to raise the base Stormwater fee
Rate Change Process – The Notice of Intent (NOI)
What is the Stormwater fee rate change NOI
As the name implies: it’s a notice to the public that the Stormwater Fee may be adjusted
Stormwater Rates Analysis Report and the amended Stormwater Utility Schedule of Fees available for public review
Publish in a newspaper of general circulation at least 60 days prior to public hearing, and again at least 20 days prior
Scheduling public hearing, where the Town Council considers adoption of the proposed base rate changes
Why do we need an NOI
State law not clear for Stormwater utility rate changes – so process conservatively
For transparency, following the OVWU process for their rate adjustments
Allows for maximum input from our residents
What the NOI does not do
Does not on its own adjust the rate. It is merely an educational tool
A Council hearing after the prescribed notice period is how the fee can be adjusted

Proposed Fee Increase Implementation
Summary
For consistency of implementation and predictability for the public, staff is
requesting the original $2.00 per ERU fee increase, as an escalating three-part,
three-year enactment:
That would be 67¢ per ERU for years 1&2 and 66¢ third year increase.
The impact is a diminishing year over year increase of 15% first year, 13% the
second year and 11% the third year.
We feel that this meets the spirit of what the SWC reviewed & approved while
meeting Council phasing direction and providing predictability to the public and
funding to accomplish some projects.
Request all three years of this implementation is covered by this NOI and
subsequent rate hearing.

•The Arizona State Land Department (ASLD) serves
as fiduciary for a multi-generational, perpetual Trust
whose assets were granted to the State at statehood
•Trust revenue supports 13 Public Service

some of their educational programs, the State’s

Proposed Tax Rate Increases
Shouldn’t be “sitting on the people’s money”.
Staff agrees. The financial policies direct that excess reserves be directed toward PSPRS excess contributions or capital needs. This policy has been followed since at least FY2020. (Marana’s General Fund ending fund balance for FY24 is $130M).
Fund balance reserves and cash balances comprise 30% of a bond rating analysis and score.
Pile-on effect on businesses. Impact on residents.
Some businesses do not pay much to the Town in exchange for the level of services they receive.
Generally, the proposal distributes revenue collections to non-residents and residents alike, meaning that residents would not bear the full burden of the tax changes.
Five-Year Forecast
Five -year forecast does include a minimal amount of new personnel. That assumption will be removed from future forecasts.
Five -year forecast does include new tax revenues associated with OV Marketplace, including about $250k/year in additional bed tax revenue. The model assumes two apartments and one hotel.
What do cuts look like across all departments? Degrees of severity?
This would need to be evaluated during the upcoming budget process. Cuts would begin in capital before operations would be impacted.
