PLANNING STAFF REPORT TO THE BOARD OF ADJUSTMENT
From: David A. Williams, Senior Planner
Date: April 28, 1992
Re OV10-92-2 BAILEY REQUEST FOR VARIANCE TO THE HEIGHT RESTRICTION
OF THE R1-144 DISTRICT
Summary:
:
Rickard Bailey is requesting a variance to the height restrictions of the Ri-
144 Zoning District which peLinits only single story houses no taller than 18
feet. The property for which the variance is requested is located at 9382 N.
Calle Buena Vista in the Linda Vista Citrus Tracts. This property is
approximately 4.8 acres in size and is abutted on the east by property owned
by Amphitheater School District, on the north by a 5 acre single family lot
with an existing residence, on the west by a 5 acre lot with an existing
residence, and on the south by a 40 acre parcel with an existing residence.
The parcel may be characterized as extremely flat with moderate to heavy
vegetative densities.
The applicant is requesting a variance in order to construct a single family
residence which incorporates two stories over approximately one-quarter of the
building. The proposed maximum height of the residence is 28 feet at the peak
of the roof. The majority of the house height lies at about 18 feet.
The applicant states that the two-story house is requested in order to reduce
the size of the footprint of the home, thereby minimizing the impact on the
vegetation on the lot . Further, the applicant believes the house has been
sited to avoid blocking views of the existing neighbors. Staff has inspected
the lot and generally agrees that the two-story portion of the house will not
impinge upon the views from the existing neighboring residences.
When considering the request for variance, the Board of Adjustment needs to
review the following findings:
A. That there are special circumstances or conditions applying to the
property referred to in the application including its size, shape,
topography, location or surroundings which do not apply to other
properties in the district; and
B. That special circumstances were not created by the owner or applicant;
and
C. That the authorizing of the variance is necessary for the preservation
and enjoyment of substantial property rights; and
D. That any variance granted imposes such conditions as will assure that the
authorizing of the adjustment shall not constitute a grant of special
privileges inconsistent with the limitations upon other properties in the
vicinity and zone in which such property is located; and
Report to BOA
OV10-92-2
page 2
E. That the authorizing of the variance will not be materially detrimental
to persons residing in the vicinity, to adjacent property, to the
neighborhood or the public welfare in general.

Chairman Gilman opened the public hearing.
David Williams, Senior Planner, said all property owners were
notified of the hearing and Staff has received letters of support
from the existing neighbors, with the exception of CDO who usually
does not respond to these issues, and Mary Tellez who gave verbal
support of the variance. Mr. Williams said this is a request in
the R1-144 Zoning District which permits only single story houses
no taller than 18 feet. The property is 4 .8 acres abutted on the
east by property owned by Amphitheater School District, on the west
by a 5 acre lot with an existing residence, and on the south by a
c40O acre parcel with an existing residence. The parcel is extremely
flat with moderate to heavy vegetative density.
Mr. Williams said the house will have a maximum height of 28 ft. at
the peak of the roof. The majority of the house lies at about 18
feet. The two-story house will reduce the size of the footprint of
the home, thereby minimizing the impact on the vegetation on the
lot. The house has been sited to avoid blocking views of the
existing neighbors. Staff has inspected the lot and generally
agrees that the two-story portion of the house will not impinge
4/29/92 Minutes, Regular Session 2
upon the views from the existing neighboring residences. Mr.
Williams said he does not have a problem with this request.
Rickard Bailey, applicant, said there are seven members in his
family, requiring at least five bedrooms. They have chosen as a
design a house that has architectural precedence in the ranch homes
built in Arizona and New Mexico in the late 19th and early 20th
centuries. These residences are characterized by 11 stories,
porches, and overhangs to protect the windows and provide shading
from the sun. They are described as 11/2 story because only part of
the home protrudes above the one story plain of the house. The
center section of the house will have the 1 story to provide
sleeping quarters and more efficient heating, cooling and storage.
The lot is heavily vegetated and they wish to have views of Pusch
Ridge by rising above the heavy vegetation. The primary reason for
choosing this design is to minimize the impact on the ground
itself. In being sensitive to the impact upon the area the house
was sited so it will have minimum impact on the neighbors. Mr.
Bailey said each of the neighbors gave their support and submitted
documents to the Town, with the exception of Mary Tellez who gave
verbal support.
Mr. Bailey informed the Board that his company is an architectural
design and publishing company that has been in business for over 50
years. His home, when complete, will be professionally
photographed and used as an example of their architecture in
publications such as House Beautiful and Decorator Remodeling and
their own Home Planner books. Mr. Bailey has both a personal and
professional interest in doing this home very well. The house and
land when complete will be valued between $550, 000 - $570, 000 and
will add good value to the neighborhood and a quality residence to
Oro Valley.
Mr. Williams noted that the lot is landlocked, it doesn't front on
any of the public streets. This is down a private drive or access
easement.
There being no further comments, Chairman Gilman closed the public
hearing.
A MOTION was made by Vice-Chairman Myers to APPROVE the request for
variance OV10-92-2 in that it does have special circumstances
regarding its topography and its dense vegetation that they are
working to try and preserve. That the circumstances were not
created by the applicant, he is trying to design and improve with
sensitivity for the area. That it is necessary for him to house a
number of people in his family in a reduced footprint and it makes
sense to try and achieve it this way. It is clear that he is not
infringing on the rights of his neighbors to have views across the
property so that he has gained support of all properties
surrounding him except for the school site which Mr. Williams
indicated does not usually respond. This is sufficient criteria
4/29/92 Minutes, Regular Session 3
that has been met to grant the variance. MOTION SECONDED by Member
Hershberger and UNANIMOUSLY carried 3 - 0.

