Dear Steve:
We hereby request that the sign located near Oracle Road and 1st
Avenue for the purpose of advertising the builders at Rancho
Vistoso be approved.
The sign is 8 'x16 ' . This size is necessary in order to be legible
and at the same time contain all of the builders names. Having one
sign would accomplish our goals better than having numerous small
signs for all of the builders in Rancho Vistoso.
This sign will greatly enhance our marketing program and will help
our customers find the beautiful community of Rancho Vistoso.

Dear Steve,
It is my understanding that the Wolfswinkel Group will be going
before the Board of Adjustment next week in an effort to obtain a
variance so that they may install an 8' X 16' sign at the corner of
Oracle and First Avenue.
There are numerous benefits to the community, the builders within
Rancho Uistoso, and to the Town itself in approving this variance. The
benefit to the builders is clear - the sign would provide greater
visibility (and hopefully traffic) and therefore sales could increase.
The community would have one attractive sign that conforms in size
to the other Rancho Uistoso signs already in place along Oracle. In
addition, one larger sign would be much more aesthetically pleasing
than the myriad of smaller signs the builders would almost certainty
have to put up if this request were denied.l
The town's advantage would be that in supporting the builders, by not
putting up roadblocks to their marketingefforts, the increased sales
volume would increase revenue from boh building permits as well as
sales taH.
For all of the reasons stated above, this company strongly supports
Wolfswinkel's request, and we urge you to recommend that the Board
approve this variance.

Please accept this letter as a request for approval of the variance to
permit the above-referenced sign. We feel the larger sign is absolutely
necessary to provide for the proper traffic identification. This sign
would be the same size as those existing on Oracle as constructed by the
Wolfswinkel Group, Inc. for the Rancho Vistoso project.
We know the success of Neighborhood Seven will be greatly benef i tted by
this signage, and we sincerely believe the success of this development
is greatly beneficial to the Town of Oro Valley.

SIGN ON U.S. 89
The Wolfswinkel Group, developers of the Rancho Vistoso Planned Community,
is making a request for a variance to the Oro Valley Sign Standards in
order to permit the erection of a directional sign to be located at the
intersection of U.S. 89 (Oracle Road) and North First Avenue. The sign
would be located along the east side of the right-of-way on private
property. The owner of this property is the Rooney Ranch Trust. The
proposed sign would be 16 feet tall and 8 feet wide for a total square
footage of 128 square feet. This sign would allow the consolidation of
all builders within Rancho Vistoso onto one directional sign.
The property on which the sign is proposed to be constructed is currently
vacant and is used as range land as are the parcels immediately to the
west across Oracle Road.
Per Section 12-602F, no. 3, if signs are erected along U.S. Highway 89,
the area of each sign shall be no more than 32 square feet and the
maximum height shall be 8 feet.
Under the Oro Valley Sign Code, directional signs must be spaced 100 feet
apart fruit similar signs on the same parcel of land. Therefore, in order
for the Wolfswinkel Group to display the same information as that proposed
on the one sign, four signs could be constructed, one for each builder
within Rancho Vistoso and space them over an area of approximately 300 to
400 feet on the same parcel of land. Planning Staff feels the proposed
sign has merit and should be carefully considered. The sign, as proposed,
and depicted on the illustration included in your packet, would meet all
other Oro Valley requirements, other than square footage and maximum
height.
When reviewing a request for a variance, the Board needs to consider the
following findings:
A. That there are special circumstances or conditions applying to the
property referred to in the application including its size, shape,
topography, location or surroundings which do not apply to other
properties in the district; and
B. That special circumstances were not created by the owner or applicant;
and

C. That the authorizing of the variance is necessary for the preservation
and enjoyment of substantial property rights; and
D. That any variance granted imposes such conditions as will assure that
the authorizing of the adjustment shall not constitute a grant of
special privileges inconsistent with the limitations upon other
properties in the vicinity and zone in which such property is located;
and
E. That the authorizing of the variance will not be materially
detrimental to persons residing in the vicinity, to adjacent property,
to the neighborhood or the public welfare in general.

