Nogales Highway Tucson, Arizona 85706 RE: Request for PAD Exemption for Signs for Rooney Ranch Area D, OV311-005 Dear Mark: Staff has received this request for a PAD Exemption for Signs at Rooney Ranch Area D. The process for approval of a PAD Exemption is defined in Zoning Code Section 28.2.C., PAD Exemption. The request is forwarded to the Conceptual Design Review Board (CDRB) for recommendation. The request is then scheduled for Town Council which shall approve, conditionally approve, or deny the request. The section notes: "A letter requesting exemption from the specific PAD sign regulations must be submitted by the property owner within the PAD with a list of all homeowner/master associations within the affected area." There are various property owners in the Rooney Ranch Area D, and staff concludes that the intent is that they should all be notified (see attached map of my inventory of property ownership within Area D). Based on this code requirement, please revise your letter to include this list of property owners for staff verification. In your letter you noted the La Reserve Homeowners association; perhaps you were thinking the request was for adjacent area HOA's. Please revise your letter to remove that information since it is not correct. Also, Section 28.2.C. indicates that Notice must be sent by Town staff to the homeowners associations (or, as we have determined, property owners) not less than thirty days in advance of the CDRB meeting date. With this notice requirement, the next CDRB meeting date at which this request may be scheduled is Tuesday, December 13, 2011. In order to meet this schedule, please provide an updated request letter by Monday, October 31, 2011. I will research our files to determine which properties have at Area D have received Sign Criteria or other sign approvals. OV311-006. SUMMARY: This applicant is requesting an exemption from the Rooney Ranch Oro Valley Center PAD, Parcel B Sign Guidelines (Attachment 1). The Rooney Ranch Planned Area Development (also referred to as Oro Valley Center) includes specific guidelines for signs in Area B (Attachment 2). A Planned Area Development (PAD) that has its own sign standards may request to operate under the requirements of Zoning Code Chapter 28, Signs. The Conceptual Design Review Board (CDRB) must review the request and provide a recommendation, which is forwarded to Town Council for a decision. A Sign Criteria is a set of sign standards for more than one business. In this case, the Rooney Ranch Parcel B Sign Guidelines are the approved Sign Criteria for Area B. The applicant notes that the reason for the request is that the Sign Criteria for the Area B was approved in 1998, and is outdated. In addition, recent changes in the Zoning Code sign standards will permit tenants to update their signage consistent with these new standards. Site Conditions The PAD Exemption would apply to all businesses in Rooney Ranch Area B, except for McDonald's Restaurant (Attachment 3). McDonald's Restaurant was granted a PAD Exemption and approval of a Master Sign Program in 2009. Of the seven parcels in Area B, four are owned by the applicant and the rest are owned by others. Rooney Ranch Area B is one of two commercial districts in Rooney Ranch. A PAD Exemption has also been submitted for Area D, the second commercial area. Proposed Improvements No specific sign standards or designs are included with this request. In order to utilize the Town zoning standards, the applicant would be required to submit a new Sign Criteria in accordance with the Zoning Code for businesses in the Center. BACKGROUND: Approvals to Date • 2009: Town Council approved a Master Sign Program and PAD Exemption for McDonald's Restaurant. • 1998: Town Council approved Rooney Ranch Parcel B Sign Guidelines. • 1990: Town Council approved Rooney Ranch Oro Valley Center PAD. TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 2 of 4 ANALYSIS: Zoning Code and Rooney Ranch Parcel B Sign Guidelines The Rooney Ranch PAD includes specific guidelines that apply to Area B signs. A key element of the guidelines is that wall signs must utilize a copper patina material for sign text, except Major tenants may utilize muted orange, blue and white; logos may utilize corporate colors. Monument signs may also utilize orange, blue or white text. The Rooney Ranch Parcel B Sign Guidelines and the Zoning Code standards are compared below: User Rooney Ranch Parcel B Sign Guidelines Oro Valley Zoning Code Wall Sign Major Tenant 1.5 sq ft per building facade(footage) on which the Area: May be 24 sq ft, with no single wall sign (over 40,000 sign is to be placed, not to exceed 500 sq ft for any containing more than 1 sq ft for each linear foot of sq ft) single user. Facades must face a street. building frontage, for a maximum sign area of 150 sq Minor Tenant .8 of building facade footage ft..Wall signs for building elevations further than 300 (0— 10,000 sq feet from the street may contain no more than 1.5 sq ft) ft for each linear foot of building frontage, for maximum sign area of 200 feet. Pad Building 1 sq ft per bldg facade on which the sign is to be Area: 1 sq ft for each linear foot of building frontage placed, any 2 sides facing a street. up to 24 sq feet within 300 feet of street. Number:A 3rd wall sign may be utilized for a single tenant building. Monument Sign Two permitted; one 8 ft high sign along Oracle Road One per street frontage. If frontage is greater than and one 6 ft high sign along First Street. 