o0°ROB. f (1417 iram IZc January 5, 1990 TO: All Builders doing work in the Town of Oro Valley. SUBJECT: Handrails The Uniform Building Code (1985 edition) Section 3306 (j ) states that "The handgrip portion of handrails shall be not less than 1; inches nor more than 2 inches in cross sectional dimension or the shape shall provide an equivalent gripping surface. " There have been requests for variances of the 2 inch dimension to 25/8 inches for oak railings. There are numerous existing installations employing the 25/8 inch railings. These installations do not meet the intent of the code. The Town contacted the adjoining 'local jurisdictions as well as the ICBO office in Whittier and found that they all consider the 2 inch maximum dimension to be lust that. Consequently the Town will enforce this requirement of the code. Because of the confusion over this item, the Town will permit those installations already permitted to employ the 25/8 inch railings. Any new building permits issued must conform to the 2 inch handrail requirement. - Robert J. • Maassen Building Official Town of Oro Valley Pi • RECE VEO JANU810 Ana'd............ pg.2 Artistic Stairs Inc. CIRCULAR STAIRS AND SPECIALS 738 South Perry Lane,#5 7041 N.Camino Martin#137 Tempe,Arizona 85281 Tucson,Arizona 85741 (602)968-5953 (602)744-9643 RECEIVED JAN 1 7 1990 January 15,1990 TOWN of ORO VALLEY To: Town of Oro Valley Subject: Acceptable Handrails. The Uniform Building Code ( 1985 edition )Section 3306 (j) states that " The handgrip portion of handrails shall be not less than 14 inches nor more than 2 inches in cross sectional dimension or the shape shall provide an equivalent gripping surface." It is the interpretation of Robert Massen, Building Official with the Town of Oro Valley, that ". . . there are numerous existing installations employing the 2 5/8 inch railings. These installations do not meet the intent of the code." Artistic Stairs Inc. feels this interpretation considers only the cross sectional dimension, and does not take into account rail profile and shaping methods which provide an equivalent gripping surface. The 2 5/8 inch sample, submitted for your approval, not only provides an equivalent gripping'surface; but one which is in fact safer. In addition, " The town contacted the adjoining local jurisdictions as well as the ICBO office in Whittier and found that they all consider the 2 inch maximum dimension to be just that." Artistic Stairs Inc. has contacted both Pima County and the City of Tucson Building Officials, and obtained approval of the 2 5/8 inch handrail based on providing an equivalent gripping surface. In contacting the ICBO office in Whittier, the ICBO was unable to strictly define what handrail profiles provide an equivalent. gripping surface; and will not take a stance.on this issue. Artistic Stairs Inc. respectfully submits that the 2 5/8 inch sample, does provide an equivalent gripping surface as said in the Uniform Building Code ( 1985 edition ) Section 3306 (j) and asks for your approval. Sincerely, Bill Burke Artistic Stairs Inc. pg• 1 Artistic Stairs Inc. CIRCULAR STAIRS AND SPECIALS 738 South Perry Lane,#5 7041 N. Artistic Stairs Inc. respectfully submits the names of the eight cities or towns within the greater Phoenix metropolitan area which have approved the 2 5/8 inch handrail based on providing an equivalent gripping surface as said in the Uniform Building Code (1985 edition) Section 3306 (j). In response to the decision of the Town of Oro Valley Building Officials, I concur with Artistic Stairs Inc. position that the 2 5/8 inch handrail conforms within the intent of the Uniform Building Code ( 1985 edition ) Section 3306 (j). ADJOURNMENT • MINUTES OF THE ORO VALLEY BOARD OF ADJUSTMENT SPECIAL SESSION MARCH 30, 1990 CALL TO ORDER: 8 :45 a.m. PRESENT: Darrell Gilman, Chairman Terry Lon Myers, Member Hayward Thresher, Member EXCUSED: Freddy Hershberger, Member Richard Starkey, Member Chairman Gilman welcomed Mr. Hayward Thresher to the Board of Adjustment. He was appointed by the Mayor and Council to serve a two year term on March 28, 1990. Mr. Thresher served on the Board of Adjustment in Florida. APPROVAL OF MINUTES - SEPTEMBER 26, 1989 A MOTION was made by Vice-Chairman Myers and SECONDED by Member Thresher to APPROVE the minutes of the September 26, 1989 meeting. MOTION UNANIMOUSLY carried 3 - 0. PUBLIC