When possible, a packet of agenda materials as listed above is available for public inspection at least 24 hours prior to the Council meeting in the office of the Town Clerk between the hours of 8:00 a.m. – 5:00 p.m. The Town of Oro Valley complies with the Americans with Disabilities Act (ADA). If any person with a disability needs any type of accommodation, please notify the Town Clerk’s Office at least five days prior to the Council meeting at 229-4700. PUBLIC COMMENT ON AGENDA ITEMS The Town has modified its public comment procedures for its public bodies to allow for limited remote/virtual comment via Zoom. The public may provide comments remotely only on items posted as required Public Hearings, provided the speaker registers 24 hours prior to the meeting. For all other items, the public may complete a blue speaker card to be recognized in person by the Mayor, according to all other rules and procedures. Written comments can also be emailed to Town Clerk Michael Standish at mstandish@orovalleyaz.gov for distribution to the Town Council prior to the meeting. Further instructions to speakers are noted below. INSTRUCTIONS TO IN-PERSON SPEAKERS Members of the public shall be allowed to speak on posted public hearings and during Call to Audience when attending the meeting in person. The public may be allowed to speak on other posted items on the agenda at the discretion of the Mayor. If you wish to address the Town Council on any item(s) on this agenda, please complete a blue speaker card located on the Agenda table at the back of the room and give it to the Town Clerk. Please indicate on the blue speaker card which item number and topic you wish to speak on, or, if you wish to speak during Call to Audience, please specify what you wish to discuss. Please step forward to the podium when the Mayor calls on you to address the Council. 1. For the record, please state your name and whether or not you are a Town resident. 2. Speak only on the issue currently being discussed by Council. You will only be allowed to address the Council one time regarding the topic being discussed. 3. Winfield, Mayor Melanie Barrett, Vice-Mayor Harry Greene, Councilmember Joyce Jones-Ivey, Councilmember Mary Murphy, Councilmember Josh Nicolson, Councilmember Elizabeth Robb, Councilmember PLEDGE OF ALLEGIANCE    Mayor Winfield led the audience in the Pledge of Allegiance.   UPCOMING MEETING ANNOUNCEMENTS    Town Clerk Mike Standish announced the upcoming Town meetings and events.   MAYOR AND COUNCIL REPORTS ON CURRENT EVENTS     Councilmember Jones-Ivey recognized Ruby Hyatt, a 5th grader at Innovation Academy, for her outstanding academic excellence, generosity, curiosity, and strong character. Councilmember Jones-Ivey encouraged citizens to volunteer and participate in Amphi School District's Project Graduation events and fundraisers. Councilmember Murphy reported that she had attended the 48th Birthday Celebration for Golder Ranch Fire District and the Ribbon Cutting for the grand opening of Golder Ranch Fire Station #378. Councilmember Murphy also reported that she had attended the Pusch Ridge Christian Academy 11/19/25 Minutes, Oro Valley Town Council Regular Session 1  Veterans Day assembly. Councilmember Greene reported that he and other Coucilmembers had attended the Naranja Park Archery Range ribbon cutting ceremony on November 19, 2025. Mayor Winfield recognized Assistant Recreation Manager Dylan Hiatt, of the Oro Valley Parks and Recreation Department, for securing a twenty-five thousand dollar grant from the Arizona Game and Fish Department, for the new shade structure at the Naranja Park Archery Range. Vice Mayor Barrett reported that she had attended a Veterans Day event at the Oro Valley Church of the Nazarene and at Wilson K-8 School. Mayor Winfield reported that he and other Councilmembers had attended and participated in the Oro Valley Police Department Citizens Academy Graduation event. Mayor Winfield reported that he and other Councilmembers had attended the Rockin' 4 Heroes 2025 event, held on November 9, 2025, at James D. Kreigh Park. EXECUTIVE SUMMARY: Each year, in preparation for the upcoming State Legislative Session, the Oro Valley Town Council reviews and adopts a legislative agenda that reflects the priorities and needs in key policy areas of importance to the Town of Oro Valley, such as state-shared revenues, protection of local control and other matters specific to the Town's interests. This agenda is designed to guide the town's positions on both State and Federal legislative matters. The 2026 Legislative Agenda will be applicable to the second regular session of the 57th Arizona Legislature and the 119th United States Congress. By adopting this resolution, the Oro Valley Town Council grants the necessary authority for Town staff and lobbyists to advocate for these policies at the state and federal levels. This Legislative Agenda resolution identifies the recommended legislative priorities of the Town and will guide the Town's requests and lobbying activities. The Legislative Agenda also encompasses the Municipal Policy Statement, which encompasses policies developed and approved at the 2025 League of Arizona Cities and Towns (League) Conference with involvement from cities and towns throughout the state. Mayor Winfield represented the Town of Oro Valley as the Town's voting official