This letter reflects comments to be addressed. Please make the following corrections: 1. This Fry's location is part of the Canada Hills Marketplace. The center has an established sign criteria which primarily allows 24" tall, halo illuminated copper patina letters. That center is currently updating their criteria but the applicant of that criteria (the retail shops) claim that Fry's did not want to participate in the criteria revision. The new criteria doesn't fit the larger proposed signs. Fry's may create their own sign criteria for the development possibility allowing larger signs with more color choices. (OVZCR 28.2.B.) 2. The proposed freestanding sign is for a fuel station which is not located in the same center as the Fry's store. The El Conquistador PAD section 1.12.0 does not allow "off premise" signs. The fuel sign will need to be located on the property of the center, Mercado at Canada Hills. The Mercado at Canada Hills shopping center has an established sign criteria which could be email to you if you would like. Please return corrected drawings with a comment letter. Proposed monument sign The Fry's fuel station proposes to build a monument sign on the property owned by the Fry's grocery store. The fuel station is not located on the Fry's property but on the neighboring property, Mercado at Canada Hills. This proposed sign cannot be approved on the Fry's property per the following code sections: El Conquistador PAD section 1.12.c. No off premise signage, except for directional signs, shall be allowed. OVZCR 28.9.A.12 Prohibited Signs 12. Off-site signs OVZCR definition 51. Off site sign: Any sign not located on the premises or site of the use identified or advertised by the sign. Site conditions A site visit reveled there are currently two monument signs on the La Canada frontage of the Fry's development. One for Fry's Food and Drug and one for the Diamond Gas station. • Current zoning code section 28.5.B.8 allows for one monument sign per street frontage. Two if greater than 600'and there is more than one entrance. • The Fry's development has approximately 490'of frontage. • The two existing signs can remain as legal non-conforming. • If one of the signs is removed, it could not re re-installed because only one sign is allowed. Solutions • Fry's fuel could use the one remaining Mercado monument sign and it would be placed on the Mercado's property where the fuel station is located. The new Fry's sign should include text referencing the fuel station. • The El Conq. PAD allows for off site directionals. Fry's can have one 6 sq ft 3'directional inside the Fry's parking lot directing people to their station at Mercado. Wall signs Fry's also proposes to install new wall signs on their building including signs for the Tully's Coffee shop. Currently the Fry's center does not have a sign criteria or master sign program for their store. However there is a code section that may help with that process. • OVZCR 28.2.B. allows a development that shares access to use the neighbors sign criteria. This would allow Fry's to take advantage of the Mercado at Canada Hills sign criteria. That criteria may have enough allowances in size and color to shorten the process to a sign permit only. Staff would be more that happy to email a copy of that criteria to the applicant's sign contractor for review. The request includes two off-site combination signs (fuel pricing and monument) to be located on two street frontages (See Attachment 1). The OVZCR provides the maximum number of allowed monument signs within the three shopping centers. The following is a breakdown of all the allowed monument signs along La Canada Drive and Lambert Lane (See Attachment 4). • 3 of 5 allowed monument type signs along La Canada Drive have been installed. o Mercado shopping centec(north-center) • • Monument sigh: 1 of 2 installed • Fry's Fuel Pricing sign: 0 of 1 installed o Market Place shopping center (south center) • Monument sign: 1 of 1 installed • Fuel pricing sign: 1 of 1 installed • 2 of 3 allowed monument type signs along Lambert Lane have been installed. o Retail Shops shopping center (southeasterly center) • Monument sign: 0 of 1 installed o Market Place shopping center (south center) • Monument sign: 1 of 1 installed • Fuel pricing sign: 1 of 1 installed Proposed Improvements (Applicant's Request) • Relocate and convert two existing monument signs along La Canada Drive and Lambert Lane o Signs proposed to contain fuel pricing and tenant panels o Signs will be located approximately 155' and 585' from the gas station site • Signs will meet the larger size requirements for a monument sign. Code Requirements include: a Monument Sign Requirements: • Area: 50 sq ft single tenant and 75 sq ft multiple tenant • Height: 10' (includes 2' architectural feature) from grade o Fuel Pricing Sign Requirements: • Area: 32 sq ft • 6' from grade TOWN OF ORO VALLEY PLANNING AND ZONING COMMISSION Page 3 of 4 PAD Amendment Analysis The Zoning Code currently allows five monument type signs to be installed along La Canada Drive