HEARING OV10-90-1 - APPEAL OF THE BUILDING OFFICIAL'S DECISION, BY ARTISTIC STAIRS, INC. , REGARDING THE 1985 UBC, SECTION 3306(J) REGARDING HANDRAILS WHICH STATES THAT THE HANDGRIP PORTION OF HANDRAILS SHALL NOT BE LESS THAN 1 1/4 INCHES NOR MORE THAN 2 INCHES IN CROSS SECTIONAL DIMENSION OR THE SHAPE SHALL PROVIDE AN EQUIVALENT GRIPPING SURFACE Bob Maassen, Building Official, said the applicant is requesting to use a handrail a bit larger in size than the Building Code would allow. The 1985 UBC specifically states that the handgrip portion of the handrails shall not be less than 1 1/4" nor more than 2" in cross sectional dimension, or the shape shall provide an equivalent gripping surface. Mr. Maassen said the key word is providing "an equivalent gripping surface" , because most handrails that are on top of a guardrail. Mr. Maassen said wide banisters used to be used, however, the latest thinking on handrails is that it should be of a size and shape that are easily gripped by adults, young children and the handicapped. Mr. Maassen said he had a few arthritic people sample the wider handrails that Artistic Stairs wants to use, and these people responded negatively as to how the handrails felt as far as safety. Therefore, Mr. Maassen said he determined it would be best to conform with the Building Code and reduce the handrail to near 2" or to an equivalent, of 2 3/8" . Mr. Maassen said he has no problem with the applicant using 2 5/8" on their guardrail, but if they want to do that, then they need to have 3/30/90 Minutes, Special Session 2 another handrail on the sidewall that would meet the Code requirements for a grippable surface. Mr. Maassen said he feels that is where the dispute is. Mr. Maassen said historically they have had as much as 2 3/4" or 2 5/8" in use, however, it has never been challenged as to whether or not it meets the Code. Mr. Maassen and Mr. Burke (the applicant) sent samples to the International Conference of Building Officials, ICBO, in Whittier, CA, asking them to make a ruling on it. Mr. Maassen said he also spoke with a representative of ICBO and he was informed that they had never approved any handrail larger than 2 3/8" . After the ICBO representative examined the samples, he determined that it was conceivable that they would approve something that size, however, they wanted to leave it up to the local Building Official . Mr. Maassen said his position still stands, and it is a matter of safety. He doesn't want to imply that this is not a good railing and safe for most people, but the Town must consider children and handicapped. Bill Burke, Artistic Stairs, said they share Mr. Maassen' s opinion with regard to the handrails providing a safe gripping surface for all parties involved. Mr. Burke said Artistic Stairs feels their handrail provides a safe gripping surface. Mr. Burke said the reason for the 2 5/8" size is because the size spindle they use is a standard size spindle in the industry and to accommodate the spindle they must provide a surface underneath that will give them enough room to mount the spindle. Mr. Burke said their size rail provides such a surface, conforms to the Code and matches their spindle. The Board examined the sample staircase provided by Artistic Stairs to get a feel for the dimensions and discussed same with Mr. Burke. Mr. Burke said their rail is meant for single-family homes and is in use within the Town of Oro Valley in six different subdivisions. Vice-Chairman Myers said he feels the choice of handrails placed in a home should be up to the individual purchasing the home. Mr. Maassen agreed that a home should not be designed for handicapped individuals only, however, the Code dictates the size of the handrails. Mr. Maassen said Oro Valley has been a leader in safety and feels that other jurisdictions will follow their decision. Mr. Burke said they agree with the safety issue, and pointed out that they used to use a 3" rail changed over to the 2 5/8" gripping surface to comply with the cross sectional requirements 3/30/90 Minutes, Special Session 3 and the intent of the Code. Mr. Burke said they arrived at the 2 5/8" rail with the help of the City of Tucson and Pima County, Leroy Sayre (formerly of the ICBO) , and Jim Singleton. Mr. Burke said he contacted Mr. Sayre and Mr. Singleton and they feel the 2 5/8" surface provides an equivalent