(Plans of the proposed signage can be viewed in the office of the Deputy Clerk. ) /2e4) Steve Hagedorn Zoning Administrator Town of Oro Valley PUB: The Daily Territorial 7/09/90 PLANNING STAFF REPORT TO THE BOARD OF ADJUSTMENT DATE: July 24, 1990 FROM: David Williams, Town Planner RE : OV10-90-3 Steam Pump Ranch Temporary Sign - Request for Variance SUMMARY: This is a request by the Steam Pump Ranch Joint Venture for a variance to the Oro Valley Sign Code provisions contained in Sec. 12-602. The Steam Pump Ranch property on which the proposed sign is to be placed is located at 10,800 N. Oracle Road, across from the Allied AiResearch facility, along the west side of Oracle Road. The Oro Valley Zoning Code permits up to a 32 square foot, 8 foot high, temporary sign on private properties fronting on Oracle Road. In other parts of Town, the maximum square footage permitted for signs is 16 square feet with a maximum height of 6 feet. All signs must be located on private property and set back from the right-of-way line a minimum of 15 feet. The applicant is proposing a temporary monument sign which measures 8 feet in height by 16 feet long and is double-sided. The total square footage of the proposed sign would be 256 square feet, or 128 square feet per side. Under the Town's Sign Code, a maximum of 64 square feet for both sides is permitted. The applicant deems the variance necessary for the following reasons: 1. The permitted 32 square foot sign cannot be read easily from a vehicle travelling on Oracle Road at 55 mph, and 2. The existing right-of-way width and setback requirement combine to place the sign 50 feet from the edge of pavement. This is a public hearing and, as such, the property in question has been posted by Town staff and an advertisement has been placed in the Daily Territorial in order to provide the required public notice. All property owners within 300 feet have been notified by mail and, to date, we have received no written or verbal comments regarding this case. Planning Staff Report OV10-90-3 page 2 RECOMMENDATION: As provided for in the Oro Valley Zoning Code, a variance shall not be authorized unless the Board of Adjustment makes the following findings per Section 1-508: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. That special circumstances were not created by the owner or applicant; and C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. In response to comments from the Board of Adjustment, we have reduced both the height and width of the sign we propose to construct. I have attached four copies of this revised plan for your review. In addition, I have revisited the site and observed that the property is 4-5 feet lower than U.S. 89; that the location of the sign is fixed because of an existing traffic signal ; and that further, it is good for public welfare in that it creates less confusion on a busy roadway in Oro Valley. With respect to the lifespan of temporary signs, I would offer the following information. Temporary signs require an annual permit. This permit is renewed by the Zoning Administrator, at his discretion. There is no limit in the sign code on the number of renewals which may be granted. Contrary to information presented at the last meeting, permanent signage may be taller and contain more square footage than provided for in the code. For this class of signs, the 5' height and 40 square foot limitations only apply to the actual copy on the sign. A lamer wall, for example, may be incorporated in the sign. Further, the DRB is permitted to grant a modification to the sign standards of the code through a duly noticed public hearing process. The applicant has submitted a revised design which includes a smaller sign than that considered at the last meeting. The new proposal shows a sign containing a total of 84 square feet, and 6' in height. Additional information provided by the applicant indicates that the site of the proposed sign lies 4-5 feet lower than the pavement of Oracle Road. A site inspection reveals that the property is, in fact, lower in elevation than the adjacent roadway. Staff's opinion is that, regardless of the size of the proposed sign, in order to grant a variance, the applicant must demonstrate the unique conditions of his property which merit the granting of the request. Ass't. for David Williams, Senior Planner RE : Results of Sign Survey - Oracle Road Corridor On August 1, 1990, I performed a sign survey in response to a request from Mr. Thresher, BOA member. The results were as follows: Along Oracle Road, through the entire stretch within the Town, there are thirty-three temporary signs. Of these, twenty-four are "legal" in terms of size, color and location. The other nine are either illegal, or questionable, due to the color of the sign and/or the location. ` 1 4 DAVID: Lifespan of Temporary Signs - none. renewable on an annual basis, with no limit on the amount of renewals permitted. Temporary Development Sign (this is what Steam Pump's would be) limited to 8 feet in height and 32 square feet. BUT If they installed a permanent (or permanent-looking) entry-way sign, they could have 40 square feet of text on a wall of unlimited size (SH's interpretation) . The text could not extend higher than 5 feet above ground level, and could be double-sided. The only problem with this might be that such a sign is to identify, among other things, a commercial plaza, but it ain't there yet. But, it doesn't say it HAS to be there either! !