regarding the adoption of this policy statement. Although the Legislative Agenda should remain flexible due to the unknown nature and large quantity of bills introduced in the State Legislature, general concepts and direction are provided. More specific information will be provided, as desired and necessary, after bills are introduced during the legislative session. The areas raised in the Legislative Agenda are based on the needs of the Town and what is anticipated or commonly introduced during the legislative sessions. Council Policy In 2008, the Town Council established protocol for the legislative efforts of the Town by approving the general Legislative Agenda through a resolution and adoption of a Council Communication that includes components of the legislative program. A basic principle in any lobbying effort is to speak with one voice, so this resolution establishes guidelines for those who represent the Town. For state legislative efforts, the Council uses staff and designates a member of Town Council as Council Liaison to state legislature districts. State legislative districts includes district 17 and, as a result of the Westward Look annexation, district 18. The Mayor, if not already serving as the Legislative Council Liaison, also frequently interacts with other elected officials at all levels of government during the course of his duties and works with staff in ensuring any legislative efforts regionally, statewide or federally are coordinated in accordance with the Council-adopted agenda. League of Arizona Cities and Towns The Town’s intergovernmental liaison works closely with the League of Arizona Cities and Towns (League), specifically regarding state legislative issues with a strength-in-numbers approach to common interest legislation. The state legislative agenda is developed through involvement in the League resolutions process. The League conducts a legislative analysis and advocacy program on behalf of cities and towns for state issues, which is governed annually by the League resolutions process adopted by cities and towns around the state at the annual conference each fall. The Mayor represents the Town of Oro Valley as a voting member of the League Resolutions Committee, which comprises mayors from most Arizona municipalities. The adopted League resolutions and Municipal Policy Statement represent the mutual interests of Arizona cities and towns and will guide the League in its lobbying efforts on behalf of all cities and towns in the state. The Second Session of the 57th State Legislature The Legislature typically operates on a 100-day calendar; however, the Governor also has the authority to call the Legislature into session to address specific issues. The Second Regular Session of the 57th Legislature will begin on January 12, 2026. During the 2025 state legislative session, 1,854 bills, memorials and resolutions were introduced in the House and Senate. For the 2026 session, the last day for the introduction of bills is February 9, 2026, although there are provisions that allow members to introduce bills after this date with the permission of the Rules Committee. Priorities for the Second Session of the 57th State Legislature Broad legislative goals for 2026 focus on preserving local decision-making and protecting local revenues. Cities and towns are the level of government closest to the people, most accessible to them and most responsive to their needs. Cities and towns provide most of the public safety services, business development services and quality of life amenities that matter to our residents. Therefore, as much as possible, the state legislature should respect those attributes which contribute to Oro Valley’s voter approved community vision including our exceptional experience, outstanding livability, community prosperity and distinctive character by supporting the retention and restoration of local decision-making authority. Key to this is the opposition to unfunded mandates and preemptive efforts which remove the ability to set policy at the local level and the protection of funding and authorizations that bring revenue to Oro Valley and are essential to supporting quality of life for our residents. Specific legislative priorities for the session include: • Supporting legislation that preserves municipal authority to manage growth, plan infrastructure and maintain community character through local zoning ordinances, and • Supporting efforts to protect municipal fiscal autonomy, including the ability to allocate revenues in a way that best serves the needs of the community. FISCAL IMPACT: Adopting the agenda does not necessitate additional funding. However, legislative actions may affect the town's budget. Meeting Date:12/03/2025   Requested by: Bayer Vella, Community and Economic Development  Submitted By:Michael Garcia, Community and Economic Development Case Number:2501701 SUBJECT: PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION REGARDING AN APPEAL OF AN ADMINISTRATIVE DETERMINATION ON THE PROPOSED SURF THRU EXPRESS CAR WASH ART WITHIN THE ORO VALLEY MARKETPLACE ADJACENT TO THE SOUTHWEST INTERSECTION OF WATER HARVEST WAY AND ORACLE ROAD RECOMMENDATION: Staff recommends upholding the administrative determination.   