gripping surface within the intent of the Code. Mr. Maassen said he also checked with the City of Tucson and Pima County. Phil Seaders, City of Tucson's Chief Plan Examiner, assured him that something closer to 2" is closer to the intent of the Code. Mr. Maassen said the Building Official with Pima County assured him he feels the same. Mr. Maassen said he asked Mr. Burke to obtain a written letter from Mr. Sayre and/or Mr. Singleton, but neither of them would put it in writing that 2 5/8" is adequate. Kevin Craig, Artistic Stairs, said Mr. Maassen is right, the final decision comes down to the local jurisdictions. However, according to the UBC and what is acceptable throughout Arizona, Artistic Stairs has an equivalent gripping surface which is safe. Mr. Maassen reviewed the samples on display, and said the 2 1/4" is closer to the intent of the Code. Vice-Chairman Myers asked if the UBC contains verbage "or the shape shall provide an equivalent gripping surface"? Mr. Maassen replied yes. Member Thresher said if this request is approved, how will handrails be selected in the future? Mr. Maassen said it would be difficult and his decision would continue to be challenged in front of the B.O.A. Mr. Maassen pointed out once again, that it is a matter of safety, and the letter from the ICBO states . . . final determination of the appropriate shape should be made by the local Building Official . Mr. Burke said there is a code entitled Cable (Conference of American Building Officials) Code whose purpose is to eliminate conflicts and duplications among the model codes to achieve national uniformity. Mr. Burke said the latest edition of the Cable Code states "the handgrip portion of the handrail shall not be more than 2 5/8" in cross sectional dimension where the shape shall provide an equivalent gripping surface. . . " and the Code is written for 1 and 2 family dwelling units. Member Thresher said his problem is that if this were a specific building request it would be one thing, however, this is changing the entire Code. Mr. Thresher questioned whether or not the B.O.A. is the appropriate group to change the Code? 3/30/90 Minutes, Special Session 4 Chairman Gilman said as far as safety and gripping he thinks they should look further down the road as to what they decide this evening. A MOTION was made by Vice-Chairman Myers that the railings that Artistic Stairs submitted that have a nominal cross section of 2 5/8" do meet the criteria established in the Building Code which calls for 1 1/4" as a minimum and 2" as a maximum, or the shape shall provide an equivalent gripping surface. Vice-Chairman Myers said the basis for his determination of 2 5/8" is strictly because the shape provides an equivalent gripping surface. This is a highly subjective matter which apparently Artistic Stairs has gone out to get a scientific opinion by people that evaluate these on the basis of a more thorough study than just the dimensional cross section. Vice-Chairman Myers said he feels it is that sort of effort that is necessary when the apparent dimension is in conflict with the dimensions giving that some extra step has to be made by an expert agency to give us the benefit of their expertise when we have to make a subjective determination. And so, with the latitude that is provided in here, apparently the engineers with that expertise have determined that by the provision for equivalent gripping surface the criteria has been met. MOTION SECONDED by Member Thresher, with the amendment of 2 5/8" but no larger. Vice-Chairman Myers said it provides for an equivalent gripping surface. If it was taken to the experts and it was 3" but it had a unique shape, he feels the same latitude should be available, but only if approved by an expert, such as the agencies that have reviewed these unique shapes. Chairman Gilman said the motion refers to "experts" and asked how experts are determined? Vice-Chairman Myers said he is willing to accept the agencies as being experts. Member Thresher withdrew his amendment. Vice-Chairman Myers - yes Member Thresher - yes Chairman Gilman - no MOTION carried 2 - 1. *** Chairman Gilman stated that Mr. and Mrs. Lindsay have withdrawn their request for an appeal to the Zoning Administrator's . 1. 3/30/90 Minutes, Special Session 5 interpretation of the use of a recreational vehicle as a structure for visitor's use.
