Your skills and creativity are apparent to us all. As we discussed, the sculpture will be located at the front on the facility on Innovation Park Drive. It will be composed of stainless steel tubing substantially in the configuration depicted on the attachment to this letter, unless we mutually agree otherwise. We envision the dimensions of the sculpture to be as follows: approximately 8' to 12' in width and approximately 10' in height. The final plans for the sculpture are subject to our approval. The agreed upon price for the sculpture is $15,000, which includes all costs in the design, fabrication and erection of the sculpture at our facility. We shall be responsible for the foundation and landscaping. As you know, the sculpture is subject to the approval of the Town of Oro Valley. Should either the Oro Valley Public Art Review Committee or the Oro Valley Mayor and Council refuse to approve the sculpture, or if all approvals are not received by March 15, 2003, this agreement shall be null and void. As to timing, the sculpture must be in place before we receive our certificate of occupancy. We project the completion of the facility by late summer/early fall. Accordingly, you agree to have the sculpture completed and ready for installation no later than August 15, 2003, with time being of the essence. As to payment, once the sculpture is finally approved by the Town of Oro Valley and we approve the final drawings, we will pay you $1,500 to start the project. Another $5,000 shall be paid upon presentation to us of invoices demonstrating that substantially all materials required for the sculpture have been acquired. Another $5,500 will be paid upon completion of the sculpture, and (7/9 J the final $3,000 will be paid upon the erection of the sculpture at our facility. It is our intention to cover your reasonable out-of-pocket expenses as the project proceeds (so you will not have to bear them), so we are amenable to revising the payment scheme should that be necessary. Once again, we are excited to be working with you and look forward to enjoying your attractive and meaningful sculpture for all the days we occupy our new facility. qMo incerel , Ro rt S. Please find enclosed the following: 1. Seven(7) sets of color prints of the sculpture, with dimensions, from all four angles. 2. Seven(7) copies of Artist's Resume 3. Three (3) copies of Artist contract, which stipulates the total cost of the sculpture. I have included a delivery and installation charge for the delivery to Oro Valley. One copy is for the Public Art folks, one copy for your records and one to sign and return. I can get a Structural Engineering estimate from Starling &Associates, the structural engineer we work with. This should not be necessary, as the sculpture will be mounted on concrete pad already approved by the building inspectors. I have included a detailed description and sketch of the mounting method and materials used. Unfortunately, the numbered edition which we have on display here at Arizona Bronze Fine Arts Atelier has been sold to the City of Mesa's Sculpture in the Streets Program. We will need to cast an additional numbered edition piece for your project, which should only take 4-5 weeks at the most. I believe we quoted $13,000.00 as the last price to you in July of 2002. I can honor that price, but will need to add the delivery and installation to the final price. Thanks again for the opportunity, please let me know if there is any additional information which you require. RENEWAL OF EMPLOYEE BENEFIT PLANS (HEALTH, DENTAL, LIFE AND LONG-TERM DISABILITY) FOR ADOPTION IN THE FISCAL YEAR 2003/2004 BUDGET http://www.ci.oro-valley.az.us/Townhall/Council%20Minutes.html 07/29/2003 Town Minutes - Oro Valley, A 7 Page 5 of 16 Human Resources Director Jeff Grant presented an overview of the recommended employee benefit plans for health, dental, life and long-term disability for fiscal year 2003/2004. Mr. Grant stated that he is recommending the following: Aetna be contracted for Health Insurance which will save the Town approximately$126,482 compared to the renewal quote from CIGNA, MetLife be renewed for Dental coverage, Jefferson Pilot continue Long-Term Disability Coverage, MetLife be contracted for Basic and Supplemental Life Insurance benefits and the continuation with AFLAC for supplemental insurance products. In response to questions from the Council, Mr. Grant explained that the only concern expressed by Town employees regarding the change from CIGNA to Aetna was regarding the doctors on the new plan. He explained that about 65% of the doctors contract with both companies. He also explained that long term contracts (more than one year) are contingent upon the plan remaining unchanged. Craig Hanson, Hanson& Associates, Inc. further explained that life and disability insurance usually have a two-year rate guarantee; however, you typically do not find that to be the case with medical and dental insurances. Mr. Grant then explained that because the Town will have changed carriers twice in two years, there could be potential disadvantages as future negotiations for benefits may be affected in the number and quality of bids that the Town receives. MOTION: Council Member Johnson MOVED to approve the recommended Employee Benefit Program changes for adoption in the Fiscal Year 2003/2004 budget. Vice Mayor Wolff SECONDED the motion. Council Member Abbott expressed concerns regarding some of the employees having to change their doctors, but she felt that the savings to the Town and lower co-pays would balance it out. Council Member Johnson commented that the Town covers 100% of the employees' health costs and 75% of their dependents. He stated that by realizing the cost savings, the coverage can remain and the Town can retain its commitment to the employees and their families. MOTION CARRIED, 5 —0. 