NECESSARY:
We wish to build a 1-1/2-story house with maximum grade to roof height of
28 feet. This style of house, with two bedrooms on the top floor, is a more
efficient, economical way to house our family of 2 adults and 5 children and
saves land area for natural vegetation over the same size one-story. The
19th Century Terretorial farmhouse style is in keeping with early Southwestern
architecture and the low roof profile will have minimal impact on the area.
We will carefully site the house to avoid blocking views of neighbors. The
value and professionalism of the house and landscaping will add greatly to
the neighborhood. The site is 600' down a private lane and away from any
public roadway. There is ample precedent_1_ in this area for such a variance.

Dear Sirs/Mesdames :
As the new owner of the property at 9382 N. Calle Buena Vista, I am hereby
requesting a variance to Section 6-203D of the Oro Valley Zoning Code.
On this flat, heavily vegetated, 4.77 acre piece of property, my wife and
I would like to build a personal family home of approximately 4,000 square
feet to house ourselves and five children, as well as occassional guests in
a detached garage and guest house of approximately 2,000 square feet.
Paul R. Olson, A. I .A. , of Desert Living, Inc. , in Tucson has helped us design
a Southwestern Ranch house that has architectural precedent in the sprawling,
low-slung ranch houses that dotted the Arizona and New Mexico territory in
the late 19th and early 20th centuries.
We chose this 1-1/2-story design because it provides primary livability on
the first floor (like a ranch house) , but with sleeping quarters for three
children upstairs on a half-story. This allows us more room for our large
family without an overly large one-story "footprint" on the land and with
minimal disturbance of the natural vegetation and surrounding environment.
This style of home also minimizes the roof height for a second story and maintains
a lower, more acceptable building profile.
In order to build this house, we require a variance to the existing code which
would allow us a maximum grade to roof height of 28 feet. However, as you
can see from the attached drawings, only a small portion of the upper story
would extend to this height. All dormer windows, porch projections and the
neighboring garage/guest house building will stay at or below the 18' height
limit required by code.
In building this house, we will be sensitive to the desert environment and
the views and feelings of surrounding neighbors. We plan to prepare a site
plan and scale model of the house to present to interested neighbors within
the next few weeks and to bring to the public hearing on this matter. I might
also point out that the site is quite secluded, located 600 feet down a private
lane off Calle Buena Vista and the house will not be seen from any public
roads. The home will also be surrounded by natural vegetation and will offer
no blockage of Pusch Ridge views for any adjoining property owners.
You can be assured that this property will be designed and built with the
utmost professionalism and care. My company, which employs a licensed architect
and a number of registered draftsmen, has been designing homes and selling
construction drawings to the public for nearly fifty years . We publish Home
Planner, a quarterly home-planning magazine, and supply the home designs and
editorial material for a number of publications, including House Beautiful ,
Better Homes & Gardens and Decorating/Remodeling. Our house in Oro Valley,
when furnished and landscaped, will be professionally photographed and used
as an exemplary design in a number of these national publications.
Therefore, as you can see, I have both a personal and professional interest
in building this home carefully and sensitively. I feel that there is ample
precedent in Linda Vista Citrus Tracts for such a request and the variance,
if granted, will allow us to build a house that will be in keeping with the
architectural spirit of the area and will add significant value to the neighborhood
and surrounding properties.
Thank you for your time and attention to this request.

Note per Rickard Bailey:
I spoke with Mary Tellez by phone on 4/12/92. I explained the project briefly
to her and indicated the total height of the house I desired to build. She
said: "I live on 10 acres and we're pretty self-contained here. I don' t
really care what you build on the lot to the north as long as you meet set-
back requirements. I don' t care if the house is 28' tall . " I asked if
she would sign a note showing no objection to the variance and she said
she did not want to sign anything or get further involved.
Later, on 4/20/92, while a percolation test was going on at the property,
Mary Tellez and her son did come over to inspect the site plan and view
the height marker on the lot. Again, they were satisfied and registered
no objection to the placement or height of the house.
