Your skills and creativity are apparent to us all. As we discussed, the sculpture will be located at the front on the facility on Innovation Park Drive. It will be composed of stainless steel tubing substantially in the configuration depicted on the attachment to this letter, unless we mutually agree otherwise. We envision the dimensions of the sculpture to be as follows: approximately 8' to 12' in width and approximately 10' in height. The final plans for the sculpture are subject to our approval. The agreed upon price for the sculpture is $15,000, which includes alj costs in the design, fabrication and erection of the sculpture at our facility. We shall be responsible for the foundation and landscaping. As you know, the sculpture is subject to the approval of the Town of Oro Valley. Should either the Oro Valley Public Art Review Committee or the Oro Valley Mayor and Council refuse to approve the sculpture, or if all approvals are not received by March 15, 2003, this agreement shall be null and void. As to timing, the sculpture must be in place before we receive our certificate of occupancy. We project the completion of the facility by late summer/early fall. Accordingly, you agree to have the sculpture completed and ready for installation no later than August 15, 2003, with time being of the essence. As to payment, once the sculpture is finally approved by the Town of Oro Valley and we approve the final drawings, we will pay you $1,500 to start the project. Another $5,000 shall be paid upon presentation to us of invoices demonstrating that substantially all materials required for the sculpture have been acquired. Another $5,500 will be paid upon completion of the sculpture, and (//9 the final $3,000 will be paid upon the erection of the sculpture at our facility. It is our intention to cover your reasonable out-of-pocket expenses as the project proceeds (so you will not have to bear them), so we are amenable to revising the payment scheme should that be necessary. Once again, we are excited to be working with you and look forward to enjoying your attractive and meaningful sculpture for all the days we occupy our new facility. Mo incerel , I/ I Ro rt S. At age six I started a childhood career of building plastic models. Very quickly I had the need to alter the kits from their intended construction. When I was ten I bought a professional airbrush. At age twelve my family moved to Holland, Europe for five years. I learned Dutch. Drawing was my favorite class. I studied European masters and practiced the formal elements of drawing and painting as taught in the Dutch tradition. graduated with a Dutch high school degree. In 1984 I returned to America and attended a U.S. high school where I became acquainted with wood working and several other crafting techniques. In college I excelled in silver jewelry. I graduated from Wittenberg University in Springfield, Ohio in June of 1990 with a business major and an art minor. Many of the jobs that interested me required AutoCad skills, a computer drafting program. Early in 1992 I took local classes in drafting and in Autocad. This immediately opened doors to a successful career in product design. In the late nineties I took undergraduate art classes in Birmingham, Alabama as a way to sooth creative desires. Consequently in 1999 I started the sculpture MFA program at the U of A in Tucson, Arizona where I graduated in May 2002. In 2001 I completed a commissioned sculpture for Lady of Lourdes Catholic Church in Center Point, Alabama. In April of 2002 I gratefully became the recipient of the 2002 University of Arizona Centennial Sculpture Award. This sculpture is now completed and will be installed on the north west corner of Old Main in January 2003. LADD PEPKE 1021 N. (0)03- 03 OV9-01-07 AN ORDINANCE AMENDING THE TOWN OF ORO VALLEY ZONING MAP BY REZONING THE PROPERTY LOCATED ON THE EAST SIDE OF ORACLE ROAD IN THE PROXIMITY OF DESERT SKY ROAD FROM TECHNOLOGICAL PARK TO COMMERCIAL DISTRICT (C-1) IDENTIFIED AS PARCELS 224-31-009C, 224-31-009D, 224-31-009E, 224-31-009F AND 224-31- 009G AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH Planning and Zoning Administrator Bryant Nodine reviewed the Council Communication and reported that the property owners are requesting a rezoning on 7.98 acres from Technological Park (TP) to Commercial District (C-1). If approved, the rezoning would permit the development of approximately 44,950 square feet of commercial/office development. Mr. Nodine reviewed an aerial view of the site and explained that currently there is a single-family residence and church on the site. He explained that the rezoning request has been filed in order to allow the church and reception facility existing on the site to expand the services they offer and