Chairman Gilman opened the public hearing and acknowledged the
presence of the applicant.
Mr. Williams said the Wolfswinkel Group Inc. , developers of the
Rancho Vistoso Planned Community, are requesting a variance to
the Oro Valley Sign Standards in order to permit the erection of
a directional sign to be located at the intersection of U.S. 89
(Oracle Road) and North First Avenue. The sign would be located

footage and maximum height. Mr. Williams displayed a drawing of
the proposed sign.
Mr. Williams indicated when reviewing the variance request, the
Board must consider the five findings as outlined in Section
1-508 of the Zoning Code. (Five findings previously stated on
Page 2 . )
Mr. Williams said no written protests have been received as of
this date.
Member Hershberger asked what staff's recommendation on the
request is?
Mr. Williams said staff likes the idea of a consolidated sign,
they would prefer to see only one sign rather than four.
Member Hershberger asked if staff thinks the five findings apply?
Mr. Williams said per the Board's perspective, it may.
Bruce Schroeder, WLB Group representing the Wolfswinkel Group,
said due to topography the actual location of the sign will be
2-3 feet below the roadway elevation. Mr. Schroeder said when
driving down the road in a car, eye level is at about 4 1/2 feet.
When looking at a normal size sign you would look right over the
top of it. This is the reason for requesting a larger sign. The
proposed location is also a major access to their property. Mr.
Schroder noted that the Rancho Vistoso PAD allows for this size
of a sign.
Vice-Chairman Myers asked if there is an agreement with the
builders in Rancho Vistoso that they will abide by the
consolidation of one sign and not place their own signs there in
the future?
Mr. Williams said there is no guarantee of not having future
signs.
Dick Maes, Vice-President of the Wolfswinkel Group, said during
the meetings with the builders they all came to an agreement that
the proposed site would be the ideal location to have a combined
sign. As far as the future is concerned, Mr. Maes said he does
not think additional signs can be allowed in that area.
Member Starkey noted that he did not see any directional arrows
on the drawing displayed.
Mr. Schroeder said the final drawing will depict arrows,
constituting a directional sign.

Chairman Gilman asked if the builders will be under the
management of the Wolfswinkel Group?
Mr. Maes said a master marketing plan is being created for all of
Rancho Vistoso, and the builders will have to adhere to the plan.
Vice-Chairman Myers asked if the merits of the variance were to
deteriorate, what review process would be used to eliminate the
over-sized sign or not approve future signs?
Mr. Williams replied that sign permits are issued, which must be
renewed annually. At the time of renewal, the sign would be
reviewed by staff. Mr. Williams said other sign permits may be
applied for but not necessarily granted. The Zoning
Administrator reviews all sign permits, which include review of
colors and text. Mr. Williams said the variance will remain
valid and the permit will be renewed annually.
Chairman Gilman asked if the sign could be cut down to 8 x 10
rather than 8 x 16 and still have all the builders placed on the
sign?
Mr. Maes replied that if the size of the sign is cut down, it
would become ineffective and so small that a person in a car
would not see the sign.
Member Starkey stated that the theory is as traffic goes down
the hill the visual impact is such that the sign will not seem
as large as it actually is.
Mr. Schroeder agreed.
Chairman Gilman closed the public hearing.
Mr. Williams wanted to clarify for the record that the Zoning
Administrator is not recommending approval of the variance,
however he does enjoy the idea of a consolidated sign.
A MOTION was made by Vice-Chairman Myers to approve the variance
on the over-sized sign and that there are special circumstances
in topographic features that require a larger sign; that the
special circumstances were not created by the owner; and in fact
the points of entry to the project are a function of the
available roads and not something that the owner chose; also that
it does not impact the property rights of adjacent owners since
approval was granted from the major property owner where the sign
will be placed; and that the variance does not grant special
privileges inconsistent with other properties because of the
special conditions; and that further, it is materially good for
the neighborhood and public welfare in that it gives a sense of
direction and creates less confusion on a busy thoroughfare in

Mr. Williams commended Vice-Chairman Myers on his motion and
said he would like the other Board members to consider including