EXECUTIVE SUMMARY: The purpose of this item is to consider an appeal (see Attachment 1) to the Planning and Zoning Administrator's (PZA) administrative determination to deny proposed art for Surf Thru Express Car Wash. More specifically, this agenda item is to determine if the PZA correctly applied zoning code standards related to the Town’s artwork provisions for the proposed art. Regarding required art for non-residential development projects, Town Council is the appellate decision-making body for administrative determinations made by the Planning and Zoning Administrator, and decisions made by Town Council on art appeals are final.  Town Council is tasked solely with deciding on whether to uphold the PZA's administrative determination. Town Council does not have the statutory or Town code authority to grant a zoning code variance, as that authority is exclusive to the Board of Adjustment. The administrative action is entirely based on specific criteria in zoning. The denial is not predicated on quality or artistic merit. The proposal does not meet standards regarding "representations of corporate identity" and the requirement to fit the "context" of the surroundings. The applicant, on behalf of Surf Thru Express Car Wash, submitted an art proposal for their commercial project located at 11595 N. Oracle Road, within the Oro Valley Marketplace, outlined in red below. The proposed art consists of two separate sculptures, each resembling a humanoid figure on a surfboard, shown below. "Sky Rider": "Ride the Wave": Administrative Determination An administrative determination is an application of the zoning code, exercised by the Planning and Zoning Administrator. The zoning code establishes artwork provisions to implement the General Plan's "Arts and Culture Element" and to support the cultural and educational enrichment of the residents and visitors to Oro Valley.  §27.3.H of the zoning code establishes nine (9) art design principles that all art proposals are subject to. Of the nine (9) art design principles, the proposed art is not in compliance with two (2): “Advertising Elements” (§27.3.H.9) and “Response to Context” (§27.3.H.2).  §27.3.H.9: “Advertising Elements… Art shall not reflect or include advertising elements of a business or corporation including colors, graphics, logos or other representations of corporate identity.” Representations of Corporate Identity: The proposed art is not in compliance with §27.3.H.9 because the design of the proposed art too closely reflects the name of the business, “Surf Thru Express Car Wash.” The proposed sculptures, each resembling a humanoid figure on a surfboard, are only relatable to the name of the business. They relate not to the use of the property, not to the existing art established within the Oro Valley Marketplace, nor to their immediate and general social and physical environments. Colors: The proposed art is not in compliance with §27.3.H.9 because the colors utilized for both sculptures' surfboards are identical to those of the business logo. See background for visual comparison.  §27.3.H.2: “Response to Context… Artwork should be appropriate in scale, material, form and content for the immediate and general social and physical environments with which they are to relate.” Context and Content: "Context" may include previous art approvals within a shopping center, architecture, landscape or other elements of the built and natural environment. The proposed art is not in compliance with §27.3.H.2 because it fails to appropriately respond to the context and content of art within the Oro Valley Marketplace. In 2007, an arts package for the Oro Valley Marketplace (Attachment 2) was proposed by the property owner and approved by Town Council with the passage of OV5-07-07 (Attachment 3). By the art provided in the arts package, the property owner established a specific art theme of desert flora within the Oro Valley Marketplace. This theme was and still is reflected in the existing art within the Oro Valley Marketplace today. The proposed art fails to relate to the specific and established art theme present within the Oro Valley Marketplace, which includes the site of the proposed Surf Thru Express Car Wash. Appeal and Response As provided in §27.3.F.8 of the zoning code, the applicant of the subject art proposal has submitted an appeal to the Planning and Zoning Administrator's administrative determination in a timely manner. The applicant’s appeal (Attachment 1) asserts their disagreement with Staff's read of §27.3.H.2 and §27.3.H.9 and claims the action relies on incorrect facts and fails to incorporate changes in the Oro Valley Marketplace over time. The Planning and Zoning Administrator maintains that the proposed art is not in compliance with the Town’s zoning code per §27.3.H.2 and §27.3.H.9. Furthermore, Town staff finds the applicant's claims to be unsubstantiated. The appeal narrative does not succeed in refuting a "representation of corporate identity" and other statements are either not germane or make a case for a variance or change in code requirements.  As a result, staff recommends the Planning and Zoning Administrator’s determination on this matter be upheld. If the administrative determination made for the subject art proposal is upheld, the applicant may propose new or revised art for their commercial project in the future.  