to add 30,450 square feet of commercial space. Mr.Nodine reported that the tentative development plan is in conformance with the requirements of the Oracle Road Scenic Corridor Overlay District (ORSCOD), the Zoning Code and the Town's Grading Ordinance. He also stated that it is conformance with the General Plan Land Use Plan and Policies and that it conforms overall to the General Plan. Mr. Nodine further explained that the Arizona Department of Transportation (ADOT)has reviewed the site analysis and their only requirement would be to widen the existing driveway into two exiting lanes and one entering lane. (Oracle Road is under the jurisdiction of ADOT.) He stated that the Planning and Zoning Commission also voted to recommend approval of the project with the condition that when the access was developed that it be made right in/right out only. However, ADOT has stated that they would not require the right in/right out only as the development would not generate 2/05/03 Minutes,Council Regular Session 5 enough traffic to warrant such a restriction. Mr. Nodine stated that the staff also recommends the approval of the rezoning with certain conditions. Linda Morales, The Planning Center, representing the applicants, reviewed a site plan depicting the existing and proposed buildings. Discussion followed regarding: • Condition#12 of Exhibit"A"should require that the minimum first floor elevation should be at the minimum 2644.47 feet. • Zoning of property for church is not Technological Park, but in the past the property was allowed to keep church use. • Master Planning for property with adjoining properties. • Left turn bay currently off of Oracle Road to access property. • Oracle Road will be going to 6 lanes (under ADOT design.) • Concerns expressed regarding traffic generated by weddings, etc. and access to Oracle Road. • Possible connection to property to El Conquistador Way. Possibly obtain easements and require a connection. 25% slopes on property create issues for connections. • Critical Habitat Survey completed on property. Survey was negative and will provide documentation. Mayor Loomis opened the public hearing. Bill Adler, 10720 N. Eagle Eye Place, stated that he did not oppose the proposed uses but he did oppose the rezoning as it was not necessary. He stated that none of the identified uses are prohibited under Technological Park which means they could be accepted with Conditional Use Permits. He stated that to rezone the property to C-1 would grant the owner far more uses than have been identified or are desirable. He stated that if the Council chooses to rezone the property, he would suggest that they limit the rezoning to the specific identified uses. Mayor Loomis closed the public hearing. Further discussion followed regarding: • Maximum building height is 25 feet and is allowed in ORSCOD. • Rezoning approval not only approves the district type but also approves the proposed tentative development plan. The applicant would be bound to the development plan in future development except where there is substantial change (anything that increases the intensity of the development, change in the uses, and change in the circulation.) • Connection to El Conquistador Way and adjusting the circulation accordingly could be part of the new tentative development plan. (Condition#3 would be changed to read "Connection from this property to the property on the north and south shall be stubbed in." (Developer would have to obtain easement from the 2/05/03 Minutes,Council Regular Session 6 property owners. When adjacent properties are developed, the connections would be provided.) • Plan will not work without connection to a traffic light. • Possibly require property owners to provide traffic control plan (police officers, temporary right in/right out) when having large events. • ADOT has absolute control of traffic controls on Oracle Road and has concerns that right in/right out would cause people to do a 180 degree turn at El Conquistador Way which would be the highest potential for accidents. ■ 30 foot easement on northern most property joining El Conquistador Way. However, can't force owner to sell to individual person or another property owner and could require potential eminent domain for public purpose. ■ Work with applicant to make ingress and egress safer. MOTION: Vice Mayor Johnson MOVED to CONTINUE OV9-01-07 to March 5, 2003 and to direct staff and the applicant to come up with a method of connecting to El Conquistador Way or working with ADOT or other alternatives to mitigate the safety issues with regard to ingress and egress and to obtain documentation for the Critical Habitat Survey and to clarify condition #12 in Exhibit "A". Council Member Rochman SECONDED the motion. Motion carried, 5 —O. Mayor