Conant, Jr. Planner II Dear Bob: The purpose of this letter is to verify Architekton's authorship of the public artwork designed for the Safeway#1521 fuel station. Under the stipulations of section 7, item d of Oro Valley's Public Art Provisions, public art may include benches, fountains or shade screens. Since there will be pedestrian traffic and an ADA accessible pathway between the fuel station and the store, the option of seating benches located near this route of travel seemed particularly appropriate. Working in conjunction with Michael Flanders, Project Architect for the Safeway team, and Greg Brickey, Structural Engineer of Brickey Design Associates, I produced the conceptual sketches and construction drawings for the project. As indicated on the site plan, the seating benches are located in a landscaped area near the accessible pathway and are oriented towards the east to maximize the vistas of the nearby mountains. The undulating trellis of steel angles overhead will providing shade for the benches while allowing the sky and mountains to be clearly visible through it. To the west, the steel cage that extends around the seating area will provide a shield from the west sun by intertwining with the growing bougainvillea shrubs. As the elevations on Sheet SP1.3 indicate, all materials and material finishes used in the construction of this artwork will be compatible with the Safeway Fuel station, the existing Safeway store and the shopping center. It is Architekton's and Safeway's intention that this artwork enrich the experience of the pedestrian by providing a pleasant "niche" from which to view the natural beauty of the area. If you have any questions or need additional information, you may contact me at my office at 480-894-4637. The public art, if approved, will be located within the landscaped median at the front of the Safeway store. Staff and the Public Art Review Committee suggested that the public art would be better viewed, if placed in front of store rather than near the fuel center. Safeway agreed with this concept. STAFF REVIEW: The proposal meets and exceeds the 1% construction cost and will be visable to the public for more than 40 'ours per week. PUBLIC ART REVIEW COMMITTEE (PARC) ACTION: The PARC met with the applicant and the artist on January 7, 2002, and voted unanimously(3-0)to recommend approval. RECOMMENDATION: PARC and staff recommend approval of the public art for Safeway as presented. David Grigsby The committee was un- imous i' s greement that the proposed public art was not a good response for the project being reviewed for the following reasons: 1. We questioned that two mosaic tile covered sitting benches without hacks represented the value that was required to be invested in the public art for this project. The specific amount was documented by a Town of Oro Valley letter to the Developer. 2. The proposal of benches in this strip mall walkway location also was questioned. We have accepted benches and similar items in the past when they appear to provide a needed accommodation. In this instance, in our opinion, they did not. Additionally; when we review these proposals we expect see that the site furnishings them selves a set in a meaningful composition relative to what is going on around them, and again the siteing here was very perfunctory. 3 We made some suggestions as to what the artist might suggest to his client, as possible proposals since the artist seem to have no ideas of his own. We saw this proposal as purely perfunctory in meeting the letter of the law with no interest, imagination, or enthusiasm for the meaning and intent of the ordinance. We know more meaningful art can be provided within the parameters of this project, MINUTES ORO VALLEY TOWN COUNCIL REGULAR SESSION FEBRUARY 20, 2002 ORO VALLEY COUNCIL CHAMBERS 11,000 N. Approval of 2001/2002 Planning &Zoning Commission Work Plan 2. CONTINUED PUBLIC HEARING — ORDINANCE NO. (0)01-29 OV7-01- 06 INSERTING A NEW CHAPTER 17 "OUTDOOR LIGHTING" TO THE ORO VALLEY ZONING CODE REVISED AND AMENDING ALL REFERENCES TO OUTDOOR LIGHTING IN CHAPTERS 6, 8, 9, 10 AND 13,AND BY DELETING ALL LIGHTING REQUIREMENTS IN SAID CHAPTERS,AMEND CHAPTER 2 DEFINITIONS, AMEND ARTICLE 16-1 DESIGN GUIDELINES OF THE ORO VALLEY ZONING CODE REVISED, AND AMENDING THE ORO VALLEY TOWN CODE BY DELETING IN ITS ENTIRETY,ARTICLE 6-7 OUTDOOR LIGHTING CODE (CONTINUED FROM 12-19-01) Sangeeta Jain, Planner II, reported that the Outdoor Lighting Ordinance was continued by the Council from the December 19, 2001 Council meeting in order to hold a Study Session on the item. She stated that the Study Session was held on January 14, 2002 to review several issues. Ms. Jain reviewed proposed changes in the following areas: • Height of Light Poles o Recommendations for C-2 Zoning—28 ft. o All other zoning districts— 18 ft. (With exceptions in the T-P District being forwarded to the Development Review Board to allow an increase up to 28 ft.based on factors such as lot size, proximity to residential areas, etc.) • Light Trespass (Reworded definition to provide clarity) • Light Shielding (Wall-mounted luminaries and reflectivity) 02/20/02 Minutes,Council