BACKGROUND OR DETAILED INFORMATION: Art is required for all non-residential developments in Oro Valley by the Town’s zoning code standards, and all applicants who receive Planning and Zoning Administrator denial for art proposals may appeal the decision before Town Council. The applicant is responsible for establishing whether the Planning and Zoning Administrator’s decision was made in error. The Town Council is the final decision-making body for all art appeals. If this agenda item does result in the upholding of the administrative determination made for the subject art proposal, the applicant may still provide new or revised art in the future. Ultimately, the Council must determine whether the Planning and Zoning Administrator’s determination is correct. Upon subsequent review by the Planning and Zoning Administrator, the art proposal additionally failed to comply with §27.3.H.2 of the zoning code, which states:   “Response to Context… Artwork should be appropriate in scale, material, form and content for the immediate and general social and physical environments with which they are to relate.” Context and Content: The proposed art is not in compliance with §27.3.H.2 because it does not appropriately respond to the context and content of art within the Oro Valley Marketplace. "Context" may include previous art approvals within a shopping center, architecture, landscape or other elements of the built and natural environment. On August 14, 2007, an arts package for the Oro Valley Marketplace (Attachment 2) was proposed by the property owner and approved by Town Council with the passage of OV5-07-07 (Attachment 3). By way of the art provided in the original art package, the previous property owner established a specific art theme of desert flora within the Oro Valley Marketplace. This theme was and still is reflected in the existing art within the Oro Valley Marketplace today. The proposed art fails to conform to the specific and established art theme within the Oro Valley Marketplace, which includes the site of the proposed Surf Thru Express Car Wash. Applicant's Appeal And Staff Commentary The appellant, on behalf of the applicant, provided a letter of their appeal (Attachment 1). Staff has provided the following comments in response to primary statements within the appeal:     Appellant's statement: "The Sculpture Does Not Constitute a Representation of Corporate Identity" (Please see Attachment 1 for detail) Staff comment: The proposed art constitutes a representation of corporate identity because the design directly reflects the name of the business. The proposed sculptures, each resembling a humanoid figure on a surfboard, are only relatable to the name of the business. They relate not to the use of the property, not to the existing artwork established within the Oro Valley Marketplace, nor to their immediate and general social and physical environments.  Appellant's statement: The sculpture is in "Alignment with the Intent of Oro Valley’s Public Art Program." (Please see Attachment 1 for detail) Staff comment: This assertion fails to address the specific zoning code criteria. As a result, it is not germane. The proposed art is not in alignment with the "Town's Public Art Program" which is defined by the code-adopted criterion.  The art functions more as business signage that enhances corporate identity and presence, rather than artwork that harmonizes with and enhances Oro Valley’s visual environment, cultural identity, and aesthetic character.     Appellant's statement: "Other Arizona municipalities and national public art programs — including the City of Scottsdale, City of Phoenix, and Tempe Public Art — explicitly differentiate between: Artworks that incorporate logos or depict a company’s product (prohibited), and Artworks that include abstract, metaphorical, or thematic imagery (permitted)." (Please see Attachment 1 for detail) Staff comment: This assertion fails to address the specific zoning code criteria. As a result, it is not germane. As a result, this appears to be an argument for a code variance or amendment, which isn't a consideration before Town Council. Definitions and considerations on what constitutes a company product or thematic imagery utilized by other Arizona municipalities does not apply to Oro Valley zoning code administration.     Appellant's statement: "No Documentation Exists Stating That All Future Development Must Follow the 2007 Theme" (Please see Attachment 1 for detail) Staff comment: This assertion fails to address the specific zoning code criteria. As a result, it is not germane. By the comprehensive art package previously approved, the former property owner established a specific art theme of desert flora for the Oro Valley Marketplace. Documentation stating that future development must follow a specific theme is not required to identify an appropriate "context" within the Oro Valley Marketplace.  Appellant's statement: "The Town Center Has Undergone Fundamental Changes Rendering 2007 “Context” Inapplicable" (Please see Attachment 1 for detail) Staff comment: The benchmark is "context" with the current established art and design of the center.  As a result, this appears to be an argument for a code variance, which isn't a consideration before Town Council. The original owner established master architecture (style, color palette, materials etc.), landscape, signage and art for the entire center to ensure continuity. Since then, there have been changes to land use enabled — not comprehensive design themes. By the art provided in the arts package, the property owner established a specific art theme of desert flora within the Oro Valley Marketplace. This theme was and still is reflected in the existing art within the property today.     