Loomis recessed the meeting at 8:20 p.m. The meeting resumed at 8:30 p.m. 8. RESOLUTION NO. (R)03- 06 AMENDING POLICY FOR ANNEXATION OF UNINCORPORATED LAND AND MAKING SUCH DOCUMENT A PUBLIC I RECORD; AND RESCINDING RESOLUTION NO. (R)95-22 Special Projects Coordinator Scott Nelson reported that on November 19, 2002, the Planning and Zoning Commission voted to recommend a new policy in the General Plan related to expediting annexations within the General Plan Planning area. Staff is therefore, recommending the following changes to the formerly adopted Resolution (R)95-22 to help expedite annexations: 4. Future annexations of the Town shall be generally consistent with the policies, THE LAND USES, and the planning area of the Town's adopted General Plan 7. The Oro Valley Planning and Zoning Commission shall review any proposed annexation for,.,,;.,-.,,;+,+ +,o „a„r+oa r__, ,,,-- vonfo mit t-the adopted General-Pfs n OUTSIDE THE GENERAL PLAN PLANNING AREA.J The Commission shall forward a recommendation to the Town Council within 30 days of the initial hearing on the proposed annexation. 9. The Mayor and Council may appoint a Council Member to serve on the annexation team. Mayor Loomis expressed concern with the change in#4 by adding "the Land Uses." He stated that if we go outside the planning area of the General Plan, there is no land use identified. He also asked if the property is already zoned and is in conflict with the General Plan, would this prevent annexation. • 2/05/03 Minutes,Council Regular Session 7 Mr.Nodine explained that we look at "generally consistent" so they would look at the area overall. He also stated that if they were looking at an area outside the General Plan Planning Area, it would be addressed by item #7 which specifically addresses areas outside the Planning Area. Mr. Nodine further explained that they would look at compatibility of adjacent areas and base recommendations on that. MOTION: Vice Mayor Johnson MOVED to ADOPT Resolution No. (R)03-06 and to strike the new recommended wording"the Land Use" from item #4. Council Member Rochman SECONDED the motion. (R)03-06 changes as amended: 4. Future annexations of the Town shall be generally consistent with the policies, THE LAND USES, and the planning area of the Town's adopted General Plan 7. The Oro Valley Planning and Zoning Commission shall review any proposed annexation for eonfe it-3 te-the-adepted-Genefal-Plan OUTSIDE THE GENERAL PLAN PLANNING AREA. The Commission shall forward a recommendation to the Town Council within 30 days of the initial hearing on the proposed annexation. 9. The Mayor and Council may appoint a Council Member to serve on the annexation team. MOTION CARRIED, 5 —0. 9. RESOLUTION NO. (R)03- 07 APPROVAL OF AN ANNEXATION DEVELOPMENT AGREEMENT BETWEEN THE TOWN OF ORO VALLEY AND BIGHORN COMMERCE CENTER, LLC (PROPERTY LOCATED ON THE SOUTHSIDE OF RAMS FIELD PASS AND EAST SIDE OF ORACLE ROAD CONSISTING OF APPROXIMATELY 3.03 ACRES) Special Projects Coordinator Scott Nelson reported that staff feels the best action on this item would be no action. It is recommended that this item be denied and that both parties continue to work on the annexation development agreement and bring forward at a later date. MOTION: Council Member Abbott MOVED to DENY Resolution No. (R)03-07. Vice Mayor Johnson SECONDED the motion. Motion carried, 5 —O. TOWN MANAGER'S REPORT—No report. COUNCIL REPORTS Vice Mayor Johnson reported that he attended a Metropolitan Tucson Convention and Visitors Bureau (MTCVB) meeting and it appears that the State Legislature will be combining the Arizona Office of Tourism with the Department of Commerce and will be cutting the budget. He stated that this translates to lower revenues for the MTCVB, tourism, and less promotion for the State and our area. He suggested that we keep the legislators aware of the need for tourism dollars in the southwest area of the state. He 2/05/03 Minutes,Council Regular Session 8 also stated that there is word that there will be a future sign placed on Interstate 10 at the Tangerine Road exit directing people to Oro Valley. Council Member Wolff stated that the Planning and Zoning Commission is one member short and is looking for a replacement. He also stated that the Budget and Bond Committee met on January 27th to study the long range revenue options for the Town. He stated that they will be meeting again on February 18th to refine their plans and recommendations. DEPARTMENT REPORTS Police Chief Sharp reported that they have received monies from their grant request to the Governor's Office of Highway Safety for a second Speed Trailer and a BMW motorcycle. The Department has purchased the Speed Trailer and is working on the purchase of the motorcycle. CALL TO AUDIENCE —No speakers.