Regular Session 4 ■ Lumen Levels for Schools and Churches (Moved to higher lumen category —E3a) Ms. Jain also reviewed recommended technical comments as provided by Chris Monrad of Monrad Engineering and other lighting professionals. These included suggested changes to Section 17-301 3 - If canopy lighting is being proposed, then provide calculations for average maintained levels of horizontal illuminance at 36 inches above grade level in foot candles. In Section 17-402 A—The height of a pole-mounted luminaire shall be measured from finished grade to the bottom of the lens of a luminaire. In Section 17-403 E—Canopy lighting shall be limited to an average maintained horizontal illuminance level at 36 inches above grade of 50 fc(foot candles) in E3 and E3a, 30 fc in E2, and 10 fc in E2a. Ms. Jain also stated that staff is recommending a change to Section 17-403 C—The churches and schools shall uniformly reduce lighting to 50% or to a minimum level required by IESNA (Illuminating Engineering Society of North America) for security purposes one hour after close of business. Other businesses in E3 and E3a areas may uniformly reduce the level of lighting one hour after close of business. *(Wording to be changed per Council's motion.) In response to a question from Mayor Loomis regarding the requirements for the height of the light fixture verses the requirements for the actual height of the light pole and whether there should be limits applied,Mr. Hy Kaplan, Technical Consultant, explained that a trunion is mounted on top of the pole which holds the light fixture in place. He explained that unless something additional is placed on top of the pole, the pole would be limited to the allowed height. Planning and Zoning Administrator Bryant Nodine then explained that the other sections of the Zoning Code would address any additional pertinence over that allowed by the Lighting Code. He stated that a restriction could be added to the pole height stating that the pole and lens height would be no higher than"x" amount of feet. Further discussion followed regarding the allowed minimum safe lighting for churches and schools. Mayor Loomis requested that an illustration be added to the Outdoor Lighting Code that depicted the pole, trunion and lens mounting. Mayor Loomis opened the public hearing. Bill Adler, 10720 N. Eagle Eye Place, referenced photographs that he presented to Planning Staff depicting lighting in other cities that are using shorter light poles (typically 18 feet.) He stated that technology is such that now there can be adequate lighting with lower heights on poles without compromising safety and security. He stated that the Town should apply the 18 foot pole height limitation and treat other requests as variances that would be heard by the Board of Adjustment. 02/20/02 Minutes,Council Regular Session 5 Mayor Loomis closed the public hearing. Further discussion followed regarding the rationale for 28 foot poles in C-2 Zoning Districts (such as the Home Depot and Target shopping areas)which have large parking lots, limitations as used by the City of Tucson and Pima County, and the fact that there is nothing in the Lighting Code that prevents C-2 zones from installing 18 foot poles. MOTION: Council Member Wolff MOVED to approve Ordinance No. (0)01-29, adopting amendments as shown in Exhibits "A"through "I" and with changes as presented in the Supplemental Council Communication. Council Member Rochman SECONDED the motion. (Exhibits "A"—"I" are attached to the end of the minutes.) AMENDMENTS TO THE MOTION: Mayor Loomis asked to add an additional sentence to Section 17-402 that limits the pole height and lens as discussed (identify height of pole mounted luminaire would be from the finished grade to the bottom of the lens -18 feet or 28 feet and allowing up to 2 feet additional pole height) and to include an illustration. He also asked that in Section 17-403C (*additional comment from Staff)be changed by deleting "to 50%" and change the word "required"to "recommended." Council Members Wolff and Rochman agreed to the amendments. MOTION AS AMENDED, carried 4—0. 3. PUBLIC HEARING—RESOLUTION NO. (R)02-18 ADOPTION OF THE TOWN OF ORO VALLEY CAPITAL IMPROVEMENTS PROGRAM FOR FISCAL YEAR 2002/03 THROUGH FISCAL YEAR 2006/07 Nina Trasoff, Consultant and Facilitator for the Capital Improvements Program Technical Advisory Committee (CIP TAC,) explained that Capital Projects are identified as costing over $10,000;have an expected useful life of two years or more; and become an asset of the town. She explained that this was an especially challenging year since there were no available funds in the General Fund. Ms. Trasoff reviewed recommendations made by the CIP TAC which included: extending the use of vehicles from 100,000 miles to 120,000 miles before replacement, including the Town's Information Systems Technician as a CIP TAC member, and to look at visioning meetings that would look at such things as ADA compliance within the community, computer system needs for the Town, etc. The TAC also recommended that there be a liaison between the General Plan Steering Committee and the CIP TAC. Ms. Trasoff also