RE : Your Inquiry Regarding Directional Signs at North First Avenue and Oracle Road
Dear Mr. Madden:
David Williams has asked me to respond to your inquiries about two large signs, one erected
several months ago, and one just several days ago, at the above-referenced location.
As David may have mentioned to you, both these signs were approved for size and height
variances by the Town's Board of Adjustment, which is a Town Council appointed, quasi-
judicial body. The Rancho Vistoso sign was approved in 1989 and, while the original sign was
blown down some time ago, the replacement sign is legal, because it did receive a variance and
a permit has been issued, based on that variance. It should be noted that, since the Board placed
no time limit on approval of the blue sign, it can remain in place, virtually, until the
subdivisions it advertises are built-out or the property owner withdraws his permission to place
the sign at that location.
The second sign, that directing traffic to the Builders' Showcase event, to be held in late
January, has a finite life, however. The variance approval, and the permit for the sign, expire
on March 31, 1996. The Town's Zoning Inspector will ensure that this sign is removed
promptly.
I hope this clarifies your questions. The Town's Planning and Zoning Department Staff cannot
violate, nor act in any way to negate, a decision rendered by the Oro Valley Board of
Adjustment.

Dear Ms Mason-Frew
Thank you very much for your letter of October 17, containing an
explanation for the existence of the two billboards along the
planned Scenic Corridor on Oracle Road and First Ave.
Since I plan on giving a report on this matter at the La Reserve
Annual Community meeting in November, I would greatly appreciate
your assistance in helping me answer some of the questions that I
anticipate will be asked.
1) I was told, by either Don Chatfield or Kevan Kish or both,
that neither Vistoso nor Oro Valley could find a record of the
original 1989 granting of the variance. Did they find it ?
If they did, I would presume that all of the variances to the
then existing code, that were to be waived, such as height,
color, size etc, etc are noted. I would also think that the
location of where the sign would be placed would also be
included. Is that document a matter of public record ? If so, it
would certainly help me explain to about three hundred very angry
Oro Valley Voters, just why we have the two largest real estate
signs in Oro Valley placed in the middle of the proposed " Scenic
Corridor " and at the entrance to our community.
2) You mention that the original sign was blown over. In checking
around, I can find no one that can remember that there ever was
an original sign. Is there any way to verify that in fact, the
sign was ever erected and if so, is the present sign the same
size ?
3) As for the board not inserting a time frame for the original
variance. Under the old code and probably the new code too, " Sec
12-201-H, Permit Expiration, " the first sentence states that. . . "
Every permit issued under this chapter shall expire by limitation
and become null and void if the work authorized by such permit is
not completed within a 180 days from the date of such permit. " If
the sign blew down, it obviously was not satisfactorily completed
therefore a request for an extension or renewal would seem to be
mandated.
Another way of approaching this problem would be; The original
granting of a variance was for the specific sign that blew down,
and could not possibly apply to the erection of another sign six
years later.
There are several other points that I am sure I will be asked
about this sign but if indeed, Vistoso was granted a variance in
1989 and it can be proven, I will just refer all those questions
and complaints to what ever Oro Valley Official you suggest.
As for the other sign that is advertising a Builders Showcase
Event. May I categorically state to the La Reserve Residents,
that it will be taken down by March 31, 1996 ? The copy on the
sign says that the Showcase runs from " January 19 through
February 11, but has omitted the year.
By the way, I am a tad curious as to the rational for allowing a
variance for that sign in the first place. It seems to me that
what ever it was, it will make it extremely difficult to turn
down the next request.

RE: DIRECTIONAL SIGN ORACLE AND 1ST AVENUE
Dear Blake:
In follow up to our previous conversation, please consider this letter
as our agreement to lease a sign location from the Canada Del Oro
Partners at the corner of Oracle and 1st Avenue within the Town of Oro
Valley.
The lease rate will be $1,000 for the first six months and a
month-to-month extension at $100/month thereafter.
We will construct a double faced 4 X 8 sign on the west side of Oracle
Road to direct people to Rancho Vistoso.
If this letter agreement is acceptable, please sign below. return a copy
to me and I will forward $1,000 to cover the first six months of the
lease term.