and three monument type signs to be installed along Lambert Lane. The applicant proposes to relocate and convert two existing monuments signs into two combination fuel/monument signs (See Attachment 3). Staff analysis of the applicant's request is as follows: La Canada Fuel/Monument Sign • The proposed sign is located approximately 155' from the Fry's Gas Station, near a shared driveway entrance. • The combination fuel/monument sign will replace an existing monument sign. • A combination fuel/monument sign will reduce the total number of monument signs from five to four along La Canada Drive. • All monuments signs along La Canada Drive will observe a proposed 150' separation. Lambert Fuel/Monument Sign • • Th-espro ap proximately sign is located approximat ly 585' from the future•gas station • The combination fuel/monument`sign will replace an existing monumr nt sign.• :. • The combination fuel/monument sign will require the Retail Shops' allowed monument sign ,4 to be located at least 150' east from the proposed sign. • All monument signs along Lambert Lane will observe a 150' separation. Section 28.5.B.10 of the OVZCR limits fuel pricing signs to one per street frontage. The applicant's proposed fuel component on Lambert Lane exceeds the code standard, and therefore raises a concern. A map depicting all of the existing, proposed and allowed monument signs is attached for your reference (See Attachment 5). Attachment 6 contains the specific language to be incorporated into the El Conquistador PAD that includes: location of the proposed combination fuel/monument signs, size and spacing requirements and off-site tenant panel advertisement. Oro Valley General Plan The Town General Plan designates this site as Neighborhood Commercial/Office. This designation denotes commercial and office areas with good arterial access that are located close to residential areas. The following is an applicable General Plan policy: Policy 2.1 of the General Plan provides that the Town shall ensure that the built environment is aesthetically pleasing and compatible with the natural surroundings. The proposal will reduce the total number of moment signs allowed along La Canada Drive. TOWN OF ORO VALLEY PLANNING AND ZONING COMMISSION Page 4 of 4 RECOMMENDATION The proposed text amendment to the El Conquistador PAD should allow monument signs within the Canada Hills Market Place and the Retail Shops at Canada Hills shopping centers to advertise any business tenant within these two centers, except the Diamond Shamrock Gas Station. The amendment in Attachment 6 provides for this. Staff supports the amendments to the El Conquistador Planned Area Development as shown on Attachment 6, finding that the proposed text amendment will allow more efficient signage within the shopping centers located on the northeast corner of Lambert Lane and La Canada Drive. Staff has a minor concern with the remote location of a Fry's fuel sign on Lambert Lane. SUGGESTED MOTION The Planning & Zoning Commission may wish to consider one of the following motions: I move to recommend approval of the proposed amendment to the El Conquistador Planned Area Development as provided on Attachment 6, based on the finding that: • The proposed amendment =will allow reasonable identification for the fueling station: and - grocery store along La Canada Drive and Lambert Lane. :: - • The proposed amendment will reduce the total number of allowable monument signs along La' Canada Drive. • OR I move to recommend denial of the proposed amendments to the El Conquistador Planned Area Development as the proposed amendment is not warranted at this time, specifically ATTACHMENTS: 1. This Application is to Modify the Comprehensive Sign Criteria for the Fry's Food & Drug at Lambert and La Canada Drive,#117. The Fry's has outdated signage that is old and needs to be replaced. The signs that are installed at site now are the old Copper Patina style letters that were the standard for the center. Fry's is looking to change that standard to be aloud there corperate standard for signage. This store in Oro Valley is the only store state wide to not have these signs. It is important that Fry's be identified by there signage standard statewide for there shoppers and for business success.. The Signs that are being proposed are all to code and UL standards, pan channel and reverse channel signage. These new signs with the store remodel will benefit the appearance of the center and the Town. The new signs will look pleasing to the town along with the new colors the store is being painted. Along with new wall signs Fry's is looking to remove and dispose of the old outdated ground signs and replace them with new monuments signs that match the store colors and stones. The new proposed ground signs are to town code and would greatly increase the appearance of the center and the town. Please review the attached sign package for Fry's Food & Drug. The Mercado has an existing Sign Criteria adopted in 2008 but the Marketplace does not have a sign criteria established. The