Appellant's statement: "National Public Art Standards Prohibit Municipal Imposition of Art Themes on Private Developers" (Please see Attachment 1 for detail) Staff comment: The application of "national art standards" fails to address the specific zoning code criteria. As a result, it is not germane. The Town does not impose any art themes on private developers. The art themes present within the Oro Valley Marketplace were established by the previous property owner, and were approved by Town Council.  Theme art is currently established in the Marketplace.     Appellant's statement: "The Town’s New Position Conflicts With Statements Made in 2007" (Please see Attachment 1 for detail) Staff comment: Measuring "context" within an existing shopping center requires consideration of art in place, architecture, landscaping and other elements of the built and natural environment. The art in place today establishes "context" as opposed to exact wording in the 2007 comprehensive Oro Valley Marketplace arts package.  The 2007 art plan “did not foresee a need for additional art” because it had, under the approval of Town Council, provided all public art to be located within the Oro Valley Marketplace property. Surf Thru Express Car Wash is only required to provide public art because of an art deficit created when one of the installations, a cactus mural on the existing water tanks, was later removed.     Appellant's statement: "The Town’s Interpretation of 'Context' Is Technically and Legally Misapplied" (Please see Attachment 1 for detail) Staff comment: The Town does not require “replication” of art themes for proposed art. §27.3.H.2 of the zoning code requires all proposed art to “relate” to the immediate and general social and physical environments in which they are located. The proposed art submitted does not relate to the specific art theme of desert flora within the Oro Valley Marketplace or the built and natural environment.     Appellant's statement: "Town West Was Never Notified of Any Thematic Mandate" (Please see Attachment 1 for detail) Staff comment: Town West has been directly apprised by staff of the comprehensive plan approvals for architecture, landscaping, signage, building locations and art. A notification of art themes present on a property, before a formal submittal is provided, is not the responsibility of Town Staff. All applicants are advised to meet code standards as part of their due diligence before a formal submittal. All applicants and consultants are highly and frequently encouraged to schedule a free pre-application meeting to consult with Town Staff to identify and address such factors before a formal submittal. Public Notice A public hearing is required for administrative appeals and public notice must be provided 15 days prior to the hearing. A public notice was released on the Town’s webpage. The term “corporate identity,” as widely recognized in planning, design, and legal contexts, refers to: • Visual or graphic elements such as logos, trademarks, color schemes, or typographic standards associated with a company’s brand; • Literal depictions of products or services offered by the company; and • Marketing-oriented imagery or messaging intended to increase commercial visibility or sales. The clause is intended to preserve the integrity of public art by ensuring works are created for aesthetic, cultural, and community enrichment purposes, not for commercial promotion. II. The Sculpture Does Not Constitute a Representation of Corporate Identity 1. No Connection to the Company’s Business Activity Surf Thru Express Car Wash provides drive-through car wash services. The company does not sell, manufacture, or utilize surfboards, nor does its operation involve human flgures or surflng activities. The sculpture does not depict a car, vehicle, or any other element of the business’s commercial service. 2. Abstract and Interpretive Nature of the Artwork The design is abstract, featuring a stylized human form on a simple sculptural plane resembling a surfboard. It conveys universal themes of movement, balance, and energy, common in contemporary public sculpture, and bears no literal or commercial association with Surf Thru’s operations or marketing materials. 3. Absence of Branding, Logos, or Marketing Elements The sculpture includes no text, logo, brand colors, or visual identiflers used in Surf Thru’s signage, promotional materials, or corporate marks. It is not being used in advertising and will stand independently as part of the site’s public art requirement, distinct from any business signage. 