(R)26-01, APPROVING A GIFT AGREEMENT BETWEEN VP II LOAN LLC , ML MANAGER LLC, AND THE TOWN OF ORO VALLEY, PROPERTY ADJACENT TO HONEY BEE CANYON PARK Background Council is asked to consider/approve a Gift Agreement to accept two natural desert parcels adjacent to Honey Bee Canyon Park Approximately 33.3 acres Zoned Rancho Vistoso Planned Area Development Open Space Acceptance of the property supports long-term preservation of open space and maintains future Council discretion regarding any potential use Parcels being offered as donation without compensation Location •Donation parcels illustrated in yellow •Honey Bee Canyon Park illustrated in green Property (Current State) No immediate or proposed uses associated with acceptance of the property Any future use would require separate Council direction and approvals Properties offer long-term potential for trail connectivity and open space continuity with Honey Bee Canyon Park Tonight’s Action Consideration of approval for Resolution No. (R)26-01, authorizing the Town Manager/staff to accept and execute the Gift Agreement Authorize staff to complete due diligence and finalize acceptance of the property If accepted, allows Council to discuss and determine any use (trails, Honey Bee Canyon Park expansion, etc.) as part of future planning efforts Questions? (subject to ADOT approval) 6.Design to create courtyards and gathering areas 7.Owner approval of rezoning changes in Area 2 Potential conditions for preferred concept Stormwater Utility Authorizing and Approving an Increase to raise the base Stormwater Fee over a Three-Year Period Post Notice of Intent (NOI) Rate Change Process – The Notice of Intent (NOI) follow-up In accordance with A.R.S. § 9-511.01, the Town Council adopted Resolution No. (R)25-52 on October 15, 2025, issuing a Notice of Intent to increase the Stormwater Utility Base Rate. This action initiated the required public process, including: Publishing the Notice in the Daily Territorial on October 21, 2025 that specified: A public hearing shall be held at the regular meeting of the Mayor and Council at 6:00p.m. on January 14, 2026, to deliberate and vote on the proposed increases. This set a date for a public hearing on the proposed increase that shall be held at least sixty days after adoption of the notice of intention, which has been satisfied. Over the NOI period, making the Stormwater Rates Analysis Report and Updated Stormwater Utility Schedule of Fees available at the Town Clerk’s Office and on the Stormwater Utility webpage, which has been satisfied. Over the NOI period, received no comments from the public.