600 feet, a 2nd sign is permitted. If frontage is greater 64 sq ft of sign area permitted. than 800 feet, additional signs may be approved by the Town. Directional Sign Maximum height 3 feet, maximum area 4 sq_ft. Maximum height 3 feet, maximum area 6 sq ft. The illumination standards permitted under the two documents are comparable: both sets of standards permit halo-illuminated text, and internally illuminated cabinet signs with logos, for which only the logos emit light. However, the Rooney Ranch Parcel B Sign Guidelines permit only white illumination, whereas a range of illumination colors is allowed under Zoning Code standards. The comparison shows that additional signage would be allowed under the Zoning Code, for instance: • A freestanding pad with a single tenant is allowed an additional wall sign. • Additional monument signs may be permitted along Oracle Road and First Avenue, and monument signs along First Avenue could be eight feet high. • For wall signs, Minor tenants would be allowed one square foot of signage for each linear foot of building frontage, or 1.5 square feet per linear foot for building elevations further than 300 feet from the street, rather than .8 square feet. • Directional signs may be up to six square feet in area. However, an exception is wall signs: wall signs would be limited to 200 square feet in area under Zoning Code standards, whereas under the Rooney Ranch Area B guidelines, Major Tenants are allowed up to 500 square feet. TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 3 of 4 Zoning Code, Addendum A Design Standards • Standard 2.1.F.4. Location and placement of building mounted signs shall be integrated into building architecture. Building signs shall be consistent in terms of materials and construction. The Rooney Ranch Parcel B Sign Guidelines require consistent use of one material: copper patina for sign text. The applicant notes that the copper patina material style appears dated, and is in need of updating. This design standard could be utilized to ensure that a new sign design is integrated into existing building architecture, to the extent feasible, and provides consistent standards for materials and construction. • Standard 2.1.F.2. Project identification and sign elements shall incorporate unifying architectural treatment and project unifying elements which are integrated with the overall design of the project in terms of style, materials, color and theme. The existing sign guidelines incorporate copper patina material as a unifying design element. The applicant notes they wish to modify this element of the current design. This design standard would be utilized to review a proposed new Sign Criteria or Master Sign Program to ensure that the design included unifying elements for this large commercial center. PUBLIC NOTIFICATION AND COMMENT: All property owners were provided with notice of the meeting, and notice was posted at Town Hall and on the Town website. To date, no comments have been received. CONCLUSION/RECOMMENDATION: This request for a PAD Exemption will provide an opportunity for Rooney Ranch Area B businesses to utilize the updated provisions of the Zoning Code sign standards. In addition, the Town's new Design Standards would be utilized to review a new Sign Criteria or Master Sign Program. If a new Sign Criteria for Area B is submitted and approved, businesses in the Center may choose to continue using their approved signs, but any new signs would need to comply with the Zoning Code standards. Staff recommends approval of this application. SUGGESTED MOTION: The CDRB may wish to consider one of the following suggested motions: I move to recommend approval of OV311-006, PAD Exemption for Rooney Ranch Oro Valley Center Area B from the Rooney Ranch Oro Valley Center Parcel B Sign Guidelines to allow the applicant to utilize the Zoning Code sign standards, finding that this will permit the businesses in the Center additional flexibility in sign design that is consistent with Town standards. I move to recommend approval with conditions of OV311-006, PAD Exemption for Rooney Ranch Oro Valley Center Area B from the Rooney Ranch Oro Valley Center Parcel B Sign Guidelines to allow the applicant to utilize the Zoning Code sign standards, finding that this will permit the businesses in the Center additional flexibility in sign design that is consistent with Town standards, subject to the following Conditions of Approval TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 4 of 4 I move to recommend denial of OV311-006, PAD Exemption for Rooney Ranch Oro Valley Center Area B from the Rooney Ranch Oro Valley Center Parcel B Sign Guidelines finding that this will not produce improved sign design at Rooney Ranch Parcel B. The Sign criteria for this center is outdated having been developed in 1998 and time is taking its toll on the signage for the center. At that time, the requirement was that signage needed to be copper patina with halo illumination. With that requirement has come a wide variety of interpretations of that color, some of which are not very attractive. Also, due to recent changes in the Oro Valley Sign Code, it can afford us the opportunity to be able to allow our tenants to update their signage with some of the more modern methods available. At the same time, we intend to update the monument signs to provide our tenants more visibility along Oracle Road which has always been a challenge due to the setback from Oracle Road which can be over 600 feet in most cases. OV311-006. SUMMARY: This applicant is requesting an