HomeMy WebLinkAboutOV30407 Plaza Escondida Master Sign Program submittal request 6/17/04 A) The proposed sign program provides consistancy to the development. The main entry sign to the development is designed in conjunction with the old sign style that was there and the utilization of tenant's logos for the center. The dark background on the tenant panels provides consistancy for the different logos on this sign. In conjunction with that consistancy, this sign will tie in to the existing base as shown on the attached drawing. B) The Master Sign Program meets the Oro Valley sign code design guidelines by providing a comprehensive overview of the signs in the center. This is a unique center in conjunction with grandfathered signs existing on site and new signs that will go into the site for a businesss that will possibly change in the future. This criteria and code does accommodate for future changes and provides the comprehensive overview. C) The sign criteria provides for any differences from the code for the signs that would be grandfathered in this particular center. D) The sign criteria specifies pan channel letters consistant with present signs on site. E) The development should be allowed latitude to the sign code because the development has been in existence for an extended period of time. The extended period of time has produced grandfathered signs in the development and these grandfathered signs will not be changed. The grandfathered signs and the development of the sign criteria help to provide consistancy for any future changes. -d d6s : T0 tr0 LI unr s PURCHASE REQUISITION TOWN OF ORO VALLEY VENDOR INFORMATION DATE: / L% / c-y Name: TERMS: ----- Address: SHIP/DELIVER TO: Unit Total Account No. Item Description Quantity Cost Cost `.00e o'er Qs) Check Request Dict Special Instructions: cciZ)) ( (Date Required, etc.) 09- 7 Purpose or Use Unencumbered balance $ If account Overdrawn, funds available in Account No. Unencumbered balance $ Requested by: \<N), Approved by: In compliance with SOP #2, if a single purchase is in excess of$1000, purchaser must submit three separate bids. Per our fee schedule, charges for partila review of any project will be based on the stage of review and staff time already dedicated to the project. The Planning and Zoing Administrator may refund up to 80% of the fee. As stated in a previous conversation with you, I recommend that you request the project be put on hold, schedule the meeting for review and then submit revisions to the orginal packet that you submitted and we can continue from there. This would allow you not to have to pay additional fees or possibly loose 20% or more of your original submittal check. Also, Mariash schedules regular meetings with us on a monthly basis. There next scheduled meeting is the 23rd of this month. Would you like to conduct the meeting you are requesting at that time or schdule a meeting separately? Let me know as soon as possible so that I can give notice to all others who are attending the meeting. June 22, 2004 Jerrilyn Billings Oro Valley, Town of Oro Valley 11000 N. La Canada Oro Valley, AZ 85737 Dear Jerrilyn, Regarding Plaza Escondido Master Sign Program: We are requesting to pull the package from the "Master Sign Program" with Oro Valley. Please find this letter as a formal request to pull the package. Reasons are as follows: 1. We would like to have more time to meet with Oro Valley. This will give us a chance to go over the request on the Master Sign Program VS the DRB review. Maybe we will not need to go to the Master Sign Program. This may require an adjustment in height or go back to the original submittal of just the directory sign for the Master Sign Program. 2. We would like to clarify the colors and construction required on the signs. After the last meeting we had some confusion and not everyone at the meeting is clear to the final direction with building and freestanding colors. 3. Also we would like to get the final input from Oro Valley for the criteria and sign package. I know Jerrilyn has some recommendations. Thank you, Mike Addis Addisigns Cc: Venture West Mariash Corp. As part of a new comprehensive sign package for Plaza Escondida the Town of Oro Valley proposes using certain site — specific sales tax revenue for the purposes of bringing current landscaping and certain signage associated with the property into compliance with applicable Town requirements and general standards; in attempt to create a gateway effect. The proposed items for the Mayor and Council consideration, are the following: 1. New monument sign on Oracle Road 2. New tenant under canopy signage 3. New entrance sign on Magee Road 4. New landscaping along Oracle and Magee Road It should be noted that due to cost and/ or future construction along Magee Road, some of these item will need to be phased in. Very Truly Yours, G Jonathan Lew Planning Technician CC: Debbie Moran, Development