explained that this year the TAC studied cost savings as they ranked Assumption Projects (Assumption Projects have not been rated in the past.) Also ranked were Non-Assumption Projects. One project that has been recommended for funding is Evaporation and Heat Blankets for the Municipal Pool. She reported that it was strongly felt that this item would demonstrate a savings of at least the original cost ($28,000) of the blankets within one year. Each year following, a similar return should be realized by the Town. 02/20/02 Minutes,Council Regular Session 6 In response to a question from Council Member Rochman, Parks and Recreation Administrator Ainsley Reeder explained that the manufacturer of the blankets has provided staff with percentages for savings in costs of heating and evaporation. She stated that staff has also worked the numbers and a similar savings was projected. She also stated that the blanket and the reels are guaranteed for 5 years. Ms. Trasoff reported that the CEP TAC has recommended that the Council fund the projects under HURF (Highway Users Revenue Funds) and the Townwide Roadway Impact Fees as the funding is available for these projects. Council Member Wolff stated that he sat as the Council liaison to the CIP TAC. He commended staff and all those involved in the process. Mayor Loomis opened the public hearing. There being no speakers, the public hearing was closed. Discussion followed regarding the Townwide Roadway Impact Fees, specific project funding, ranked assumption projects, the Reserve Fund, and revenue projections for the next fiscal year. MOTION: Council Member Rochman MOVED to ADOPT Resolution No. (R)02-18, approval of the Capital Improvements Program FY 2002/03 through 2006/07 with the CIP TAC recommendations. Council Member Wolff SECONDED the motion. Discussion followed on standardizing the criteria set for service levels and reporting project cost savings to the CIP TAC for next year's planning. Motion carried, 4—0. Mayor Loomis recessed the meeting at 8:00 p.m. The meeting resumed at 8:10 p.m. 4. CONSIDERATION AND/OR POSSIBLE ACTION REGARDING THE ORO VALLEY CACTUS SPEED CLASSIC VI MARATHON AND FITNESS SKATE ON NOVEMBER 3, 2002 Parks and Recreation Administrator Ainsley Reeder reported that the Parks and Recreation Advisory Board and staff are recommending that the Cactus Speed Classic VI Marathon and Fitness Skate be held on Sunday,November 3, 2002 and that the Town sponsor route support not to exceed $5,000. MOTION: Council Member LaSala MOVED to APPROVE the Cactus Speed Classic VI in Oro Valley on November 3, 2002 with a sponsorship for route support not to exceed$5,000, subject to the 2002/03 budget appropriation. Council Member Wolff SECONDED the motion. Motion carried, 4— 0. 02/20/02 Minutes,Council Regular Session 7 5. Mr. Sinclair also reported that the average lots are 7,700 square feet in size and will be in a gated community with private streets. There will also be a .35 acre private recreation area. In response to a question from Mayor Loomis, Steve Oliverio, The WLB Group representing Vistoso Partners, explained that the proposal for the gated community is similar to the subdivision across the street and that this project would provide a single entrance. He also explained that the Homeowners Association would have the responsibility to maintain the streets. Mr. Oliverio stated that they had no problem with the conditions as listed in Exhibit "A". In response to the same question from Mayor Loomis, Town Engineer Bill Jansen further explained that the minimum width for the streets to be accepted by the Town is a 45-foot wide right-of-way and the proposed plat provides for a 32-foot wide right-of-way. He also stated that he was comfortable with the provisions as listed in Exhibit "A". Council Member LaSala asked that a condition be added that notes that the roads within the parcel are private and will be the responsibility of the Homeowners Association for that parcel (the Sub-Association.) • 02/20/02 Minutes,Council Regular Session 8 Mayor Loomis opened the floor for public comment. Bill Adler, 10720 N. Eagle Eye Place, expressed his concern for the maintenance of the riparian area in the parcel. He stated that when the Town designates a riparian or conservation area, they should also take responsibility along with the Homeowners Association for enforcing compliance with all the requirements of the Town's ordinance that protect and preserve such areas. In response to a question from Mayor Loomis, Planning and Zoning Administrator Bryant Nodine explained that a portion of the parcel falls in the Riparian Habitat Overlay District. He explained that the enforcement of the riparian and conservation areas are managed by responding to telephone complaints, "windshield surveys", and studying the riparian areas when visiting nearby sites. He stated that the applicant has requested to plat six lots, a natural open space, Common Area A (the sloped area to the north) and Common Area B (the drainage channel.) Mr. Nodine explained that a condition of the rezoning was that the concrete used to construct the drainage channel be colored to match the soils on the site.