exemption from the Rooney Ranch Oro Valley Center PAD, Parcel B Sign Guidelines (Attachment 2). The Rooney Ranch Planned Area Development (also referred to as Oro Valley Center) includes specific guidelines for signs in Area B (Attachment 3). A Planned Area Development (PAD) with its own sign standards may request to operate under the requirements of Zoning Code Chapter 28, Signs, or propose a Master Sign Program. The applicant, Barclay Group, has requested review of a proposed Master Sign Program, which is also included in this agenda. The Conceptual Design Review Board (CDRB) must review the request and provide a recommendation, which is forwarded to Town Council for a decision. The Rooney Ranch Parcel B Sign Guidelines are the approved Sign Criteria for Area B. The applicant notes that the reason for the request is that the Sign Criteria for the Area B was approved in 1998, and is now outdated. In addition, recent changes in the Zoning Code sign standards appeals to tenants who want to utilize these new standards. Site Conditions The PAD Exemption would apply to all businesses in Rooney Ranch Area B, except for the Big 0 Tire Center, McDonald's Restaurant, and Bank of America (Attachment 4). McDonald's Restaurant was granted a PAD Exemption and approval of a Master Sign Program in 2009. The Big 0 Tire Center has a separate Sign Criteria. Rooney Ranch Area B is one of two commercial districts in Rooney Ranch. A PAD Exemption and Master Sign Program has also been submitted for Area D, the second commercial area. Proposed Improvements No specific sign standards are included with this request. The applicant has submitted a Master Sign Program. Approval of this request allows the CDRB to provide a recommendation on the Master Sign Program. BACKGROUND: Approvals to Date • 2009: Town Council approved a Master Sign Program and PAD Exemption for McDonald's Restaurant. • 1998: Town Council approved Rooney Ranch Parcel B Sign Guidelines. • 1990: Town Council approved Rooney Ranch Oro Valley Center PAD. TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 2 of 2 DISCUSSION: The Rooney Ranch Area B is currently operating under the PAD Sign Guidelines for Area B. To ensure that the PAD continues to have a set of approved sign standards, the PAD Exemption should not become effective unless the proposed Master Sign Program for Area B is approved. A condition noting this has been added to Attachment 1. PUBLIC NOTIFICATION AND COMMENT: All property owners were provided with notice of the meeting, and notice was posted at Town Hall and on the Town website. To date, no comments have been received. CONCLUSION/RECOMMENDATION: This request for a PAD Exemption will provide an opportunity for Rooney Ranch Area B businesses to utilize the updated provisions of the Zoning Code sign standards, and to propose modified standards in a Master Sign Program. In addition, the Town's new Design Standards will be utilized to review the new Master Sign Program. If a new Master Sign Program for Area B is approved, businesses in the Center that are included in the request may choose to continue using their approved signs, but any new signs would need to comply with the Master Sign Program standards. Staff recommends approval of this application. SUGGESTED MOTION: The CDRB may wish to consider one of the following suggested motions: I move to approve the request for a PAD Exemption from the Rooney Ranch Area B Sign Guidelines with the Conditions in Attachment 1, finding that: • The request meets the Zoning Code requirements for a PAD Exemption. OR I move to deny the request for a PAD Exemption from the Rooney Ranch Area B Sign Guidelines, finding that: • The proposal does not meet the Zoning Code requirements for a PAD Exemption, specifically Attachments: 1. Austin Sr. VP Barclay Group Phoenix.Arizona Diniedin,Florida Atlanta,Georgia Texas • Hayes, Patty From: Hayes, Patty Sent: Tuesday, June 02, 2015 2:43 PM To: Keesler, Paul Cc: Laws, David Subject: T Mobile Sign Paul, RE: T-Mobile wall sign Currently T-Mobile has a wall sign over their tenant space in the Copper Patina color at 9 sq.ft. in size. Rooney Ranch Area B (Home Depot center) sign standards allows: • Color—Copper Patina • Logo—10 sq. ft. • Illumination: White halo • Size allowance: 80%of building frontage • Total maximum size sign for this store that has 18' linear feet of frontage is 14.4 sq ft of sign The Rooney Ranch sign standards would allow this tenant to have a sign larger than they have now,for a total of 14.4 sq ft in size. Only 10 sq. ft. of that sized sign could use their logo colors. Possible quick solutions: • Since their current sign on the building is under the allowed size for logo colors, they could have the entire sign painted their corporate color. Pink. Obtain a sign permit before changing colors. • They could install a larger sign up to 14.4 sq ft in size and 10 sq ft of that sign could be pink. The rest of the sign, 4.4 sq ft,would need to be Copper Patina in color. Obtain a sign permit before installing new sign. Best long term solution: • The Rooney Ranch sign standards could submitted to be revised to allow the same or similar standards as the adjacent Target Center. • A sign PAD exemption would need to be approved by CDRB and Council. • The property owners could choose to proceed with a new Sign Criteria (CDRB review only) or a new Master Sign Program (CDRD and Council review). • The PAD exemption and new sign criteria or program could go through the process concurrently. History: • In 2012 the Barclay