Coordinator. www.townoforovalley.com TOWN OF ORO VALLEY STAFF REPORT TO DEVELOPMENT REVIEW BOARD MEETING DATE: NOVEMBER 9, 2004 TO: DEVELOPMENT REVIEW BOARD FROM: Jonathan Lew,Planning Technician and Bayer Vella, Principal Planner SUBJECT: OV3-04-07, ADDISIGNS INC., REPRESENTING SCHOEDER ESCONIDA, LLC, TYROL ESCONDIDA, LLC, AND MAIASH ESCONDIDA, LLC, REQUESTS PRELIMINARY APPROVAL FOR A MASTER SIGN PROGRAM FOR PLAZA ESCONDIDA, LOCATED ON THE SOUTHEAST CORNER OF ORACLE ROAD AND MAGEE ROAD, PARCEL#225512140. BACKGROUND: For all new shopping centers the OVZCR requires an applicant to pursue approval of a Sign Criteria or a Master Sign Program. A "sign criteria" enables the applicant to apply the standards and guidelines set forth within the OVZCR, and it only requires DRB approval. A Master Sign Program (MSP) allows the applicant an opportunity to present a higher quality sign package that is customized for a specific development. The following description of an MSP is provided in code: • MSP shall be based on the provisions of Chapter 12 of the OVZCR and shall conform to the purpose and intent of the Chapter and to the guidelines in Chapter 3 and Chapter 16. • MSP shall include only those sign types already permitted within OVZCR Chapter 12 and may allow adjustments to the standards of those types provided they are justifiable. • MSP required to be reviewed by DRB and approved by Town Council. • Compliance with these provisions does not necessarily guarantee approval by the Town Council. On May 7, 2003, the Town of Oro Valley annexed Plaza Escondida as part of a larger annexation of land called "Area B". The Pre-Annexation Development Agreement states that the existing signage would be allowed, and any future signage would have to comply with the appropriate Town regulations. Photographs of existing signage have been provided within the applicant's submittal. APPLICANT'S PROPOSAL: Although the applicant is not required to submit either sign programs they are seeking a Master Sign Program under Chapter 12 of the OVZCR. Per OVZCR Chapter 12.202B, a MSP allows the applicant to request adjustments to the sign standards, provided they are justifiable. The applicant is requesting the following exceptions: • Allow a freestanding sign to be 13 feet in height. (Code allows 8 feet) • Allow two freestanding signs(one on Oracle Road and the other on Magee Road)to be 84 square feet in area. (Code allows 50 square feet) • Allow a directory sign an area of 41 square feet. (Code allows 40 square feet) • Allow wall sign allowance of 2 square feet of signage for every linear foot of frontage. (Code allows a maximum of 1.5 square feet of signage for every linear foot of frontage) TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 2 The following is a description of sign types proposed: Freestanding Sign (See page 2 of the applicant's submittal for a graphics) • Height is 13'. (Code allows only 8' in height from the grade of the road.) • Area is 84 square feet. (Code allows 50 square feet.) • Faux Rock along the base and one side of the sign • Gold Neon trim along the top edge of the sign • 2 Freestanding signs have been proposed. One along Oracle Road at the northern most entrance, and the other will be place along Magee Road. • The sign will be internally illuminated with white fluorescent lamps. • The sign cabinet will be painted with a light beige background. Individual tenants would be allowed all colors in the proposed palette, or logo. Directory Signs (See page 3 of the applicant's submittal for graphics) • Area 41 square feet (Code allows 40 square feet) • Height 8' • Internally illuminated, with tenant names to follow the proposed color palette • 20 tenant panels • Faux Rock base • Location: 1-by the southwestern entrance, 1-by the northeastern entrance Under Canopy Signs (See page 4 of the applicant's submittal for a graphics) • 4 square feet • Non-illuminated Wall Signs (See page 5 and sections B &C on page 9 of the applicant's submittal) • Individual pan channel letters, internally illuminated with matching colors of neon • Raceways would be allowed where no access is provided • Tenants with fewer than 40 linear feet of street frontage would be allowed to have 2 square feet of signage for every linear foot of frontage. (The maximum allowed under code is 1.5 square feet of signage for every 1 foot of street frontage.) Color Palette(See page 5 of the applicant's proposal) 1. Turquoise 230-236, PMS 3282C 2. The following is a synopsis of comments followed by an updated staff and applicant response: Freestanding Signs: • Site Visibility of the Freestanding signs o Applicants Response: No Response o Staff's Response: Oro Valley Public Works staff has reviewed the submittal. The locations for the freestanding signs are acceptable. Please see page 6 of the applicant's submittal to review the proposed locations. • Remove Criss-Cross design on the bottom