Marketplace was built prior to the sign criteria requirement. The construction of a Fry's fuel station on a lot in the Mercado development while the grocery store is located in the adjacent development was the catalyst for creating a joint Sign Criteria for both developments. The Conceptual Design Review Board (CDRB) is required to review Sign Criteria for final approval. A sign criteria is a set of proposed sign standards for a development that complies with the provisions of the Zoning Code and Addendum A, Design Standards. The intent of a Sign Criteria is to ensure that all signage within a multi-tenant development is consistent in terms of design, color and illumination. BACKGROUND: Site Conditions The subject properties include the Mercado at Canada Hills which is an 8 acre development that includes the Ace Hardware, Goodwill and the future fuel station. Canada Hills Marketplace is a 6 acre property which is the current location of the Fry's Grocery store. Both developments are commercially zoned as part of the El Conquistador Planned Area Development, Area D. • Surrounding land uses include: o West: Single family residential, day care and drug store o North: A townhome development o East: Single family residential o South: Oro Vista commercial development o All surrounding properties are part of the El Conquistador P.A.D. Proposal The joint Sign Criteria would maintain the previously approved sign standards for the Mercado while allowing the fuel center and grocery store their proposed wall and monument signs. Although both centers wish to keep the proposed colors exclusive to their developments, the fuel center wall signs would be allowed as corporate signage per the existing Mercado Sign Criteria. Process Section 21.5.B of the Zoning Code provides that a Sign Criteria shall be reviewed and must be approved by the CDRB prior to the issuance of a permit. The standards proposed in the revised sign criteria will regulate all allowable signs for this site. TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 2 of 3 Previous Proiect Approvals • Sign Criteria for Mercado at Canada Hills approved in February 2008. • Sign permit for new wall signs for the Fry's store using the Mercado's existing criteria allowing red as their corporate colors approved in September 2012. • An amendment to the El Conquistador P.A.D. requesting a location and sign type modification for the monument signs was recommended for approval by the Planning and Zoning Commission on September 18, 2012 and will be considered by the Town Council on October 3, 2012. For this reason a condition has been included in Attachment 1. ZONING CODE COMPLIANCE • Zoning Code Section 28.3.C.1, Various sign colors are permitted, except for fluorescent or iridescent colors. The proposed Sign Criteria does not contain fluorescent or iridescent colors. • Zoning Code 28.2.B.4.a, Review of a Sign Criteria shall be guided by the overall character of the entire development, including landscaping, architecture, topography, uses, and design. The shopping centers provide retail, restaurant and a soon to be built fuel center with shared access. The shared access and parking functionally integrates the two developments into of one cohesive development. Although the design of the buildings in the two centers is slightly different, the colors used in both developments are compatible. ANALYSIS OF CONCEPTUAL DESIGN REVIEW PRINCIPLES AND DESIGN STANDARDS Conceptual Site Design Principles The following Design Principles are notable for this application: • Zoning Code 22.9.D.5.b.iv, Sign colors, design and placement shall be complementary and integral to the project's architectural and site design themes. The proposed wall signs will provide a contrast to the earthtone colors of the building while the proposed monument signs will use similar colors and brick treatments as used on the existing Fry's store. The number, size and location of the combination monument signs for the Fry's fuel station and grocery store are currently under review as a P.A.D. amendment by the Town Council. Addendum A Design Standards The following Design Standards are notable for this application: • Section 2.1.F.2, Project identification and sign elements shall incorporate architectural treatment and project unifying elements which are integrated with the overall design of the project in terms of style, materials, color and theme. The Mercado is a contemporary interpretation of Southwest Traditional architecture with earth tone stucco, exposed block and steel metal roof elements of contrasting earth tone shades. The proposed Sign Criteria proposes no change in color or style for the Mercado signs, but would allow a size increase for future monument signs up to the size currently allowed in the Zoning Code. TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 3 of 3 The Marketplace is a Territorial/Spanish Colonial design with arched entry portals and red clay tile roofs. The stucco colors of the building coordinate with the adjacent Mercado buildings which have also been