4. Metaphorical Naming and Artistic Interpretation The name “Surf Thru” is metaphorical, expressing the idea of speed and fiow — much like “Amazon” or “Apple” are metaphorical business names unrelated to literal products. To deny an abstract “surf” reference on this basis is to impose an overly literal and inconsistent standard that could unjustly restrict creative expression across future art installations. III. Alignment with the Intent of Oro Valley’s Public Art Program The Town’s Public Art Program, as established under §27.3.H, seeks to: “Enhance the community’s visual environment, promote cultural identity, and contribute to the town’s aesthetic character.” This sculpture does precisely that. It adds vibrancy, human connection, and motion to a commercial corridor while aligning with the Town’s vision of art as an enhancement to public spaces. Disallowing it on the grounds of an abstract, metaphorical reference would contradict the spirit of the ordinance and risk discouraging high-quality, creative investment in Oro Valley’s public realm. IV. Comparable Municipal Interpretations Other Arizona municipalities and national public art programs — including the City of Scottsdale, City of Phoenix, and Tempe Public Art — explicitly differentiate between: • Artworks that incorporate logos or depict a company’s product (prohibited), and • Artworks that include abstract, metaphorical, or thematic imagery (permitted). None of these programs consider a non-commercial sculpture referencing a metaphorical name to be a “representation of corporate identity.” V. Requested Action In light of the above, we respectfully request that the Town of Oro Valley Planning & Zoning Administrator and Town Council: 1. As written, the determination would impose a thematic requirement on all future development— regardless of ownership, design evolution, or redevelopment scope—without any documented basis in the original agreement or in the Town’s public art code. This appeal outlines factual, procedural, and policy-based reasons why Section 27.3.H.2 does not require replication of a 17-year-old fiora/fauna aesthetic, and why the current submission fully complies with the code’s intent regarding “context.” II. Summary of the Town’s Position as Communicated Town staff’s rationale for the denial relies on two assertions: 1. That the 2007 Vestar public art package established a fiora/fauna theme applicable to all future development within the property, indeflnitely. 2. That “context” within Section 27.3.H.2 must therefore be interpreted as requiring new artwork to match, mimic, or continue the aesthetic created in 2007, even though the center is undergoing a full redevelopment and ownership change. Town staff additionally stated: “The plan did not foresee a need for additional art. The code stipulation addresses the need to ensure appropriate context. The context we have to work with is the 2007 approval.” This appeal addresses and rebuts these claims point by point. III. Grounds for Appeal 1. No Documentation Exists Stating That All Future Development Must Follow the 2007 Theme Art State Arizona (formerly SAACA/GOVAC) managed the artist selection process for Vestar in 2007 and reviewed over 77 submissions. During that process: • The fiora/fauna concept was a site-speciflc design choice for installations at that time. • It was never stated by Vestar or the Town that all future public art—years or decades later— must adopt the same aesthetic. • No development agreement, Council resolution, or public art program document codifles a requirement that subsequent developers adhere to this theme. If the Town believes such a requirement exists, we request the speciflc location in the public record where it was approved, adopted, or disclosed to subsequent property owners. To date, no such mandate has been identifled. 2. The Town Center Has Undergone Fundamental Changes Rendering 2007 “Context” Inapplicable The Oro Valley Town Center redevelopment is not a continuation of the 2007 Marketplace project. It is: • New ownership • New site plans • New architectural and urban design language • New placemaking goals • A full reimagining of the built environment Public art best practices—and the Town’s own code—require the artwork to respond to the current environment, not an outdated and unrelated past iteration of the site. Imposing an aesthetic determined by a former owner nearly two decades ago confiicts directly with the purpose of Section 27.3.H.2, which is to ensure contextual relevance—not to mandate historical replication. 3. National Public Art Standards Prohibit Municipal Imposition of Art Themes on Private Developers Established public art commissioning standards affirm: • The commissioning entity (the property owner/developer) determines the artistic direction. • The municipality ensures compliance with code (location, maintenance, durability, safety), not artistic content or theme. • Public art must refiect the identity and future vision of the development—not the preferences of a previous owner. To require Town West to follow an aesthetic chosen by Vestar in 2007—especially without documented authority—would fall outside ethical public art practice. 4. The Town’s New Position Confiicts With Statements Made in 2007 Town staff has stated: “The plan did not foresee a need for additional art.” This accurately refiects the intent in 2007: Vestar produced a comprehensive arts package for their build-out, not a perpetual thematic overlay binding all future redevelopment. There was no language stating: • that any future buildings constructed on sold parcels would be governed by Vestar’s aesthetic choices, or • that artists commissioned in 2007 set the artistic trajectory for all future public art on the property. Had such a restriction existed, it would have required explicit disclosure to subsequent developers—including Town West—during land transactions and pre-development coordination. No such disclosure occurred. 