of the freestanding signs (previous submittal). o Applicant's Response: Applicant has removed the design. o Staff's Response: It has been deleted from page 2 of the submittal. • Application of the Gold Neon—two members wanted the gold neon moved under the top arch portion of the sign. One member wanted it removed completely. o Applicant's Response: Applicant has moved the gold neon trim under the top arch portion of the sign. o Staffs Response: This new design entirely mimics the application of neon in the Oracle Crossing development. • Increase use of the faux rock along the side of the sides of the sign o Applicant's Response: Applicant has extended the use of the rock work along the left side of the sign. o Staffs Response: This change has helped simplify the design. • Shrink the size of the sign along Magee Road to meet code, but keep the proportions o Applicant's Response: Applicant wishes to establish an oversized sign. o Staffs Response: Staff agrees and finds little justification to establish a larger sign on Magee Road. There isn't a grade differential or extensive landscaping to overcome. Furthermore, this stretch of Magee Road receives less traffic. • Eliminate the architectural triangle features (previous submittal) o Applicant's Response: Feature has been removed. o Staffs Response: It was deleted from page 2 of the previous submittal • Make the 2 side columns appear equal in width o Applicant's Response: The applicant felt the design is well balanced. o Staffs Response: The two columns are disproportionate; however, the overall design has been simplified by adding more rock. This should help meet the desired aesthetic. Directory Signs: • Verify the location of the signs to ensure that they are not located within any site visibility triangles. o Applicant's Response: No Response TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 4 o Staff's Response: The Town's Public Works Department and Planning staff have reviewed the location of the directory signs. Staff strongly asserts that the signs are located within site visibility triangles and must be relocated. They pose an unacceptable risk to public safety. A condition has been added to Exhibit A to require the applicant to reposition the signs. • Incorporate 1' of faux stone to the bottom of the sign. o Applicant's Response: Faux rock has been added to the base of the sign. o Staffs Response: Addition can be noted on page 3 of the submittal. • Reduce the number of tenants listed on the directory and make the panels larger. o Applicant's Response: The applicant would like to have all the tenants listed on both directory signs. o Staffs Response: The tenant's names on the sign are only 3 1/4" high. This is too small to be seen from a vehicle and to direct traffic in a safe manner. By making the tenant panels larger, the tenants would be easier to identify, producing a safer and more efficient flow of traffic. A condition has been added to Exhibit A to require larger tenant panels and provide the applicant additional name coverage by establishing a third sign in the middle of the center. Under Canopy Signs • Member requested that the under canopy signs be non illuminated (previous submittal). 2 members requested that the signs be eliminated from the MSP. o Applicant's Response: Illumination has been removed from the signs o Staffs Response: Under canopy signs help pedestrians find each store. They are not generally visible to automotive traffic. Such signage can be found in the following Oro Valley shopping Centers: Rooney Ranch Centers and Oracle Crossing. Please see page 4 of the applicant's submittal to review the proposed under canopy signs. Wall Signs • Use white neon or LED to maximize the consistency of internal illumination for the wall signs. One member requested the applicant switch to halo illumination o Applicant's Response: The applicant had proposed using white, red, gold, and blue colors for internal illumination. The current application specifies the use of white neon and LED "where possible". He has also proposed using halo illumination on a component of the freestanding signs only. o Staffs Response: White lighting would provide a more consistent and subdued lighting to the center. Halo illumination would not be compatible with the existing signs and would be impractical on the southern building due to lack of access (multiple raceways utilized). Colors • Member's requested that the applicant utilize the same color palette as Oracle Crossings and organize the palette to limit the use of bright colors. o Applicant's Response: Applicant has resubmitted using the Oracle Crossings color palette and 3 additional colors used only on the freestanding sign. o Staffs Response: An attempt to reduce the over use of bright colors on the center could be achieved by limiting tenants under 9,000 square feet to a specific sub-section on the color palette and control/limit the use of bright colors. A condition has been added to Exhibit A to reflect this. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 5 CHAPTER 12, SECTION 12.202, MASTER SIGN PROGRAM The proposed Master Sign Program will not change any existing wall signs within the center. New tenants would be subject to the provisions of this Sign Program. Therefore, it is important to note that this Master Sign Program will take years to implement. In considering a Master Sign Program, the Development Review Board shall be guided (per code)by the following: CHAPTER 3, SECTION 3-302, CRITERIA: The proposed design shall promote a desirable relationship of structures to one another, to open spaces and topography both on the site and in the surrounding areas: Internal Compatibility There is no internal compatibility among the existing signs. A broad array of color, sign types, designs, and illumination is utilized. The proposed color palette represents a broad range of colors that are presently utilized within the center. As previously mentioned, staff is proposing use of one type of internal illumination and a specific organization of the colors. The applicant's color palette would be applied to all buildings 9,000 feet and greater. Smaller structures would use the same palette—minus bright colors (red, orange, and yellow). The character of the proposed design shall be in harmony with, and compatible to, those structures and signs in the neighboring environment and the design character adopted for any given area avoiding excessive variety or monotonous repetition: External Compatibility The signs that are external to the center present a wide range of sizes and colors. Capin Plaza Capin Plaza will have 3 freestanding signs, 2 along Oracle Road, and 1 along Cool Drive. The plaza has a large amount of red within the center, and a sign allowance of 1.5 square foot of signage for every linear foot of frontage. Oracle Crossings Oracle Crossings has a similar color palette to the one the applicant is proposing. The Crossings will also have 3 freestanding signs and multiple directory signs with arch features, gold neon, and a rock base. The aforementioned design features have been incorporated into this application. Signs, ingress, egress, internal traffic circulation, off-street parking facilities, loading and service areas and pedestrian ways shall be so designed as to promote safety and convenience: The Freestanding signs have been located in manner to facilitate safe traffic circulation. The directory signs however, are located within site visibility triangles. Because this is a public safety issue, it must be rectified. Staff also recommends that tenant panels on the directory signs be made larger to promote greater visibility TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 6 and better traffic circulation. In sum, the directory signs must be moved and the tenant panels increased in size to promote safer traffic flow. In order to protect the visual serenity of the Town, design of signage should be based on trying to get information across with the least signage possible: The proposal fails to meet this criterion because the applicant is requesting more signage than is permitted by code. As mentioned previously, the applicant is seeking a Master Sign Program that would allow the applicant to increase the size standards for the signs. In exchange, DRB may ask the applicant for appropriate mitigation and amenities to "broker" a superior package. A review of the exceptions requested by the applicant is provided below: • Allow the freestanding signs to be 13 feet. (Code allows 8 feet) • Allow two freestanding signs to be 84 square feet in area. (Code allows 50 square feet) The applicant has proposed two oversize signs — one on Oracle Road and the other on Magee Road. The need for the oversize sign on Oracle was explained at the DRB subcommittee meeting. They are establishing one sign on Oracle Road — rather than two. The applicant made it clear; however, that they may ask for a second freestanding sign on Oracle Road in the future. Staff asserts that one oversize sign on Oracle Road would have less impact than two slightly smaller ones. If this exception is approved, staff would recommend that only one freestanding sign be permitted on Oracle Road. As discussed previously, staff finds no justification for placement of an oversized sign on Magee Road. • Allow a directory sign an area of 41 square feet. (Code allows 40 square feet) There are no mitigating circumstances to warrant this proposal. The sign should be reduced by one square foot. • Allow wall sign allowance of 2 square feet of signage for every linear foot of frontage. (Code allows a maximum of 1.5 square feet of signage for every linear foot of frontage) This would allow a substantial increase to the amount of signage allowed for small tenants. This exception could be greatly mitigated by requiring the consistent use of white internal illumination and restricting the use of bright colors. Sign designs shall be in compliance with the purpose statements established in Section 12-101: All components shall be in compliance with Article 16,Design Guidelines: Chapter 16, Design Guidelines are written to reflect the purpose statements in Chapter 12, Signs. Both areas of the code address uniqueness, character, compatibility and the use of materials and colors that appear natural to the environment and surrounding community. The application meets each criterion—as previously discussed. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 7 SUMMARY: The applicant is submitting a Master Sign Program. This allows the applicant to request an increase to standards on proposed signs. In return, the Town may request mitigation to produce the goal of a customized and superior sign program. RECOMMENDATION: Staff recommends approval of the master sign program with the conditions specified in Exhibit A. SUGGESTED MOTIONS: I move to recommend that Town Council approve OV3-04-07, Master Sign Program for Plaza Escondida with the conditions in Exhibit A. OR I move to recommend that Town Council approve OV3-04-07,Master Sign Program for Plaza Escondida, with the conditions in Exhibit A and the following conditions OR I move to recommend that Town Council deny OV3-04-07,Master Sign Program for Plaza Escondida. PLAZA ESCONDIDA (ORACLE/MAGEE) This project is for a Master Sign Program. It has been an on going project. It is being handled by Addisign Company(Mike Addis). The current number on this is OV3-04-07. Scott Nelson and I have met with the owners/project coordinators in regards to this location. Currently, Bob and Ryan have been instructed as to where they need to continue with this. They have been instructed to get back with Mike Addis and redesign and criteria according to the guidelines that we went over with them at a recent meeting. All information and inquiries can be directed to Scott Nelson at this time. The project has been continued and is currently on hold for a new submittal. The file is on my desk This project will be going forward to the DRB and Town Council for s Master Sign Program for the development. They should be moving forward with all sign types that they wish to include in this development. 4. ORACLE CROSSING (ORACLE/MAGEE) This project is going to DRB for a sign criteria. The following is a breakdown of the schedule: a. Package was submitted on 7/15/04 b. Needs to get on Executive Summary ASAP c. Reports are due on 7/30/04 d. Packets are due 8/2/04 e. DRB meeting is 8/10/04 This criteria is written to reflect the Pre-annexation Agreement. The criteria cannot be adjusted in anyway except for the portion regarding colors. It is the only area that has room to move. Dennis St. John and I spent 3 hours writing the original criteria (Date April 14, 2004) per the pre-annexation agreement. This is the only criteria that is correct except for the color palette portion. Since that time, Mr. Addis has been trying to change it along the way. I have explained to him numerous times that he cannot make changes to the original criteria. The submittal that came in on 7/15/04 is the most current and correct submittal. It must be read through thoroughly. Mr. Addis is notorious in adding wording that does not belong or isn't allowed by code. You must watch him on all submittals that he brings in. I have reviewed the criteria that came in and by all accounts it looks like it is ok to move forward. It has been my attempt to meet with Dennis and Mike for months now but they did not want to meet. I have been telling them that we need to discuss the color issues but they don't seem willing to budge on any of it. PLAZA ESCONDIDA SIGN CRITERIA These criteria have been established for the purpose of assuring an outstanding shopping center and for the mutual benefit of all Tenants. A. GENERAL REQUIREMENTS 1. All new signs will be constructed in accordance with the approved Oro Valley Plaza Escondida Comprehensive sign plan. All existing signage, which may be nonconforming, may continue in the same manner to the extent that it existed at the time of annexation into the Town of Oro Valley, provided that the signage has not increased in area or height, and remains in substantially the same location; further provided that the sign remains structurally unchanged except fro reasonable repairs or alterations or change of text. 2. Each Tenant shall submit or cause to be submitted to the landlord for approval before fabrication at least two (2) copies of detailed drawings indicating the location, size, layout, design and color of the proposed signs including all lettering and/or graphics. Landlord approved is required and Landlord reserves the right to make recommendations for sign layout and vendor usage. 