incorporated into proposed monuments sign color. The proposed wall sign colors will provide a contrast to color of the building. • Section 2.1.F. 4. Location and placement of building mounted signs shall be integrated into building architecture. Building signs shall be consistent in terms of materials and construction The buildings in both developments have been built to provide adequate space for tenant wall signs with their varied rooflines and parapet walls. • Section 2.1.F.5. As feasible, sign colors shall utilize the project color palette approved as part of the Conceptual Design for the project. The property owners have chosen to provide a separate set of colors for each development based on the different architectural styles and colors within each development. The Mercado will maintain the same wall and monument sign colors as previously approved. Mercado's previously approved Sign Criteria allows corporate colors for 50% of the allowed sign area and the proposed criteria continues that allowance. The Marketplace proposes the use of eight (8) colors for the monument signs and eight (8) colors for use on the wall signs. Although different colors are proposed for the sign letters of each development, the colors for the structural components of the monument signs are similar and coordinate with the colors of the buildings in both developments. Condition 1 in Attachment 1 will apply to this criteria to ensure the same color is used for each line of copy. CONCLUSION/RECOMMENDATION: The CDRB should closely consider the design standards, highlighted herein, in evaluating the proposed sign criteria. The criteria should be approved if the board finds compliance with these standards. SUGGESTED MOTION: The CDRB may wish to consider one of the following suggested motions: I move to approve OV312-006, a Sign Criteria for the Canada Hills Marketplace and Mercado at Canada Hills, based on the finding that the proposed Sign Criteria, as conditioned, is in conformance with the applicable Zoning Code and Design Standards and Principles, subject to the conditions in Attachment 1. OR I move to deny the sign criteria the Canada Hills Marketplace and Mercado at Canada Hills, based on the following findings that the proposal does not meet the Design Principles and Standards, specifically Attachments: 1. Conditions of approval 2. Map of Subject Area 3. Proposed Sign Criteria 4. Examples of Proposed Signs David Williams, Planning Division Manager r ,. Attachment 1 Conditions of Approval Sign criteria for the Canada Hills Marketplace and Mercado at Canada Hills 1. Only one color from the approved color palette can be used for sign letters and characters on any one line of sign copy. 2. This Sign Criteria shall be subject to the Town Council approval of the El Conquistador P.A.D. Amendment under case OV912-003. ATTACHMENT#1 Canada Hills Marketplace Mercado at Canada Hills Pad Amendment An additional request for 4 (four) illuminated monument signs to be permitted for the Canada Hills Marketplace and Mercado at Canada Hills shopping center. Three will be located on the North La Canada Drive frontage, and one will be located on West Lambert Lane frontage. A recent site visit has determined that exterior color modifications were made to the Fry's Grocery Store. These color modifications are considered to be minor changes, and therefore only require an administrative review and approval. The purpose of the administrative review is to ensure compliance with the Town's adopted design standards per Section 1.3.2 of Addendum A, Design Standards, of the Oro Valley Zoning Code Revised. To better assist you with your submittal, staff has prepared an application and checklist for you to submit(See attached). The following documents will be required for a submittal: • Completed application • $270.00 application fee • Three 8" x 11" sheets containing color and material palette for all building elevations, including roof material, accents, wainscot, color light reflective values(LRV) We also observed the removal and replacement of landscape trees in front of this store. Your submitted PAD Amendment and Sign Criteria are two sign-related applications that require approvals from different deciding bodies. The PAD Amendment requires a recommendation from the Planning and Zoning Commission (9/18 PZC Meeting) and an approval by the Town Council (10/3 TC Meeting) . The submitted Sign Criteria requires an approval from only the Conceptual Design Review Board (10/9 CDRB Meeting) , who's decision is appealable to the Town Council. The HOA supports our change and we have their approval. Is it standard to have a Planning and Zoning, Town Council and Design Review Board hearing for this type of request? Our bids came in and we're $90K over budget because of the fuel canopy requirements. At this point I'm not sure if it makes sense for me to make several more trips down there. Every time i think the Town is trying to help, something comes up and it ends up costing more. I knew there was a Town Council Meeting for the signage but