RE : Response to Your Letter Received October 26, 1995
Dear Mr. Madden:
I am in receipt of your letter requesting further information regarding approvals given to the two
over-sized directional signs located near the intersection of North Avenue and Oracle Road
(southeast quadrant). I shall attempt to answer your questions in the order given.
1) Record of Previous Approvals
A trip to our archives, several weeks ago, revealed that, on August 22, 1989, the Oro Valley
Board of Adjustment approved a variance for an 8 foot by 16 foot sign at the above-referenced
location. The minutes from that meeting state that the sign was to be located "at the intersection
of US89 (Oracle Road and North First Avenue). The sign would be located along the east side
of the right-of-way on private property... owned by the Rooney Ranch Trust". The file on this
variance request is a matter of public record.
2) Life of Sign Variance
I did mention in my last letter to you that the original Vistoso sign had blown over but, since
I wrote you, I have heard two different stories. The Vistoso Partners' representative claims that
termites got into the sign supports and the sign had to be removed, while the sign contractor,
who says he recalls erecting the sign, stated that the sign was plowed down by bulldozers when
First Avenue was graded through to the east several years ago. I do not know which story to
believe, but both stories seem to lend credence to the fact that the sign was actually erected in
late 1989. There is further evidence, in that the Town did issue a sign permit in September of
1989 for an 8 foot by 16 foot sign, in accordance with the BOA's approval. While the issue of
whether there was, or wasn't, a sign erected in 1989, I can confirm that the sign in place at this
time is of a size approved by the Board of Adjustment in 1989.
3) Expiration of Permit
As explained above, a permit for the sign was issued on September 21, 1989 and, although we
cannot verify it, we have received evidence, in the form of the sign contractor's invoice and his
verbal testimony, which indicates that the sign was actually erected. Regardless of this
uncertainty, however, i must emphasize that, whether or not a sign was erected previous to the
one existing is not really relevant, because the Board's approval had no time limit and the
variance runs with the land, per our Town Attorney. Thus, no matter how long the delay
between Board approval of the variance, and erection of the sign permitted by that variance, the
sign is legal. The fact that no time limit was placed on the BOA's approval is documented in
the minutes of the Board's August 22, 1989 meeting (see excerpted motion to approve attached).
Rationale for Approval of Sign Variance
Planning Staff is not in a position to evaluate the appropriateness, nor defend the rationale, for
the Board of Adjustment's 1989 decision. The Board members simply made a decision which
they felt was warranted, based on the applicant's presentation. The fact that no opposition was
expressed during the public hearing could certainly have been a factor in that decision. Relative
to your concern regarding possible similar approvals for sign variances in the future, I can only
state that the Board of Adjustment is charged with evaluating variance requests on a case by case
basis, therefore, no decision should be construed to set precedent.

Builders' Showcase Sign
Mr. Madden, you may categorically state to the La Reserve residents that the Builders'
Showcase directional sign will be removed by March 31, 1996. I have informed the Town's
Zoning Inspector to assure that this is done. Further, when I noted that the 31st was a Sunday,
when we do not ordinarily have a person available to inspect, I contacted Mr. Jim Shiner, who
represents Builders' Showcase, and asked his cooperation in removing the sign on a work day.
He readily agreed to have the sign removed by 5:00 p.m. on Friday, March 29th, or before, and
he confirmed this with a faxed note (attached).

EXCERPT FROM BOARD OF ADJUSTMENT MINUTES OF 8-22-89:
"A MOTION was made by Vice-Chairman Myers to APPROVE the variance on the over-sized
sign and that there are special circumstances in topographic features that require a larger sign;
that the special circumstances were not created by the owner; and in fact the points of entry to
the project are a function of the available roads and not something that the owner chose; also,
that it does not impact the property rights of adjacent property owners since approval was
granted from the major property owner where the sign will be placed; and that the variance does
not grant special privileges inconsistent with other properties because of the special conditions;
and that, further, it is materially good for the neighborhood and public welfare in that it gives
a sense of direction and creates less confusion on a busy thoroughfare in Oro Valley.
MOTION SECONDED by Member Hershberger and UNANIMOUSLY CARRIED."
