape. o No tenant panels o Materials: Brushed Brass, Brushed Copper, and/or Copper Patina o Single line of copy • Vehicle Directional Signs o Established shape and style. 1 o Dimensions: 8' in height X 6' in width X 1 foot deep. o Colors: Tan (Dunn Edwards PC 2490) Green (Dunn Edwards 425 U 1/Jewel) Maroon (Frazee (AC 117N/French Red) F:\OV\OV3\2008\OV3-08-011\DRB Report 1-13-09.doc TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD,OV3-08-11 Page 3 The Rancho Vistoso PAD Sign Standards were created and adopted in the late 1980's. Since this time, Ventana (approved in 2002), Northwest Hospital (approved in 2003), Innovation Park Monument (approved in 2005) and Oro Valley Marketplace (approved in 2006) have been granted for P.A.D. exemptions by Town Council. Retail centers that currently follow the Rancho Vistoso PAD Sign Standard are: the Safeway Center (Northeast corner of Rancho Vistoso Boulevard and Tangerine Road) and the Rancho Vistoso Center (Northwest corner of Rancho Vistoso Boulevard and Oracle Road). Each of these centers has a single anchor tenant with a few national tenants as well as small shop tenants. The applicant's proposal to use the OVZCR would result in a combined use of the Rancho Vistoso PAD materials and integrate some of the materials from the surrounding buildings. Providing a unique look for this corporate center and allowing flexibility for the tenant signs. The OVZCR has been modified over the years in an attempt to address expectations and tenant signage requirements; whereas the Rancho Vistoso PAD has not been modified. SUMMARY If approved, the applicant's proposal would allow Innovation Corporate Center to utilize the standards for a Freestanding and Directory signs under the OVZCR. DRB will make its recommendation and Town Council will render the final decision. The applicant has requested that review of the PAD Exemption be considered at the same time as Sign Criteria for the development (OV3-08-10). Lewis Management Resources, Inc. for the Vistoso Community Association has approved the request for a PAD exemption. The letter of approval is included with the application of request to the Town. SUMMARY OF FACTORS Findings in Favor • 1) The RV PAD sign standards do not adequately address the needs of corporate centers of this magnitude. 2) The PAD criteria have not been updated and reflect 1987 trends. 3) The OVZCR Standards better reflect current community values and development needs. 4) Use of OVZCR Standards will enable development of a specific identity for Innovation Corporate Center. 5) Home Owner's Association approval Findings Against 1) Use of the OVZCR is a departure from the PAD's intent to create uniform signage throughout Rancho Vistoso. DISCUSSION OF TOWN FINANCIAL SUSTAINABILITY INCLUDING CONSIDERATION AND POSSIBLE APPROVAL OF TOWN ORGANIZATIONAL RESTRUCTURING AND REDUCTION-IN- FORCE PLAN Item 5 Town Manager David Andrews stated that the passage of the Utility tax renewal aided in addressing the revenue shortfall. He identified the causes for the shortfall: -Sunset of the 2% Utility tax -Decreased construction activity in the amount of$1 M -Decreased State shared revenues of$1.2M -Recession in the economy http://orovalley.granicus.com/MinutesViewer.php?view_id=2&clip_id=5 82 05/01/2009 Town Council Page 7 of 13 He stated that his recommendations were meant to enhance revenues and cut costs. He recommended: -Organizational restructuring *Reduction in force plan *Net savings of$1.5M *Eliminating 27 positions -Use Bed Tax revenues that were earmarked for the failed Naranja Town Site Park bond. -Renewal of Utility Sales tax -Eliminate $300,000 from Operations and Maintenance to include: *Out of state travel *Consultants -Deferring Capital Improvement Projects for FY 09/10 and possibly FY 10/11 -One time expenditures of$500,000 -6 police officer positions contingent on a grant from the U.S. Department of Justice He noted that: -Initially he recommended 33 positions be eliminated -6 positions remain vacant due to the hiring freeze -There were two options for severance pay -This recommendation was not a result of any employee's performance *75% of the Town's expenditures were pay and benefits. Discussion clarified the following: -The deficit from the General fund in January was $4.2M *The Highway fund numbers were not available -Has a deficit of $1 M -Lifting the hiring freeze was not part of the motion for this item -Reclassifications were meant to compensate employees that would have to perform the duties of positions that were cut -Department heads reviewed areas to cut spending *Not enough to close the gap *Warranted eliminating positions *Each department had to cut position(s) -The grant application for the police officer's positions would take six weeks to process *The grant would fund the officers' salaries for three years *The Town could be required to retain the officers at the Town's expense at the end of that time -Officers removed from calls facilitated a reduction in traffic accidents and incidents Mayor Loomis opened the floor for public comment. http://orovalley.granicus.com/MinutesViewer.php?view_id=2&clip_id=582 05/01/2009 Town Council Page 8 of 13 Oro Valley resident John Musolf stated that he was opposed to Staff reductions. Oro Valley resident Melanie Larson stated that people out of work need places to go and that hours of operation for the library and parks should not be reduced. She concurred that the Contingency Fund should be used to maintain service levels. Discussion noted the following: -Direction was given to directors to make cuts in staff for each department. -The Municipal Operations Complex was not included -Capital Improvement Projects would be deferred for 1-2 years -Each department reviewed areas to cut in operations and maintenance. -Cuts had been made to the Oro Valley Vista Newsletter. -Recession is projected to be long term Mayor Loomis clarified that the Town revenues were derived from sales tax, State shared revenues from income tax and State tax. He noted that the State shared revenues lagged two years behind. He explained that the Oro Valley Marketplace was anticipated to do better than it has. He stated that in the next 3 years the Town's State shared revenues will be down. http://orovalley.granicus.com/MinutesViewer.php?view_id=2&clip jd=5 82 05/01/2009 Town Council Page 10 of 13 It was noted that: -The Hilton El Conquistador's revenues were down 20%. -Layoffs in the police department were not part of this proposal -The largest Staff reductions were in Development Services, due to the lack of growth. -The long term must be considered with respect to the Contingency Fund. Council Member Kunisch stated that he could not support the reclassifications. Council Member Gillaspie stated that the Town ran leaner than other municipalities and was well run. He stated that it was important to protect the long term. He noted that if services were cut and parks and the library were shut down, the Town will not recover. Council Member Garner noted that each department had to make cuts and the police department would not have made any cuts if the grant is awarded. Chief Sharp stated the following: -He chose to cut a single program instead of crippling several programs. -If funded the grant would cover salaries and benefits for those positions *The details of the grant were still unclear. -95 positions in the police department were funded by the General fund *Remaining positions were funded from other sources of revenue. Human Resources Director Sandra Abbey stated that the attrition rate of 8- 9% projected for next year was based on the attrition rate of previous years. Council Member Abbott stated that the positions recommended for layoffs should be reconsidered. She requested that furloughs and salary reductions be investigated. She noted that she was opposed to reclassifications. She stated that the Contingency fund should be considered only after all other sources have been exhausted. She recommended further reductions to out of state travel beginning with Council. Mayor Loomis stated his concern that the plan did not identify the programs that would be impacted. He noted the items he anticipated seeing in the recommended budget from the Manager on April 1, 2009: -Identify essential versus non-essetial jobs -Anticipated attrition for the coming year -Continuation of the hiring freeze http://orovalley.granicus.com/MinutesViewer.php?view_id=2&clip_id=582 05/01/2009 Town Council Page 11 of 13 -Elimination of recreation and aquatic programs -Reduction of library programs -Reduction or elimination of Community funding.