6. RESOLUTION NO. (R)03- 55 ADOPTING THE ARIZONA STATE RETIREMENT SYSTEM FOR ALL ELIGIBLE EMPLOYEES, AND AUTHORIZING THE TOWN MANAGER TO ENTER INTO RELATED AND NECESSARY AGREEMENTS WITH THE ARIZONA STATE RETIREMENT SYSTEM Human Resources Director Jeff Grant explained that at the Town Council's request, an anonymous "Employee Opinion Survey"was conducted to determine the employees' preferences regarding a change from the current ICMA 401(a)program and the Arizona State Retirement System (ASRS.) He stated that 168 surveys were distributed and 143 were returned. Of those returned, 102 employees favored ASRS, 18 favored ICMA and 23 were undecided. He further explained that ASRS is a defined benefit retirement plan in which participants receive a benefit based on a combination of years of service and salary. Mr. Grant reported that ASRS can not be offered in tandem with other retirement plans. He also explained that employees will be contributing 5.7% of their pay to ASRS verses the 5% they currently contribute to ICMA. The Town in turn, will contribute 5.7%to ASRS on behalf of each employee http://www.ci.oro-valley.az.us/Townhall/Council%20Minutes.html 07/29/2003 Town Minutes - Oro Valley, A 7 Page 6 of 16 verses the 7% currently being paid to ICMA. Mr. Grant stated that the Town must elect whether to waive any obligation to assist employees with the purchase of prior service credit, or to adopt the responsibility to assume any or all the obligation for the purchase of prior service on behalf of the employees. He explained that staff is recommending that the Council waive any assistance to the employees for purchase of prior service credit since the Town has contributed to ICMA in the past. In response to questions from the Council, Mr. Grant explained that employees can leave their past contributions in the ICMA plan and are not required to buy their prior service. Mayor Loomis opened the floor for comments. Craig Civalier, Town employee, thanked the Council for pursuing ASRS. He stated that employees are looking for stability for retirement and the majority of employees have voted in favor of the change. He stated that approval of the ASRS would boost the moral and loyalty of the employees and encouraged the Council to pass the Resolution approving ASRS. Don Manspeaker, Town employee, stated that the majority of the Town employees support the approval of ASRS. He stated that he believes strongly in the program and it is ranked in the Top 10 in the country. He asked that the Council continue their commitment to the Town's employees and approve the Resolution. MOTION: Vice Mayor Wolff MOVED to ADOPT Resolution (R)03-55, adopting the Arizona State Retirement System for all eligible Town of Oro Valley employees and authorizing the Town Manager to enter into any related and necessary agreements with the Arizona State Retirement System. He explained that Development Plans for the OSCO Drug and Bank One facilities located on the site were approved by http://www.ci.oro-valley.az.us/Townhall/Council%20Minutes.html 07/29/2003 Town Minutes - Oro Valley, A7 Page 9 of 16 Council in 2001. Mr. Nodine reported that The Beztak Companies are now requesting approval of a Development Plan to construct 138 apartment units ranging from two to three stories and approximately 31,000 square feet of commercial buildings. Mr. Nodine then reviewed architectural features of the proposed project and discussed the applicant's and staff's response to issues that have been raised: • Open space - 39%being provided, El Conquistador Planned Area Development (PAD) requires 24%. • Long expanse of buildings-Redesign creates 2 and 3 story buildings and breaks up roof lines. • Site was lowered which creates less visual impact. • Separation between residential and commercial created by 10 feet buffers and vegetation increased by approximately 20% over current Zoning Code requirements. Backs of buildings create solid, opaque break between residential and commercial. Access focused to 3 key areas (security, protection of pedestrians, and access can be controlled.) • Apartments look down on back of commercial buildings. Loading areas will be screened with dense trees. • Protection for homes at south end of property was achieved by moving the 25-foot setback to a 50-foot setback, a 38-foot maximum height limit was reduced to 22 feet and 8 inches, additional mature vegetation was added, parking lot lighting will be properly screened and height of the grade of the buildings was reduced. • Comments were received from the Police Department regarding security and controlled access. Staff would recommend adding gated entries at two entries to residential areas. Mr. Nodine stated that staff recommends approval of the Development Plan as it meets the requirements of the El Conquistador PAD, the Zoning Code and the Design Guidelines. Further discussion followed regarding the six foot wall that would surround the apartments, comments from the Police Department relating to the Landscape and Development Plans, gating and vehicular access control to the site, traffic volume and pedestrian access. Michael Franks, Seaver-Franks Architects, representing the applicant, presented an overview of the Development Plan. He stated that the proposed revised Development Plan was a result