3. PASSED AND ADOPTED by the Mayor and Town Council, the Town of Oro Valley, Arizona, this 31 s1 day of March, 2003. TOWN OF ORO V LEY .... .._4dVeier----___ Paul H. Loomis, Mayor ATTEST: T ' Kath.On E. Cuvelier, Town Clerk APPRO ED AS TO FORM: 62;a7---./ Tow ttorne PRE-ANNEXATION DEVELOPMENT AGREEMENT This PRE-ANNEXATION DEVELOPMENT AGREEMENT (this "Agreement") is made and entered into by and between the Town of Oro Valley, a municipal corporation (the "Town"), Tyrol Escondida, LLC, an Arizona limited liability company; Mariash Escondida, LLC, an Arizona limited liability company; and Schroeder Escondida, LLC, as Tenants-In-Common (hereinafter collectively referred to as "Developer"), as of the 31 day of March, 2003. Town and Developer are referred to herein collectively as the "Parties". RECITALS Authority A. A.R.S. § 9-500.05 authorizes the Town to enter into a development agreement with a landowner or other person having an interest in real property located within or without the Town boundaries to facilitate development of the property by providing for, among other things, the conditions, terms, restrictions and requirements for development and public infrastructure and the financing of public infrastructure. The Property B. The Developer, holds title to Parcel No. 1 and Parcel No. 2 property as tenants-in-common which is legally described in Exhibit A attached hereto (collectively the "Property"). C. The Property is presently located in unincorporated Pima County(the "County") adjacent to the incorporated boundaries of the Town. The Property is known as Plaza Escondida at 7846-7972 North Oracle Road, Pima County. Arizona. D. The Developer is the owner of the Plaza Escondida, a retail shopping center located at 7846-7972 North Oracle Road, Pima County, Arizona (the "Project"). The Property was zoned CB-1 on October 18, 1960, by Pima County Ordinance No: 1960-52. A copy of the Zoning Map and Site Plan and Subdivision Plat are attached hereto as Exhibit B. E. For the purposes of this Agreement, the Parties contemplate that the Property which is developed as a retail shopping center as depicted on Exhibit B, may be in need of future redevelopment consistent with the existing zoning as a retail shopping center. It is the intention of the Developer that any future redevelopment would continue its use as a retail shopping center, with the existing type uses which are allowed under the proposed C-1 Commercial District Zoning which will be effective upon Annexation to the Town of Oro Valley. F. On March 20, 2002, the Town held a public hearing pursuant to A.R.S. § 9- 471(a) (3)to discuss a proposal to annex the Property as well as other property owned by third parties other than Developer(the"Proposed Annexation District"), and directed Town staff to begin to obtain signatures on blank annexation petitions as required by A.R.S. § 9-471 to annex the property within the Proposed Annexation District into the Town (the "Annexation"). The Town must complete the petition signature process by April 3, 2003. G. Annexation will benefit the Property by providing certain Town services. This benefit will be offset by the Town sales tax on sales generated by the Property. H. Annexation will provide to the Town and its residents additional revenue, enhanced public infrastructure, all included within an integrated development to include landscaping and parking, linkages and the new construction on the Property, and satisfaction of the Town's 1%public art requirement. I. The parties intend to address the potential of entering into an Economic Development Agreement discussing the financial aspects of this Agreement. Existing Zoning and Development of the Property J. The zoning is CB-1 (Local Business)which allows retail shopping center use. The Property was rezoned to CB-1 on October 18, 1960, by Ordinance No: 1960-52, more particularly described on Exhibit C. Town Zoning of the Property K. The Town is required to adopt original zoning classifications ("Original Town Zoning") to be applied to the Property, which shall become effective after the effective date of the annexation. State law (A.R.S. § 9-471(L))provides that the Town shall adopt Original Town Zoning classifications that permit densities and uses no greater than those permitted by the County immediately before annexation. L. The current County Comprehensive Plan designation for the Property is CB-1 by Ordinance No: 1960-52 and the current Town General Plan and proposed Town General Plan 2020 designation for the Property is Community Commercial. M. Plaza Escondida is an existing retail shopping center and is substantially fully developed, but may require extensive remodeling, in the future, which remodeling would be in accordance with the then existing commercial zoning of the Town of Oro Valley. Exhibits: 2 A—Legal Description of Property B—Zoning Map,Site Plan and Subdivision Plat C—Existing County Zoning Map N. Adoption of the Original Town Zoning with the Town Conditions, the