5. The Town’s Interpretation of “Context” Is Technically and Legally Misapplied Section 27.3.H.2 requires that public art “respond appropriately to the context,” meaning: • the physical environment, • current architectural design, • current community experience, • the evolution of the site, and • the present-day development goals. “Context” does not mean: • historical aesthetic replication • required adherence to an outdated theme • artistic continuity with an unrelated prior owner’s art package Had the code intended to require replication of previously approved art themes, it would state this explicitly—as other municipalities do when they establish formal “thematic districts.” Oro Valley has no such district in code or in policy. Therefore, applying a 17-year-old design theme as the required “context” is an administrative reinterpretation that exceeds the intent of the ordinance. 6. Town West Was Never Notifled of Any Thematic Mandate Town West has made clear: • They were never informed that all art must follow a fiora/fauna theme. • They reviewed all available documents during acquisition and found no such requirement. • This obligation was not raised during pre-application meetings or during preliminary public art discussions. Developers cannot be held retroactively responsible for an unwritten or unrecorded requirement. Failure to disclose such a requirement during earlier stages raises due-process concerns. IV. Compliance of the Proposed Artwork With Section 27.3.H.2 The artwork submitted: • Responds to the current architectural vision for the redeveloped Town Center. • Aligns with the contemporary, mixed-use placemaking strategy set forth by Town West. • Refiects the development’s future identity, not its former iteration. • Meets all technical and regulatory requirements in the public art code (materials, durability, placement, scale, installation, safety, and public accessibility). This project is not a routine public art requirement; it is a site-speciflc, purpose-built expression of a center in transition—an environment undergoing one of the most signiflcant transformations in Oro Valley’s recent history. The artwork was designed to refiect that evolution. It speaks to renewal, reinvestment, and the unprecedented opportunity to shape a new identity for a redevelopment that will serve residents, families, and businesses for decades ahead. To halt this project at this stage would not only delay the developer’s progress but would deeply impact the artists who have committed their expertise, original concepts, and months of planning to create something unique and meaningful for the community. Nationwide research is clear: High-quality, diverse public art in commercial developments increases pedestrian activity, strengthens community identity, supports local economic vitality, and enhances the overall success of redevelopment projects. The Americans for the Arts, Public Art Network, and Urban Land Institute consistently affirm that public art works best when diversity of style, theme, and approach is encouraged. Communities with the strongest commercial public art programs—Tempe, Scottsdale, Mesa, Chandler, Phoenix, Tucson—do not mandate thematic replication. Instead, they embrace: • A wide range of artistic styles • Contemporary and traditional approaches • Freedom for developers to select artwork aligned with their architectural vision • Collections that evolve as the community evolves This diversity is exactly what makes those Arizona programs so recognized and successful. Oro Valley deserves the same level of excellence. Diversity in artistic themes is not just a preference; it is best practice. It creates public art collections that feel vibrant, relevant, and representative of the community’s growth, not constrained by historical limitations or outdated themes. A Respectful Request to Revisit the Public Art Code We say this with humility and genuine partnership: the recent addition of language referencing “business themes” and interpretive requirements around past artwork has created signiflcant gray areas in the code. These gray areas are already producing unintended consequences—delays, confusion, and the risk of unintentionally rejecting artwork that aligns with professional standards and would elevate the Town’s public art collection. We formally request that, together with Town leadership, the Planning Department, and community stakeholders, we revisit this section of the code and explore amendments that: • Remove ambiguity around “context” and “themes” • Clarify the intended scope of municipal review • Restore alignment with national best practices • Ensure that developers can confldently design and commission artwork without fear of subjective interpretation • Support the Town’s economic development goals by avoiding delays caused by unclear or overly prescriptive public art criteria Revisions of this kind are common and healthy. Phoenix, Scottsdale, Mesa, Chandler, and Tempe each revisited their commercial public art codes over the past decade speciflcally to ensure clarity, fiexibility, and alignment with industry standards. Those revisions have resulted in stronger public art collections, improved developer relationships, and smoother processes for municipal review. Oro Valley can absolutely achieve the same.