of a one year process and the combined efforts of the land owner, design team, Town staff and community participants. Mr. Franks addressed the changes to the grading, augmentation of landscaping, screen walls, views, setbacks, reduced heights, stepping of apartment buildings, provision of 2 and 3 story buildings and security. He then stated that the applicant agrees to all the conditions as defined in Exhibit «A „ In response to questions from the Council: • Mr. Franks reported that the developer will be participating in the under grounding of the power lines along Lambert Lane . http://www.ci.oro-valley.az.us/Townhall/Council%20Minutes.html 07/29/2003 Town Minutes - Oro Valley, A 7 Page 10 of 16 • Mr. Tom Tracy, Manager of the Golf Villa Apartments, explained that their average rental rate is $930 per month and the average qualifying amount of income for the potential renter is $55,000. He stated that the rental rates anticipated for the Lambert Lane/La Canada project is in excess of$930. • Mr. Tracy explained that he has heard of Crime Free Multi-Housing. He stated that he participated in the initiation of it in the City of Tucson about ten years ago. He stated that he believed that the call for police services has been very low at the Golf Villas. He said that they had no objection to participating in the Crime Free Multi-Housing at the Golf Villas, it was just a matter of timing and meeting with the residents. He also explained that they would be glad to participate in the Crime Free Multi-Housing at the new project and Crime Prevention Through Environmental Design(CPTED) has been integrated in the new project. • Mr. Tracy explained that the occupancy rate for the Golf Villas last year was in excess of 92%. • Mr. Franks reviewed the pedestrian access points for the site. He also explained that the well site would have improved screening and landscaping to minimize impact. • Mr. Nodine stated that conditions from the old plan were considered but the new plan is different so all conditions would not still apply. Pertinent conditions that meet the Zoning Code were applied to the new Development Plan. • Mr. Franks stated that Buildings 9 & 10 are two-story only, Buildings 1, 2, 7 & 8 are a combination of two and three story buildings. Buildings 3, 4, 5, & 6 in the interior portion of the site are three-story. • Mr. Tracy explained that market conditions cycle but the economics of the project are long term. He also explained that the market for residents is varied and includes young, single professionals, "empty nest" seniors, people building homes that need temporary accommodations, students and visiting professionals. • Mr. Franks explained that the elevation difference between the site and the homes at the southern end is at about 4—5 feet. • Mr. Tracy stated that they have visited with Amphitheater School District regarding the impact to the schools. He said that it has been indicated that there was adequate capacity in the schools for the school age children that would be living at the new apartment complex. • Mr. Franks stated that without exception, every comment received was considered and implemented where it was possible. Many suggestions made no economic sense, contemplated a development that would fail or were not consistent with the type of project the developer wanted to build. • Mr. Franks stated that these apartments would be termed luxury apartments and that there are not elevators planned for the 3-story buildings. In response to questions from Council Member Johnson and Mayor Loomis, Town Attorney Mark Langlitz explained that the property owner is entitled to build apartments on the property. He stated that this right was granted twenty years ago by a former Council when the El Conquistador PAD was approved by Ordinance. He stated that the PAD designates certain permitted uses, i.e. residential units http://www.ci.oro-valley.az.us/Townhall/Council%20Minutes.html 07/29/2003 Town Minutes - Oro Valley, A 7 Page 11 of 16 including apartments, single family town homes, condominiums, commercial and retail type uses. He explained that the Development Plan as being proposed by The Beztek Companies is in legal compliance with the PAD. Mr. Langlitz further explained that when the Town Council adopts a zoning district, it is a legislative act where they define policies and procedures and the manner in which the policies and procedures are going to be accomplished. Once the PAD is accepted, the property owner has the right to develop the property consistent with the PAD. He explained that the current Council will address whether the Development Plan is in compliance with the previously adopted PAD. If it is determined that it is in compliance, then it is incumbent upon the Council to approve the Development Plan. Further discussion followed regarding the gating of the complex, traffic volume and stacking issues, parking, HOA support or non-support of Plan. Mayor Loomis recessed the meeting at 10:10 p.m. The meeting resumed at 10:20 p.m. Mayor Loomis opened the floor for public comment. The following citizens spoke against the Development Plan citing such concerns as the building of the apartments, apartments are not authorized in the El Conquistador PAD, ADA requirements, sacrificing safety and security, separation of residential and commercial uses, possible transient problems, access to and from site, views of apartments from surrounding homes, legality of development, Development Review Board recommended denial of plan, plan is bad and apartments do not reflect community's standards.