wasn't aware of the CDRB until yesterday. Please be aware I need to make cost saving changes or we can't make this work. I'm very open for suggestion, with the exception of our pylon signs. Everyone has worked very hard on this and I want to thank all of you. Hopefully we can figure this all out. 1 Mayes, Patty From: Kate/Jim Harrison [ Sent: Thursday, October 04, 2012 7:29 AM To: Hiremath, Satish Cc: Williams, David; Hayes, Patty; Arellano, Rosevelt; Bums, Brendan; Garner, William; Homat, Joe; Waters, Lou; Snider, Mary; Zinkin, Mike Subject: Fwd: Fry's Fuel Center etc Mayor Hiermath- Thank you for your spirited comments at last night's Council Meeting about "trust." I could not agree more, and I sincerely hope that I have clearly and consistently conveyed same to you and to Council over the past months. We have been heard throughout the approval process for the Fry's Fuel Center, our views have been carefully considered, and we accept your decisions. You and the Council certainly have my trust as well as my profound respect. And I too was most unhappy with the implications made last night with respect to the professionalism of Town Staff who I have come to know as highly responsive, thoughtful, and committed. Because I will again be on travel at the next Council meeting, I have compiled my thoughts on Fry's & the proposed monuments below. I absolutely TRUST you, Council and Town Staff to consider these points in coming to your decisions, and I thank you and your colleagues for that and for your continued hard work on behalf of the Town. (1) I thoroughly agree with your view that less is more when it comes to the number of monuments on La Canada; while I applaud the comments of Mr. Burns, I too enjoy breathing through my nose. . . (2) I admit to struggling with the clear message that the visual appeal of these 2 centers has been forever compromised; but the new signage on the Food Store launched without warning and I do want confirmation when Patty Hayes returns that it meets code; similarly, I do not want to see a pass given to the design of the combination signs simply because there is no existing code; combination signs should be held to a standard that is consistent with the intent of existing standards (e.g., fuel prices not to exceed the height to which they are limited by existing code for fuel signs) ; (3) I see Fry's ask for the fuel sign on Lambert as consistent with a predatory approach to the Valero business and, consistent with my comments in the CTA, urge you to plan ahead for the rapid demise, reclamation and re-purposing of that site; (4) I have lost all confidence in this Fry's as a good neighbor, but, given the difference in compliance between the 2 stores in town, am not convinced that this is a corporate problem; my suggestion is to escalate the compliance issues once and for all (including the latest violation around overnight illumination of the new signs on the food store) ; my guess is that Dick Johnson might get this done on behalf of the Town in a single phone call.. (5) re: design consistency with existing monuments, the comments last night, along with Bill Adler's suggestion of bringing the 2 owners together to collaborate on signage, were spot on; why not appeal to Fry's and the landlords to get together on this instead of continuing to push, degrade, push...? As always, please let me know if there is anything that I can do to help. Thank you again for your time & consideration. TOWN OF ORO \/ALLE`/ CONCEPTUAL DESIGN RE\/|EVV BOARD Paqe 3 of 3 The Marketplace is a Territorial/Spanish Colonial design with arched entry portals and red clay tile roofs. The stucco colors of the building coordinate with the adjacent Mercado buildings which have also been incorporated into proposed monuments sign color. The proposed wall sign colors will provide econtrast to color of the building. w Section 2.1./ 4. Location and placement Vf building mounted signs shall bo /nhgQ/a/ed into building architecture. Building signs shall be consistent Ili terms of materials and construction The buildings in both developments have been built to provide adequate space for tenant wall signs with their varied roof|ineo and parapet walls. w Section 2.1.F.5. Mercado'y previously approved Sign Criteria allows corporate colors for 50% of the allowed sign area and the proposed criteria continues that allowance. The Marketplace proposes the use of eight (8) colors for the monument signs and eight (8) colors for use on the wall signs. Although different colors are proposed for the sign letters of each development, the colors for the structural components of the monument signs are similar and coordinate with the colors of the buildings in both developments. Condition 1 in Attachment 1 will apply to this criteria to ensure the same color im used for each line Vfcopy. CONCLWS|ON/RECODHN0END/\T|CJN: The CDRB should closely consider the design standards, highlighted herein, in evaluating the proposed sign criteria. The criteria should be approved if the board finds compliance with these standards.