General Plan designation, a Master Plan and all Development Plans brought forward in substantial conformance with the Master Plan for Plaza Escondida are subject to procedures and public hearings required by state law and the Oro Valley Zoning Code Revised (the "OVZCR"). Such approvals are discretionary legislative acts of the Town Council to be exercised in the public interest. The parties therefore enter this Agreement to establish a process that will provide the assurances required by the Developer for the appropriate land use approvals in a manner consistent with the legal and legislative obligations of the Town. O. The Town and Developer wish to establish and identify terms related to the annexation of the Property, the Original Town Zoning, the 2020 General Plan designation, and the zoning for the Property, development of the Property needed to serve the Proposed Annexation District and surrounding areas. AGREEMENT NOW, THEREFORE, in consideration of the foregoing recitals, which are incorporated here as the purpose and intent of the Parties in entering into this Agreement, and in consideration of the mutual covenants and obligations contained in this Agreement, the Parties agree as follows: 1. Accuracy of the Recitals. The Parties hereby acknowledge and confirm the accuracy of the Recitals, which are incorporated herein by this reference. 2. Effective Date. This Agreement shall be effective upon adoption by Town Ordinance No: (0)03-09 and the execution of this Agreement by both Parties as provided in law(the"Effective Date"). The term of this Agreement shall commence on the Effective Date and shall automatically terminate on the fifth(5th)anniversary of such date or at such later date as may be agreed upon in the EDA(the"Term"). 3. Annexation. 3.1. Annexation Adoption. Developer shall execute and deliver a petition authorizing annexation of the Property to the Town on or within 30 days from April 3, 2003. Thereafter, the Town shall diligently undertake to perform all necessary acts and procedures required by A.R.S. § 9-471 to adopt an ordinance annexing the Property into the Town as part of the Proposed Annexation District within 30 days from April 3, 2003. If for any reason the annexation cannot be finalized within 30 days from April 3, 2003, this Agreement shall be void and of no effect. 3.2. Costs and Expenses. All procedural and administrative costs and expenses of the Town pertaining to the annexation shall be paid by the Town. Exhibits: 3 A—Legal Description of Property B—Zoning Map,Site Plan and Subdivision Plat C—Existing County Zoning Map Developer shall bear its own legal and consulting costs and expenses incurred in connection with the negotiation and preparation of this Agreement. 3.3. Effective Date. Pursuant to A.R.S. § 9-471 (D), the annexation ordinance will become effective after the expiration of thirty days from the adoption of the annexation ordinance, or, if the annexation is the subject of a referendum petition, upon completion of that process (the "Annexation Effective Date"). 4. Original Town Zoning. As it pertains to this Agreement only, Original Town Zoning shall mean Town zoning as applied to the Property upon successful Annexation of the Property in conformance with A.R.S. § 9-471 (L). Pursuant to state law, the Town shall initiate and pursue the procedures for the adoption of the Original Town Zoning in a manner so as to permit Town Council action on an ordinance adopting the Original Town Zoning not later than six months from the effective date of annexation. Nothing herein shall limit the Town's legislative discretion to determine the appropriate Town Zoning in conformance with A.R.S. § 9-471 (L); provided, however, that the Developer and the Town understand it is the express intention of the Developer that the current uses of retail shopping center, with the current uses, shall be allowed to continue under any proposed Town zoning so that none of Developer's current uses would become non-conforming. It is anticipated that the Town zoning would be C-2 Commercial District. 4.1. County Zoning. As it pertains to this Agreement only, Original County Zoning shall mean the County Zoning as applied to the Property immediately prior to successful Annexation by the Town. 5. Architectural Design. The existing Plaza Escondida architectural design shall continue and shall, in the event of extensive remodeling or reconstruction, substantially conform to the Town's architectural design guidelines in effect as of the Effective Date of remodeling or reconstruction and shall govern the architectural development of the Project. Exhibits: 4 A—Legal Description of Property B—Zoning Map,Site Plan and Subdivision Plat C—Existing County Zoning Map 7. Signage. The Town shall permit Developer to continue its existing signage in conformance with the on and off-site signs currently existing; provided, however that any future signage would have to comply with appropriate Town regulations. 