g TOWN OF ORO VALLEY STAFF REPORT TO DEVELOPMENT REVIEW BOARD MEETING DATE: NOVEMBER 9, 2004 TO: DEVELOPMENT REVIEW BOARD FROM: Jonathan Lew, Planning Technician SUBJECT: OV3-04-08, MAXICRAFT SIGNS INC., REPRESENTING BANK OF AMERICA, REQUESTS APPROVAL FOR A FREESTANDING SIGN TO BE LOCATED WITHIN THE SAFEWAY VISTOSO PLAZA, ON THE NORTH EAST CORNER OF RANCHO VISTOSO AND TANGERINE, PARCEL# 223-02-0340. BACKGROUND: The Safeway Vistoso Plaza is located within the Rancho Vistoso Planned Area Development (PAD). The building abuts Rancho Vistoso Boulevard and is between the Safeway Fuel Center and the future "All About Running and Walking"pad. On October 7, 2003, a freestanding sign, located at the southern most entrance to the Safeway Vistoso Center, was permitted for the Safeway Fuel Center. This sign was exempted from the Rancho Vistoso PAD guidelines by Town Council on August 20, 2003. The sign, with the exception of having Red and Green L.E.D. electronic price change, is painted to match the existing center. APPLICANT'S PROPOSAL: The applicant is proposing to place a Rancho Vistoso model P-4 sign (monument sign) on the northern most entrance to the Safeway Plaza. The following are the guidelines for the Rancho Vistoso P-4 model sign: • Double Faced rectangular monolith mounted on pyramidal sandstone veneer base. • Maximum height of 8 feet • Maximum area 40 square feet • Location is to 5' behind the right of way and 20' form the entrance. • May be internally illuminated, halo illuminations is also permissible. The applicant has proposed a sign with the name of the center and 6 tenant panels. The following is the proposed color(samples attached) and illumination scheme for the signs: • Background color is to be painted ICI 570 Shell Creek. • The name of the center and tenant names are to be Mathew's Brown Berry 88-4D • The trim separating the center name and the tenant panels will be painted ICI 160 Old Redwood. • Cabinet to be internally illuminated with fluorescent lamps with white halo illumination only through edges of the acrylic letters. DRB SIGN-SUB COMMITTEE On October 27, 2004, the DRB subcommittee met with the applicant to discuss the submittal. The members concerns regarding the sign are as follows: • The members wanted the sign lights to be turned off at an appropriate time. o The OVZCR 12.502F states that the illumination shall be turned off no later than 11:00 pm. • Meets all visibility triangles and guidelines. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 2 o Oro Valley Public Works staff has reviewed the submittal and finds that the sign is not within a site visibility triangle. • Ensure that the proposed sign matches the existing Safeway Fuel Center Sign. o The proposed sign is consistent in color and style to the Safeway Fuel Center Sign. • Landscaping cleared to establish the proposed sign should be replaced with landscaped treatments. o As provided in Exhibit A, the applicant shall submit a landscape plan, when permitting the sign, showing what vegetation will be removed and how it will be replaced. CHAPTER 3, SECTION 3-302, CRITERIA: In considering any application, the Development Review Board shall be guided by the following criteria: The proposed design shall promote a desirable relationship of structures to one another, to open spaces and topography both on the site and in the surrounding areas: Internal Compatibility The wall signs within the Safeway Vistoso Plaza are painted with the proposed Brown Berry color, and are halo illuminated. The Safeway Fuel Center freestanding sign also utilizes the Brown Berry color. The character of the proposed design shall be in harmony with, and compatible to, those structures and signs in the neighboring environment and the design character adopted for any given area avoiding excessive variety or monotonous repetition: External Compatibility Category Safeway Center Walgreen's—lst and Tangerine Color Mathew's Brownberry Copper Patina Illumination Halo Illumination Combination of Halo and Internal Illumination The proposed sign is modeled after the Rancho Vistoso P-4 model sign for the entire PAD. The sign is compatible with all surrounding development. Signs, ingress, egress, internal traffic circulation, off-street parking facilities, loading and service areas and pedestrian ways shall be so designed as to promote safety and convenience: This application has been reviewed by the Town of Oro Valley Public Works staff. The location, colors and illumination has been restricted in a manner to provide safety, proper visibility and convenience in regards to flow of traffic. In order to protect the visual serenity of the Town, design of signage should be based on trying to get information across with the least signage possible: The addition of a freestanding sign along Rancho Vistoso does not meet this criterion; however, mitigating circumstances exist that merit the signs placement. The Safeway Vistoso Plaza is approximately 500 feet from Tangerine Road. A large drainage area along Tangerine Road further TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 3 inhibits the Plaza's visibility from Tangerine Road. A large amount of established landscaping along Rancho Vistoso Boulevard further inhibits the Plaza's visibility from a major roadway. The applicants proposed amount of signage meets the minimum standards set forth in Chapter 12 of the OVZCR. Sign designs shall be in compliance with the purpose statements established in Section 12-101: All components shall be in compliance with Article 16, Design Guidelines: Chapter 16, Design Guidelines are written to reflect the purpose statements in Chapter 12, Signs. Both areas of the code address uniqueness, character, compatibility and the use of materials and colors that appear natural to the environment and surrounding community. The application meets most of the criterion—as previously discussed. SUMMARY: The proposed freestanding sign for Bank of America incorporates the design guidelines for the Rancho Vistoso PAD. The sign is compatible in style, material, color, and size with the surrounding area. The applicant's proposal does not meet one of the review criteria; however, mitigating circumstances merit its placement. RECOMMENDATION: It is recommended that DRB approve the freestanding sign for Bank of America with the landscaping condition in the attached Exhibit A. SUGGESTED MOTIONS: I move to approve OV3-04-08, freestanding sign for Bank of America, with the sole condition in Exhibit A. Attachments: 1. Exhibit A 2. Applicant's Proposal CC: Stacy Malo(602)233-0830 EXHIBIT A OV3-04-08 FREESTANDING SIGN FOR BANK OF AMERICA 1. A landscape plan shall be submitted with the sign permit application. It must depict how disturbed areas (due to sign installation)will be landscaped. He thought the color palette was bright even though they were desert colors and approved by the Rancho Vistoso's architectural committee. Vice Chair Glueck thought the colors looked bright due to copying effects. Member Feinberg agreed the colors were different. Member Kunisch asked if there were restrictions for the plan's construction until La Canada was completed. Mr. Vella confirmed the halt of construction until La Canada was completed but needed to research it further. MOTION: Member Panas MOVED to Table Item Number C. Member Sturmon SECONDED the motion. Jonathan Lew introduced staff report. Chair Caswell informed that the Sign Committee was concerned with the view hazard. Mr. Lew indicated that the Public Works Department reviewed the site and did not find any dangerous view hazards. Vice Chair Glueck pulled this Agenda Item because of the letter that was in the packet from Corbett Properties, L.L.C. She read the conditions in the letter. She asked the Board to include the letter as a condition; otherwise, nobody would be responsible for the sign and nothing would protect the rights of Corbett Properties. Mr. Andrews indicated that the Town would not be involved in the liability between the parties of the signage. Mr. Vella indicated that the items addressed in the letter were private contractual matters not the DRB's responsibility. Vice Chair Glueck was concerned with the maintenance of the sign. Mr. Andrews indicated that if the sign was not maintained, it would be sited for falling below standards and the responsible party would be the one to maintain it.