Group (owners of both Target and Home Depot centers) submitted for a PAD exemption and new Master Sign Programs for both centers. • The Target Center was successful in obtaining their PAD exemption and new Master Sign Program which has allowed tenants to update their signs and allowed the center to update their monument signs. • At some point during the process the owners pulled the Home Depot center sign update project from the process. We were told it was due to conflicts with the large anchor tenant in the development. • Although we've encouraged them to try to move forward, we haven't seen anything come back. A gentlemen with a sign company has called here recently asking about changing the sign. We informed him of the same solutions and processes that I've explained to you in this email. i Thanks, Patty Hayes Senior Planning Technician Town of Oro Valley (520)229-4819 or phayes@orovalleyaz.gov 2 Hayes, Patty From: Vella, Bayer Sent: Thursday, June 04, 2015 3:27 PM To: Hayes, Patty r Cc: % Zanch r L .uject: RE: sign research info '"/ ov.Pm r ry 444 Patty, % 2 3 ep Please see responses below. Will we request that Barclay,or really the Town, notify all property owners such as McDonald's,Taco Bell, Home Depot, Bank of America, etc. ? lam confused. Let's discuss Procedure normally followed: PAD Exemption: Affected HOA's Master Sign Program: Affected HOA's Can Barclay move forward with changes that effect only the shop buildings and not Home Depot? That would get a little sticky with the monument signs. Let's chat. History: • Barclay paid $700.00 in 2011 for a PAD Exemption for Area B from the Rooney Ranch sign standards ✓ Barclay paid$1000.00 in 2012 for a master sign program for Area B for review. 1 • ' 10-19-11: Letter from staff to the applicant asked the applicant to provide a list of all property owners in the center because they would all need to be notified. • March 2012 CDRB: Rooney Ranch Areas D and B where both on the agenda but both pulled. • April 2012 CDRB: Only Area D was heard at CDRB. • At the April 2012 meeting staff said that Area B was pulled at the applicants request. • A letter dated 4-10-12 from Barclay asked for a continuance due to the need to meet with the representatives of the Home Depot to discuss signage. • At the April 2012 CDRB meeting the applicant stated that Area B would come back at a later date. Applicant's representative stated that Barclay is talking with Home Depot and will come forward later. • In summary the applicant paid $1700.00 for two processes that they never completed. Staff reviewed submittals, wrote reports, scheduled meetings and placed cases on agendas before the project was abandoned. Patty Hayes Senior Planning Technician Town of Oro Valley (520) 229-4819 or phayes(aorovalleyaz.gov 2 Hayes, Patty From: Hayes, Patty Sent: Wednesday, June 10, 2015 8:46 AM To: 'afoster@barclaygroup.com' Subject: Rooney Ranch signs Attachments: PAD Sign Exemption Process Guide.pdf; Sign Criteria Process Guide.pdf Arlene, After reviewing the past submittals for Rooney Ranch the following is recommended for your sign update project: Submit a PAD sign exemption Submit a revised sign criteria Although these submittals will be new we can still continue the fees from the old processes started in 2012. So new information is needed from your side, but paid fess will be carried over to the new submittals. Previously your submittal included sign updates for the entire Rooney Ranch development that included all the shops, Home Depot and all monument signs. Although updating signage for the entire development is the preferred and ideal situation,we understand that you have some internal conflicts with the major in the development which may prevent a whole update. You could explore the following process that would allow you to update the wall sign for the shops only and leave the majors out. Propose a Planned Area Development(PAD) sign exemption from a portion of the PAD sign standards. The specific portion is the page of the PAD document titled "Oro Valley Center,Area B Sign Guidelines". Propose to revise only the second line titled "Minor Tenant" sign standards. That is the section that applies only to wall signs for the shop tenants in the development and it leaves the monument signs out and the major tenants out. That should exclude Home Depot from being affected. One draw back is that it would also exclude the Sports Authority building also because it is also a major tenant. You could consider adding a new line to that table that add a Junior Major and define what space that would be and then that Sports Authority space would be included in the new revision sign criteria. I hope this offers some viable possibilities for you and your tenants. I would be more than happy to meet with you about this project or speak to your sign company if you like. It's a process that leaves Home Depot out of the equation. I sent Arlene with Barclay the "how to" on that process. It seems that their problem isn't with us or our processes but an internal issue. She needs to either work on changing their CC&R's or lean on Home Depot to understand the issue. That's where we could help. She explained the process for your larger sign approval is to have our sign company generate a new sign criteria to submit to the Town of Oro Valley. The CCR's require that Home Depot would have to approve a new sign criteria. I have communicated with Home Depot corporate and they would not approve any change to the sign criteria. Please call me if you have any questions.