8. Designated Representative. To further the commitment of the Parties to cooperate in the implementation of this Agreement, the Town and Developer each shall designate and appoint a representative to act as liaison between the Town and its various departments and Developer. She did not think the item should be continued since the applicant worked with the Sign Committee. VOTE: Member Reddin Nay Member Feinberg Aye Chair Caswell Aye Member Sturmon Nay Member Panas Nay Member Kunisch Aye Motion failed 3-3. Member Reddin clarified his issue was not the artwork. His issue was that there was no visualization of to the relationship between the sign and the property. Chair Caswell asked if a sign criteria has been approved without pictures of the sign and the center's compatibility. Mr. Vella explained that in the past, staff supplied pictures and apologized for not providing them at the meeting. He suggested a motion that would approve the sign with the condition that the Sign Committee does any tweaking, if necessary, to ensure the sign matches the art wall and to take their opinion as final. Member Panas was in agreement with Member Reddin that there was not enough information. He asked if the Sign Committee agreed with the project. Chair Caswell confirmed the Sign Committee agreed with the project. Member Sturmon agreed with the Committee and the sign itself, but thought they needed to see how the sign would match the property. MOTION: Member Feinberg MOVED to approve OV3-04-09, Sign Criteria for Canada Crossroads, with the conditions listed in Exhibit A and the following condition that the Sign Committee meet and make a decision on the compatibility of the signs to the surroundings. David Ronquillo presented the staff report into the record. The applicant, Yvette Ensign, 801 East Placita De Arnoldo, stated that they have accommodated the previous conditions. MOTION: Member Kunisch MOVED to approve OV 12-04-02, Landscape Plan for La Reserve Villas. Member Reddin SECONDED the motion. Motion carried 6-0. 5. Bayer Vella introduced the staff report into the record. The applicant Mike Addis, 3808 East 38th Street, overviewed the attachments on the overhead. Member Feinberg asked the height of the monument sign that was across the street. Mr. Addis estimated the height at 10 to 12 feet for the monument sign across the street. Member Kunisch asked about Sigh B directional signs and the traffic safety. Mr. Addis indicated that Sign B would be perpendicular to the traffic. It would be possible to move it and/or adjust to accommodate the area. Mr. Vella pointed out that Exhibit A, Condition 4 addressed the visibility issue and requires further Public Works review. Member Panas asked the applicant the reason for the variance on height. Mr. Addis responded that the multi-façade design was to match the buildings. Chair Caswell did not understand with the need for a large sign on Magee since it entered into residential area. F:\Minutes\DRB\2004\12-14-04 Minutes Approved on January 11, 2005 12/14/2004 Development Review Board Minutes Page 7 of 9 Mr. Addis replied that he did not think it was excessive but tasteful. He would be open to reducing the sign. CALL TO AUDIENCE Opened at 7:44 p.m. Bill Adler, 10720 North Eagle Eye Place, indicated the intent of the master sign program was to allow an applicant to propose a quality alternative to what the code would allow. The sign was not about quality or upgrades, but bigger with no justification. The General Plan stated that signs were for identification not advertising. The applicant needed to confine within the code. CALL TO AUDIENCE Closed at 7:47 p.m. MOTION: Member Kunisch MOVED to recommend that the Town Council deny OV3-04-07, Master Sign Program for Plaza Escondida. Member Feinberg SECONDED the motion. Discussion: Member Kunisch indicated that his reason for the denial was that the current signs were readable. He thought it was strictly for advertising and that the code should be followed. Member Panas concurred with Member Kunisch's comments. Member Feinberg noted that the sign would be a gateway into Oro Valley and should be pleasing to those who enter. A 13-foot monument screaming on a street would not be pleasant. Member Reddin acknowledged the architecture of the sign was beautiful but the massing of the sign was large. Member Sturmon pointed out that he was a member of the Sign Committee and had many discussions on this plan. The intent of the sign was to compromise and support the businesses Oro Valley annexed. Because of the large size of the sign, there would only be one on Oracle Road. In Exhibit A there was a condition that the sign on Magee must meet code; therefore, it would be smaller than proposed. Also, Exhibit A provides that the directional signs must be changed from listing 20 businesses to just 10. Motion carried 5-1 (Sturmon).
