DATE: October 30, 1990
RE : OV10-90-4 MACO Asset Management Request for Over-Sized Signs
The Villages of La Canada
The MACO Asset Management Company, on behalf of the builders in The
Villages of La Canada, is making a request for a variance to the Oro
Valley Sign standards in order to permit the erection of temporary signage
at the two entrances of The Villages of La Canada located on La Canada
Drive, south of Lambert Lane and, on Lambert Lane, approximately one-half
mile east of La Canada Drive. A plot plan showing the intended location
of the signs is included in your packet. Both of these signs would be
located on The Villages of La Canada property. The proposed signs would
be ten feet tall and eight feet wide for a total of eighty square feet.
The signs would allow consolidation of all builders within The Villages of
La Canada into one, single sign. Currently, four companies are building
in The Villages of La Canada, including Dominion Homes, The Doucette
Company, US Home and Vision Homes.
The property on which the sign is proposed to be constructed is currently
part of a landscaped common area of The Villages of La Canada.
Per Sec. 12-602C, Developer, Contractor Identification Signs, no. 4, "Such
a sign shall have a maximum size of sixteen square feet, maximum height of
six feet and must be set back from the property line a minimum of fifteen
feet".
Under the Oro Valley Sign Code, it may be possible for each builder to
construct similar sixteen square foot signs spaced one hundred feet apart.
Planning staff feels that the proposed sign has some merit and should be
carefully considered. The signs, as proposed, and depicted in the
illustration included in your packet, if approved, would be required to
meet all other Oro Valley requirements, including color and setback.
When reviewing a request for variance, the Board needs to consider the
following findings:
A. That there are special circumstances or conditions applying to the
property referred to in the application including its size, shape,
topography, location or surroundings which do not apply to other
properties in the district; and
B. That special circumstances were not created by the owner or applicant;
and
C. That the authorizing of the variance is necessary for the preservation
and enjoyment of substantial property rights; and
Planning Staff Report to BOA
10-30-90
page 2
D. That any variance granted imposes such conditions as will assure that
the authorizing of the adjustment shall not constitute a grant of
special privileges inconsistent with the limitations upon other
properties in the vicinity and zone in which such property is located;
and
E. That the authorizing of the variance will not be materially
detrimental to persons residing in the vicinity, to adjacent property,
to the neighborhood or the public welfare in general.

REQUESTING A VARIANCE.
7. STATE BRIEFLY AND FULLY THE REASONS WHY THE VARIANCE IS DEEMED NECESSARY:
Currently, there are four homebuilders and the owner operating at the Villages of
ti.
La Canada. In a joint effort to prevent a cluttering of five seperate, allowable
and permitable signs at each entrance, the homebuilders and owner have agreed to a
compromise which would make use of a single sign at each entrance. Under the pro-
posed compromise, a single 8'x10' sign would mark each entrance to the community,
listing the name of the community and the four builders. Granting of this variance
would prevent a "free-for-all" cluttering of signage along Lambert Lane and La
Canada Drive.

RE : Signage at The Villages of La Canada
Dear Sirs:
On November 8, 1990, the Oro Valley Board of Adjustment approved a request
to place two 80 square foot signs at the entrances to the above-referenced
subdivision. These signs are to be erected in accordance with the plans
prepared by Territorial Sign Company which are on file in our offices.
Today, a Territorial Sign representative made application to erect these
signs. The annual fee for the two temporary signs will be $652.00 each,
or a total of $1,304.00. This figure may be pro-rated for the balance of
1990, however, so to obtain the permit for 1990, you must remit $108.66.
Should you so desire, you may remit $1,412.66 to keep the two sign permits
in effect through December of 1991.
If $108.66 is remitted at this time, you may expect an invoice for the
full annual fee of $1,304.00 in January of 1991.
Upon receipt in either amount, I shall notify Territorial Signs that the
approved signage may be erected and will forward to you copies of the
permits for your records.
Thank you for your cooperation in this matter.
Sincerely,
Steve gedorn

RE: Temporary Signage at the Villages of La Canada
Sign Variance Case OV10-90-4
Dear Mr. Alcala:
It has come to our attention that the two temporary signs approved by the Oro
Valley Board of Adjustment have been erected. The purpose of this letter is
to inform you that these signs have not been located properly per the approved
plans submitted to the Town. These signs have approval only for location on
the Villages of La Canada property with a 20 foot setback. Upon inspection,
it is obvious that both signs are located in the public rights-of-way of La
Canada Drive and Lambert Lane. This is unacceptable and the signs must be
removed from the right-of-way immediately.
If you have any questions regarding the location of the right-of-way lines,
please contact our office. Please make arrangements to have these signs
relocated by January 2, 1991. Your cooperation in this matter is appreciated.
Sincerely,

RE: Temporary Signage at the Villages of Ta Canada
Sign Variance Case OV10-90-4
Dear Mr. Fields:
It was a pleasure to meet with you on Monday regarding the Villages of La
Canada signage. I have reviewed your case with the Town Engineer, Jim Kriegh,
and Zoning Administrator, Steve Hagedorn, and they have instructed me to
inform you that the two subject signs must be removed from the right-of-way
by January 24, 1991 and relocated onto private property as approved by the
Board of Adjustment. I realize that this may mean that the Lambert Lane sign
might be eliminated entirely.
If you are aware of any other signs within Oro Valley which may have been
placed within public rights-of-way by your staff or clients, you or your
clients should arrange to have them relocated onto private property in
accordance with our Sign Code. We are in the process of reviewing all signs
within the Town and will be notifying all owners of signs which are illegal
in any respect.
We appreciate your cooperation in this matter.
Please contact me or the Town Engineer, Jim Kriegh, if you have questions
concerning the Town regulations regarding location of signs in public rights-
of-way.
Sincerely,

PLANNING STAFF REPORT TO THE BOARD OF ADJUSTMENT
DALE: April 23,1991
RE: OV10-91-01 La Reserve Community Association Request for Over-
sized Sign for La Reserve Development
The La Reserve Community Association, on behalf of the builders in La Reserve,
is requesting a variance to the Oro Valley Sign Code standards in order to
permit the erection of a temporary sign along Oracle Road, approximately 400
feet south of La Reserve Drive. A plot plan showing the intended location of
the sign is included in your packet.
The proposed sign would be eight (8) feet wide and sixteen (16) feet in height
for a total of one hundred twenty eight (128) square feet in area. Per Sec.
12-602B, Development Signs, each development is permitted one such sign,
measuring thirty two (32) square feet in area and a maximum of eight (8) feet
in height, on each street that the development fronts.
The proposed sign would allow the developers in La Reserve (currently nine
subdivisions under development) to consolidate all of their permitted signage
onto one sign.
This sign, as proposed, and depicted in the illustration included in your
packet, if approved, would be required to meet all other Oro Valley code
requirements, including color and setbacks.
When reviewing a request for variance, the Board needs to consider the
following findings:
A. That there are special circumstances or conditions applying to the
property referred to in the application including its size, shape,
topography, location or surroundings which do not apply to other
properties in the district; and
B. That special circumstances were not created by the owner or
applicant; and
C. That the authorizing of the variance is necessary for the
preservation and enjoyment of substantial property rights; and
D. That any variance granted imposes such conditions as will assure that
the authorizing of the adjustment shall not constitute a grant of
special privileges inconsistent with the limitations upon other
properties in the vicinity in which such property is located; and
E. That the authorizing of the variance will not be materially
detrimental to persons residing in the vicinity, to adjacent property,
to the neighborhood or the public welfare in general.
